10 689 Meeting of the Johnston County Board of Commissioners December 1 , 2025 10 00 am The Johnston County Board of Commissioners met in regular session Monday , December 1 , 2025 , at 10 00 am in the Commissioners Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina The following members were present Present Chairman Patrick E Harris , Vice Chairman RS “ Butch ” Lawter , Jr , Ted G Godwin , April Stephens , Bill Stovall , Michelle Pace Davis and Mike Rose Absent None Also Present County Manager Rick J Hester , Finance Officer and Deputy County Manager J Chad McLamb , County Attorney Jennifer J Slusser , Clerk to the Board Dana Cuddington , and Executive Assistant Deputy Clerk Susie Reeves Chairman RS “ Butch ” Lawter , Jr called the meeting to order at 10 00 am Commissioner April Stephens opened the meeting with an invocation Marine Corps League Detachment 1236 of Johnston County led everyone in the Pledge of Allegiance to the American Flag Chairman Lawter reminded everyone of the Board’s six priorities including Public Safety , Infrastructure , County Employees , Financial Stewardship , Educational Funding , and Land Use and the Board’s continuing efforts to keep these priorities in mind when working through the agenda 1 Organization of the Board Chairman RS “ Butch ” Lawter , Jr called on County Manager Rick Hester to conduct the nominations for Chairman of the Board Chairman of the Board County Manager Rick Hester called for nominations for Chairman of the Board Commissioner Ted G Godwin nominated Commissioner Patrick E Harris , seconded by Commissioner April Stephens , to serve as Chairman There being no further nominations , the County Manager closed the nominations , and Commissioner Patrick E Harris was elected by acclamation to serve as Chairman for a one - year term Chairman Patrick E Harris thanked Commissioner RS “ Butch ” Lawter , Jr for his leadership stating he has guided the Board with courage and dignity , and the Board appreciates his dedicated service The Board presented a plaque of appreciation to Commissioner Lawter in recognition of his role as Chairman from 2021 to 2025 Chairman Patrick E Harris thanked his fellow Commissioners for their trust in appointing him as Chairman He stated he looks forward to working with the Board along with all the partners to continue moving the County forward and sticking to the Board priorities that have been mentioned He thanked the citizens of Johnston County for allowing him to serve on the Board of Commissioners Vice Chairman of the Board Chairman Patrick E Harris called for nominations for Vice Chairman of the Board Commissioner Ted G Godwin nominated Commissioner RS “ Butch ” Lawter , Jr , seconded by Commissioner April Stephens , to serve as Vice Chairman There being no further nominations , the Chairman closed the nominations , and Commissioner Lawter was elected by acclamation to serve as Vice Chairman of the Board for a one - year term Commissioner Godwin commented that the County has been involved in many projects over the last several years and the leadership team of Vice Chairman Lawter and Chairman Harris have helped move things request by the Town of Clayton , the Board adopted the following resolution appointing map review officers for the Town of Clayton Johnston County Board of Commissioners RESOLUTION OF APPOINTMENT FOR THE TOWN OF CLAYTON REVIEW OFFICERS th WHEREAS , NC Senate Bill 875 , ratified the 8 day of July , 1997 , revised Article 2 of Chapter 47 of the NC General Statutes by adding section 47 - 302 to require the Board of Commissioners of each county to designate by name one or more persons as a Review Officer to review each map and plat required to be submitted for review before recordation by the the National Dog Show after the Macys Thanksgiving Day Parade is a holiday tradition for many He stated this year’s Best in Show Winner , Soleil , and his handler Mr Daniel Martin , are from Princeton in Johnston County He invited Mr Martin to come forward and introduce Soleil Mr Martin stated he and his wife are professional dog trainers based in Princeton He stated Soleil originally comes from Oklahoma and a few years ago , her owners contacted them , and she has been living with them for approximately eighteen months He stated through dedicated training , they achieved success and were fortunate enough to win among a field of around 2,000 dogs He stated Soleil demonstrated exceptional determination and skill throughout the competition Commissioner Rose noted that he recently learned about the popularity of North Carolina , specifically Johnston County , among dog handlers Mr Martin stated they live near Brogden Road and the area is known for its peaceful environment and strong sense of community He explained that having grown up in the Raleigh - Garner region , where dogs were always present , he appreciates how welcoming and dog - friendly the local environment remains He stated whether he is at Lowes or Tractor Supply , residents are supportive and friendly toward dog owners Mr Martin stated overall , this community provides an excellent setting for raising both dogs and a family He noted that he and his wife recently welcomed their first daughter about a year ago and found the area to be truly outstanding A photo was taken with Mr Martin , Soleil , and the Board of Commissioners B Human Resources - Recognition of Retiring County Employees Human Resources Director Paulette Williams recognized the following retiring County employees Jeannie Evans , Tax Department Julie Gudac , Health Department Jamie Sheldon , Health Department Patty Barbour , Sheriff’s Office not in attendance Chairman Patrick E Harris congratulated the retirees stating their service is greatly appreciated Ms Sheldon addressed the Board stating she is the outgoing WIC Director and it has been an honor to serve Johnston County A photo of the retirees was taken with the Board and they were presented with challenge coins Chairman Harris expressed his appreciation for the Boards commitment to prioritizing employees and recognizing their valuable contributions and years of dedicated service to the community C Recognition of David Fulcher , Environmental Health Johnston County Environmental Health Specialist and Supervisor David Fulcher was recognized for receiving the Steve Steinbeck Hall of Fame Award Mr Fulcher stated this honor was both humbling and unexpected and he was genuinely moved by the recognition He stated it has been a rewarding 27 - year career , and he has enjoyed every moment serving Johnston County Mr Fulcher stated he hopes to continue serving the citizens for a few more years Commissioner Ted G Godwin asked for an overview of the award Mr Fulcher explained that he received the award for the Steve Steinbeck On - Site Wastewater Protection Hall of Fame Mr Fulcher stated his division handles two main areas , those being food and lodging , and the other being on - site septic systems He noted Johnston County is rapidly growing with many new homes needing on - site septic systems He stated he has worked in this field for 27 years , serving as the on - site supervisor for about eight years He reported that new rules were implemented on January 1 , 2024 , and he was involved with their implementation He stated he has also 5 Emergency Services – Johnston County Fire Commission Cost Share Policy Johnston County Fire Division Chief and Fire Marshal Travis Johnson stated Cleveland Fire Chief and Johnston County Fire Commission Chairman Chris Ellington will present the Fire Commission Cost Share Policy Mr Johnson took a moment to remind everyone to check their heaters and smoke detectors as the cold weather approaches Chief Ellington congratulated Chairman Patrick E Harris on his appointment as Chairman Chief Ellington noted as staff travels throughout various counties and discusses the Fire Service Protection District initiative , they are reminded how fortunate Johnston County is to experience such effective communication and cooperation among fire service leaders , County administration , and Commissioners He stated this level of collaboration is not common across the State Chief Ellington extended his gratitude to the Commissioners , County staff , and all fire service leaders for working together as a unified team stating the positive results of this teamwork is evident in the significant strides the County has made , and he is confident that this spirit of collaboration will continue to benefit the County moving forward Chief Ellington explained that initially in focusing on cost share as it relates to funding the County’s Fire Service Protection District , the goal was to address funding and fairness issues He stated as staff reviewed models from other counties , cost sharing emerged as a key topic in that it determines how funding for fire protection services is split between the County and municipal departments , outlining their respective percentages He stated the policys goal is to set up a fair and transparent model , ensuring both the towns and the County pay their proper share of fire protection costs He stated the analysis revealed that , in many areas across the County , citizens residing outside municipalities were subsidizing fire services in towns and conversely , there were a few instances where certain towns contributed more than was required He stated to address these discrepancies staff is recommending a cost - sharing policy designed to ensure fairness Chief Ellington continued that to achieve fairness , staff developed a formula informed by established practices , which evaluates four data - driven factors - call volume both inside and outside municipal boundaries , real and personal property values , population , and the square mileage protected He stated this approach is entirely based on quantitative data and by applying these metrics , the resulting policy determines the percentage of costs to be borne by both the County and the towns He stated staff’s findings indicated notable differences between the intended and actual contributions and the initial formula specifically addresses operational costs and fire apparatus He stated it should be noted that decisions regarding the purchase of equipment , such as fire trucks , remain at the discretion of each town ; however , the same cost - sharing formula , based on the identified data points will apply Chief Ellington stated the consideration of new fire station construction within municipal limits presents a unique scenario He stated if a new fire station is proposed inside the town limits , it is important to evaluate its potential benefit for citizens both inside and outside the town , thus cost sharing becomes relevant He stated such a facility will require appropriate staffing and equipment and can serve County needs as well as those within the respective town He stated cost sharing calculations exist and may differ slightly depending on location and most critically , approval from the Johnston County Board of Commissioners is mandatory for any new construction involving cost share participation with the Johnston County Fire Protection Service District He stated under the policy a town cannot independently construct multiple fire stations and request reimbursement without Commissioner approval and proper vetting Chief Ellington stated all related data will be reviewed annually and after several years , a rolling average will be utilized to assist the towns and the County with budgeting decisions He noted this process is crucial and must begin with careful annual reviews before transitioning to the rolling average system and the town governing bodies and will be implemented according to its terms He stated staff has met with each Commissioner individually to review cost share and has also met with every town Parks , Greenways and Open Space Coordinator Adrian ONeal reported the Triangle Land Conservancy TLC , with County funding involved , secured the purchase of a 313 - acre tract at Devils Racetrack and Rose Dairy Roads , with plans to transfer it to the County for a passive park He stated the site already features trails , two fishing ponds , and other resources that can be used by County residents He explained that before the transfer , the County needs a lease to perform initial work He stated TLC requires insurance , and costs are lower than expected , at about 3,600 annually for staff and contractor liability He stated this will allow staff to move offices there and begin minor renovations At the inquiry of Commissioner Ted G Godwin , Mr O’Neal stated it is anticipated TLC will move forward in the first quarter ; however , there are some outstanding issues with the Department of Transportation related to the reconfiguration of Highway 701 and I - 95 , which may cause some delays received nine applications , encompassing a total of fourteen projects from throughout the County He stated overall , the quality of the applications was high and for this funding cycle staff increased the required matching funds to 25 , which may have discouraged some applicants from participating this year ; however , there was still strong representation He stated the total amount provide input into local governance Commissioner Stovall stated he appreciates everyone who volunteers to serve and his comments are not meant as a criticism of any current members He continued that the Board often needs to grant waivers in the length of service policy because Board policy allows three terms before requiring a waiver He stated board and committee terms typically span two years or longer , though the exact duration may vary He stated occasionally , due to a shortage of candidates , term waivers are granted repeatedly and , in some instances , individuals have served on boards for over a decade by receiving multiple waivers Commissioner Stovall stated it is important that qualified candidates receive thorough consideration , as this approach supports the introduction of new ideas and perspectives within these boards He stated engaging citizens in County governance is essential , and he encourages his fellow Commissioners to ensure opportunities are provided for fresh Hester thanked Vice Chairman RS “ Butch ” Lawter , Jr for his years of service as Chairman stating his leadership has been greatly appreciated , and he speaks on behalf of all employees in expressing this gratitude He congratulated Chairman Patrick E Harris on his new role Mr Hester reported that prior to the Thanksgiving holidays , he and Commissioner Mike Rose were contacted by a property owner experiencing issues with their water service He stated the County’s Utilities staff responded promptly , working several nights to flush the system and make necessary connection adjustments , successfully resolving the matter Mr Hester stated on Thanksgiving Day morning , he received a text from that resident expressing their appreciation for the staff’s dedication and exemplary service He recognized Public Utilities Director Chandra Farmer and her staff for these outstanding efforts 15 Board Reports and Comments Commissioner Michelle Pace Davis commented that the Thanksgiving holiday came quickly this year and she thoroughly enjoyed attending the Youth Livestock Supper , where the young people helped serve and clean up She stated the Farm City Week Banquet on the following Tuesday night was also a highlight and both events are something she looks forward to every year Commissioner Bill Stovall mentioned that he also enjoyed attending the Youth Livestock Supper and Farm City Week Banquet , noting they are both excellent events Commissioner Stovall reported he will be having right knee replacement surgery tomorrow , so he will not be mobile for several weeks and will rely on his family for transportation Commissioner Stovall stated if he is not seen around , that will be the reason Chairman Patrick E Harris stated everyone wishes Commissioner Stovall a successful surgery and swift recovery Commissioner Ted G Godwin stated with Christmas approaching , he would like to encourage everyone to take part in community events , especially the upcoming parades starting tomorrow night in Selma and Cleveland He urged residents to support local activities , stating they bring people together and enhance small - town life Commissioner April Stephens reminded everyone about the groundbreaking for the regional park at 444 Matthews Road , inviting everyone to attend at 10 am this Friday as was mentioned by Mr O’Neal during his presentation Commissioner Stephens echoed Commissioner Godwin’s comments and emphasized the importance of community involvement , sharing that her own journey began with attending Planning Board meetings Commissioner Stephens stated she encourages the setting personal goals for 2026 that include civic engagement , noting that from experience , volunteering and giving back can be very rewarding Commissioner Mike Rose stated he would like to clarify that the funds for the Open Space Fund Grants did not come from taxpayers , but instead from developers through the open space fee - in - lieu program He explained that developers can either set aside land for open space or contribute to this fund when constructing new residential developments , which supports community projects Commissioner Rose spoke on the agricultural workers for their dedication to their work which is often done in difficult conditions He stated this is not an easy industry and he appreciates all their hard work Vice Chairman Lawter reflected on the Boards efforts since 2019 to enhance the quality of life for County residents through delivering results Vice Chairman Lawter stated with regards to board and committee appointments , as Commissioner Stovall talked about earlier in the meeting , he believes the Commissioners consistently select the most qualified candidates for open positions He noted that sometimes these may be newcomers while other times they are existing members receiving another term He stated while some boards may lack sufficient applicants , he feels confident that the Commissioners are choosing the best people available for the open positions Chairman Patrick E Harris stated he would like to highlight how much he appreciates the Farm City Week Banquet and the dedicated people involved in agriculture as they work hard for everyone , and it is a privilege to be surrounded by those people He stated their efforts benefit everyone daily Chairman Harris stated in looking ahead , it is important to have a vision and set things in motion that will benefit future generations He stated some of these efforts may take years , but he is thankful this Board has a vision that will benefit
