10 441 Meeting of the Johnston County Board of Commissioners April 3 , 2023 10 00 am The Johnston County Board of Commissioners met in regular session Monday , April 3 , 2023 , at 10 00 am in the Commissioners Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina The following members were present Present Chairman RS “ Butch ” Lawter , Jr , Vice Chairman Patrick E Harris , Tony Braswell , Ted G Godwin , Fred J Smith , Jr , and April Stephens Absent Commissioner Richard D Braswell Also Present County Manager Rick J Hester , Finance Officer and Deputy County Manager J Chad McLamb , County Attorney Jennifer J Slusser , Clerk to the Board Dana G Cuddington and Executive Assistant Deputy Clerk to the Board Susie Reeves Chairman RS “ Butch ” Lawter , Jr called the meeting to order at 10 00 am Commissioner Fred J Smith , Jr opened the meeting with a prayer American Legion Post 405 of Pine Level led everyone in the Pledge of Allegiance to the American Flag Chairman Lawter stated last year the Board of Commissioners established six priorities as follows Public Safety , Infrastructure , County Employees , Financial Stewardship , Educational Funding , and Land Use He reminded everyone that the Board is trying to address one or more of these items during the meetings in an effort to move the County forward 1 Approval Discussion of Agenda Upon a motion by Commissioner Ted G Godwin , seconded by Vice Chairman Patrick E Harris , and carried by unanimous vote , the Board approved the agenda as presented 2 Visit from 2023 Miss Cleveland and Miss Cleveland Teen Chairman RS “ Butch ” Lawter , Jr introduced 2023 Miss Cleveland Maura Westbrook and Miss Cleveland Teen Hanley Claire House Miss Westbrook addressed the Board and stated she represents the Miss Johnston County Cleveland Scholarship Organization that is an umbrella under the Miss North Carolina and Miss America Organizations She stated she will be competing for the Miss North Carolina Pageant in June and if she wins , she will move on to the Miss America Pageant the following year Miss Westbrook shared her background with the Board stating she is a senior at UNC Chapel Hill double majoring in Management Society and Public Relations Miss Westbrook stated her platform is an initiative called the Be With Purpose Foundation which is a nonprofit organization she founded that focuses on eradicating homelessness and reducing pollution She stated her three - prong initiative in the Cleveland Community is to implement a community garden within the next few years and implement a food and general waste initiative called # wastewithpurpose Miss House stated she is a sophomore at Cleveland High School and was born and raised in Johnston County Miss House shared her background with the Board which includes competitive dance and owning a personalization and customization design business She stated the business has taught her confidence , financial management , time management , service skills and has allowed her to give back to the community Miss House stated the business has allowed her to donate over 1,000 to organizations in Johnston County Miss House stated her platform is promoting community service and empowering young entrepreneurs to own their own businesses She stated her future plans are to attend the University of North Carolina at Chapel Hill to study architecture and design Commissioner April Stephens stated she had the honor of being a part of the interview and judging for both pageants Commissioner Stephens stated the accomplishments and aspirations of these individuals are very admirable 3 Consent Agenda Items Upon a motion by Vice Chairman Patrick E Harris , seconded by Commissioner Ted G Godwin , and carried by unanimous vote , the Board approved the consent agenda items as follows Page442 April 3 , 2023 – 10 00 am Continued A Approval of Minutes – March 6 , 2023 10 00 am and 6 00 pm B Proclamation – Litter Sweep Spring 2023 – April 15 - 29 , 2023 , adopted as follows PROCLAMATION SPRING LITTER SWEEP 2023 WHEREAS , the North Carolina Department of Transportation organizes an annual spring statewide roadside cleanup to ensure clean and beautiful roads in North Carolina ; and WHEREAS , the spring 2023 LITTER SWEEP roadside cleanup will take place April 15 - 29 , 2023 , and encourages local governments and communities , civic and professional groups , businesses , churches , schools , families and individual citizens to participate in the Department of Transportation cleanup by sponsoring and organizing local roadside cleanups ; and WHEREAS , Adopt - A - Highway volunteers , Department of Transportation employees , Department of Public Safety – Division of Adult Correction inmates , community service workers , and interested citizens conduct annual local cleanups during LITTER SWEEP and may receive certificates of appreciation for their participation ; and WHEREAS , the great natural beauty of our state and a clean environment are sources of great pride for all North Carolinians , attracting tourists and aiding in recruiting new industries ; and WHEREAS , the cleanup will increase awareness of the need for cleaner roadsides , emphasize the importance of not littering , and encourage recycling of solid wastes ; and th WHEREAS , the 2023 SPRING LITTER SWEEP will celebrate the 35 Anniversary of the North Carolina Adopt - A - Highway program and its volunteer groups that donate their labor and time year round to keep our roadsides clean ; and WHEREAS , the LITTER SWEEP cleanup will be a part of educating the children of this great State regarding the importance of a clean environment to the quality of life in Johnston County and North Carolina ; and NOW to adopt a resolution supporting National Public Safety Telecommunicator’s Week Mr Renfrow recognized Jimmy Turbeville and Morgan Harris from 911 Communications along with Tammy Ammons from the Sheriff’s Office stating everyone works together for the same common goal which is to provide the utmost care for the citizens He stated there are 55 telecommunications staff members and they are all commended the telecommunications staff and stated the calls are answered no matter what time it is Vice Chairman Harris read the following resolution aloud and moved for its adoption Commissioner Ted G Godwin seconded the motion , which carried by unanimous vote National Public Safety Telecommunicator’s Week April 9 - 15 , 2023 WHEREAS , emergencies can occur at anytime that require police , fire or emergency medical services ; the 911 Communications Center was created to provide a vital contribution to the quality of life enjoyed by citizens and visitors to Johnston County ; and WHEREAS , when an emergency occurs , the access to a 911 center dramatically improves the prompt response of police officers , firefighters and paramedics , is critical to the protection of life and preservation of property ; and WHEREAS , the Telecommunicators are trained , prepared and ready ; the safety of our police officers , firefighters and EMS personnel are dependent upon the quality and accuracy of information obtained from citizens who telephone the Johnston County 911 Communications Center ; and WHEREAS , Public Safety Telecommunicators are the first and most critical contact our citizens have with emergency services ; and WHEREAS , Public Safety Telecommunicators are the single vital link for our police officers , firefighters and EMS personnel by monitoring their activities by radio , providing them information and ensuring their safety ; and WHEREAS , Public Safety Telecommunicators of the Johnston County 911 Communications Center have contributed substantially to the apprehension of criminals , suppression of fires and treatment of patients ; and WHEREAS , each Telecommunicator has exhibited compassion , understanding and professionalism during the performance of their job ; and WHEREAS , National Telecommunicator’s Week will serve to recognize the Telecommunicators of Johnston County who provide a vital public safety service NOW THEREFORE BE IT RESOLVED , that the Board of Commissioners of the County of Johnston , hereby proclaim and declares the week of April 9 - 15 , 2023 as National Telecommunicator’s Week in Johnston County , in honor of the men County employee and taxpayer he can personally say that the Board’s commitment to this priority does not go unnoticed 6 Health Department – Public Health Week 2023 Health Director Dr Marilyn Pearson requested the Board to adopt a resolution supporting Public Health Week She stated there are more than 157 employees in four divisions which include Vital Records , Behavioral Health , Environmental Health , and Preventive Health She commended the employees stating they make sacrifices to promote health and safety every day in Johnston County Commissioner Tony Braswell read the following proclamation aloud and moved for its adoption Vice Chairman Patrick E Harris seconded the motion , which carried by unanimous vote PUBLIC HEALTH WEEK 2023 RESOLUTION BY THE JOHNSTON COUNTY BOARD OF COMMISSIONERSPagePage pageNumber6446 April 3 , 2023 – 10 00 am Continued WHEREAS , the Johnston County public health workforce is a critical component of our emergency response to natural and man - made disasters and widespread disease outbreaks in our county , including COVID - 19 ; and WHEREAS , our county and state public health workers have been courageous , inventive and tireless in their work to protect our residents from the threats of the COVID - 19 pandemic , while continuing to perform their other essential public health functions , often times at the risk of their own safety and health ; and WHEREAS , public health measures to control and eliminate infectious diseases , improve environmental sanitation , and promote healthy lifestyle practices have been the greatest cause of improved health status and increased life expectancy for the residents of our County and all North Carolinas residents ; and WHEREAS , public health plays a critical role advancing health equity and preventing chronic diseases and injuries , resulting in improved productivity and decreased health care costs for all North Carolinians ; and WHEREAS , the Johnston County Board of Health is committed to a continued emphasis on prevention in public health , and to helping our County and all North Carolina reach a better state of health through actions outlined in the Healthy North Carolina 2030 objectives ; and WHEREAS , communities , local health departments , employers , hospitals and health care providers , individuals and families , insurers , county leaders and policy makers , faith - based communities , and schools and childcare facilities must work together to identify and develop innovative solutions to health problems facing the people of Johnston County ; and WHEREAS , the Johnston County Board of Commissioners encourages all residents to recognize that public health is working to ensure that all residents are protected from threats such as COVID - 19 , influenza , foodborne disease , injury , and chronic diseases such as diabetes , heart disease , and asthma ; and WHEREAS , April 3 - 9 , 2023 , has been designated as NATIONAL PUBLIC HEALTH WEEK NOW , THEREFORE , WE , THE MEMBERS OF THE JOHNSTON COUNTY BOARD OF COMMISSIONERS in regular session , do hereby UNANIMOUSLY PROCLAIM that April 3 - 9 , 2023 , shall be designated as PUBLIC HEALTH WEEK in Johnston County , and commend its observance to all county residents and convey our deepest gratitude to those public health professionals who serve our county every day rd Adopted this the 3 day of April , 2023 Commissioner Ted G Godwin commended Dr Pearson and her staff for their hard work noting that especially the last three years have been very challenging Recognition of Environmental Health Supervisor Dr Pearson recognized Johnston County Environmental Health Supervisor Todd Ramsey for receiving the North Carolina Environmental Health Supervisor of the Year Award from the North Carolina Environmental Health Association for 2022 Dr Pearson stated Mr Ramsey has worked for the Environmental Health Division for over 17 years and has been the Environmental Health Supervisor since January of 2017 She stated his emphasis is on teamwork and she spoke on his work during the pandemic with the assisted living and daycare facilities in the County Dr Pearson stated Mr Ramsey is committed to his staff and is a leader at the local and state level Mr Ramsey stated it is a pleasure working with the County and he is very humbled by the award He stated the leadership from the Board , Dr Pearson , and County Manager Rick Hester along with the community support has carried him through his career Commissioner Ted G Godwin stated he is very impressed with Mr Ramsey’s technical expertise amazing to see the cohesiveness of the divisions within the Health Department and their commitment to serving the public He stated this award for Mr Ramsey is very well deserved Commissioner April Stephens stated coming in as a new County Commissioner she was grateful for Mr Ramsey and his department’s assistance in helping with a septic issue for a citizen Commissioner Stephens stated she did not realize what Mr Ramsey’s job encompasses and she thanked him for his work Chairman RS “ Butch ” Lawter , Jr stated that he appreciates the time Mr Ramsey has always taken for him when he calls with questions Chairman Lawter thanked Mr Ramsey for his leadership not only at the County level but at the State level Mr Ramsey thanked his staff for their work in the Environmental Health Division stating they are phenomenal 7 Social Services – Child Abuse Prevention Month DSS Director Scott Sabatino requested the Board to adopt a proclamation supporting Child Abuse Prevention Month He thanked law enforcement , the hospital , Health Department , and the court system for their efforts in child abuse prevention Mr Sabatino stated last year 2,057 calls were received for suspected child abuse and of those calls , 1,745 reports were assigned for assessment He stated there were 108 petitions filed for legal custody and 77 petitions filed for court oversight Mr Sabatino reported there was an average of 154 children in the legal custody of the Department of Social Services , and an average of 60 children in the custody of relatives during the year Mr Sabatino thanked his staff stating they work very hard Mr Sabatino invited the Board of Commissioners to attend the community event on April 20 , 2023 from 4 30 pm until 6 30 pm at Smith Collins Park and provided information on some of the activities to be held at the event Mr Sabatino read aloud the proclamation and requested its adoption Vice Chairman Patrick E Harris moved to adopt the following proclamation Commissioner Ted G Godwin seconded the motion , which carried by unanimous vote Child Abuse Prevention Month Proclamation WHEREAS , children are vital to our County and State’s future success , prosperity , and quality of life as well as being our most vulnerable assets ; and WHEREAS , all children deserve to have safe , stable , nurturing , and healthy homes and communities that foster their well - being ; and WHEREAS , child abuse and neglect is a public responsibility affecting both the current and future quality of life ; and WHEREAS , parents need support and resources to cope with stress and nurture their children to grow to their full potential ; and WHEREAS , effective child abuse prevention strategies succeed because of partnerships created among citizens , human service agencies , schools , faith communities , health care providers , civic organizations , law enforcement agencies and the business community NOW , THEREFORE , THE JOHNSTON COUNTY BOARD OF COMMISSIONERS does hereby proclaim April 2023 as CHILD ABUSE PREVENTION MONTH and calls upon all citizens , community agencies , faith groups , medical facilities , elected officials and businesses to increase their participation in our am Continued 8 Johnston County Consumers and Family Advisory Committee CFAC – Mental Health Awareness Month Ms Marie Dodson , Chair of the Consumers and Family Advisory Committee , requested the Board to adopt a proclamation supporting Mental Health Awareness Month She thanked the Board of Commissioners for their support of mental health awareness Ms Dodson acknowledged and commended the work of the 911 - Communications staff mentioned earlier She also commended the work of the Health Department Ms Dodson reported citizens can call 988 anytime 24 hours a day , seven days a week for mental health assistance She stated there is a 20 - bed unit in the mental health section of the hospital including an 8 - bed emergency room overflow Ms Dodson stated work continues towards having a detox center Ms Dodson reported that one in four people have some form of mental illness and she spoke on her own medical concerns and the support she has through her family She stated the Consumer and Family Advisory Committee is tasked by General Statute to address the unmet mental health , intellectual development disabilities , and substance use needs in the community She stated there are efforts to bring information forward to the legislature regarding the unmet needs in the County Ms Dodson read the Proclamation aloud and requested its adoption Commissioner Ted G Godwin stated Ms Dodson has been a strong advocate for mental health Commissioner Godwin noted that he serves on the Alliance Board and Ms Dodson represents Johnston County extremely well with the CFAC organization He stated there are many needs for mental health across the County as well as the United States Commissioner Tony Braswell commented that many times issues that are personal are closer to the heart He stated the lack of adolescent mental health services is unacceptable in Johnston County He spoke specifically about suicide prevention and shared an example of an adolescent that was placed in an eight - by - eight room for six days before an adequate a mental health facility was available Commissioner T Braswell stated the mental health facilities in Johnston County are geared for adult mental health crisis situations He stated he is aware that Johnston County is part of an alliance with other counties , and if those counties have a mental health adolescent facility , then Johnston County should also have one Ms Dodson echoed Commissioner Tony Braswell’s comments and noted that there are very few adolescent facilities in the entire State Commissioner April Stephens agreed Draft Sewer Allocation Policy Ms Farmer stated the intent of the policy is to formalize priorities and the process for allocation of wastewater capacity for future projects Ms Farmer stated the draft policy was provided to the Board and she encouraged the Commissioners to provide feedback to staff on how to move forward She presented and discussed the following with the Board Ms Farmer stated Phase One is the existing project with 2 million gallons per day mgd of available capacity to allocate She stated the intent was to take 200,000 gallons from the 2 mgd and reserve it for economic development projects with 60 of the remaining 18 mgd to be reserved for the bulk customers Smithfield , Selma , Four Oaks , and Pine Level She stated this would be allocated in accordance with the Interlocal Bulk Wastewater Agreements with those towns Ms Farmer continued that the remaining 40 720,000 gallons per day would be available to allocate to County retail customers Ms Farmer stated the allocation process requires an allocation permit and all new development would receive a permit that are County retail customers She stated any existing development , subject to capacity , would be required to get approval of an allocation permit and permits would be subject to approval by the Board of Commissioners assuming the requested allocation is more than 5,000 gallons a day Ms Farmer be zoned PUD , although with the current land use rules PUD is not available for the entire area , or for the development to be immediately adjacent to an existing residential development that has public sewer and could gravity flow without requiring a wastewater pump station Ms Farmer said once the permit is obtained , these priorities would follow the Allocation Permit Expiration , as follows Ms Farmer indicated that the differences between Priority 1 and Priority 2 projects from Priority 3 and 4 are that Priority 1 and 2 projects are primarily publicly funded and economic development projects that have different funding applications She stated they may require additional time to obtain approvals for funding to begin construction Ms Farmer stated there is a provision where the Allocation Permit may be extended in periods not to exceed 90 days per extension , but that would require extenuating circumstances approval At the inquiry of Chairman RS “ Butch ” Lawter , Jr , Ms Farmer stated the list of extenuating circumstances has not yet been defined Chairman Lawter stated there were discussions early in the process about economic development projects and how to balance that and he thinks the 200,000 gpd is a reasonable number , but it could be changed if needed He asked if there would be public input from municipalities and other stakeholders County Attorney Jennifer Slusser stated staff wanted the Board to first provide feedback and or direction on the initial draft and then there would be discussions with stakeholders and community partners Ms Slusser noted that some of the information presented today may change as the draft Land Use Plan Update process continues Chairman Lawter acknowledged that Smithfield Town Manager Michael Scott and others County , but something needs to be done to figure out a way to get citizens around in Johnston County Chairman Lawter stated he is hopeful to see some good results from the Micro Transit Pilot Program Vice Chairman Patrick E Harris noted the previous discussions on mental health and stated meetings on this issue are continuing and proposals have been received from Alliance He stated once those proposals have been reviewed , they would be brought to the Board Vice Chairman Harris noted this is a tremendous problem all over North Carolina and needs to be dealt with Page8458 April 3 , 2023 – 10 00 am Continued Commissioner Tony Braswell spoke about an issue with the Department of Motor Vehicles , in particular the Drivers License Offices Commissioner T Braswell stated he receives many calls from the parents of 15 and 16 year olds that cannot get an appointment with Drivers License Offices and that it often takes as long as three months Commissioner T Braswell stated he has personally experienced this and he has reached out to Representatives Larry Strickland and Donna White and they are working on this issue He stated the citizens deserve better and this has become a real problem Commissioner T Braswell noted that the certificate a student receives from the high school in order to get their learning permit is only good for 30 days , yet there is a three - month waiting period to get an appointment in many locations and he noted that there are no appointments available in the Drivers License Offices located in Johnston County He stated the citizens are frustrated and something needs to be done Chairman RS “ Butch ” Lawter , Jr mentioned that after the Census there was a redefining of urban areas as it relates to the planning organizations for transportation He stated Johnston County is currently in two organizations , the Capital Area Metropolitan Planning Organization for essentially the western part of the County and the other part of the County is in the Upper Coastal Plain Rural Planning Organization He stated with the Clayton , Archer Lodge and Cleveland areas being recategorized as an urbanized area there is the potential for Clayton and Archer Lodge to form its own planning organization Chairman Lawter stated there has been a few meetings on this and soon the Board of Commissioners will need to send a letter to the Department of Transportation as to whether the Board wants to be in our own planning organization Commissioner Ted G Godwin stated he has spoken to several people about the MPO matter and many believe that Johnston County should be in its own MPO He noted Johnston County is one of four counties in the RPO which he has been involved with for several years Commissioner Godwin stated he thinks the seconded by Vice Chairman Patrick E Harris , and carried by unanimous vote , the Board recessed regular session to sit in closed session for the purposes of consulting with an attorney employed by the Board in order to preserve the attorney - client privilege pursuant to North Carolina General Statute 143 - 31811 a 3 , including but not limited to Davis vs McLeod & Johnston County , et al , 22 CVS 2109 and to discuss matters relating to the location or expansion of industries or other businesses in the area , pursuant to North Carolina General Statute 143 - 31811 a 4 No action was taken by the Board Commissioner Ted G Godwin moved the Board to adjourn closed session and resume regular session Commissioner April Stephens seconded the motion , which carried by unanimous vote There being no
