Resolution Providing for the Issuance of 30,000,000 GO School Bonds , Series 2023 Request approved Staff requests the Board to adopt a resolution providing for the issuance of 30,000,000 general obligation school bonds These bonds represent the first series of bonds to be issued from the school bonds approved by the voters in November 2022 Staff also requests the Board to adopt the accompanying capital project ordinance 6 Public Utilities – Construction Management and Maintenance Software CMMS Initiation project at Existing Central Johnston County Regional Wastewater Treatment Facility CJCRWWTF Request approved On May 23 , 2023 , the County received a grant offer for the Construction Management and Maintenance Software CMMS Initiation project at the Central Johnston County Regional Wastewater Treatment Facility CJCRWWTF The North Carolina Division of Environmental Quality approved the project and offered an American Rescue Plan Grant in the amount of 200,000 The Board of Commissioners previously adopted a capital project budget based on the Notice of Intent to Fund Staff respectfully request the Board’s consideration of the attached resolution accepting the grant and designating Rick Hester as the signatory authority for the grant 7 Public Utilities – Construction Management and Maintenance Software CMMS Initiation project at Timothy G Broome Water Treatment Plant TGB WTP – Offer and Acceptance for an ARP Grant Request approved On May 23 , 2023 , the County received a grant offer for the Construction Management and Maintenance Software CMMS Initiation project at the Timothy G Broome Water Treatment Plant TGB WTP The North Carolina Division of Environmental Quality approved the project and offered an AmericanPageRescue Plan Grant in the amount of 200,000 The Board of Commissioners previously adopted a capital project budget based on the Notice of Intent to Fund Staff respectfully request the Board’s consideration of the attached resolution accepting the grant and designating Rick Hester as the signatory authority for the grant 8 Public Utilities – Timothy G Broome Water Treatment Plant – 14 - 18 MGD Expansion – Proposed Guaranteed Maximum Price and Revised Capital Project Budget Request approved In April 2023 , the Board of Commissioners issued approval for initial phases design , construction administration , early work package and early equipment package of the Timothy G Broome Water Treatment Plant In addition , the Board approved a revised capital project budget and the capital project ordinance for the project After extensive negotiation with the project team , staff recommends a revised capital project budget as identified below based on a final Guaranteed Maximum Price GMP of 73,475,059 Existing Proposed Expenses Technical Services 765,00000 2,100,00000 Construction Design Build TA Loving Contract Previously Approved Design , Early Work Equipment 20,802,42400 20,802,42400 Remaining Work 000 52,672,63500 CB & I Contract Claricone Procurement 1,640,00000 1,640,00000 Claricone Painting Contract 000 300,00000 Contingency 1,569,99300 1,569,94100 Cost of Revenue Bond Issuance 000 456,50000 TOTAL 24,777,41700 79,541,50000 Revenues Water SDF Reserve Fund 7,029,41700 6,466,00000 2023 Water Sewer Revenue Bonds 17,748,00000 73,075,50000 TOTAL 24,777,41700 79,541,5000 Staff respectfully request the Board’s approval to proceed with the contract with TA Loving Company based on a GMP of 73,475,059 , approval of the revised capital project budget and approval of the capital project ordinance 9 Public Utilities – Eastfield Associates , LLC – Revised Utility Capital Reimbursement Agreement Request approved On February 15 , 2021 , the Board of Commissioners issued approval for the County to enter a reimbursement agreement with Eastfield Associates , LLC and approved a capital project budget in the amount of 2,302,250 The reimbursement agreement was executed on December 13 , 2021 , with the following key provisions 1 Eastfield shall design , permit , acquire necessary easements and complete construction for a new wastewater pump station at Seaboard Coastline Railroad and US Hwy 70 and 16 ” force main from the new pump station to the SEWWPS 2 County shall reimburse Eastfield for 50 of the costs of item # 1 above 3 Eastfield shall design , permit and complete necessary upgrades in order divert to Selma’s PS # 3 to the new wastewater pump station 4 County shall reimburse Eastfield for all costs associated with item no 3 above 5 County shall design , permit , acquire necessary easements and complete construction for new force main from Town of Pine Level 6 Eastfield shall reimburse County for costs associated with upsizing 12 ” to 16 ” a portion of the new force main item no 5 above from Pine Level in order to allow connection by Eastfield PageProjected expenses for the agreement were based on a February 2 , 2021 cost estimate provided by the developer’s engineer Bohler Engineering Furthermore , the agreement indicates that actual costs will be based on construction contract bidding The low bidder’s actual bid costs indicate the County will be responsible for 4,290,77421 On June 5 , 2023 , the Board approved a budget revision to move the Eastfield Reimbursement project to the County’s 210 Wastewater Treatment Facility Diversion Projects At that time , the Board adopted the following capital project budget for the project Expenses Construction 5,765,00000 Technical Services 15,00000 Cost of Revenue Bond Issuance 110,00000 Total Project Cost 5,890,00000 Funding Sewer SDF Reserve Fund 500,00000 Water Sewer Revenue Bonds 5,390,00000 Total Project Funds 5,890,00000 The June 5 , 2023 capital project budget includes the increased costs associated with the Eastfield Reimbursement agreement Staff respectfully requests the Board’s approval to amend the reimbursement agreement with Eastfield Associates , LLC to reflect the actual project construction bid costs 10 Public Utilities – Proposed Wastewater Allocation Policy Update Information Item The Board set a public hearing for September 5th at the 10 00 am meeting Staff will present an update to the Board on the Proposed Wastewater Allocation Policy After said presentation , staff respectfully requests the Board to schedule a public hearing on September 5 , 2023 11 Appointments A Board of Health – 1 position for a 3 year term representing Dentist and 1 position to fill an unexpired term ending February 28 , 2025 David Pearce was appointed to fill an unexpired term ending February 28 , 2025 B Hospital Authority Board of Commissioners – 3 positions ; 3 year terms Please note the Johnston County Board of Commissioners will nominate the appointments at their August 7 , 2023 meeting ; the nominations will then be sent to the Hospital Authority for review Upon review and recommendation by the Authority , Chairman RS “ Butch ” Lawter , Jr will make the final appointments at the Johnston County Board of Commissioners September 5 , 2023 meeting William W Massengill , Jr , Jeff Parlier and Patricia Chisholm - Jones were nominated 12 Delinquent Tax Collection Report - Informational item 13 Annual Tax Settlement and Charge to Collect Taxes for 2023 - The Board accepted the annual settlement and adopted the order to collect for 2023 Tax Administrator Jocelyn Andrews will present the annual tax settlement for 2022 , and request the Board to formally adopt an order to collect taxes for 2023 14 Manager Reports and Comments - NonePagePage pageNumber515 Board Reports and Comments Commissioner Richard D Braswell mentioned the meetings with the Towns regarding the regional water and sewer authority are progressing very well and looks forward to the time when the plan is initiated Commissioner Tony Braswell stated for the past 18 years it has been a pleasure and honor to serve as a Johnston County Commissioner residing in District 6 He noted he has had the opportunity to serve with a lot of great men and women during his tenure , been involved in several history making decisions and it is not an easy job He stated he will not seek reelection at the upcoming term , but will serve the remainder of his term with the same enthusiasm as he did his first year Chairman RS “ Butch ” Lawter , Jr stated he has enjoyed the last five years working with Commisioner T Braswell and will hold him to that level of enthusiasm to the end of his term 16 Closed Session – NCGS 14331811 a 3 – Attorney -
