58 provides for publication of the Bond Order as adopted ; and WHEREAS , NCGS § 159 - 61 requires the Board to fix the date of the referendum on the Bond Order , notify the Board of Elections thereof and provide for notice of the referendum to be published ; NOW , THEREFORE , BE IT RESOLVED BY THE BOARD OF COMMISSIONERS FOR THE COUNTY OF JOHNSTON , NORTH CAROLINA 1 The Clerk to this Board shall cause the Bond Order , with a statement appended in form described by NCGS § 159 - 58 , to be published in The News & Observer 2 The Board hereby calls for a referendum with respect to the Bond Order and fixes the date thereof as November 8 , 2022 3 The form of the question on the ballot shall be as follows Shall the order authorizing up to 177,000,000 of General Obligation School Bonds of Johnston County , plus interest , to finance , in whole or in part , the acquisition , construction and equipping of modifications , renovations , additions , improvements and extensions to existing facilities and or one or more new buildings or other school facilities for Johnston County public schools , including acquisition of necessary land and rights - Space Update to the Board – Recreation Master Plan Parks , Greenways , and Open Space Coordinator Adrian O’Neal updated the Board regarding the ongoing Recreation Master Plan project Mr O’Neal thanked the Board for their support and stated Stewart , Inc the County’s consultant for the study has been working hard on the plan He stated a meeting took place with the working group last week and a public information session has been scheduled for July 26 from 6 00 pm until 8 00 pm at the Old Cleveland School athletic site Mr O’Neal stated the purpose of the information session is to gauge what citizens want to see in the park He noted a website has also been established for this project in order for citizens to provide information virtually and the data is being collected in a manner that will allow staff to apply for future grants Mr O’Neal stated parks are not inexpensive anymore and there is a high standard , which is completely different from the past Mr O’Neal reported the goal is to have the study completed in January 2023 6 Child Fatality Prevention Team Annual Report Child Fatality Prevention Team Review Coordinator Kathleen Lanc submitted and reviewed with the Board the following annual report North Carolina Statute , Article 14 , 7B - 1406 and the CFPT Agreement Addenda with local health departments requires local Child Fatality Prevention Teams to advocate for system improvement and needed resources where gaps and deficiencies my exist and submit a report annually to their local county commissioners and boards of health The purpose of the local CFPTs are to ? identify deficiencies in the delivery of services to children and families by public agencies ? make and carry out our recommendations for changes that will prevent future child deaths and ? promote understanding of the causes of child deaths I Introduction In 1993 , the North Carolina General Assembly established a network of local Child Fatality Prevention Teams CFPTs across the state to confidentially review medical examiner reports , death certificates and other records of deceased residents under age 18 Each local team consists of representatives of public and nonpublic agencies in the community such as law enforcement , Guardian Ad Litem , health departments , among others , that provide services to children and their families The purpose of this report is to give a summary of the causes of death , the number of cases reviewed , recommendations for prevention , if any , that have been made to share local team activities and accomplishments II Role of the Johnston County Commissioners and Board of Health ? Receive annual reports which contain recommendations and advocate for system improvements and needed resources , if requested ? Appoint members of the local team as identified by the membership III Child Deaths by Cause , System problems Identified , Recommendations for Prevention & Proposed Action In 2021 , the Johnston County CFPT reviewed 21 child deaths and identified the following system problems and recommended actions for future prevention efforts There were 3 accidental drownings , 2 deaths related to unsafe sleep environments , 1 teen suicide , 1 motor vehicle related accident The remaining deaths were attributed to illnesses in the newborn , prematurity or prenatal conditions Some of these deaths occur regularly , eg drowning , and have been addressed extensively in past team meetings with ongoing efforts to address this concern within the community Below are examples of identified problems , recommendations for prevention and the actions that are ongoing to prevent further child deaths PagePage pageNumber66 July 18 , 2022 – 10 00 am Continued Cause of Death System Problem Recommendation Proposed Action Identified Prematurity and Lack of prenatal Provide education to Continue to provide birth defects care the community about information through the importance of early community clinics and prenatal care physician offices Undetermined co - Co - sleeping with Apply for assistance JCPHD has received a sleeping parents or siblings from community grant to purchase pack - n - due to lack of agencies to obtain items plays for distribution to resources or for safe sleep low income families cultural norms environments Teen suicide Lack of Meetings for parents Discuss with school community through schools for personnel and school resources follow - available resources for resource officers need up when history suicidal or homicidal for making parents aware of suicide or threats of available resources homicidal intent IV Johnston County CFPT Activities and Accomplishments Examples ? The Annual CPFT Summary was completed and sent to the State Coordinator by the requested date ? Members of the team participated in an intensive review of a child fatality case in Johnston county conducted by reviewers from the State CFPT agency ? In conjunction with Johnston County DSS , recommendations for assessment of safe sleep environments were added to the evaluation process when initial contact with CPS services occurs V Conclusion pageNumber77 July 18 , 2022 – 10 00 am Continued 7 Public Utilities – Request for Sole Source Purchase – Timothy G Broome Water Treatment Plant – Claricone ® No 11 and 12 Utilities Engineer Kim Rineer reported the County issued a Request for Proposals to select a design - build team for the Timothy G Broome Water Treatment Plant 14 – 18 MGD Expansion project She explained the County’s process currently consists of one unconnected and nine 9 operational solids contact clarifiers The plant expansion project will require the addition of three solids contact clarifiers Ms Rineer stated the County must install necessary piping for one existing solid contact clarifier and purchase , install and pipe two new solids contact clarifiers She stated the existing clarifiers were purchased from Chicago Bridge & Iron Company CB & I and are referred to as Claricones ® Ms Rineer reported that in order to maintain standardization , compatibility and consistency for operation , staff would like to request an exemption to the formal bidding requirements for the addition of Claricone ® No 11 and 12 as part of the Timothy G Broome Water Treatment Plant 14 – 18 MGD Expansion project She noted the request is in accordance with the standardization and compatibility exemption allowed under the statutes Ms Rineer stated this would allow the County to negotiate a contract with CB & I She stated the contract with CB & I will contain all necessary provisions to meet funding agency , Local , State and Federal requirements Ms Rineer requested the Board’s approval to proceed with a proposal to sole source purchase Claricone ® No 11 and 12 from Chicago Bridge & Iron Company CB & I with the understanding that contract award will not be completed until a capital project budget is adopted to include these costs Upon a question by Commissioner Ted G Godwin , Ms Rineer stated there are currently supply chain issues with every project underway At the inquiry of Commissioner Richard D Braswell , Ms Rineer stated the clarifiers are erected on site Upon a motion by Commissioner Ted G Godwin , seconded by Commissioner Richard D Braswell , and carried unanimously , the Board approved the sole source purchase of Claricone ® No 11 and 12 from Chicago Bridge & Iron Company CB & I with the understanding that contract award will not be completed until a capital project budget is adopted to include these costs 8 Public Utilities – Contract Award & Budget for NC Hwy 96 16 ” Water Main Replacement Utilities Engineer Kim Rineer reported the County received bids on June 9 , 2022 for the NC Hwy 96 16 ” Water Main Extension project She stated the project includes a 16 ” water main along NC 96 from US 701 to Spring Lake Road , which will ensure adequate service and fire protection for all customers in this area , including the newly constructed Ashley Furniture and future economic development Ms Rineer stated the County received six 6 bids , as follows Ms Rineer reported Park Construction of North Carolina , Inc of Morrisville , NC submitted the lowest responsive bid in the amount of 1,724,03800 and Park Construction is properly licensed and experienced in grant and Fund 67 to be reimbursed from the EDIG Fund She stated staff requests the Board to award the NC Highway 96 16 ” Water Main project to Park Construction of North Carolina , Inc of Morrisville , NC in the amount of 1,724,03800 , approve the revised project budget and approve the associated capital project budget ordinance Chairman RS “ Butch ” Lawter , Jr noted that four of the six bids were competitive and within 10 of one another which was good to see Upon a motion by Commissioner Richard D Braswell , seconded by Commissioner Ted G Godwin , and carried unanimously , the Board awarded the NC Highway 96 16 ” Water Main project to Park Construction of North Carolina , Inc of Morrisville , NC in the amount of 1,724,03800 , approved the revised project budget as presented by staff , and approved the associated capital project budget ordinance , as follows CAPITAL PROJECT ORDINANCE FOR THE NC 96 ECONOMIC DEVELOPMENT WATER MAIN EXTENSION PROJECT BE IT RESOLVED by the Board of Commissioners the “ Board ” of the County of Johnston , North Carolina the “ County ” , that pursuant to Section 132 of Chapter 159 of the General Statutes of North Carolina , the following capital project ordinance is hereby adopted Section 1 The project authorized is the NC 96 Economic Development Water Main Extension Project the “ Project ” to serve the newly constructed Ashley Furniture facility and surrounding area , which includes construction of a 16 - inch water main along NC 96 from US 701 to Spring Lake Road The Project is to be financed by a Community Development Block Grant “ CDBG ” awarded to the Town of Four Oaks the “ Town ” , a Golden LEAF Foundation grant awarded to the County , a US Department of Commerce Economic Development Administration “ EDA ” grant awarded jointly to the County and the Town , and an appropriation from the County’s Water Fund “ Fund 67 ” Fund 67 will , in turn , be reimbursed from the Industrial Development Fund from funds designated towards the Four Oaks waterline project Section 2 The officers of the County are hereby directed to proceed with the capital Project within the terms of each of the grant agreements and the budget day of July , 2022 9 Public Utilities – Acceptance of Loan for 2022 Asbestos - Cement AC Water Main Replacement Utilities Engineer Kim Rineer explained that on June 10 , 2022 , the County received a loan offer for the 2022 AC Water Main Replacement project , which includes replacement of existing asbestos - cement water mains in the County’s water distribution system She stated this project is included in the County’s previously approved Capital Improvements Plan Ms Rineer reported the North Carolina Division of Environmental Quality approved the project and offered a Drinking Water State Revolving Loan in the amount of 6,289,100 This is a 20 - year loan with 11 interest rate Ms Rineer stated staff requests the Board’s consideration of a resolution accepting the loan She noted that after the County completes the construction contract bidding process , staff will request the Board to adopt an updated budget and capital project ordinance for the project Commissioner Richard D Braswell asked if this is for County lines only and inquired as to the status of asbestos lines remaining and owned by towns Ms Rineer confirmed that this project is for County lines only ; however , she noted that the towns are eligible for this same program and often score higher than counties She stated there are grant funds available to the towns for this type of replacement project also Upon a motion by Commissioner Richard D Braswell , seconded by Commissioner Ted G Godwin , and carried unanimously , the Board adopted the following resolution accepting the loan for the 2022 Asbestos - Cement Water Main Replacement project RESOLUTION BY GOVERNING BODY OF APPLICANT WHEREAS , the Safe Drinking Water Act Amendments of 1996 and the North Carolina Water Infrastructure Fund have authorized the making of loans and or grants to aid eligible , drinking - water system owners in financing the cost of construction for eligible , drinking - water infrastructure ; and WHEREAS , the North Carolina Department of Environmental Quality has offered a Drinking Water State Revolving Loan in the amount of 6,289,100 for the construction of the 2022 Asbestos - Cement Water Main Replacement Project , hereafter referred to as the “ Project ” ; and WHEREAS , the County of Johnston intends to construct said Project in accordance with the engineering plans and specifications that have been or will be approved by the North Carolina Public Water Supply Section NOW , THEREFORE , BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF THE COUNTY OF JOHNSTON That the County of Johnston does hereby accept the North Carolina Drinking Water State Revolving Loan offer in the amount of 6,289,100 That the County of Johnston does hereby give assurance to the North Carolina Department of Environmental Quality that they will adhere to all applicable items specified in the standard “ Conditions ” and “ Assurances ” of the Department’s funding offer , awarded in the form of a North Commissioners Conference Chairman RS “ Butch ” Lawter , Jr appointed Commissioner Ted G Godwin to serve as Johnston County’s voting delegate for the 2022 North Carolina Association of County Commissioners Conference Commissioner Godwin asked Board members to provide feedback to him in advance of the meeting on any topics of concern 12 Manager Reports and Comments A Request for Qualifications – Facilities Operations Building and or Warehouse County Attorney Jennifer Slusser provided an update on the former Cox Property adjacent to the Public Safety Center site that the County now owns She stated staff requests the Board’s approval to issue a Request for Qualifications for design of a facilities operations building and or warehouse adjacent to the Public Safety Center Site She thanked Buildings & Grounds Director Daniel Clifton , Environmental Health Division Director Todd Ramsey , and Inspections Director Shane Hudson for their assistance on this project Ms Slusser stated she has prepared a draft Request for Qualifications and would like to move forward if the Board approves Upon a motion by Commissioner Fred J Smith , Jr , seconded by Vice Chairman Patrick E Harris , and carried unanimously , the Board approved for staff to proceed with issuing a Request for Qualifications for design of a facilities operations building and or warehouse adjacent to the Public Safety Center Site B Solid Waste Disposal – Postponement of Decal Elimination County Manager Rick Hester recalled that in 2020 , the Board voted to eliminate the solid waste decals by July 1 , 2023 Mr Hester stated he would like to discuss delaying the elimination of the decals until such time as a Solid Waste Director can be hired and additional consideration can be given to an alternate funding mechanism Page111 July 18 , 2022 – 10 00 am Continued Motion Commissioner Fred J Smith , Jr moved the Board postpone the elimination of decals until such time as a Solid Waste Services Director is hired and an alternate funding mechanism is identified Vice Chairman Patrick E Harris seconded the motion Discussion Commissioner Ted G Godwin expressed his concerns about Johnston County’s current practices for solid waste disposal stating he believes it is a government function and it would be a disservice to the process to postpone the elimination of decals Commissioner Godwin stated he could understand postponing it until such time as a Solid Waste Director is hired , but not to put it off indefinitely Commissioner Godwin stated the decal system was one of the reasons he ran for County Commissioner and he is sad to see this action Commissioner Smith stated he does not believe the County Manager is asking to undo the action taken in 2020 , but rather to have more time to come up with a plan that is efficient and effective Commissioner Smith stated the County is better off to have a good plan in place than to rush the process Chairman RS “ Butch ” Lawter , Jr commented that the hiring of a new Solid Waste Director may bring new ideas and postponing the decal elimination would be a smart move until that staff person is in place Vote The motion wastewater Commissioner R Braswell stated he would like for the Board to start talking about the future of wastewater treatment capacity for the County and setting plans into motion Commissioner Ted G Godwin stated he has often heard people say “ if you are not growing , you are dying ” ; however , he is beginning to rethink that statement Commissioner Godwin stated while he thinks there are many other counties that would love to have the growth problems Johnston County is experiencing , there is a real need for the Board to take a better look at the issues as the Comprehensive Land Use Plan is nearing completion Vice Chairman Patrick E Harris recognized Mr James Coleman in the audience and thanked him for his membership and participation on the Social Services Board Commissioner Tony Braswell thanked the Child Fatality Prevention Team for their annual report at today’s meeting Commissioner T Braswell stated he plans to continue talking about the lack of adolescent mental health facilities and services in Johnston County He stated Johnston County is a member of Alliance Health ; however , the County is still very underrated in child and adolescent mental health services and he plans to continue bringing this issue to the forefront Chairman RS “ Butch ” Lawter , Jr stated the Capital Area Metropolitan Planning Organization CAMPO is in the process of updating the 2017 Southeast Area Study SEAS transportation plan Chairman Lawter spoke on the importance of this study and he encouraged everyone to visit the website at https seareastudyupdatecom and complete the survey Chairman Lawter stated he plans to share more information with the Board at the 6 00 pm meeting and discuss an update of the entire Comprehensive Transportation Plan for Johnston County
