December 4 , 2023 10 00 am and 6 00 pm B Public Utilities - 2022 Local Water Supply Plan On November 10 , 2023 , the NCDEQ Division of Water Resources determined the County's 2022 Local Water Supply Plan meets the minimum criteria established in North Carolina General Statute 143 - 355 l In order to finalize the submittal , NCDEQ requires a resolution by the Board of Commissioners adopting the plan Staff respectfully requests the Board's approval of the proposed resolution C Appointments Johnston County Heritage Commission - previously advertised 1 position remaining ; 2 year term Gary R Underwood has applied for appointment D Budget Revisions i Airport - 40,00000 - To budget monies with the department to cover ordinary business expenses ii Finance - Tax Districts - 35,920,00000 - To budget additional tax district revenue and expense for the towns for FY24 to meet GASB 84 requirement iii Jail - 11,35000 - To move revenues into appropriate expenditure line items iv Public Utilities - 84,00000 - To appropriate additional funds from the Wastewater System Development Fee Reserve Fund for additional technical services rerouting required due to fiber optic cable location for the Buffalo Road Force Main project v Sheriff - 23,34756 - To move revenues into appropriate expenditure line items E Tax Releases & Refunds - 11 16 2023 thru 12 15 2023Page3 Public Comments The following individuals addressed the Board during Public Comment • County Attorney Jennifer Slusser introduced new Deputy County Attorney Jennifer O'Connor • County Manager Rick Hester introduced new Human Resources Director , Paulette Williams • Human Resources Director , Paulette Williams recognized recently retired Johnston County Employees • Emergency Services Director , Kevin Hubbard recognized Emergency Services Deputy Director , Josh Holloman and Deputy Fire Marshal Ronnie Privette • Michael King , Town of Princeton introduced Mayor Stacy Johnson • Chief Chris Ellington Note Full comments can be viewed in the video from the meeting at the following link https wwwyoutubecom watch v SAxELM0jh8M 4 Public Hearing - Economic Development Incentive Grant - Project Red River Following the public hearing , the Board adopted a resolution approving an Economic Development Incentive Grant Agreement between the County and Scot Industries , Inc The purpose of the public hearing is to receive public comment on a proposed economic development incentive grant for Project Red River A company proposes to locate , develop , and build a manufacturing distribution and processing facility in the Ingrams Township , Johnston County , North Carolina The company has proposed the development in Johnston County in exchange for certain economic incentives in the form of annual cash grants paid from general County funds over a seven - year period beginning after required investments and job creation have been satisfied The cash grants will not exceed the property taxes paid by the company in any given grant year The County believes this project will help stimulate the local economy and result in new taxable capital investments in real and personal property and the creation by the company of new , permanent jobs in the County The Board of Commissioners will solicit public comment on the proposed incentives at the public hearing The Board of Commissioners will consider approval of incentives to the company in exchange for the company's commitments to 1 plan , develop , build , and operate the facilities ; 2 create or cause to be created new , permanent full - time jobs ; and 3 invest in taxable real property and business personal property additions , all of which will return property tax revenues substantially in excess of the County's investment The cash grants are contingent upon , among other things , the company's entry into a local economic development agreement with the County containing the obligations and agreements of the company and the County The company must achieve its performance commitments plus be current on all Johnston County tax obligations to receive the proposed leases and grant funding , which is subject to adjustment for partial performance 5 Emergency Services - Resolution - Relocate Boon Hill Fire Ins District Boundary Request approved In order to increase insurance district coverage and first responder coverage for our citizens , staff requests adoption of a resolution to relocate the Boon Hill Fire Insurance District Boundary per NCGS 153A - 233 This request will not affect the current fire tax districts Page6 Four Oaks Industrial Park Road Project Request approved The Town of Four Oaks is requesting the Board to consider an allocation of funding to assist with improving access from the Four Oaks Industrial Park to Interstate 95 This project will also increase connectivity in water and sewer infrastructure and the Town will assume ownership and maintenance responsibilities for the proposed roadway The total project cost is 5,341,41100 and the Town is requesting 500,23700 from the County for this project 7 Public Utilities - Erosion & Sediment Control Joint Resolutions with the Town of Archer Lodge and the Town of Pine Level Request approved In accordance with four previously approved Joint Resolutions , the County currently enforces erosion and sediment control within the Towns of Benson , Wilson's Mills , Archer Lodge and Pine Level The agreements renew on a yearly basis However , the agreements allow for termination by either party if notice is given four months prior to renewal or at any time upon mutual agreement of both parties On November 29 , 2023 , County staff notified the Towns of Benson and Wilson's Mills that the County would not renew the agreement for another one - year term , which would begin on April 1 , 2024 Therefore , those agreements will terminate on March 31 , 2024 County staff have also talked with the Towns of Archer Lodge and Pine Level Staff at both Towns indicated they would support mutual agreement termination on March 31 , 2024 Staff respectfully request the Board's approval of the two proposed joint resolutions to terminate the County's enforcement of erosion and sediment control for the Towns of Archer Lodge and Pine Level 8 Public Utilities - 210 WWTF Diversion Projects - Johnston County Landfill Leachate Pump Station Proposed Construction Contract Award & Budget Revision Request approved The County's previously approved " 210 WWTF Diversion Projects " includes a project for a new Johnston County Landfill Leachate Pump Station The proposed project allows leachate received from the Johnston County Landfill to be directed to the County's new 210 WWTF instead of flowing into the existing Landfill Equalization Basin and being pumped to the Central Johnston County Regional WWTF for treatment The proposed diversion will allow for sufficient treatment of the high strength leachate received into the wastewater system The County received three 3 bids on November 30 , 2023 for the Leachate Pump Station AC Schultes of Carolina , Inc of Rocky Point , NC submitted the lowest responsive bid in the amount of 871,13000 AC Schultes of Carolina , Inc is properly licensed and experienced in the type of construction involved and appears to have the financial , labor and equipment resources required to complete the construction within the stipulated contract completion time The existing capital project budget for the 210 WWTF Diversion Projects includes sufficient funding for this project Staff recommends award of the Johnston County Landfill Leachate Pump Station project to AC Schultes of Carolina , Inc in the amount of 871,13000 , the appropriation of funding for the balance of the project from the Wastewater Fund Balance Fund 68 and request the Board's approval of the proposed project budget 9 Nonprofit Agency Funding Policy Request approved Staff request the Board to consider approval of the Nonprofit Agency Funding Policy Page10 Delinquent Tax Collection Report Informational item 11 Manager Reports and Comments None 12 Board Reports and Comments Commissioner Ted G Godwin stated he looked forward to a very productive 2024 Chairman RS " Butch " Lawter , Jr stated the Board has a lot on their agenda for 2024 such as the Strategic Planning Session on February 15 and 16 at the Clayton Center 13 Closed Session If Requested Closed session was not requested Page
