and WHEREAS , the need for comprehensive coordinated mental health services for children , youth , and families places upon our community a critical responsibility ; and WHEREAS , it is appropriate that a day should be set apart each year for the direction of our thoughts toward our children’s mental health and well - being ; and WHEREAS , the amount of resources needed for such services and supports are increasing due to North Carolina’s increasing population ; and WHEREAS , Johnston County is a member of Alliance Health formerly known as Alliance Behavioral Healthcare , a public Local Management Entity Managed Care Organization LME MCO responsible for providing system management and oversight for approximately 471,000 Medicaid - covered and uninsured North Carolinians across four counties ; and WHEREAS , consistent with the expectations of the North Carolina General Assembly and the North Carolina Department of Health and Human Services , Alliance’s Board of Directors has developed , and Alliance’s intent is to implement , a comprehensive reinvestment plan benefiting the citizens of Johnston County with service enhancements , including housing initiatives and innovative evidenced - based and crisis services , as part of a focused effort to reduce unnecessary emergency department admissions and to divert people from our criminal justice system ; and WHEREAS , while the North Carolina General Assembly passed mental health reform legislation in 2001 with the intent of improving clinical services and deinstitutionalizing , State funding for North Carolina’s behavioral healthcare system has been inconsistent and inadequate for more than 17 years since this legislation became law ; and WHEREAS , the North Carolina General Assembly has reduced State funding for behavioral health services known as single - stream funding by more than 458 million , including a more than 67 million reduction in funding to Alliance , over the past four years while requiring the LME MCOs to continue offering the same level of State - funded services as before such reductions ; and WHEREAS , despite these significant single - stream funding reductions , Alliance has continued serving the uninsured and underinsured using the remaining State funds and portions of its savings intended to be used for implementing its reinvestment plan ; and WHEREAS , while it is Alliance’s intent to implement its comprehensive reinvestment plan enhancing services for the citizens of Johnston County , State single - stream funding has been reduced for four consecutive years and such continued reductions have forced Alliance to eliminate , or halt work on , items from its reinvestment plan ; and WHEREAS , we are concerned that additional reductions in behavioral health funding by the State may increase the need for local allocation of County dollars and place additional strain on other County services such as Emergency Medical Services EMS , jails , and other social service resources NOW , THEREFORE BE IT RESOLVED that we , the Johnston County Board of Commissioners , do hereby request that the North Carolina General Assembly ? land adjacent to their Clayton facility and their desire to have that acreage annexed within the Research & Training Zone RTZ Chairman Godwin explained that pursuant to General Statutes , the request must be approved by Johnston County and the Town of Clayton since the property is located within Clayton’s Extraterritorial Jurisdiction ETJ Chairman Godwin stated he supports the request and believes the Workforce Development Center , which is funded with tax revenue from the RTZ , is an excellent recruitment tool for economic development and he would like to see it continue to grow Upon a motion by Commissioner Tony Braswell , seconded by Commissioner Patrick E Harris , and carried unanimously , the Board voted to verbally commit to the approval of the RTZ annexation request by Grifols , so long as the request meets all statutory requirements once the formal application has been received and reviewed by the County 4 Public Comments A Novo Nordisk – Facilities Update and Tour comments occurred later during the meeting Shaylah Jones , Principal of Government & Public Affairs for Novo Nordisk , invited the Board to attend an invitation only update and tour of their facilities scheduled for May 30 , 2019 beginning at 1 30 pm 5 Department of Social Services – Proclamation for Elder Abuse Awareness Day Department of Social Services staff members Wendy Whitfield , LV McKillon , Angie Brinkley , Jerricke Fontenette , and Director Scott Sabatino addressed the Board Ms Whitfield requested the Board to adopt a proclamation for Elder Abuse Awareness Day as June 15 , 2019 She invited everyone to attend the Elder Abuse th Awareness Walk to be held on June 7 beginning at 11 00 am at the DSS Campus in Smithfield Ms Whitfield spoke on the Social Services staff’s efforts and dedication to bring awareness to elder abuse , stating the aging population is growing and it is their mission to make sure the elderly receive the proper care and services She thanked the Board for the dedication of the EMS employees and introduced the following leaders within the EMS Division Billie Borem , Christy Lewis , Melissa Hickman , Brad Baker , Kim Grimes , Billy Langston , David Dolan , and Deputy Director Josh Holloman Mr Gagne thanked the Board for their support to the EMS Division and stated the proclamation recognizes the EMS responders and providers for the jobs they do and the sacrifices they make Commissioner Patrick E Harris stated he serves on the EMS Advisory Committee and he can say that the County is certainly well protected and cared for by the EMS System and it Proclamation Emergency Medical Services Week May 19 – 25 , 2019 WHEREAS , emergency medical services is a vital public service ; and WHEREAS , the members of emergency medical services teams are ready to provide lifesaving care to those in need 24 hours a day , seven days a week ; and WHEREAS , access to quality emergency care dramatically improves the survival and recovery rate of those who experience sudden illness or injury ; and WHEREAS , the emergency medical services system consists of emergency physicians , emergency medical technicians , paramedics , firefighters , educators , Johnston County , in recognition of this event th Adopted this the 6 day of May , 2019 7 Town of Kenly – Assistance with Demolition and Removal of the Old Kenly School Auditorium Building Kenly Town Manager Michael Douglas addressed the Board to request financial assistance with the demolition and removal of the old Kenly School auditorium building Mr Douglas provided the Board with a history of the building and explained that it was once part of the old Kenly School , which served grades K - 12 until North Johnston High School was built in the 1960 ’ s Mr Douglas continued that many years ago , the main building of the school was destroyed by fire , leaving the auditorium building on the site He stated the condition of the building has deteriorated over the years to the point where it is unsafe and due to asbestos and other hazardous conditions , it must be demolished and removed Mr Douglas stated the cost to demolish and removePagePage pageNumber7755 May 6 , 2019 – 10 00 am Continued the facility is estimated at 272,000 and the Town is hoping the County can contribute funds towards this project Mr Douglas stated once the facility has been removed , the Town plans to construct a new civic center on the site and he presented three options currently being considered for the new facility Mr Douglas stated they will be applying for grant funds , but he anticipates the proposed for a new facility , the Town hopes to offer a space for citizens to rent or lease for weddings , banquets , and other similar types of social events He stated the space could also be used for an additional library in the Town Mr Douglas stated the cost to construct the new facility is estimated between 15 million - 2 million and if they are successful in securing financing from USDA , he estimates an annual debt service payment somewhere between 78,000 - 118,000 over a 30 year period Commissioner Chad M Stewart asked how much the Town is requesting from the County Mr Douglas responded the Town would be appreciative of any amount the County can contribute He reiterated the Town is looking for grant funding , but is not relying on grant funding being available Commissioner Tony Braswell suggested that Mr Douglas check with the Johnston County Tourism Authority to see if they have any grant funds available for the project Upon a question by Commissioner Butch Lawter , Mr Douglas stated the asbestos seems to be the only environmental problem they are aware of at this time , but they will be studying the facility further prior to demolition Chairman Ted G Godwin thanked Mr Douglas for the information and stated the Board would take the request under advisement 8 Health Department – Approval of 2020 Behavioral , Preventive , and Environmental Health Fee Schedules Health Director Dr Marilyn Pearson presented the proposed Fiscal Year 2020 Behavioral , Preventive , and Environmental Health Fee Schedules to the Board Dr Pearson stated the fee schedules have been reviewed by the Johnston County Board of Health and recommended for approval Dr Pearson reviewed the proposed changes with the Board for the Behavioral and Preventive Health fee schedules Assistant Health Director Steve Strickland provided the Board with information regarding the proposed changes to the Environmental Health fee schedule as well as how the County compares with other similar Bonds , Series 2019 The Chairman introduced the following resolution , a summary of which had been provided to each Commissioner , a copy of which was available with the Clerk to the Board and which was read by title RESOLUTION PROVIDING FOR THE ISSUANCE OF UP TO 20,000,000 GENERAL OBLIGATION SCHOOL BONDS , SERIES 2019 BE IT RESOLVED by the Board of Commissioners the “ Board ” of the County of Johnston , North Carolina the “ County ” Section 1 The Board has determined and does hereby find , declare and represent a That an order the “ School Bond Order ” authorizing not exceeding 61,000,000 General Obligation School Bonds the “ School Bonds ” was adopted by the Board for the County on July 9 , 2018 , which School Bond Order was approved by the vote of a majority of the qualified voters of said County who voted thereon at a special referendum duly called and held on November 6 , 2018 b That none of the Bonds authorized to be issued by the School Bond Order have been issued , that no notes have been issued in anticipation of the receipt of the proceeds of the sale of said School Bonds , and that it is necessary to issue at this time 20,000,000 of said School Bonds in accordance principal of and the interest on this Bond shall be paid in any coin or currency of the United States of America that is legal tender for the payment of public and private debts on the respective dates of payment thereof For the prompt payment hereof , both principal and interest as the same shall become due , the faith and credit of the County are hereby irrevocably pledged [ Printed Bonds are to include the following paragraph ] ADDITIONAL PROVISIONS OF THIS BOND ARE SET FORTH ON THE REVERSE HEREOF AND SHALL FOR ALL PURPOSES HAVE THE SAME EFFECT AS IF SET FORTH HERE [ Reverse Side of Printed Bonds ] This Bond is one of an issue of Bonds designated “ General Obligation School Bonds , Series 2019 ” the “ Bonds ” and issued by the County for the purpose of providing funds , with any other funds necessary , for the acquisition , construction and equipping of modifications , renovations , additions , improvements and extensions to existing school facilities and or one or more new buildings or other school facilities in Johnston County This Bond is issued under and pursuant to The Local Government Bond Act , as amended , Article 7 , as amended , of Chapter 159 of the General Statutes of North Carolina , an order adopted by the Board of Commissioners the “ Board ” of the County which has taken effect as provided by law , and a resolution duly passed by said Board the “ Resolution ” The Bonds maturing prior to February 1 , 20__ are not subject to redemption prior to maturity The Bonds maturing on February 1 , 20__ and thereafter may be redeemed , at the option of the County , from any moneys that may be made available for such purpose , either in whole or in part on any date not earlier than February 1 , 20__ , at a redemption price equal to 100 of the principal amount of the Bonds to be redeemed , together with interest accrued thereon to the date fixed for redemption , without premium If less than all of the Bonds of any one maturity shall be called for redemption , the particular Bonds or portions of Bonds of such maturity to be redeemed shall be selected by lot in such manner as the County in its discretion may determine ; provided , however , that the portion of any Bond to be redeemed shall be in the principal amount of 5,000 or some whole multiple thereof and that , in selecting Bonds for redemption , each Bond shall be considered as representing that number of Bonds which is obtained by dividing the principal amount of such Bond by 5,000 If less than all of the Bonds stated to mature on different dates shall be called for redemption , the particular Bonds or portions thereof to be redeemed shall be called in such maturities and amounts of those maturities as shall be determined by the County Not more than 60 days nor less than 30 days before the redemption date of any Bonds to be redeemed , whether such redemption be in whole or in part , the County shall cause a notice of such redemption to be filed with the Bond Registrar and to be mailed , postage prepaid , to the registered owner of each Bond to be redeemed in whole or in part at the address of said owner appearing upon the registration books of the County Failure to mail such notice or any defect therein as to any Bond or portion thereof shall not affect the validity of the redemption as to any Bond or portion thereof for which such notice was given as required hereby On the date fixed for redemption , notice of such call for redemption having been given as aforesaid and not revoked as hereinafter provided , the Bonds or portions thereof called for redemption shall be due and payable at the redemption price provided therefor , plus accrued interest to such date If moneys for payment of such redemption price and the accrued interest are held by the Bond Registrar as provided in the Resolution , interest on the Bonds or the portions thereof called for redemption shall cease to accrue , such Bonds or portions thereof shall cease to be entitled to any benefits or security under the Resolution or to be deemed outstanding , and the registered owners of such Bonds or portions thereof shall have no rights in respect thereof except to receive payment of the redemption price thereof , plus accrued interest to the date of redemption If a portion of this Bond shall be called for redemption , a new Bond or Bonds in principal amount equal to the unredeemed portion hereof will be issued to the registered owner hereof or the legal representative of said owner upon the surrender hereof The County shall have the right to revoke any call of amount of the Bonds of such stated maturity and registered in the name of the Securities Depository Nominee as defined in the Resolution , a nominee of the Securities Depository as defined in the Resolution , is being issued and required to be deposited with the Securities Depository and immobilized in its custody The book - entry system of the Securities Depository will evidence positions held in the Bonds by the Securities Depository’s participants , with beneficial ownership of the Bonds in the principal amount of 5,000 or any whole multiple thereof being evidenced in the records of such participants Transfers of beneficial ownership will be effected on the records of the Securities Depository and its participants pursuant to rules and procedures established by the Securities Depository and its participants The County and the Bond Registrar will recognize the Securities Depository Nominee or the Securities Depository , as the case may be , while the registered owner of this Bond , as the owner of this Bond for all purposes , including payments of principal of , and redemption premium , if any , and interest on , this Bond , notices and voting Transfer of principal and interest and any redemption premium payments to participants of the Securities Depository will be the responsibility of the Securities Depository , and transfer of principal and interest and any redemption premium payments to beneficial owners of the Bonds by participants of the Securities Depository will be the responsibility of such participants and other nominees of such beneficial owners The County and the Bond Registrar will not be responsible or liable for such transfers of payments or for maintaining , supervising or reviewing records maintained by the Securities Depository , its participants or persons acting through such participants While the Securities Depository Nominee or the Securities Depository , as the case may be , is the owner of this Bond , notwithstanding the provisions hereinabove contained , payments of principal of , redemption premium , if any , and interest on this Bond shall be made to the Securities Depository Nominee or the Securities Depository , as the case may be , by wire transfer in immediately available funds to the account of said holder as may be specified in the bond registration books maintained by the Bond Registrar or by such other method of payment as the County may determine to be necessary or advisable with the concurrence of the Securities Depository Further , so long as a book - entry system is used for determining beneficial ownership of Bonds , redemption notices shall be given to the Securities Depository Nominee by certified or registered mail or by such other method as the County may determine to be necessary or advisable with the concurrence of the Securities Depository In addition , so long as a book - entry system is used for determining beneficial ownership of Bonds , if less than all of the Bonds of any one maturity shall be called for redemption , the Securities Depository shall determine by lot the amount of interest of each direct participant of the Securities Depository in the Bonds within such maturity to be redeemed In certain events , the County may replace the Securities Depository at the time with another qualified securities depository In certain events , the County may discontinue the book - entry system and deliver replacement Bonds in the form of fully registered certificates in the denomination of 5,000 or any whole multiple thereof in exchange for the outstanding Bonds as provided in the Resolution At the office of the Bond Registrar , in the manner and subject to the conditions provided in the Resolution , Bonds may be exchanged for an equal registration of transfer of Bonds The transfer of this Bond may be registered only upon such books and as otherwise provided in the Resolution upon the surrender hereof to the Bond Registrar together with an assignment duly executed by the registered owner hereof or his attorney or legal representative in such form as shall be satisfactory to the Bond Registrar Upon any such registration of transfer , the Bond Registrar shall authenticate and deliver in exchange for this Bond a new Bond or Bonds , registered in the name of the transferee , of authorized denominations , in an aggregate principal amount equal to the unredeemed principal amount of this Bond , of the same maturity and bearing interest at the same rate The Bond Registrar shall not be required to exchange or register the transfer of any Bond during a period beginning at the opening of business 15 days before the day of the mailing of a notice of redemption of Bonds or any portion thereof and ending at the close of
