10 633 Meeting of the Johnston County Board of Commissioners November 3 , 2025 10 00 am The Johnston County Board of Commissioners met in regular session Monday , November 3 , 2025 at 10 00 am in the Commissioners Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina The following members were present Present Chairman RS “ Butch ” Lawter , Jr , Vice Chairman Patrick E Harris , Ted G Godwin , April Stephens , Bill Stovall , Michelle Pace Davis and Mike Rose Absent None Also Present County Manager Rick J Hester , Finance Officer and Deputy County Manager J Chad McLamb , County Attorney Jennifer J Slusser , Clerk to the Board Dana G Cuddington , and Executive Assistant Deputy Clerk to the Board Susie Reeves Chairman RS “ Butch ” Lawter , Jr called the meeting to order at 10 00 am Commissioner April Stephens opened the meeting with an invocation American Legion Post 71 Clayton led everyone in the Pledge of Allegiance to the American Flag Chairman Lawter reminded everyone of the Board’s six priorities including Public Safety , Infrastructure , County Employees , Financial Stewardship , Educational Funding , and Land Use and the Board’s continuing efforts to keep these priorities in mind when working through the agenda 1 Veterans Services Office – Proclamation for Veterans Day 2025 Veterans Services Officer Robert Boyette requested the Board to adopt a proclamation for Veteran’s Day 2025 Mr Boyette expressed his appreciation to the Board for their support to Veterans Chairman RS “ Butch ” Lawter , Jr reminded everyone there is still time to display a green light for Operation Green Light to honor Veterans Commissioner Ted G Godwin read the following proclamation aloud and moved for its adoption , seconded by Commissioner April Stephens , and carried by unanimous vote PROCLAMATION VETERANS DAY - 2025 th WHEREAS , for decades America has paused on the 11 of November , the anniversary of the armistice that concluded World War I , to remember and to honor our veterans of military service in proud and grateful recognition of the hardships and sacrifices by the millions of men and women who have defended our land in war and in peace ; and WHEREAS , the freedoms we enjoy have been purchased and maintained at a high price , as Americans have been willing , throughout our history , to fight and die to preserve their individual rights as guaranteed in the United States Constitution and the Bill of Rights ; and WHEREAS , Americans owe a great debt to all those who have served in defense of this nation throughout the generations ; for their sacrifices , often resulting in permanent injury or death , which have preserved our unique form of government dedicated to human rights and respect for the individual , and preserved our freedoms and promise of liberty as an example for oppressed persons of the world ; and WHEREAS , in honor of these dedicated men and women , we pledge our continued defense of our nation so that their sacrifice will stand before the entire world as a tribute to the spirit and determination of a people dedicated to the principle of freedom and democracy NOW , THEREFORE , the Johnston County Board of Commissioners does hereby proclaim November 11 , 2025 , as “ Veterans Day ” in Johnston County , and urge our citizens to commend its observance rd Proclaimed this the 3 day of November , 2025 2 Approval Discussion of Agenda Upon a motion by Vice Chairman Patrick E Harris , seconded by Commissioner Michelle Pace Davis , and carried by unanimous vote , the Board approved the agenda as presented Page634 November 3 , 2025 – 10 00 am Continued 3 Consent Agenda Items Upon a motion by Vice Chairman Patrick E Harris , seconded by Commissioner Ted G Godwin , and carried by unanimous vote , the Board approved the following consent agenda items to include a revised Health Department Budget Revision reducing the amount by 56,85700 A Approval of Minutes – October 6 , 2025 - 10 00 am and 6 00 pm B Celebrate Cleveland Committee – Request for Temporary Road Closure The Board approved a request by the Celebrate Cleveland Committee to temporarily close Cleveland Road on December 2 , 2025 from 7 00 pm until approximately 7 45 pm for the annual Cleveland Christmas Parade route , subject to the Celebrate Cleveland Committee working with the North Carolina Department of Transportation , the Johnston County Sheriff’s Office , and the North Carolina Highway Patrol and obtaining all required permits and a liability insurance policy for the event C Sheriff’s Office – Request to Surplus Donated Glock Handguns Per the request of Sheriff Steve Bizzell , the Board declared the following handguns surplus and approved to offer these handguns for sale to federally licensed law enforcement firearms dealers by sealed bid These items were donated to the Johnston County Sheriff’s Office by a federal agency that had upgraded their department - DecemberPagePage pageNumber7639 November 3 , 2025 – 10 00 am Continued Andrea McAllister Health - December Thomas Bruce Solid Waste - December On behalf of the Board , Chairman RS “ Butch ” Lawter , Jr presented challenge coins for each retiree as a small token of appreciation for all they have done for the citizens of Johnston County Chairman Lawter noted that on the back of each coin are four words Empowering , Compassionate , Responsive , and Visionary He thanked the County employees for embodying these qualities every day 5 Cooperative Extension – Resolution for Farm City Week Johnston County Cooperative Extension Director Bryant Spivey shared information with the Board about the Farm City Week celebration , which honors the collaborative efforts required to bring food to American tables ; including farmers , landowners , truck drivers , processors , grocers , and retailers He noted Johnston County has celebrated Farm City Week for 19 years and the Commissioners are invited to the banquet on the Tuesday evening before Thanksgiving , where there will be a program and recognition of outstanding local farmers and agribusinesses Mr Spivey thanked Adam Carroll and Ben Armstrong with the Public Information Office for creating videos that highlight activities during Farm City Week He noted Johnston County is unique as one of North Carolinas top ten most populated counties and also ranks near the top in agriculture , especially in tobacco and sweet potato production He stated many will enjoy sweet potatoes at Thanksgiving , supporting local farms and offering a healthy option Commissioner Michelle Pace Davis stated she is honored to read the resolution as it is her tenth year serving on the Farm City Week Committee Commissioner Davis read the following resolution aloud and moved for its adoption , seconded by Vice Chairman Patrick E Harris , and carried by unanimous vote NATIONAL FARM - build agreement and Barnhill LS3P promptly conducted a thorough site assessment for a new high school building program that would allow construction to proceed while existing operations continued He stated this assessment was completed in April , after which the Board approved an additional 5 million for further design work , enabling them to advance the project documentation and prepare for market engagement with a guaranteed maximum price proposal Mr Moser stated during this period , they produced approximately 740 construction document sheets and several thousand pages of specifications He stated collaboration with the Town of Clayton has been ongoing , particularly regarding the site plan review and they are currently addressing the second round of comments , in parallel with the building permit review process He stated as a result , the project is nearing the stage where permits will be secured , allowing for the initiation of construction Mr Moser introduced Barnhill’s Pre - Construction Manager , Eric Miller , to review the current design , discuss the schedule , sequence , logistics , and go over final pricing Mr Miller shared the following information including a diagram of the site and building renderings PagePage pageNumber9641 November 3 , 2025 – 10 00 am Continued Mr Miller reviewed the site plan with the Board He continued the presentation by reviewing front and rear entry renderings as well as floor plans Page0642 November 3 , 2025 – 10 00 am ContinuedPage1643 November 3 , 2025 – 10 00 am ContinuedPage2644 November 3 , 2025 – 10 00 am Continued Mr Miller shared the following logistics plan for project phasing He noted the overall process will occur in two phases with the first phase including reclaiming the fields and tennis court and constructing the new building , all while maintaining occupancy of the existing facility He stated during the second phase , the existing building highlighted in orange will be demolished , and the remaining site work will be completed Page3645 November 3 , 2025 – 10 00 am Continued Mr Miller reviewed key dates and the project cost estimate with the Board Mr Miller stated with regards to financials , the initial contract for Phase 1 was 390,000 He stated an amendment for design and early work increased this by 4,489,320 He stated the current request , amendment two , is for 121,501,806 to finalize permitting and complete project construction , bringing the total guaranteed maximum price to 126,381,316 He stated additionally , there are 8 million in direct costs attributed to Johnston County Public Schools , resulting in a total projected cost of 134,381,316 He stated of this amount , 5 million has already been funded , leaving a remaining funding requirement of 129,381,316 Mr Moser introduced Barnhill representatives including Matt Turner , Vice President , and Dustin Hale , who will serve as the Senior Project Manager over this project Ms Andrews introduced Johnston County Schools Superintendent Dr David Pearce and Clayton High School Principal Melissa Hubbard noting that Ms Hubbard is a graduate of Clayton High Ms Andrews also recognized Matthew Johnson , Senior Project Manager with the Johnston County Schools Construction Program , and Jeff Sullivan , the District 7 representative from the Board of Education , which includes Clayton Ms Andrews stated after extensive planning , discussion , deliberation , prayer , and following a unanimous vote by the Johnston County Board of Education , they are moving forward with the rebuilding of Clayton High School Ms Andrews stated on behalf of the Board of Education , she formally requests an additional funding allocation in the amount of 129,381,316 from Johnston County to complete this rebuild project Ms Andrews stated it is understood that the Board’s approval of this financial contribution is contingent upon authorization by the Local Government Commission Upon a question by Commissioner Mike Rose , Ms Andrews stated the softball field will be new , and the practice track area in the far - left corner of the rendering could serve as both a track and a general practice space She stated that area will include long jump , triple jump , discus , and shot - put zones , and about half of the football field will be marked off for other uses , such as band or football team practice Commissioner Michelle Pace Davis noted that currently everyone enters from South Fayetteville Street , but with the new construction , the main entrance and parent drop - off will shift to Robertson Street Page4646 November 3 , 2025 – 10 00 am Continued Mr Moser stated the parent drop - off will feature a double - lane queue looping past the football field before reaching the front entry , then exit back onto Robertson He stated students will park in lot number four and continue to enter from Fayetteville Street He noted the parent drop - off and student entrance are separated to avoid mingling He stated the east side with long spaces is designated for bus parking At the inquiry of Chairman RS “ Butch ” Lawter , Jr , Ms Andrews explained that part of the 2018 bond package included plans for a new auditorium at Clayton High School ; however , as financial resources decreased , it was determined that adding a new auditorium to an old building seemed impractical , given the cost She stated Clayton High School does not currently meet modern compliance standards and as a result , the idea of rebuilding the school emerged , prompting discussions regarding potential approaches She stated initially , they briefly considered relocating the school to a new site and acquiring additional land , but it soon became clear that reconstruction could successfully occur on the existing property She stated this led to the process involving stakeholders in selecting designers and moving forward with planning Ms Andrews stated the approach of rebuilding a school on the campus of another is not unprecedented in Johnston County and Wilson’s Mills Elementary and Princeton have previously adopted similar strategies , although such practices have not been implemented in recent years She stated while this may seem like a novel concept , it has proven effective in the past Ms Andrews stated they are confident about maintaining the safety of students throughout the construction process She noted the construction zones will be separated from areas occupied by students , ensuring their safety She stated although some parking spaces will be affected , Clayton High School Principal Melissa Hubbard has assured that adequate parking will remain available to meet the needs Commissioner Ted G Godwin stated about a year and a half ago , he toured the old school when discussions began about rebuilding on this site He commented that this process has evolved in a manner that has come out better than he anticipated Ms Andrews stated she feels positive about the outcome , and believes Clayton High Schools community does too , since their input has shaped these decisions She noted that the address of the high school will change because the front door will be on a different street Commissioner Davis asked when the original part of Clayton High School was built Ms Andrews responded it was in the 1950s and included the cafeteria , main entrance , and old gym She stated the entrance area near the tunnel onto the football field needs to be made handicap accessible due to its incline She stated to access the football field with a wheelchair , visitors currently use the bleachers area and this will be improved to meet ADA standards , aligning with campus - wide compliance efforts She stated this change provides for easier access for events like graduation and senior night Commissioner Bill Stovall inquired about traffic flow or any off - site traffic flow improvements Mr Miller stated there will be an off - site traffic improvement that includes installing a traffic signal at Fayetteville Street and Hwy 70 Commissioner Davis inquired about student safety , citing several individuals that have raised concerns about ongoing traffic and construction activities on campus She stated as previously mentioned , students often travel from one end of the campus to the other and she asked how many entrance doors exist Mr Moser stated currently Clayton High School has 94 exterior doors across its existing buildings , making it challenging to effectively secure the premises with approximately 1,900 students and numerous entrances and exits He stated the new building is designed with 28 points of entry , which will significantly enhance safety for both students and staff Upon a question by Chairman Lawter , Mr Miller stated the traffic signal will be a single pole and there are no improvements planned for the actual street Chairman Lawter stated with regards to this project , both Boards wanted to ensure the campus renovations would be effective before committing He stated the goal was to avoid starting a project that might not succeed Chairman Lawter further stated that one reason for the pause was to thoroughly evaluate and confirm feasibility He stated while everything is not known , there is now much more clarity than from a year or two ago He stated this creative solution will allow for integration of the new facility into the campus with minimal disruption to students Chairman Lawter stated significant thought went into this process , and he appreciates the ingenuity of Barnhill and LS3P He also extended the Board’s gratitude to Ms Andrews and the Board of Education for their collaboration throughout this process Chairman Lawter stated the County’sPage5647 November 3 , 2025 – 10 00 am Continued involvement began with the selection of the Barnhill and LS3P team and has included numerous meetings , campus tours , and various related activities He stated historically , participation by the Board of Commissioners in such processes has been limited ; however , this project represented a distinctive opportunity for both Boards Chairman Lawter stated on behalf of the Board of Commissioners , he would like to thank the Board of Education for this collaborative effort Commissioner Stovall stated several constituents have asked about the anticipated capacity of the new Clayton High School and the expected student enrollment at opening Ms Andrews stated the final enrollment figures will depend on how many students transition from Clayton High to Wilsons Mills She stated while the facility will have a capacity for 2,000 students , current projections suggest initial enrollment will be around 1,700 Ms Andrews stated as Wilson’s Mills High School opens , students will gradually shift from Corinth , Clayton , Cleveland , and the Smithfield - Selma High Schools She stated this phased approach will reduce enrollments at those institutions over time , aligning with the broader strategy for growth management She stated opening Clayton High School with an estimated 1,700 students provides ample room for growth , ensuring that the facility is not at full capacity from day one She stated Clayton is a growing area , so new facilities are being designed to accommodate the future Commissioner Mike Rose asked about the 8 million direct Johnston County Public Schools cost Ms Andrews stated the 8 million direct cost to Johnston County Public Schools covers furniture , technology , and other equipment inside the school Dr Pearce also stated this cost includes moving expenses during the transition between Christmas and the start of the year Vice Chairman Patrick E Harris stated he is confident that the people of Johnston County , and those in Clayton , will be proud of this new facility He stated if Board members have not visited Clayton High School in the past , they may not realize the significant and much - needed changes He stated this project is a great example of teamwork , and he believes it will benefit everyone Ms Andrews stated the Board of Education is responsible for providing a sound education to every child , and quality facilities are an important part of that process She stated she appreciates the Board’s commitment to this and other projects Commissioner Davis commented that she was looking forward to the new parent drop - off line on Fayetteville Street Ms Andrews acknowledged that parent drop - offs are challenging at every school and stated the staff manages it as efficiently as possible to ensure a smooth process as much as they can Ms Andrews took a moment to invite the Board and the community to attend the Veterans Day celebration being held on Tuesday , November 11 , 2025 at the Smithfield Selma High School She thanked the Board for their support Chairman Lawter asked County Manager Rick Hester to come forward and share the finance aspects of the project County Manager Rick Hester expressed his appreciation to Superintendent Dr David Pearce and the Board of Education for their transparency at the staff level , stating it has been instrumental to this project Mr Hester stated while the Board is free to take action as it sees fit , staff’s recommendation today is to postpone a th decision until November 17 as staff will have a scheduled call next week with the Local Government Commission LGC He stated if approved with the LGC , staff will begin pursuing the necessary funding for the project Mr Hester explained that in North Carolina , the LGC is responsible for authorizing local governments to borrow funds , making their involvement a requirement Mr Hester acknowledged Finance Officer and Deputy County Manager Chad McLamb’s efforts in running multiple financial models to assess affordability He stated fortunately , the County is currently in a strong financial position with a AAA bond rating He stated after the call with the LGC next week , assuming th there are no obstacles , staff plans to return to the Board on November 17 Mr Hester stated a key topic for the discussion with the LGC will be the project’s timeline He stated as indicated earlier , Barnhill is prepared to begin work in mid - December ; however , should the LGC require the County’s audit to be completed and approved by the Board of Commissioners prior to final authorization , there may be a brief delay He stated in such a case , following consultation with LGC , staff would transparently discuss the possibility of providingPage6648 November 3 , 2025 – 10 00 am Continued initial funding for the project until the loan is finalized He stated following these steps , staff will submit the final request for authorization through the appropriate channels Mr Hester stated it is anticipated that this will be a 20 - year note with fixed interest rates , and staff expects to maintain the County’s strong bond rating Mr Hester stated staff appreciates the opportunity to initiate this process with LGC in the coming week and is confident in presenting a compelling case He offered to answer any questions of the Board Commissioner Godwin commented that time is money , and any delays could drive up costs Mr Hester stated staff is moving forward with the project and will keep the LGC staff informed about advancing some funds to maintain progress Vice Chairman Harris asked if the December 16 , 2025 start date would be an issue Mr Hester stated staff anticipates no issues meeting the December 16 , 2025 start date , provided the LGC approves the fronting of funds and the Board of Commissioners agree He stated this is a key topic staff plans to address during the upcoming call Chairman Lawter stated this item will be on the Board’s November 17 , 2025 agenda 7 Finance – Resolution Declaring Official Intent to Reimburse Expenditures for Land Purchased for Johnston Community College – West Campus The Chairman introduced the following resolution , a summary of which had been provided to each Commissioner , a copy of which was available with the Clerk to the Board and which was read by title RESOLUTION DECLARING OFFICIAL INTENT TO REIMBURSE EXPENDITURES WITH PROCEEDS OF DEBT PURSUANT TO UNITED STATES DEPARTMENT OF TREASURY REGULATIONS BE IT RESOLVED by the Board of Commissioners of Johnston County Section 1 The Board hereby finds , determines and declares as follows a Treasury Regulations Section 1150 - 2 the “ Regulations ” , promulgated by the United States Department of Treasury on June 18 , 1993 , prescribes certain specific procedures applicable to certain obligations issued by the County after June 30 , 1993 , including , without limitation , a requirement that the County timely declare its official intent to reimburse certain expenditures with the proceeds of debt to be issued thereafter by the County b The County has advanced and or will advance its own funds to pay certain capital costs the “ Original Expenditures ” associated with financing , in whole or in part , i the design , acquisition , construction , installation and equipping of one or more new buildings , plants or other facilities to be used by Johnston Community College including , without limitation , the acquisition of necessary land , easements and rights - quality financial reporting At the request of Commissioner Ted G Godwin , Mr McLamb explained the County is required to prepare a report for the Government Finance Officers Association , based in the United States and Canada He stated this organization evaluates the County’s financial reporting against 15 to 20 specific parameters Mr McLamb stated he is pleased to share that Johnston County Finance achieved excellence in every category assessed He stated while only a majority of the parameters must be met , the County received top marks across the board , which is an outstanding accomplishment The Commissioners thanked the Finance Department for their commitment and outstanding work 9 Public Utilities – Bulk Water & Wastewater Agreement Between Johnston County and Town of Clayton – Cornwallis Road Development Area Public Utilities Director Chandra Farmer , PE , presented information to the Board regarding the Bulk Water and Wastewater Agreement between Johnston County and the Town of Clayton for the Cornwallis Road development area Ms Farmer reported that staff collaborated with Town of Clayton staff on this proposed agreement , which would enable the Town to supply water and sewer services to several parcels located off Cornwallis Road , just south of Veterans Parkway She stated these parcels , known as the Kenny Property and the Troxler Yeargan Property , are currently under development by private companies and have requested annexation by the Town of Clayton She stated the agreement also provides for the future inclusion of additional contiguous parcels , should they be annexed She stated an exhibit attached to the agreement outlines these additional parcels for the Board’s reference Ms Farmer stated under this arrangement , Johnston County will provide bulk water and sewer services to the Town of Clayton , thereby supporting the delivery of retail water and sewer services to the identified parcels Ms Farmer continued that the agreement states the Town must transfer part of its current wastewater treatment and transmission capacity , already owned within the County system , to this area She stated additionally , the Town is responsible for building , or arranging to build , a 500,000 - organized and enjoyable He stated he appreciated the opportunity to meet constituents and discuss recent decisions of the Board Commissioner Michelle Pace Davis reported that two weeks ago Farm Bureau held its annual meeting in Smithfield She stated it was a pleasure to see both Commissioners Bill Stovall and Mike Rose at the event Commissioner Davis stated she is also pleased with the progress the Board has made toward its goals , as there have been numerous updates and activities over the past few weeks Commissioner Davis reminded everyone that the municipal elections are scheduled for tomorrow and she encouraged everyone residing in a municipality to get out and vote Commissioner Ted G Godwin stated on Saturday , Banner Post 109 of the American Legion in Benson hosted its annual Veteran’s Observance Celebration He stated the event was well attended , and he was invited to speak Commissioner Godwin stated during his remarks , he noted there was no place he would rather have been that Saturday morning than among those attendees He stated it was an enjoyable occasion and he encouraged everyone to attend the annual Johnston County Veterans Celebration at Smithfield Selma High School next Tuesday Chairman RS “ Butch ” Lawter , Jr stated the Board has made significant progress since the March Strategic Planning Session with about two - thirds of the goals either completed or well underway He stated the Board is addressing key initiatives like the Unified Development Ordinance UDO Chairman Lawter stated there are many initiatives moving right along and he thanked his fellow Commissioners for their work He stated additionally , the Board recently revised the Stormwater Ordinance , which introduced new requirements Chairman Lawter stated he mentioned at that time the need to look at any impacts from that action and in listening to the recent Planning Board meeting , there seems to be a need to look at how those revisions are impacting development Chairman Lawter directed staff to begin looking at this issue and bring the information back to the Board At the inquiry of Commissioner Godwin , Chairman Lawter indicated there could already be some data from the recent Planning Board meeting that would allow the Board to compare previous standards with the current ones He stated it is important to strike a balance between enhancing the quality of development while maintaining affordability 13 Closed Session – NCGS 14331811 a 4 Economic Development Upon a motion by Vice Chairman Patrick E Harris , seconded by Commissioner Ted G Godwin , and carried by unanimous vote , the Board recessed regular session to sit in closed session for the purposes of discussing matters relating to the location or expansion of industries or other businesses in the area , pursuant to North Carolina General Statute 14331811 a 4 No action was taken Commissioner Ted G Godwin moved the Board adjourn closed session and resume regular session Vice Chairman Patrick E Harris seconded the motion , which carried by unanimous vote There being no further business , Commissioner Ted G Godwin moved the Board adjourn Commissioner April Stephens seconded the motion , which carried by unanimous vote The meeting adjourned at 11 21 am RS “ Butch ” Lawter , Jr , Chairman Dana G Cuddington , Clerk to the BoardPage
