10 713 Meeting of the Johnston County Board of Commissioners April 1 , 2019 10 00 am The Johnston County Board of Commissioners met in regular session Monday , April 1 , 2019 at 10 00 am in the Commissioners Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina The following members were present Present Chairman Ted G Godwin , Vice Chairman Chad M Stewart , Jeffrey P Carver , Larry Wood , Tony Braswell , Patrick E Harris , and RS “ Butch ” Lawter , Jr Absent None Also Present County Manager Rick J Hester , Clerk to the Board Paula G Woodard , Finance Officer and Assistant County Manager J Chad McLamb , County Attorney Jennifer J Slusser , and Paralegal Deputy Clerk to the Board Dana Cuddington Chairman Ted G Godwin called the meeting to order at 10 00 am The Board held a moment of silence in memory of former Johnston County Utilities Director Timothy G Broome and Four Oaks Firefighter Brock Currens Commissioner Butch Lawter opened the meeting with a prayer Vietnam Veterans of America 990 led those in attendance in the Pledge of Allegiance to the American Flag 1 Approval Discussion of Agenda It was the unanimous consensus of the Board to adopt the agenda with the removal of the Proclamation for National Public Safety Telecommunicator’s Week from the Consent Agenda and make it a regular item th 2 Veterans Services Office – Resolution Honoring the American Legion’s 100 Anniversary Chairman Ted G Godwin read the following proclamation aloud and moved for its adoption RESOLUTION th Honoring The American Legion’s 100 Anniversary WHEREAS , the American Legion was chartered by Congress in 1919 as a patriotic veterans ’ organization , focusing on service to veterans , service members and their communities ; and WHEREAS , the American Legion evolved from a group of war - weary veterans of World War I into one of the most influential nonprofit groups in the United States Today , membership stands at more than 2 million in more than 13,000 posts worldwide ; and WHEREAS , hundreds of local American Legion programs and activities strengthen the nation one community at a time American Legion Baseball and the Operation Comfort Warriors program are great examples The Legion also raises millions of dollars to help veterans and their families during times of need ; and WHEREAS , the American Legion is a nonpartisan , not - for - profit organization that stands behind the issues most important to the nation’s veterans Legionnaires ’ sense of obligation to community , state and nation drives an honest advocacy for veterans in Washington ; 27 , 2019 , adopted as follows PROCLAMATION SPRING LITTER SWEEP 2019 WHEREAS , the North Carolina Department of Transportation organizes an annual spring statewide roadside cleanup to ensure clean and beautiful roads in North Carolina ; and WHEREAS , the spring 2019 LITTER SWEEP roadside cleanup will take place April 13 - 27 , 2019 , and encourages local governments and communities , civic and professional groups , businesses , churches , schools , families and individual citizens to participate in the Department of Transportation cleanup by sponsoring and organizing local roadside cleanups ; and WHEREAS , Adopt - service web - based notification system whereby citizens can go on the County’s website and subscribe to various notification lists Mr Taylor finally spoke on the pump station located on Wise Road and stated that facility used to be an attractive building ; however , he does not believe it to be an attractive structure anymore B Marty Clayton with Duke Energy Marty Clayton with Duke Energy briefly spoke to the Board and offered his assistance where it may be needed Mr Clayton also expressed his condolences and appreciation for former Johnston County Utilities Director Timothy G Broome C Johnston Health Foundation – Proclamation for Portofino Derby Classic Day Johnston Health Foundation Chairman Stewart McLeod requested the Board to adopt a proclamation for Saturday , May 4 , 2019 as “ Portofino Derby Classic Day ” Mr McLeod invited the Commissioners to attend the th event on May 4 and stated all funds raised will go to the Foundation’s angel fund , which helps cancer patients He noted last year the event raised over 80,000 for the angel fund Commissioner Jeffrey P Carver spoke on the event’s success last year and commended all those involved with the fundraiser Commissioner Chad M Stewart moved the Board adopt the following proclamation for Portofino Derby Classic Day , seconded by Commissioner Larry Wood , and carried by unanimous vote PROCLAMATION Whereas , in 2012 , the Clayton Rotary Club started the Clayton Derby Day event and hosted for 3 years until 2015 , simultaneous with the popular Kentucky Derby ; andPagePage pageNumber6718 April 1 , 2019 – 10 00 am Continued Whereas , May 5 , 2018 marked the revival of the Clayton Derby Day , relaunched as Portofino Derby Classic with Johnston Health Foundation as lead proponent , in collaboration with the Clayton Rotary Club , Johnston County business partners and community leaders ; and Whereas , this year’s event on May 4 , 2019 will promote the Town of Clayton and Johnston County to the Triangle and Eastern North Carolina area , expecting at least 1,000 visitors from neighboring counties and states ; and nd Whereas , cancer is the 2 leading cause of death in Johnston County , ranking # 51 in North Carolina , and cancer is nd the 2 leading significant health need in Johnston County ; and Whereas , education on early screening and access to resources for treatment and support for the underinsured and uninsured is important ; and Whereas , the financial challenges of a patient in need who is diagnosed with cancer is enormous and assistance from individuals and organizations will go a long way ; and Whereas , the net proceeds of the Portofino Derby Classic will benefit local cancer patients in need through the Johnston Health Foundation’s Angel Fund ; and Whereas , the Portofino Derby Classic is an opportunity to increase cancer awareness and the growing needs of local cancer patients in need , and to encourage support not just from our county , but from residents in neighboring communities ; and Whereas , the Portofino Derby Classic supports the Foundation’s mission to “ Bridge the gap to provide quality healthcare close to home ” ; and Whereas , on this day , we celebrate the survivorship of those we know who have experienced or are battling the disease , their families and caregivers who are their source of love and encouragement , applaud the efforts of our medical professionals who provide quality care , and remember those we have lost to the disease st NOW , THEREFORE , the Johnston County Commissioners do hereby proclaim the 1 Saturday in May , May 4 , 2019 , as “ PORTOFINO DERBY CLASSIC DAY ” and encourage businesses , industries and citizens in the Johnston County communities to support and participate in this event st Duly proclaimed this 1 day of April , 2019 , while in regular session D Town of Kenly – Assistance with Demolition and Removal of Old Kenly School Auditorium Building Kenly Town Manager Michael Douglas addressed the Commissioners and stated he would like to present information to the Board at their May meeting regarding the demolition and removal of the old Kenly School Auditorium facility Mr Douglas stated the Town would like to have the structure removed to make room for a new facility Mr Douglas stated Kenly is growing and the Town is trying to improve services and offer more opportunities for its citizens Mr Douglas stated he will have more information to share in May and will request the County’s assistance with this project 5 Proclamation – National Public Safety Telecommunicator’s Week – April 14 - 20 , 2019 Chairman Ted G Godwin commended 911 - Communications Director Jason Barbour and his entire department for the work they do every day Mr Barbour thanked the Board for considering the proclamation and stated as the County continues to grow , his staff gets busier and busier Commissioner Patrick E Harris moved the Board adopt the following proclamation for National Public Safety Telecommunicator’s Week , seconded by Commissioner Tony Braswell , and carried unanimously National Public Safety Telecommunicator’s Week April 14 - 20 , 2019 WHEREAS , emergencies can occur at anytime that require police , fire or emergency medical services ; the E - 911 Communications Center was created to provide a vital contribution to the quality of life enjoyed by citizens and visitors to Johnston County ; and WHEREAS , when an emergency occurs , the access to a 911 center dramatically improves the prompt response of police officers , firefighters and paramedics , is critical to the protection of life and preservation of property ; and WHEREAS , the Telecommunicators are trained , prepared and ready ; the safety of our police officers , firefighters and EMS personnel are dependent upon the quality and accuracy of information obtained from citizens who telephone the Johnston County E - 911 Communications Center ; and WHEREAS , Public Safety Telecommunicators are the first and most critical contact our citizens have with emergency services ; andPagePage pageNumber7719 April 1 , 2019 – 10 00 am Continued WHEREAS , Public Safety Telecommunicators are the single vital link for our police officers , firefighters and EMS personnel by monitoring their activities by radio , providing them information and insuring their safety ; and WHEREAS , Public Safety Telecommunicators of the Johnston County E - 911 Communications Center have contributed substantially to the apprehension of criminals , suppression of fires and treatment of patients ; and WHEREAS , each Telecommunicator has exhibited compassion , understanding and professionalism during the performance of their job ; and WHEREAS , National Telecommunicator’s Week will serve to recognize the Telecommunicators of Johnston County who provide a vital public safety service NOW THEREFORE BE IT RESOLVED , that the Board of Commissioners of the County of Johnston , hereby proclaim and declares the week of April 14 - 20 , 2019 as National Telecommunicator’s Week in Johnston County , in honor of the men and women whose diligence and professionalism keep our County and citizens safe st Adopted this the 1 day of April , 2019 6 Department of Social Services – Child Abuse Prevention Month Proclamation Department of Social Services staff members Robert Tarpey , Kelly Smith , Amy Keith , and Kristina Lee along with DSS Director Scott Sabatino addressed the Board and requested the adoption of a proclamation for th Child Abuse Prevention Month Mr Tarpey invited everyone to attend the April 5 kick - off event at 2 30 pm at the DSS Campus to promote awareness for Child Abuse Prevention Month Mr Tarpey thanked the Board for considering the proclamation and offered to answer any questions Commissioner Patrick E Harris moved the Board adopt the following proclamation , seconded by Commissioner Larry Wood , and carried by unanimous vote Child Abuse Prevention Month Proclamation Whereas , children are vital to our County and State’s future success , prosperity , and quality of life as well as being our most vulnerable assets ; and Whereas , all children deserve to have safe , stable , nurturing , and healthy homes and communities that foster their well - being ; and Whereas , child abuse and neglect is a public responsibility affecting both the current and future quality of life ; and Whereas , parents need support and resources to cope with stress and nurture their children to grow to their full potential ; and Whereas , effective child abuse prevention strategies succeed because of partnerships created among citizens , human service agencies , schools , faith communities , health care providers , civic organizations , law enforcement agencies , and the business community Now , Therefore , the Johnston County Board of Commissioners does hereby proclaim April 2019 as Child Abuse Prevention Month and calls upon all citizens , community agencies , faith groups , medical facilities , elected officials and businesses to increase their participation in our efforts to support families , thereby preventing child abuse and strengthening the communities in which we live st Adopted this the 1 day of April , 2019 7 Archer Lodge Veterans Memorial Committee – Request for Funding Mike Gordon , representing the Archer Lodge Veterans Memorial Committee , addressed the Board and introduced Committee Co - Chair Mike Mulhollem Mr Gordon requested the Board to consider allocating funds towards the Archer Lodge Veterans Memorial He stated even though the memorial is located in Archer Lodge , they believe it will be a showpiece for the entire County Mr Gordon spoke on their fundraising activities and stated they would appreciate the County’s assistance to finish this project Commissioner Chad M Stewart asked when the funding would be needed Mr Gordon stated although they are hoping to receive funds in advance of the Fiscal Year 2019 - mails and complaints from citizens regarding litter on the roadways The Board briefly discussed the matter and possible changes that could be made to the County’s Code of Ordinances to deter littering activity in the County Wilson’s Mills Town Councilman David McGowan addressed the Board and reported on an initiative he has undertaken in the Town of Wilson’s Mills to help clean up the roadways He encouraged the Commissioners to visit the Town and see what they are doing B US 70 Corridor Commissioner Tony Braswell spoke on the US 70 Corridor Commission’s highway safety project and how it has affected citizens living on the rural connector roads Commissioner Braswell asked Chairman Godwin to share his concerns with the membership of the US 70 Corridor Commission C Report from Commissioner Butch Lawter Commissioner Butch Lawter reported he attended the recent Triangle J Council of Governments Legislative Day as the Johnston County Commissioner Representative Commissioner Lawter stated there were some good meetings held and he updated the Board on the status of various legislative items 20 Closed Session – NCGS 14331811 a 3 – Attorney - Client Privilege , NCGS 14331811 a 4 – Economic Development , and NCGS 14331811 a 5 – Acquisition of Property Upon a motion by Commissioner Butch Lawter , seconded by Commissioner Patrick E Harris , and carried by unanimous vote , the Board recessed regular session to sit in closed session for the purposes of consulting with an attorney employed by the Board in order to preserve the attorney - client privilege pursuant to North Carolina General Statute 143 - 31811 a 3 , to discuss matters relating to the location or expansion of industries or other businesses in the area , pursuant to North Carolina General Statute 143 - 31811 a 4 , and to establish or instruct staff concerning the negotiation of the price and terms of a contract concerning the acquisition of real property pursuant to North Carolina General Statute 143 -
