10 636 Meeting of the Johnston County Board of Commissioners March 4 , 2019 10 00 am The Johnston County Board of Commissioners met in regular session Monday , March 4 , 2019 at 10 00 am in the Commissioners Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina The following members were present Present Chairman Ted G Godwin , Vice Chairman Chad M Stewart , Jeffrey P Carver , Larry Wood , Tony Braswell , Patrick E Harris , and RS “ Butch ” Lawter , Jr Absent None Also Present County Manager Rick J Hester , Clerk to the Board Paula G Woodard , Finance Officer and Assistant County Manager J Chad McLamb , County Attorney Jennifer J Slusser , and Paralegal Deputy Clerk to the Board Dana Cuddington Chairman Ted G Godwin called the meeting to order at 10 00 am Commissioner Butch Lawter opened the meeting with a prayer American Legion Post 141 Selma led those in attendance in the Pledge of Allegiance to the American Flag 1 Approval Discussion of Agenda Upon a motion by Commissioner Tony Braswell , seconded by Commissioner Chad M Stewart , and carried by unanimous vote , the Board approved the agenda as presented 2 Consent Agenda Items Upon a motion by Commissioner Larry Wood , seconded by Commissioner Butch Lawter , and carried by unanimous vote , the Board approved the consent agenda items as follows A Approval of Minutes – February 4 , 2019 10 00 am and 6 00 pm ; February 21 , 2019 ; and February 25 , 2019 B Resolution – Property Tax Revaluation Cycle , adopted as follows RESOLUTION To Set Johnston County’s Next Reappraisal Schedule to January 1 , 2025 and To Establish a Four Year Reappraisal Cycle Thereafter WHEREAS , North Carolina General Statute § 105 - 286 a requires each county to reappraise all real property every eighth year ; and WHEREAS , North Carolina General Statute § 105 - 286 a 3 authorizes a county to conduct a reappraisal of real property earlier than required and may designate a new reappraisal cycle that is more frequent than the octennial cycle if the Board of Commissioners adopts a resolution providing for advancement of the reappraisal ; and WHEREAS , Johnston County desires to conduct a reappraisal of real property earlier than required by North Carolina General Statute § 105 - 286 a , to be effective January 1 , 2025 , and to perform subsequent reappraisals every four years thereafter in an effort to provide a more equal and fair property tax base for all citizens NOW , THEREFORE BE IT RESOLVED , by the Johnston County Board of Commissioners that in the annual budget ordinance each fiscal year , the Board shall include in the special reserve fund established for the reappraisal , an appropriation for Tax Administration in the amount required for reappraisal work during that fiscal year consistent with a plan established for the reappraisal of real property , as required by North Carolina General Statute § 153A - 150 ; and BE IT FURTHER RESOLVED , that when the County budget for each succeeding fiscal year is in preparation , the Board , with the County Manager and Tax Administrator , shall review the progress of the reappraisal work , and the Board shall appropriate to the special reappraisal reserve fund such funds for reappraisal work during that year as may be necessary to continue the reappraisal work and to assure the completion of the reappraisal work on schedule ; and BE IT FURTHER RESOLVED , that a copy of this resolution be forwarded to the North Carolina Department of Revenue as required by North Carolina General Statute § 105 - Personal Real Property 1,16568 Tax releases - Personal Real Property 70096 Motor Vehicle releases refunds 14884 Recommended by Tax Administrator Jocelyn Andrews Approved by Finance Director J Chad McLamb 3 Public Comments A Johnston County Cooperative Extension – Recognition of Brandon and Jessica Batten Cooperative Extension Director Bryant Spivey introduced and recognized Brandon and Jessica Batten rd of Triple B Farms for being selected as the 2019 National Outstanding Young Farmers of the Year at the 63 annual National Outstanding Young Farmers Awards Mr Spivey stated he nominated the Battens for this national award and he spoke on the process involved with selecting the recipient for this high honor Mr Spivey spoke on the complexities of farming today and how the Battens have worked to have a successful operation Mr Spivey also spoke on all the organizations and programs the Battens belong to and how they give back to the agricultural community every day Page639 March 4 , 2019 – 10 00 am Continued Mr Batten thanked the Board for the recognition and all those that support the agricultural community stating it is still a very integral part of the economy in North Carolina The Board congratulated Mr & Mrs Batten for the honor Chairman Ted G Godwin presented the Battens with a letter of congratulations from the Board of Commissioners 4 Capital Area Metropolitan Planning Organization - Update Commissioner Butch Lawter introduced Deputy Director Alex Rickard with the Capital Area Metropolitan Planning Organization CAMPO Commissioner Lawter stated he serves as the Commissioner Representative for CAMPO and he asked Mr Rickard to come and give an update on projects and activities Mr Rickard thanked the Board for allowing him the opportunity to speak Mr Rickard reported that NC 540 is probably the biggest project CAMPO has at this time and he is pleased to note that the project is still on track and moving forward with no impacts to the study Mr Rickard spoke on widening projects for I - 40 and NC Hwy 42 from NC Hwy 50 all the way to Clayton and noted there are also a few new projects submitted to the Department of Transportation and secured for funding which include Cleveland Road from NC Hwy 42 to Barber Mill Road to accommodate the growth in that area He stated a widening project has been submitted for NC Hwy 210 and a new road is planned at the I - 40 NC Hwy 42 area behind Wal - Mart to help with congestion Mr Rickard stated all of the projects mentioned have been funded through the Department of Transportation’s prioritization system and he feels that CAMPO has been very successful getting projects funded in that system Mr Rickard also spoke on additional funding that CAMPO receives directly and stated with those funds , they recently approved an 82 million project to build a new road to connect the NC Hwy 42 Hwy 70 Business intersection in Clayton directly over to Ranch Road Mr Rickard reviewed the following presentation with the Board PagePage pageNumber5640 March 4 , 2019 – 10 00 am ContinuedPagePage pageNumber6641 March 4 , 2019 – 10 00 am ContinuedPagePage pageNumber7642 March 4 , 2019 – 10 00 am ContinuedPagePage pageNumber8643 March 4 , 2019 – 10 00 am ContinuedPagePage pageNumber9644 March 4 , 2019 – 10 00 am ContinuedPage0645 March 4 , 2019 – 10 00 am Continued At the request of Commissioner Lawter , Mr Rickard reviewed with the Board the DOT funding scoring process and how projects are approved for funding He noted that projects that receive funding are most often the projects in which everyone the Department of Transportation Division Engineer , the MPO , and the RPO can come together and agree on Chairman Ted G Godwin thanked Mr Rickard for updating the Board Page1646 March 4 , 2019 – 10 00 am Continued 5 Nursing Home Adult Care Home Community Advisory Committee Update Jimmy Parker , Chairman of the Nursing Home Adult Care Home Community Advisory Committee , provided the Board with an annual update on the Committee’s work Mr Parker stated the mission of the Committee is to serve as grassroots volunteer advocates for residents in long term care in Johnston County He added their vision is that citizens of Johnston County and the residents of long term care facilities in Johnston County will recognize the Committee as a key advocate and resource for information about long term care issues Mr Parker stated the Committee’s responsibility is to visit all the long term care facilities in the County and apprise themselves of the general conditions , assure that the residents ’ Bill of Rights are being upheld , assist residents with any concerns , and educate and inform the community about long term care Mr Parker reported they currently have 16 active committee members and are allowed to have up to 25 He noted their new member recruitment efforts are ongoing and he thanked Carolyn Pennington as the Regional Ombudsman for Johnston County Mr Parker reported this year will commemorate 40 years of the Long - Term Care Ombudsman Program He spoke on the importance of the Ombudsman Program and noted that this program has provided over 400,000 instances of information and assistance on resident rights , care , and community options as well as over 125,000 instances of information and assistance to facility staff regarding issues with discharge planning , care , rights , and abuse prevention Mr Parker reported the following on the facilities in the County 25 total facilities with a capacity of approximately 1,235 residents 5 Skilled Nursing Rehabilitation Facilities - total capacity 670 residents 10 Adult Care Homes Assisted Living - total capacity 495 residents 10 Family Care Homes 6 or fewer residents - total capacity 70 residents Dementia care special care capacity 188 beds ~ 15 of total beds - Assisted Living facilities – 168 beds in secure units - Nursing Home – 20 beds in secure units Facilities that do not have secure units will accept dementia patients depending on the level of care required Two facilities in planning and construction - An Assisted Living facility with a capacity of 60 residents including dementia care is under construction opening date has not been announced - A Family Care home is completing inspection by DHSR and will open soon Mr Parker stated facility visits are conducted by teams of three to five members grouped by geographic regions in the County He stated the teams rotate facility assignments quarterly Mr Parker reported for 2018 the Committee teams conducted over 75 facility visits devoting more than 1,315 hours and logging more than 5,918 miles He explained the teams document the visits and file reports with the full Committee for review which are then sent to the Ombudsman and finally placed on the County’s website Mr Parker stated any issues or concerns that are encountered during the visits are discussed with the staff administration , with the resident’s permission He continued that members always encourage communication with staff and any unresolved issues are immediately referred to the Regional Ombudsman Mr Parker reported on the strengths and weaknesses with the County’s long term care facilities He stated some of the weaknesses include inadequate staffing which affects the quality of care , lack of or little variety of activities , high turnover rates for staff and administrators , and improvements needed in making the dining experience more meaningful Mr Parker spoke on the strengths stating for the most part the facilities have well trained and caring staff and administrators He noted the skilled nursing facilities provide excellent rehabilitation services , there are renovations and improvements in several facilities , and many churches and civic groups are providing religious services and entertainment at facilities Mr Parker stated the Committee members continue to educate the public on the issues of long term care for the elderly by attending festivals and other community events to hand out literature and answer questions about long term care Mr Parker noted they have Committee Members serving on local , regional , and StatePage2647 March 4 , 2019 – 10 00 am Continued level boards in an effort to stay informed of the issues facing the elderly Mr Parker concluded the update by stating the Committee has developed good working relationships with facility staff and administrators and the administrators welcome the Committee’s perspective and suggestions He stated most residents express satisfaction with the care received Mr Parker noted that he believes the capacity within Johnston County is adequate as there are few waiting lists Mr Parker thanked Commissioner Chad M Stewart for his active participation with the Committee and the entire Board for their support to the Committee members The Board thanked Mr Parker and all the members on the Committee for their work and dedication 6 Wilson’s Mills Fire Department – Request for Tax Exempt Loan Status Wilson’s Mills Fire Chief Bentley Powell reported the Wilson’s Mills Fire Department is requesting the Board to adopt a resolution approving tax exempt loan status so they can borrow up to 250,00000 from the Local Government Federal Credit Union CIVIC Federal Credit Union Division Chief Powell stated the loan would be for the purchase of a 2019 Spartan MetroStar Truck at an interest rate of 315 with a 5 year term and monthly payments Chief Powell stated the loan would be for half of the purchase amount and they plan to use some of their savings to pay the other half The Fire Department held their required public hearing on February 27 , 2019 at the fire station on the proposal Upon a motion by Commissioner Chad M Stewart , seconded by Commissioner Patrick E Harris , and carried by unanimous vote , the Board adopted the following resolution NOW , THEREFORE , BE IT HEREBY RESOLVED , that the Board of Commissioners of Johnston County , North Carolina , does hereby approve a tax - exempt loan to the Wilson’s Mills Fire and Rescue Department , Incorporated the “ FD ” , from the Local Government Federal Credit Union CIVIC Federal Credit Union Division in an amount up to 250,00000 for the purchase of a 2019 Spartan MetroStar Truck RESOLVED , FURTHER , that the approval of the loan to the FD set forth above is given solely for purposes of the public approval requirements for tax - exempt financing applicable to the FD because of Section 150 e 3 and Section 147 f of the Internal Revenue Code of 1986 , as amended , and such approval does not obligate the County or its Board of Commissioners in any way regarding repayment of the debt Duly certified by the execution hereof and the placement hereon of the seal of said th county , this 4 day of March , 2019 Commissioner Patrick E Harris thanked Chief Powell and the Wilson’s Mills Fire Department for all that they do to keep the community safe 7 Request for Transfer of Funds – My Kids Club County Manager Rick Hester explained that the former Boys & Girls Club of Johnston County located in Selma was under the umbrella of the Goldsboro Boys & Girls Club ; however , the Johnston County chapter severed ties with the Goldsboro Boys & Girls Club and is no longer in existence Mr Hester reported the leadership of the former Johnston County chapter has reorganized into the new My Kids Club for Johnston County and they are requesting funds in the amount of 25,000 and formerly allocated for the Boys & Girls Club of Johnston County be transferred to the new My Kids Club Mr Hester noted the Goldsboro Boys & Girls Club has returned the 25,000 that had been allocated for the Johnston County chapter so those funds are available to transfer Upon a motion by Commissioner Larry Wood , seconded by Commissioner Patrick E Harris , and carried by unanimous vote , the Board approved the transfer of funds in the amount of 25,000 from the former Boys & Girls Club of Johnston County to the new My Kids Club 8 Clayton Community Recreational Foundation – Update on Harmony Playground Project Dean Penny , Board of Directors Chairman for the Clayton Community Recreational Foundation , addressed the Board Mr Penny recognized other members of the Board of Directors in the audience including Michael Sims , Clayton Mayor Pro - time positions at a cost of 456,278 Mr Sabatino stated the positions are not currently filled and if approved , it would build a quality assurance team to help strengthen Medicaid Services and reduce caseload sizes Mr Sabatino also noted the State does not allow temporary employees to work with NC Fast cases Commissioner Tony Braswell moved the Board approve the request to convert 18 temporary positions in the NC Fast System to 9 permanent full -
