Advertised – 2022 Chairman RS “ Butch ” Lawter , Jr opened the public hearing for the purposes of allowing public comment on the proposed road abandonment of a portion of SR 2815 Bear Farm Road from the State Maintained System County Attorney Jennifer Slusser reported the property owners have petitioned the North Carolina Department of Transportation to abandon a portion of SR 2815 Bear Farm Road She stated the Board had discussed this item previously , but there were utilities matters that were outstanding ; however , those matters have since been resolved Ms Slusser referenced the map in the Johnston County Executive Director Neal Davis presented a request for matching funds in the amount of 198,350 for the Fiscal Year 2023 - 2024 NC DOT Community Transportation Program Grant for the Johnston County Area Transit System JCATS Mr Davis reported the total grant from the NC DOT is 1,739,293 and is the primary administrative and capital grant with which JCATS operates Mr Davis outlined the request and proposed funding as follows 488,397 – Administrative Expense Request 206,339 JCATS administrative staff 282,058 other administrative expenses ie , utilities , vehicle insurance , etc for an update on the pilot micro transit program Mr Davis stated the issue with the pilot micro transit program has been getting the necessary vehicles ; however , they hope to have them here and ready with software by mid - February Commissioner Ted G Godwin asked about the contract rides and whether the rising costs of fuel and other factors have had impacts Page0298 January 3 , 2023 – 10 00 am Continued Mr Davis explained that the contracts have a fuel modifier in the price and there is an agreed upon funding formula in which a benchmark is established each year that can be modified as needed Mr Davis shared the good news that the JCATS staff has been occupying their new building as of December 2022 Vice Chairman Patrick E Harris commented that everyone is excited about the pilot micro transit program as it is a significant need in this County 6 Parks , Greenways , and Open Space – Integrated Mobility Division Paved Trails Feasibility Study Program Parks , Greenways , & Open Space Coordinator Adrian O’Neal along with Grants Manager Austin Cross requested the Board’s approval to apply for grant funding from the Paved Trails Feasibility Study Program Mr Cross explained that this grant focuses on providing planning funds for paved trails and is funded from the Federal Highway Administration and administered by the NCDOT’s Integrated Mobility Division He stated the grant’s purpose and goal are to provide alternative transportation routes to reduce carbon emissions and it coincides with the 2023 Year of the Trail Great Trail State Initiative that was recognized by the North Carolina General Assembly He stated this will be the final planning effort for Johnston County’s East Coast Greenway route from th Smithfield to Benson Mr Cross stated the application is due by January 9 Upon a motion by Vice Chairman Patrick E Harris , seconded by Commissioner Richard D Braswell , and carried unanimously , the Board approved the request to submit an application and adopted the following resolution in support 7 Public Utilities – Agreement for the Purchase and Sale of Nitrogen Offset Credits Utilities Director Chandra Farmer reported that in March 2022 the Board of Commissioners approved an agreement with Restoration Systems , LLC for the acquisition of nitrogen offset credits for future wastewater treatment expansion projects The original “ Agreement for the Purchase and Sale of Nitrogen Offset Credits ” between Johnston County and Restoration Systems , LLC requires Restoration Systems to complete 181 acres of riparian buffer restoration to generate 13,699 lbs per year of nitrogen reduction nitrogen offset credits in the Neuse River Estuary The agreement requires the County to purchase the nutrient offset credits for 5,400,000 Ms Farmer explained that these credits combined with the County’s existing allocation are sufficient for the County to complete wastewater treatment plant expansions to approximately 155 MGD She stated RestorationPage1299 January 3 , 2023 – 10 00 am Continued Systems will release nutrient offset credits incrementally after project implementation and the agreement outlines a payment and credit release schedule Ms Farmer stated County staff further negotiated with Restoration Systems for additional nitrogen nutrient offset credits and recommends an updated agreement She stated the proposed updated “ Agreement for the Purchase and Sale of Nitrogen Offset Credits ” between Johnston County and Restoration Systems , LLC requires Restoration Systems to complete 362 acres of riparian buffer restoration to generate 27,398 lbs per year of nitrogen reduction nitrogen offset credits in the Neuse River Estuary and the agreement requires the County to purchase the nutrient offset credits for 10,800,000 Ms Farmer stated staff and the County’s consultant Dewberry are currently working with the State NPDES staff to modify the County’s existing NDPES permit in phases Phase 1 would allow for expansion up to 160 MGD She noted that in accordance with the NCDEQ process , Restoration Systems will release nutrient offset credits incrementally after project implementation and the agreement new plant and 75 MGD at the old plant She stated the goal is to get to 16 MGD 8 MGD at the old plant and 8 MGD at the new plant with nitrogen credits , but there is a need to expand the NPDES Permit She stated staff will bring more information back to the Board on this in the next several months Commissioner Ted G Godwin noted that Restoration Systems generates activities for the credits and asked if it is possible for the County to generate those activities Ms Farmer explained that it is a process that must be monitored over 30 years and a certification process would be necessary for the County to generate such activities She stated at this time , it is more financially feasible to utilize entities like Restoration Systems , LLC and she is currently unaware of any other local Carolina , the following capital project ordinance is hereby adopted Section 1 The project authorized is the County’s Nitrogen Nutrient Credit Acquisition Project the “ Project ” , including the purchase of nitrogen credit allocation from a private mitigation bank in order to secure additional nitrogen allocation for the County’s National Pollutant Discharge Elimination System NPDES discharge permit The Project is to be financed by a portion of the County’s Water and Sewer System Revenue Bonds , Series 2021 the “ 2021 Revenue Bonds ” and future revenue bonds anticipated to be issued by the County If for any reason the County does not issue revenue bonds in the future , the remaining portion of the project will be financed from an appropriation from the County Sewer Fund “ Fund 68 ” and or an appropriation from the Wastewater System Development Fees Reserve Fund the “ Wastewater SDF Reserve Fund ” Section 2 The officers of the County are hereby directed to proceed with the capital County provides bulk wastewater transmission and treatment services for the Town of Selma She explained the County receives most of the flow and will receive all flow in the future at the County’s Selma Equalization and Wastewater Pump Station located at 1457 W Noble Street Ms Farmer stated the previously adopted Capital Improvements Plan includes a project for additional storage and pumping capacity at the site Ms Farmer stated in order to accommodate additional future flow from the Town of Selma and divert flow from the Town of Pine Level through the facilities , system improvements are necessary The consultant CDM Smith , Inc completed the preliminary study to evaluate improvement options for the facilities and identified a detailed project scope to achieve additional storage and maximum capacity at the WWPS , and staff recommends proceeding with the detailed project design Ms Farmer presented the following proposed project budget revision for technical services to complete the improvements are completed that are associated with the reimbursement agreement with Eastfield Associates , the Pine Level flow will pump to the Selma Equalization Facility She stated the Selma Equalization Facility pumps to the Town of Smithfield Buffalo Creek Wastewater Pump Station and there is an additional project under design that will divert flow from the Town of Selma around the spoke on the letters received for public comment He stated with regards to the letter from the citizen in the Meadow Community about growth , while he can understand those concerns , he believes in freedom and if his neighbor wants to sell his land to a developer then there is not much he can do about that Commissioner Godwin commented that while growth can be bothersome , it is sometimes inevitable Commissioner Godwin also commented on the letter received from Taylor for a unicorn license stating this request was a breath of fresh air Commissioner Godwin challenged all the citizens to have that same kind of hope , optimism and imagination as Taylor Vice Chairman Patrick E Harris reported on a meeting with the health care partners including the Board of Health , Alliance Health , the Department of Social Services , and Johnston Health discussing the needs of the mental health patients in the County He stated the next meeting is at the end of January and he will report back to the Board with more information after that meeting He noted that everyone is working diligently to address the needs Commissioner Godwin thanked Vice Chairman Harris for his work on this effort and noted that there has been some recent correspondence from Alliance Health Executive Director Rob Robinson and if everyone keeps working , he can foresee solutions Chairman RS “ Butch ” Lawter , Jr requested an update from staff on the Sewer Allocation Policy at the next meeting He further requested updates on the next phase of the Regionalization Study as well as the Water Supply Study Chairman Lawter asked his fellow Commissioners for feedback regarding committee and board assignments Chairman Lawter also requested the Board consult with the County Attorney regarding the municipal funding
