Mr Taylor stated he has worked with the Department of Transportation to get trash and debris removed and he has also asked the Sheriff’s Office to monitor that area Mr Taylor reported he frequently picks up high - powered rifle bullet casings near the dead - end section and spoke on the safety concerns associated with such activities Mr Taylor requested the Board to assist in getting the road closed off until such time as there is a need for it to be publicly used The Board thanked Mr Taylor for the information and asked the County Manager to look into the situation B Juvenile Crime Prevention Council - Resolution Juvenile Crime Prevention Council Chair Judge Addie Rawls requested the Board to adopt a resolution regarding additional State funding for the Council Judge Rawls stated the additional funding is being requested from the State to cover additional costs as a result of the “ Raise the Age ” Legislation Upon a motion by Commissioner Tony Braswell , seconded by Commissioner Patrick E Harris , and carried unanimously , the Board adopted the following resolution Resolution Supporting Juvenile Crime Prevention Council Allocation Expansion WHEREAS , Juvenile Crime Prevention Council JCPC funding is a partnership between the State of North Carolina and the County to ensure a local continuum of services for court involved and at - risk juveniles ; and WHEREAS , the Juvenile Crime Prevention Council , under the authority of NCGS 143B - 851 , and within the scope of its powers and duties , “ Each County Council shall annually review the needs of public comment on a proposed economic development incentive grant Chairman Ted G Godwin called on staff for an explanation of the proposed grant Economic Development Director Chris Johnson explained the proposed economic development incentive grant is for Dollar General and consists of the up - fitting of an existing 343,000 square feet located in the Carolina Distribution Center in Clayton with an investment of over 13 million and the creation of over 105 new jobs Mr Johnson recalled that back in the fall of 2018 , a number of jobs in this facility were lost when Smithfield Foods relocated their operations out of Johnston County and he is hopeful that those individuals may be able to find new jobs with Dollar General Mr Johnson explained the economic development incentive grant is proposed for five years at 50 of the net new ad valorem tax value for business personal property He stated the proposed grant has been reviewed and recommended for approval by the Johnston County Economic Development Advisory Board Mr Johnson noted that payment of the incentive grant will only occur once the company has satisfied all terms within the economic development incentive grant agreement ; therefore , there is no risk to the taxpayers Jeff Forsythe with Forsythe & Associates , representing Dollar General , thanked the Board for the partnership on the project and stated they from traditional economic development incentive grants because the investments will be made in tranches Ms Slusser explained that following such time as when the investments have been reported and verified by the Tax Office as well as other commitments within the agreement met , the County shall then disburse grant incentives to Eastfield She stated the grants shall be measured by and equal to an amount of 70 of the ad valorem taxes paid on each eligible tranche over a seven year period of time Ms Slusser noted the calculation of the incentives shall not be based upon any portion of ad valorem taxes paid which represents interest or penalties nor any fire , insurance , or service district ad valorem taxes or any other charge , fee , assessment , or tax other than the County’s primary general revenue ad valorem tax She stated in order for Eastfield to receive the grant , in addition to meeting all commitments and milestones within the agreement , they must be current in the payment of all taxes , charges , and fees to the County and current with the filing of all property tax listings with no appeals pending regarding the valuation of property at the project site Ms Slusser reviewed the default and remedies section of the proposed agreement with the Board and noted there are recapture provisions if needed Ms Slusser also noted there is a residential phase planned within the project ; however , the residential section is not a part of the economic development incentive grant and no incentives will be paid towards the residential development Ms Slusser also stated there are limitations on the retail development of the project as well as language included in the agreement to avoid the creation of “ dark stores ” in other parts of the County Ms Slusser introduced Attorney Sam Johnson with Poyner Spruill who assisted with the agreement and offered to answer any questions Kevin Dougherty , President of AdVenture Development , stated AdVenture Development will be the project developer for Eastfield and they appreciate the Board considering the economic development incentive grant Mr Dougherty stated they hope to deliver a project that everyone will be excited about Commissioner Tony Braswell thanked Mr Dougherty for investing in Johnston County and specifically in the I - 95 corridor , stating it will be a great asset to not only Selma but all the towns located along I - 95 Commissioner Chad M Stewart agreed with Commissioner Braswell’s comments and stated he is thankful for opportunities such as this to help some of the smaller towns along that corridor Former North Carolina Department of Commerce Secretary John Skvarla congratulated the County , stating a remarkable agreement has been negotiated for the project and indirect creation of a substantial number of new jobs ; and WHEREAS , North Carolina General Statute 158 - 71 a authorizes the County to make appropriations to aid and encourage the location of manufacturing enterprises , industrial and commercial facilities within the County and other purposes which will increase the population , taxable property , employment , industrial output or business prospects of the County ; and WHEREAS , the Board has determined that granting incentives the Incentives to the Company in exchange for the commitment of the Company to locate and operate the MUD in well as the state of the childcare industry in Johnston County Mr Morris stated the bus tours are scheduled for February 21 and March 14 , 2019 from 8 00 am until 12 00 pm and he encouraged the Commissioners to attend one of the tours Mr Morris stated the tours are funded with a mini - grant the Partnership received from the North Carolina Early Education Coalition to increase public awareness about issues facing Johnston County’s infants , toddlers , educators , and families He noted that in between stops on the bus tours , participants will be able to meet with parents , service providers , along with a representative from the Coalition to discuss the issues facing families and young children in Johnston County The Board thanked Mr Morris for the invitation 7 Johnston County Farm Bureau – Development and Agriculture Discussion Johnston County Farm Bureau President Dennis Durham addressed the Board regarding concerns relating to development and agriculture in the County Mr Durham stated on behalf of the Johnston County Farm Bureau Board of Directors , he would like to thank the Commissioners for the working relationship they have had for many years Mr Durham stated as a way to ease the tension between development and agriculture in Johnston County , they are recommending the Board consider revising the current ordinance to provide for setbacks in between residential developments and existing agricultural operations , swine operations in particular Mr Durham suggested the Commissioners look at Wayne County’s ordinance as an example of something to consider Mr Durham stated the Wayne County ordinance requires residential lots to be set back 750 feet from an active swine operation and 150 feet from a swine waste spray field , except those created individually He stated the setbacks would help protect the agricultural operations as well as the homeowners Mr Durham continued his remarks stating they also request the Board to consider authorizing a community services cost study which would help reveal the true cost of providing services to each type of land use in the County as compared to the revenue generated from those same land uses Mr Durham stated that perhaps the most important request is to open a dialogue between the agricultural community and the County to look at how best to protect the agricultural economy while allowing for continued growth Mr Durham stated they are not opposed to development , but would like to find a way to coexist He offered to answer any questions Chairman Ted G Godwin stated this is not a new subject for the Board and he noted the Commissioners are currently looking at the County’s congestion , growth , and infrastructure needs and that agriculture is certainly an important part of that discussion Chairman Godwin stated the Board is sensitive to the agricultural community and it is very important to the Commissioners Chairman Godwin stated the Board will take the concerns and requests under consideration and the Commissioners welcome feedback in an effort to find ways to coexist Commissioner Chad M Stewart thanked Mr Durham for the relationship the County has with Farm Bureau and stated he looks forward to continued dialogue and feedback Commissioner Patrick E Harris expressed his appreciation for the agricultural community and spoke on the importance of working together to find common ground Mr Durham stated Johnston County Farm Bureau is opposed to decreasing development density because they feel that ultimately it will take away more farmland 8 NC Department of Transportation – Transportation Projects Update District 3 Engineer Sam Lawhorn , PE , with the North Carolina Department of Transportation Highway Division 4 , updated the Board on the current ongoing and future planned transportation projects for the County Mr Lawhorn noted that the projects listed in the presentation have already received funding He reviewed and discussed the guaranteed funding Mr Lawhorn continued that there are a lot more projects in the next five years category which have to be re - prioritized every two years He noted typically if a project is within year seven , then within two years that project can be placed on the five year list for funding ; however , that is not always guaranteed Mr Lawhorn explained how the scoring process works and noted that in the January 2019 Statewide Transportation Improvement Program , there are widening projects planned for Hwy 1010 and Hwy 210 around McGee’s Crossroads Mr Lawhorn stated those projects are not within the guaranteed funding cycle yet , but would be scored again within the next round of re - prioritizing Commissioner Butch Lawter noted he is attending the CAMPO meetings as the Commissioner representative along with some of the Planning staff and they hope to work with the Department of Transportation to get as many points as possible for transportation projects in the County 9 Emergency Services EMS Division – Request to Approve Medical Transport Franchise Emergency Services Deputy Director Josh Holloman reported the Johnston County Emergency Medical Services EMS Advisory Board met in regular session on January 22 , 2019 and reviewed a franchise application received from Vector AeroMedical Mr Holloman stated Vector AeroMedical is a fixed - wing air medical transport provider with current services located at the Johnston County Airport He stated in order to base an ambulance for the purposes of transporting patients from the airport to a hospital destination , or from a hospital to the airport for flight , a local system franchise is required Mr Holloman stated Vector AeroMedical has no intention of competing with current non - emergency medical transport providers in Johnston County , rather , this is to support and expand their already existing flight operations in Johnston County Mr HollomanPage5597 February 4 , 2019 – 10 00 am Continued stated the Johnston County EMS Advisory Committee reviewed the request and recommends that a franchise be granted to Vector AeroMedical and if approved , staff will work to add Vector AeroMedical to the system plan Commissioner Patrick E Harris explained that this would be for the ground transportation part of Vector’s operations and would alleviate the fact that they have to depend on another transport company to take their patients to the hospital Commissioner Patrick E Harris moved the Board grant a franchise to Vector Aero Medical , seconded by Commissioner Butch Lawter , and carried by unanimous vote 10 Solid Waste Services Department – Methane Gas Rights Agreement Solid Waste Services Director Rick Proctor requested the Board to adopt a resolution authorizing the execution of a Methane Gas Rights Agreement to CII Methane Management IV , LLC for the Landfill Gas Capture and Collection System for a term extending until October 24 , 2031 Mr Proctor stated the original agreement was approved in June of 2010 and payment under the agreement to Johnston County as compensation for the lease is 100 per year and the County will also receive royalties from CII Methane Management IV , LLC for right and title to use the gas collected Mr Proctor offered to answer any questions At the inquiry of Chairman Ted G Godwin , Mr Proctor stated the revenue from the operation brings in approximately 9,000 each month Upon a motion by Commissioner Butch Lawter , seconded by Commissioner Larry Wood , and carried unanimously , the Board adopted the following resolution RESOLUTION BY THE JOHNSTON COUNTY BOARD OF COMMISSIONERS AUTHORIZING THE EXECUTION OF A METHANE GAS RIGHTS AGREEMENT ON COUNTY - OWNED PROPERTY WHEREAS , Johnston County owns the Johnston County Landfill located at 680 County Home Road , Smithfield , North Carolina , in which contains a Landfill Gas Capture and Collection System ; and WHEREAS , Johnston County intends to authorize the execution of a Methane Gas Rights Agreement to CII Methane Management IV , LLC for the Landfill Gas Capture and Collection System for a term extending until October 24 , 2031 with payment to Johnston County as compensation for the lease under the agreement at 100 per year and Johnston County to also receive royalties from CII Methane Management IV , LLC for right and title to use the gas collected ; and WHEREAS , pursuant to the provisions of NCGS 160A - 272 , notice has been timely given by publication describing the property affected by the agreement , stating the compensation to be received by Johnston County , and announcing the trained positions are needed for the Medicaid and Food Stamps divisions Mr Sabatino noted the four temporary positions are not currently filled and converting them to the two fill - time positions Understanding – Third Amendment Utilities Director Chandra Farmer , PE , explained that in order to assist and support the Town of Selma in obtaining industrial site certification and the eventual development of the Selma Crossings industrial tract , the County executed a Memorandum of Understanding on November 7 , 2011 offering the Town three options for additional future water supply from the County Ms Farmer stated the agreement terms were for five years , but allowed for renewal in one year increments by bilaterally signed amendments and the Town has requested renewal of the agreement Ms Farmer reported the first amendment was approved by the Johnston County Board of Commissioners on November 7 , 2016 extending the agreement terms for one year , and the second amendment was approved by the Johnston County Board of Commissioners on February 5 , 2018 extending the agreement terms for one year Ms Farmer stated staff requests approval of the proposed Third Amendment to the Memorandum of Understanding between the Town of Selma and Johnston County related to water supply for Selma Crossings , which will extend the agreement terms for an additional year Upon a motion by Commissioner reported the Board adopted a project budget for the Buffalo Creek Wastewater Pump Station Upgrade and Force Main project in December 2017 She explained that updated capital project planning since 2017 now requires revisions to the project Ms Farmer reported the original project was identified in the “ Johnston County Public Utilities 2017 Capital Improvements Plan ” adopted September 4 , 2017 and included modifications to the existing wastewater pump station located next to the Town of Smithfield Water Treatment Plant along with 13,000 LF of 20 ” force main from the existing station to the influent gravity sewer main at the County’s wastewater treatment plant Ms Farmer stated Phase 1 of the revised project will include modifications at the existing wastewater pump station and approximately 4,000 LF of 20 ” force main from the existing wastewater pump station to US 70 BUS Phase 2 will include transmission facilities gravity main , a new regional wastewater pump station and force main to move wastewater from US 70 BUS to the landfill area and future wastewater treatment plant expansion Ms Farmer stated the existing Buffalo Creek wastewater pump station receives wastewater flow from the Town of Selma , the Town of Pine Level and a portion of the Town of Smithfield The station is currently at capacity , and the improvements will allow the facilities to accept
