10 718 Meeting of the Johnston County Board of Commissioners April 4 , 2022 6 00 pm The Johnston County Board of Commissioners met in regular session Monday , April 4 , 2022 at 6 00 pm in the Commissioners Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina The following members were present Present Chairman RS “ Butch ” Lawter , Jr , Vice Chairman Patrick E Harris , Tony Braswell , Ted G Godwin , Fred J Smith , Jr , Richard D Braswell , and April Stephens Absent None Also Present County Manager Rick J Hester , County Attorney Jennifer J Slusser , Clerk to the Board Paula Woodard , and Paralegal Deputy Clerk Dana Cuddington Chairman RS “ Butch ” Lawter , Jr called the meeting to order at 6 00 pm and the following business was transacted The Commissioners took a moment to welcome new Commissioner April Stephens to the Board Commissioner Stephens stated she is honored to serve and is excited to be a part of the future of the County Chairman Lawter announced that Case 22 - 06 as was previously included on the public hearing notice , would not be heard at this meeting Chairman Lawter stated Case 22 - 06 will be heard at the May 2 , 2022 6 00 pm meeting 1 Appointments Announcement Chairman RS “ Butch ” Lawter , Jr stated the Board utilized written ballots at the 10 00 am meeting for appointments to the Airport Authority and the Beulah Fire Protection District Commission Chairman Lawter stated the votes have been tallied and he announced the following appointments were made Airport Authority – John Bullock , Ken Starling , and Tim Stevens were reappointed ; and Edwin Aldridge , Jr was appointed for four year terms to expire on April 30 , 2026 Beulah Fire Protection District Commission – Eleanor Aycock Johnson was appointed for a two year term to expire on April 30 , 2024 Page719 April 4 , 2022 – 6 00 pm Continued Upon a motion by Commissioner Ted G Godwin , seconded by Commissioner Richard D Braswell , and carried unanimously , the Board granted Mr Starling a waiver in the length of service policy for the Airport Authority 2 Approval Discussion of Agenda Upon a motion by Commissioner Ted G Godwin , seconded by Commissioner Tony Braswell , and carried by unanimous vote , the Board approved the agenda as presented 3 Public Comment A NC GREAT Grant Proposals County Broadband Consultant Jeff Brooks , ECC Technologies , recalled that the Board heard from two broadband providers at their March 21 , 2022 meeting with regards to applications for NC GREAT Grant funding which supports broadband services to citizens Mr Brooks stated since that time , the application deadline for the grant funding has been extended and two additional providers have come forward and requested the opportunity to present application partnership proposals to the Board Mr Brooks stated he recommends the Board hear the information from these additional providers who are Lumos NorthState and Conterra Mr Brooks provided the Board with a brief background on the two providers , stating he has met with them and they would be sending more detailed information soon for the Board to consider County Manager Rick Hester noted that at the March 21 , 2022 meeting , the Board voted to approve providing the NC GREAT Grant matching funds in an amount not to exceed 1 million from the County’s American Rescue Plan Act ARPA funds , for the provider that is selected by the State of North Carolina for the grant award At the inquiry of Commissioner Tony Braswell , Mr Brooks stated the two additional providers are looking at similar and different areas than Charter and Brightspeed and there would be some overlap Commissioner Ted G Godwin commented that he does not see a downside in hearing the two additional providers Chairman RS “ Butch ” Lawter , Jr instructed staff to coordinate with Lumos NorthState and Conterra to th be heard at the April 18 meeting B Republican Party – Comments Regarding District 4 Vacancy Johnston County Republican Party Chairman Darryl Mitchell addressed the Board and stated they were pleased to be a part of the recent interview process for the Commissioner District 4 vacancy Mr Mitchell stated the Republican Party has selected April Stephens to be placed on the ballot in November as the Republican nominee Mr Mitchell spoke on the process stating although it was a tough decision , it was the right decision to select Ms Stephens Chairman RS “ Butch ” Lawter , Jr thanked Mr Mitchell for their coordination and cooperation during the interview process Mr Mitchell introduced and recognized Max Raynor , Eddie Helm , Ed Perry , Brian Barefoot , and General Counsel Marshall Conrad from the Republican Party C Emails Received The Chairman acknowledged an email received from Mr Shannon Petersen regarding Senate Bill 437 concerning authority for counties and cities to impose impact fees 4 Public Hearing Rezoning Requests Advertised – The News & Observer , The Johnstonian News and The News in Review – March 23 and 30 , 2022 Certified letters were mailed to adjoining property owners on March 21 , 2022 Notices were posted at the locations on February 2 , 2022 for Cases 22 - 05 , 22 - 07 , and 22 - 08 The Chairman opened the Rezoning Hearing for Case 22 - 05 Page720 April 4 , 2022 – 6 00 pm Continued Case 22 - 05 Petition to rezone 381 acres located at 1275 Country Store Rd in the Pine Level Township from Agricultural Residential AR and General Business GB to General Business GB Tax ID 12N11197W Owner Country Store Road Trust & Mike Smith Trustee Applicant Todd Gurganus Planning Director Braston Newton stated the petition is to rezone 381 acres located at 1275 Country Store Road in the Pine Level Township from Agricultural Residential and General Business to General Business Mr Newton stated the site is currently vacant The surrounding land uses are zoned Agricultural Residential and used for residential and agricultural purposes and General Business for a gas station convenience store The area is located within a designated “ Primary Growth Area ” on the County’s Comprehensive Land Use Plan Mr Newton stated the traffic count for this portion of Country Store Road is not available and it does not appear on the Comprehensive Transportation Plan as needing improvement Applicant Todd Gurganus stated they have had some inquiries on the subject site and would like to have it rezoned in order to have flexibility There being no further public comments , the Chairman closed the public comment portion of the hearing Mr Newton reported the Planning Board recommended approval of the rezoning and adoption of a Resolution for the Statement of Consistency as submitted in the agenda packet There being no further comments , the Chairman recessed the Rezoning Hearing for Case 22 - 605 , prior to adopting or rejecting a zoning amendment , the governing board is required to adopt a statement approving or rejecting the zoning amendment and describe if the amendment is consistent or inconsistent with the comprehensive zoning plan and why the board considers the action taken to be reasonable and in the public interest ; WHEREAS , the Johnston County Planning Board has reviewed a proposed amendment to The Official Zoning Maps of Johnston County , for a parcel identified as tax Tag ID 12N11197W located at 1275 Country Store Road in Pine Level Township , from Agricultural Residential and General Business - 07 , although he now has no direct financial interest in Fred Smith Company , he did in the past and his son currently does Commissioner Smith further stated for Case 22 - 08 , he used to own that property along with the current owner , Randy Edwards , and although he sold his interest in the property over a year ago , he feels that he should request to be recused from that case Upon a motion by Commissioner Tony Braswell , seconded by Commissioner Ted G Godwin , and carried unanimously , the Board voted to accept requests from Chairman RS “ Butch ” Lawter , Jr and Commissioner Fred J Smith , Jr to recuse themselves from Cases 22 - 07 and 22 - 08 Chairman Lawter turned the meeting over to Vice Chairman Patrick E Harris The Vice Chairman reopened the Rezoning Hearing for Case 22 - 07 Case 22 - 07 Petition to rezone 2687 acres located in the 14000 block of Raleigh Road in Banner Township from Agricultural Residential AR to Industrial 2 - Conditional Zoning I2 - CZ Tax ID 01G10024 Owner Freddy Kinsey Applicant FSC II , LLC Conditional Zoning Request Asphalt Storage Terminal Planning Director Braston Newton stated the petition is to rezone 2687 acres located in the 14000 block of Raleigh Road in Banner Township from Agricultural Residential to Industrial 2 - Conditional Zoning Mr Newton stated the site is currently vacant and the conditional zoning request is to allow for an asphalt storage terminal The surrounding land uses are zoned Agricultural Residential and used for residential and agricultural purposes and Industrial 2 – Special Use District and used by Martin Marietta and ST Wooten for asphalt plants The area is located within a designated “ Primary Growth Area ” on the County’s Comprehensive Land Use Plan Mr Newton stated the traffic count for this portion of Raleigh Road is 1,800 vehicles per day as of 2018 and appears on the Comprehensive Transportation Plan as an existing minor thoroughfare with adequate design capacity The Vice Chairman called for the applicant to come forward Staff displayed the proposed conditions on the screen , as follows Conditions 1 The following uses shall be permitted On - 15 of what is normally seen at asphalt plants ; however , when it occurs , the noise does not come from the terminal plant in as much as it does the trucks that leave the site Mr Wood stated they do what they can to minimize the noise from the trucks At the inquiry of Commissioner Ted G Godwin , Mr Wood clarified that this operation is a terminal with nothing but the liquid that is used in the production of asphalt Upon a question by Commissioner Richard D Braswell , Mr Wood referenced the aerial map and stated there is one resident on a rental property nearby ; otherwise , he is unaware of any other residences on that road Mr Wood stated there is nothing behind them Mr Wood stated this operation is primarily for their own needs and although it is possible for them to supply their competitors , that is not the purpose of this operation Commissioner Tony Braswell asked how long they anticipate the terminal being on the property Mr Wood responded that while asphalt plants can be mobile , and technically their operation could be considered mobile , it is expensive and takes a lot to move There being no further public comments , the Vice Chairman closed the public comment portion of the hearing In response to the Vice Chairman , Mr Wood confirmed that they agree to the conditions as proposed Mr Newton reported the Planning Board recommended approval of the rezoning and adoption of a Resolution for the Statement of Consistency with an attached list of conditions as submitted in the agenda packet The Vice Chairman asked if there were any questions or concerns from Commissioners on the conditions as proposed At the inquiry of Commissioner Tony Braswell , Mr Newton clarified that the applicant requested the change in the hours of operation and the Planning Board approved that change There being no further comments , the Vice Chairman recessed the Rezoning Hearing for Case 22 - 08 Case 22 - 08 Petition to remove eight parcels at Stotts Mill Road in Wilders Township out of the Environmentally Sensitive Area Overlay District due to the map being inaccurate Tax ID 16K01025 , 16K01025D , 16K01025E , 16K01025F , 16K01025N , 16K01025O , 16K01025P , 16K01024J Owners Frances K Henderson , Randy L Edwards Applicant RBV 231 , LLC Planning Director Braston Newton stated the petition is to remove eight parcels 16K01025 , 16K01025D , 16K01025E , 16K01025F , 16K01025N , 16K01025O , 16K01025P , 16K01024J on Stotts Mill Road in Wilders Township out of the Environmentally Sensitive Area ESA Overlay District due to the map being inaccurate Mr Newton stated the purpose and intent of the ESA is to protect certain environmentally sensitive water features in the County He stated residential development subject to the ESA overlay allows for lot areas no less than 40,000 square feet and should the requested map amendment be approved , lot areas would decrease to 30,000 square feet minimum At the inquiry of Commissioner Richard D Braswell , Mr Newton confirmed that if the request is approved the developer could increase the density of a subdivision on the property Mr Newton stated without having knowledge of the history , all staff could derive from the files is that when the ESA was created , it appears that the boundary was perhaps a little more arbitrary and it did not follow the topographic features of the properties in the area and hold true to the drainage basin associated with Little Creek Mr Newton stated staff is checking several areas within the ESA to make sure the maps are as accurate as possible He noted when comparing the maps to the Division of Environmental Quality maps , there is quite a bit of difference in this area Page1728 April 4 , 2022 – 6 00 pm Continued Upon a question by Commissioner Ted G Godwin , Mr Newton stated a subdivision plan was submitted originally with 30,000 sf lots instead of 40,000 sf ; however , that application is pending until this issue is resolved Mr Brad Hart , Engineer with WithersRavenel , representing the applicant , stated the request is to clarify that the subject parcels should not be within the ESA Kelly Allen , Stotts Mill Road , addressed the Board and expressed her concerns that there has not been enough due diligence on the request Ms Allen stated there is a reason that the parcels were originally included in the ESA and she feels a comprehensive study needs to be completed Ms Allen expressed concerns regarding the watershed areas and how subdivisions are impacting those areas There being no further public comments , the Vice Chairman closed the public comment portion of the hearing Mr Newton reported the Planning Board recommended approval of the rezoning and adoption of a Resolution for the Statement of Consistency as submitted in the agenda packet Commissioner Godwin asked Mr Newton how sure is staff that the parcels should not have been included in the ESA Mr Newton responded that although it appears to have been an error that the parcels were included in the ESA , there is not enough historical data available to say for sure what the intent was Mr Newton continued that in looking at the existing topography of the property and drainage data from other resources , it is extremely inconsistent Mr Newton stated the Johnston County Public Utilities Department also reviewed the request and had no concerns Mr Newton clarified that this request is about changing the ESA map , and not about approvals related to a subdivision There being no further comments , the Vice Chairman closed the Rezoning Hearing for Case 22 -
