de - sac Chairman Letchworth stated that the proposed subdivision does include paved roads designed to the Johnston County subdivision standards Mr Wayne Worley , 3465 Progressive Church Rd , Princeton , NC , nearby property owner , expressed concern for road flooding and water runoff from the subject property and stated that flooding has been an issue since 2013 Mr Worley showed video to the Board of flooding across Progressive Church Rd Chairman Letchworth asked Mr Lane to address the shared concerns for stormwater drainage , septic setbacks from wells , and transportation impact Mr Lane responded that the roads are proposed to be paved to Johnston County and NCDOT standards and they are proposed to be turned over to the NCDOT system once the proposed subdivision is complete Mr Lane stated that the roads would be designed in such a way that emergency vehicles and school buses could godown them Mr Lane stated that there would be one mail kiosk for all residents in the proposed subdivision per the requirement from the Postmaster General Ms Davis asked about the location of the mail kiosk Mr Lane responded that the mail kiosk would be located on the property line of lot 14 and lot 15on the right side as you enter Mr Lane stated that there would be an internal water system that would service all of the lots and there would be on - site septic for each lot much like the neighboring lots Mr Lane stated that the County requires all septic systems to be 100 feet from any wells Mr Lane stated that the septics permitted in the proposed subdivision would be 100 feet from any adjacent well and there are no proposed wells for the proposed subdivision Mr Lane stated that the septics would be permitted through Johnston County Environmental Health and would meet all Johnston County and state standards Mr Lane stated that the stormwater up and down the existing NCDOT road system is not in their control and it is a NCDOT situation that needs to be addressed by NCDOT Mr Lane stated that the proposed subdivision is required to have a stormwater management 4PagePage pageNumber5plan that is designed , implemented , built , and completed such that no additional water runoff nor any greater volume happens post - development as it is pre - development Mr Sasser stated the amount of water runoff now should be the same amount of water runoff after development Mr Lane responded yes or less water runoff Mr Lane stated that the road system would allow less impact but not more Ms Davis asked about a note on the preliminary plat for the nearby Voluntary Agricultural District Mr Lane stated that if there was a note it would be in the small note section on the preliminary plat MsHoward stated that there is a Voluntary Agricultural District at the corner of Woodard Rd and Quarterhorse Rd Mr Lane stated if it was not noted on the preliminary plat , he would make sure that the note was added Mr Lovering asked about the design of lots 5 - 9 Mr Lane responded that those lots have off - site septic areas , so the houses would pump to those areas which would be designated as their septic area Chairman Letchworth asked if it was primary or repair Mr Lane responded that it is repair and the primary is on - site with repair off - site Mr Little asked if anyone had performed the pre and post caps on the runoff Mr Lane responded not that he knew of yet and that engineering typically shares it once the County approves it and it is ready to go MsWells asked for more information on the septic Chairman Letchworth responded that homeowners are required to have a primary septic field and a repair area that is used if the primary septic field ever goes bad Chairman Letchworth stated that the repair areas may never be used , but they are there in case the primary system ever goes so there is more room to put in a new one Chairman Letchworth stated that you basically are required to have double the amount of septic field needed There wasno further discussion Chairman Letchworth asked for the staff recommendation Mr Marr stated the staff recommended approval with the stated conditions and requirements in the staff report 5PagePage pageNumber6Ms Davis noted that the proposed subdivision would be served by the Brogden Fire Department and that it is an all volunteer department Staff Recommendation Approval Upon a motion by Mr Lovering to approve Pendergrass , seconded by Mr Little , Pendergrass was approved by a unanimous vote of 7 - Beth Blackmon Acreage Lots 403 acres , 26 lots Tax ID # 05E99011G Address 1300 Block of Cooper Branch Rd Mr Marr introduced the subdivision and referenced the above information Mr Marr stated that this subdivision was tabled at the May 2023 meeting Mr Marr provided the Board with an updated preliminary site plan showing the existing easement as prepared byTimmons Group Chairman Letchworth stated that the remaining question from the previous meeting was about the easement to which Mr Marr confirmed 9Page0Mr Keith Roberts , 202 Bonica Creek Dr , Garner , NC , Engineer , stated the particulars of the subdivision and was present to answer any questions from the Board Mr Roberts stated that he spoke with some of the neighbors of the subject property following the previous meeting about the easement and access to the landlocked property behind the subject property Mr Roberts stated that since the last meeting , a surveyor went out to the subject property and located the easement Mr Roberts stated the easement is now shown on the preliminary site plan along the southern property line towards the south of the property Mr Roberts stated the plan is to leave the existing easement where it is and not relocate it Mr Roberts stated that there is an existing farm path within the easement Mr Roberts stated that the preliminary site plan shows the easement off all proposed lots and in doing so they lost one lot Mr Roberts stated that the easement goes all the way to the road and would parallel the driveway coming into the proposed subdivision Mr Roberts stated he does not know NCDOT’s opinion of the two parallel driveways , so they could come in the proposed subdivision a little ways and then put in a pipe and cross over into the easement if needed Chairman Letchworth stated the NCDOTwould dictate what would need to be done Mr Roberts stated that he would ask NCDOT about stacking the easement and proposed subdivision road Mr Elsworth Lee , 1683 Cooper Branch Rd , Clayton , NC , adjacent property owner , stated that he was glad the easement would remain Mr Lee asked which lot was lost by keeping the existing easement Mr Roberts responded that the proposed subdivision went from 22 lots on one side of Cooper Branch Rd to 21 lots and that it was a reconfiguration of the lots Mr Roberts stated that the road network is the same Mr Lee spoke about water runoff and expressed concern about runoff from these lots and asked if a retention pondwould be built Chairman Letchworth stated that the County stormwater requirements are stringent on stormwater runoff and containing stormwater runoff on - Conditional Zoning AR - CZ Tax ID 16K06015 Owner Roberts & Wellons Inc Applicant Duke Energy Progress , LLC Location 28 acres of a 200 acre lot located at 10000 Block of Buffalo Rd in the Wilders Township Conditional Zoning Request Duke Energy substation and related electrical facilities Mr Marr introduced the case and referenced the information listed above Mr Marr stated surrounding land uses and zonings Mr Marr stated this request dealt with the portion on the northeast side of Buffalo Rd Ms Howard asked if they already have an easement at the back of what is proposed to which Mr Marr confirmed it was an overhead power line Mr Matthew Rhoad , Smith Anderson Law Firm , 150 Fayetteville St , Raleigh , NC , representing the Applicant , stated the particulars of the request and was present to answer any questions from the Board Mr Rhoad stated that members of the project team were also present Mr Rhoad provided background for the reason that the substation is needed Mr Rhoad stated that they would have equipment for the substation interconnection to the transmission line that is in the 100 ’ wide easement across the back of the property as well as vegetative buffer and landscaping Mr Rhoad stated that the site would be monitored remotely and the substation would be about a thousand feet from Buffalo Rd down a driveway Mr Hudson asked if they would only remove trees needed for the path Mr Rhoad confirmed that trees would only be removed for what is needed for the driveway and then closer to the substation they would have to clear enough so that nothing is tall enough to fall and hit the facilities Chairman Letchworth asked Mr Rhoad if they had reviewed and understood the proposed conditions and if they agreed to the proposed conditions 13Page4Mr Rhoad confirmed and agreed to the proposed conditions There wasno further discussion Chairman Letchworth asked for the staff recommendation Mr Marr provided a staff recommendation of approval and presented a draft statement of consistency for consideration Staff Recommendation Approval Upon a motion by Mr Little to approve Rezoning Case 23 - From any access easement , 15 feet 8 Equipment and structures located within the electrical substation’s security fence shall not exceed 40 feet To the extent not already exempted from height regulations by Section 14 - 9 of the Land Development Code , the following structures and facilities may exceed the height limit established by this condition and any applicable height limit otherwise stipulated in the LDC light masts and poles ; electrical transmission lines , poles , and towers and electric distribution lines , poles and towers Proposed by Applicant 9 Because expansion of the footprint of an electrical substation would not involve a change of use or increase the density of development on the property , such a modification shall be deemed a minor modification that 14Page5can be approved administratively so long as the modification complies with applicable development standards in place at the time Proposed by Applicant Extension Consideration Petition Consider a three year extension of Preliminary Plat approval of Overlook at Cattail Lake and Cattail Mill Subdivisions that were previously approved on August 11 , 2020 Mr Newton introduced the petition request and stated that these two subdivisions were two separate approvals but were done concurrently on August 11 , 2020 Mr Newton stated , per County Ordinance Section 14 - 177 , the expiration of preliminary plat approval is three years to record some portion of the development Mr Newton stated that the developer had requested per letter dated May 23 , 2023 an extension for each of these developments and he is asking for an additional three years Staff provided the Board with copies of the maps originally approved Mr Newton stated that this petition request is not changing anything with their approval but that it is only an extension of the approvals Mr Lovering stated that what he was looking at on the mapswas not going to change Mr Newton confirmed and stated that it will not change Mr Newton stated that if there were major modifications , it would have to come back to the Board Chairman Letchworth stated that the Board had in the past approved subdivision extensions where there were extenuating circumstances Mr Alexander Gwynn , 405 E Market St , Smithfield , NC , Attorney representing the Applicant , stated the particulars of the request and was present to answer any questions from the Board Mr Gwynn discussed the background and project timeline as provided to the Board in a letter from Mr Robert Bailey , R & R Development Group of NC , LLC Mr Gwynn stated that they have received the NCDOT driveway permit , the soil scientist work is complete , and the wetland survey has resumed Mr Gwynn stated the Applicant has been diligent in pursuing the project Chairman Letchworth asked for clarification regarding the requested extension The letter provided to the Board requested an 18 - month extension Mr Gwynn stated that Mr Bailey believes an 18 - month extension would be sufficient , but the County Ordinance provides a three - year extension so they have requested a three - year extension out of an abundance of caution Upon a motion by Mr Little to approve a three year extension of Preliminary Plat approval of Overlook at Cattail Lake and Cattail Mill Subdivisions , seconded by Ms Howard , a three year extension was approved by a unanimous vote of 7 - 0 at the June 20 , 2023 Planning Board Meeting 15Page6There were no discussion items The meeting ended at 6 57 pm Respectfully submitted by _______________________________________ Jodie Gay , Secretary for the Board 16Page
