Commissioners Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina The following members were present Present Chairman RS “ Butch ” Lawter , Jr , Vice Chairman Patrick E meeting to order at 6 00 pm Commissioner Tony Braswell opened the meeting with a prayer Commissioner Ted G Godwin led everyone in the Pledge of Allegiance to the American Flag Chairman Lawter noted that Commissioner Fred J Smith , Jr would be joining the meeting virtually Chairman Lawter reminded everyone of the Board’s six priorities including Public Safety , Infrastructure , County Employees , Financial Stewardship , Educational Funding , and Land Use and the Board’s continuing efforts to keep these priorities in mind when working through the agenda and especially during the budget process The Chairman recognized Princeton Mayor Don Rains and Selma Mayor Byron McAllister in the audience and welcomed them to the meeting 1 Approval Discussion of Agenda Upon a motion by Vice Chairman Patrick E Harris , seconded by Commissioner Ted G Godwin , and carried unanimously , the Board approved the agenda moving Item Numbers 8 , 9 , and 10 ahead of Item Number 4 and for the agenda to be renumbered accordingly in the minutes 2 Consent Agenda Items Upon a motion by Commissioner Ted G Godwin , seconded by Vice Chairman Patrick E Harris , and carried by unanimous vote , the Board approved the consent agenda items as follows A Approval of Minutes – May 15 , 2023 6 00 pm B Department of Transportation – Additions to System The Board concurred with the North Carolina Department of Transportation’s recommendation to add the following roads to the State Maintained System Pleasant View Lane – Pleasant View – Pleasant Grove Township C North Carolina Railroad Company Build Ready Site Grant The Board adopted a grant project ordinance for the 750,000 North Carolina Railroad Company Build Ready Site Grant accepted by the Board on March 21 , 2022 , as follows GRANT PROJECT ORDINANCE FOR THE NORTH CAROLINA RAILROAD COMPANY BUILD READY SITE GRANT AWARDED TO JOHNSTON COUNTY FOR THE EASTFIELD SITE BE IT ORDAINED by the Board of Commissioners the “ Board ” of the County of Johnston , North Carolina the “ County ” , that pursuant to Section 132 of Chapter 159 of the General Statutes of North Carolina , the following grant project ordinance is hereby adopted Section 1 This ordinance is to establish a budget for the portion of the costs of land preparation to be funded by a North Carolina Railroad Company “ NCRR ” Build Ready Site Grant for the Eastfield site located at 101 Providence Boulevard , Selma , NC the “ Build Ready Site ” The grant funds are to be used for engineering , design , and site preparation work on the Build Ready Site , including but not limited to grading , drainage , and any other work associated with the land preparation of the Build Ready Site the “ Project ” Page615 June 19 , 2023 – 6 00 pm Continued Section 2 The following amounts are appropriated for the Project and authorized for expenditure Eastfield Build Ready Site Project 750,000 Section 3 The following revenues are anticipated to be available to complete the project North Carolina Railroad Company Build Ready Site Grant 750,000 Section 4 The Deputy County Manager Director of Finance is hereby directed to maintain sufficient specific detailed accounting records to satisfy the requirements of the NCRR , the Grant agreement , the agreement between Eastfield and the County , and all State and federal regulations Section 5 The Deputy County Manager Director of Finance is hereby directed to report on the financial status of the project to the Board of Commissioners on an annual basis Section 6 Copies of this grant project ordinance shall be furnished to the Clerk to the Board , the Budget Officer and the Deputy County Manager Director of Finance for direction in carrying out this project Section 7 This grant project ordinance expires on April 4 , 2027 , or when all the Grant funds have been obligated and expended , whichever occurs sooner Adopted this 19th day of June , 2023 D Triangle J Council of Governments – Charter Amendment The Board of Delegates for Triangle J Council of Governments unanimously approved changes to the organization’s Charter to reflect a change in name from Triangle J Council of Governments to Central Pines Regional Council The Board adopted the following resolution approving the amended charter RESOLUTION RATIFYING , ACCEPTING AND APPROVING THE AMENDED CHARTER RESOLUTION OF CENTRAL PINES REGIONAL COUNCIL FORMERLY TRIANGLE J COUNCIL OF GOVERNMENTS WHEREAS , the Councils of Governments system was created by the State of North Carolina in 1970 by Governor Bob Scott designating seventeen Regional Councils to serve across the state and Triangle J Council of Governments TJCOG , formerly the Research Triangle Regional Planning Commission , as the regional entity serving Chatham , Durham , Johnston , Lee , Moore , Orange , and Wake counties , and the municipalities within those counties ; WHEREAS , the TJCOG Board of Delegates approved an organization rebrand process in its Fiscal Year 2022 - 2023 budget to identify and implement a new name , logo , and brand for the organization , and rebranding consultant Carrboro Creative was selected to conduct the process in the Fall of 2022 ; WHEREAS , the proposed rebrand , including a name change from Triangle J Council of Governments to Central Pines Regional Council was presented to the TJCOG Officers , TJCOG Executive Committee , and TJCOG Board of Delegates in December , February , and March of 2023 for consideration ; WHEREAS , the TJCOG Executive Committee and TJCOG Board of Delegates unanimously approved the name Central Pines Regional Council and approved a proposed amended charter to reflect this change ; WHEREAS , the charter is TJCOG’s governing document and must be endorsed by all member governments when they join the organization and by a minimum of 2 3 when amendments to the document are made ; NOW , THEREFORE , BE IT RESOLVED that the Johnston County Board of Commissioners does hereby ratify , accept , and approve the amended Charter Resolution reflecting the organization’s new name of Central Pines Regional Council Further , the governing body authorizes that the new name will be effective July 1 , Young for a term to expire on April 30 , 2025 3 Public Comments A Citizen Comment – Kelly Blas – JoCo Angels Opioid Awareness and Support Kelly Blas , President of JoCo Angels Opioid Awareness and Support , recalled that she addressed the th Board during the budget public hearing at the June 5 meeting Ms Blas stated she understands that their request may be too late for consideration ; however , she would like to share an example with the Board on how their funds are spent Ms Blas introduced Bruce Hatcher who received assistance from JoCo Angels Mr Hatcher stated he has lived in Johnson County his entire life and has struggled with addiction for 15 years Mr Hatcher spoke on his time spent in and out of jail struggling with addiction and a lack of support until he discovered JoCo Angels Mr Hatcher shared how JoCo Angels provided him with assistance to enter rehabilitation which has helped him complete 16 months of being clean Mr Hatcher stated he now has a good job and a future to look forward to Mr Hatcher praised the JoCo Angels program for their work and support to those struggling with addiction B Citizen Comment – Christina Arena – Down Home North Carolina Christina Arena , with Down Home North Carolina , addressed the Board and stated in addition to Down Home North Carolina , she is also speaking as an African American , biracial woman and citizen of Smithfield , Johnston County Ms Arena stated when she first moved to Johnston County ten years ago , she was made aware of the history of Johnston County ; however , in the past ten years , she has seen the potential of the community grow Ms Arena stated today is Juneteenth which is an important holiday that celebrates the end of slavery in the United States and serves as a reminder of the ongoing struggle for racial equality She stated that given the importance of today for the country and the large African American community , it is vital to acknowledge Juneteenth as a Federal holiday Ms Arena stated the request to acknowledge Juneteenth as a holiday in Johnston County was made to the Board in 2020 and they support that request Ms Arena provided the Board with information on Juneteenth stating it is a holiday that represents the th end of slavery in the United States and is observed annually on June 19 She stated it originates from Galveston , Texas where union soldiers declared the end of the Civil War and the freedom of all slaves in 1865 Ms Arena stated although the Emancipation Proclamation was signed two years prior , many slaves in Texas were not informed of their freedom until union troops arrived She stated Juneteenth has since become a celebration of African American freedom , culture , and achievements Ms Arena encouraged the Board to consider making changes to the holiday schedule for the upcoming year to accommodate the Federal Juneteenth Holiday and pay tribute to those that celebrate the holiday C Citizen Comment – Elizabeth Lynn – Down Home North Carolina Elizabeth Lynn , with Down Home North Carolina , requested the Board to support and consider everything that Christina Arena said during her public comments regarding Juneteenth Ms Lynn stated she wanted to acknowledge the community coming together to support local teachers through Down Home North Carolina’s first issue - based campaign She stated teachers do their best when they are supplied with the proper tools and this has been a great learning experience for herself and other members with Down Home North Carolina Ms Lynn stated they are proud to have been able to sit at the table with the County Commissioners as well as the Board of Education on this matter and they know that it is now a priority topic Ms Lynn spoke on how they came together as a group to rally the community’s support for local teachers and have collected well over 600 signatures in a petition of support She stated this demonstrates the community’s desire to ensure that teachers have the necessary supplies to educate the children Ms Lynn stated they will continue to do their part to hold elected officials accountable and she hopes the Board will do their part to make the best decisions for the County D Comments from Selma Mayor Byron McAllister The Honorable Selma Mayor Byron McAllister thanked the Board for allowing him to speak Mayor McAllister stated he is speaking as the Chairman of the Johnston County Mayors ’ Association Mayor McAllister stated everyone is aware of the matter regarding the County having the opportunity to create its ownPagePage pageNumber5618 June 19 , 2023 – 6 00 pm Continued Metropolitan Planning Organization MPO because of the 2020 Census and the increase in population the County has experienced He stated currently Johnston County , Clayton , and Archer Lodge are part of the Capital Area Metropolitan Planning Organization CAMPO , which serves all of Wake County and parts of Granville , Franklin , Harnett , and the aforementioned pieces of Johnston County Mayor McAllister stated from 2010 to 2020 , Johnston County saw the population increase , according to the Census , by 47,121 people and estimates indicate that Johnston County added another 10,000 people from 2020 to 2021 He stated 100,000 more people could easily come to Johnson County before 2030 He stated the hope of the Johnston County Mayors ’ Association is that the Johnson County Commissioners will consider the effect this decision will have on the transportation and growth of all the communities He stated the majority of the Johnson County Mayors are excited about the possibility of Johnston County having an MPO dedicated to the interest of the municipalities and time is of the essence to make a decision E Comments from Princeton Mayor Don Rains The Honorable Princeton Mayor Don Rains addressed the Board and introduced Princeton Town Commissioner Michael Holmes also attending the meeting Mayor Rains stated he is speaking to the Board as the Chairman of the I - 42 Corridor Commission He stated a meeting was held recently with DOT Division Four and Division Two members who are part of the Corridor Commission and there was discussion about Metropolitan Planning Organizations MPO and Rural Planning Organizations RPO throughout eastern North Carolina Mayor Rains stated it was the consensus of the I - 42 Corridor Commission that if the MPO were to come to Johnston County , more funds would be available for improvements to not only I - 42 but also I - 95 and other areas He stated the biggest bottleneck in terms of construction of I - 42 is going to be the intersection of I - 95 and NC Highway 42 where there are two interstates and two US highways coming together He stated it could potentially be a billion dollar project and the last part of that project would be from Wilson’s Mills to Princeton Mayor Rains stated it would be a massive project because of the capacity of having to put that intersection together He suggested before the Board decides to stay with the Capital Area Metropolitan Planning Organization , that more research be done and he further suggested involving Economic Development in the decision process 4 & 5 Public Utilities – Water and Wastewater System Development Fee Study for Fiscal Year 2024 and Water and Sewer System Development Fees for Fiscal Year 23 24 Commissioner Tony Braswell noted that the Board had previously heard a thorough presentation at the th June 5 meeting on the Water and Wastewater System Development Fee Study during the public hearing The Board agreed with Commissioner T Braswell’s comment Upon a motion by Commissioner Tony Braswell , seconded by Commissioner Richard D Braswell , and carried unanimously , the Board voted to adopt the Water and Wastewater System Development Fee Study for Fiscal Year 2024 , including the updated Water and Sewer Capital Improvements Plan , the water system development fees and water bulk capacity fees effective October 1 , 2023 RS “ Butch ” Lawter , Jr expressed his appreciation to Vice Chairman Patrick E Harris for his diligence in speaking with Commissioners about this year’s budget Chairman Lawter thanked the staff for the countless hours they have put into the budget along with all the adjustments He thanked his fellow Commissioners for the number of hours they have put forth reviewing the budget multiple times Motion to adopt the Fiscal Year 2023 - 2024 County Budget Vice Chairman Patrick E Harris moved the Board adopt the County Manager’s proposed budget for Fiscal Year 2023 - 2024 with the following revisions • Reduce the property tax rate from 73 cents to 69 cents ; • Appropriate to Johnston County Public Schools a total of 88,497,179 for current expense and 6 million for capital outlay ; • Appropriate up to 4 million to 911 Communications for communications operability improvements in schools ; • Appropriate to Johnston Community College 6,912,390 for current expense and 12 million for capital outlay ; • Appropriate to the Veterans Services Office 50,000 for transportation services for veterans ; • Appropriate to the Town of Micro up to 180,000 for the Micro Community Building project subject to project updates prior to disbursement of funds ;PagePage pageNumber7620 June 19 , 2023 – 6 00 pm Continued • A 5 pay adjustment for employees in July with the possibility of a 2 from the General Fund ; • Appropriate an additional 12,000 to Community and Senior Services for the additional match needed for their increased Home and Community Care Block grant ; • Appropriate one time 650,000 to the solid waste fund for solid waste convenience centers to transition away from the decal program starting in Fiscal Year 24 - 25 For Fiscal Year 23 - 24 , decals to be sold quarterly on a prorated basis - Q1 - 100 , Q2 - 75 , Q3 - 50 , and Q4 - 25 Decals will be eliminated June 30 , 2024 Board will evaluate an enterprise fund availability fee to be adopted at a later meeting for implementation in FY 24 - 25 ; • Appropriate one - time 42 million allocation for the start of Phase 2 of the Fire Tax Funding Matrix - instruct staff to move towards the creation of a single county fire protection service district Board will move to adopt a county wide fire service tax district based on fire protection service needs effective Fiscal Year 24 - 25 ; • Approve individual fire tax service district rate adjustments , as follows o Brogden Fire Department 012 o Selma Fire Department 013 o Antioch Fire Department 010 o North Side Fire Department 012 o Wilson’s Mills Fire Department 008 o Claytex Fire District 015 o 50 210 Fire Department 0095 • Reduce expenses in the County Manager’s proposed budget by 22 million The majority of these expenses are designated as capital - outlay related ;PagePage pageNumber8621 June 19 , 2023 – 6 00 pm Continued • Appropriate 500,000 to the Johnston County Economic Development Corporation to develop and fund an economic development program in Johnston County to attract new or expanding businesses with the JoCo Building Reuse Program ; and • Concur with the RTZ Board on maintaining an 8 cents property tax rate in the RTZ Commissioner Richard D Braswell seconded the motion Discussion Commissioner Ted G Godwin clarified that on the 180,000 for the Town of Micro Community Building , 150,000 had been appropriated in a previous year for that project , which did not get used when the plans were delayed Commissioner Godwin asked about the appropriation for the Triangle Land Conservancy and the funding for preserving land in Johnston County He asked if any of that includes farmland Chairman RS “ Butch ” Lawter , Jr stated there are 110 acres in current farmland that will be preserved with these funds Vice Chairman Patrick E Harris noted that is also one of the reasons that 110,000 will be used from the PUV Rollback funds Chairman Lawter stated the PUV Rollback funds is money that is collected when farmland is converted to another use and the Board felt strongly that if that is the reason it was collected then it should be taken and used towards farmland and land conservation Chairman Lawter thanked County Manager Rick Hester for his tireless efforts working on the budget this year Vote The motion to adopt the Fiscal Year 2023 – 2024 County Budget and the following budget ordinance carried by unanimous vote Fire District Boundary Revisions At the request of the Chairman , Fire Marshal Ryan Parker stated the purpose of the hearing is to provide the public with an opportunity to address the Board on the proposed changes to the boundary lines of the Fire Service Districts in Johnston County pursuant to NCGS 153a - 304 Mr Parker explained that the Fire Marshal Division staff reviews the fire service district lines each year to ensure the movement of parcel lines , residential development , or other potential changes do not cause an increase in fire department response distances while striving to maximize five - mile coverage from a fire station for insurance grading purposes Mr Parker stated a report reflecting all the changes to the fire service districts , including maps of the service districts and the adjacent territories showing the current and proposed boundaries of the districts has been made available He stated the report includes a statement indicating that the proposed boundary relocations meet the standards and requirements of NCGS 153a - 3043 Mr Parker stated a plan to provide service to the areas affected by the relocation of district boundaries has been on file in the Clerk to the Board’s office as well as the Johnston County Emergency Services Department for public inspection He stated following the public hearing , unless there are any objections , staff
