Courthouse Annex , Smithfield , North Carolina The following members were present Present Chairman RS “ Butch ” Lawter , Jr , Vice Chairman Patrick E Harris , Tony Braswell , Ted G Godwin , Fred J Slusser , Clerk to the Board Dana G Cuddington , and Executive Assistant Deputy Clerk Susie Reeves Chairman RS “ Butch ” Lawter , Jr called the meeting to order at 10 00 am Vice Chairman Patrick E Harris opened the meeting with a prayer Marine Corps League Detachment 1236 of Johnston County led everyone in the Pledge of Allegiance to the American Flag 1 Organization of the Board Chairman RS “ Butch ” Lawter , Jr called on County Manager Rick Hester to conduct the nominations for Chairman of the Board Chairman of the Board County Manager Rick J Hester called for nominations for Chairman of the Board Commissioner Tony Braswell nominated Commissioner RS “ Butch ” Lawter , Jr , seconded by Commissioner April Stephens , to serve as Chairman There being no further nominations , Commissioner Ted G Godwin closed the nominations , and Commissioner Lawter was elected by acclamation to serve as Chairman for a one - year term Chairman RS “ Butch ” Lawter , Jr thanked the citizens and the Board for their faith in him to serve as Chairman Vice Chairman of the Board Chairman RS “ Butch ” Lawter , Jr called for nominations for Vice Chairman Commissioner Ted G Godwin nominated Vice Chair Patrick Chairman RS “ Butch ” Lawter , Jr asked that any audience members or in the hall that wish to address the Board on an item not already on the agenda to come forward He asked that they state their name and a general location town or township of residence He said speakers will be allowed 3 minutes to address the Board and shall at all times maintain proper decorum and make their comments in a civil manner He said public comment is a listening opportunity for the Board to hear the thoughts and concerns of the public and is not intended for the Board to respond or answer any impromptu questions Interim Johnston Community College President Dr Ken Boham , Holly Springs Township , congratulated the Commissioners for being elected to their offices today He thanked the Board for their support of Johnston Community College and expressed his appreciation for working with County Manager Rick J Hester Dr Boham gave a brief update on Johnston Community College He stated enrollment is up by 93 students and there are 38 additional full time employees Dr Boham stated it is the Johnston County Commissioners ’ promise that has given the citizens opportunity and he stated he will miss working with the Board He read aloud information from a letter from the November 10 , 2022 meeting of Johnston Community College Board of Trustees He said a recommendation has been made for the Johnston County Commissioners to place on the ballot for the November 2024 a referendum for 75 million for Johnston Community College He stated the funds will be for the purposes of land acquisition , infrastructure requirements , facility construction , campus remodeling and renovations , instructional equipment upgrades , and improvements and repairs for the enhancement of educational opportunities for Johnston County residents and for economic development in the form of workforce development Dr Boham provided the letter to the Clerk Chairman RS “ Butch ” Lawter , Jr thanked Dr Boham for his service as interim of the college He said changes have been made , and the morale has moved in a positive direction Vice Chairman Patrick E Harris thanked Dr Boham for his service Commissioner Tony Braswell said Dr Boham has brought a fresh breath of air to the Commissioners ’ meeting in bringing forward requests Dr Boham wished the Board a Merry Christmas and Happy New Year public comment on a proposed Economic Development Incentive Grant for Project Ready PagePage pageNumber7250 Economic Development Director Chris Johnson stated over the last 12 months , the Johnston County Economic Development office has not been able to respond and submit to over 60 investment and job creation projects due to the lack of building inventory , which represents billions of dollars of investment and thousands of high paying jobs Mr Johnson continued that in Johnston County there has been a more prudent and conservative approach where the government is not competing against the private sector Mr Johnson stated during this year’s budget discussion , the Board addressed this philosophy and approved the ability to support four opportunities to work with willing developers to meet the “ Speed to Market ” demands that still exist today Mr Johnson explained that with the building lease program that was funded in the budget , developers work in partnership with the County to construct a “ Class A ” building to be marketed to potential clients considering Johnston County He noted this model has been extremely successful in Lee County , and it is the hope that it can be duplicated in Johnston County Mr Johnson stated this two year , month - to - month lease program does not begin until the building has received its temporary certificate of occupancy and the 300 per foot for up to 100,000 square feet lease rate is well below the average market rate for a Class A space He stated if the building is sold or leased prior to the completion of the building , the County is not required to make any lease payment for the building , and if at any time during the two - year lease period the building is sold or leased to a client , the County’s commitment is immediately over Mr Johnson stated it is ED Parker Corporation’s desire to partner with the County through this program and invest and build a state - of - the - art 270,000 plus square foot Class A facility that will be located on Chicopee Road in the Town of Benson He stated The Parker Corporation is a leading commercial real estate development and design - build firm in multiple markets throughout the Triangle Region and they have a very strong background that focuses on build - to - suit office , medical and industrial projects Mr Johnson stated in addition to the over 25 million dollar industrial investment , the project has the ability to create over 25 new jobs or more in the foreseeable future , with an average salary of over 50,000 , which far exceeds the current average for the County and Town Mr Johnson stated as with all Economic Development Incentive Grants , this has been vetted and approved by the Johnston County Economic Development Board that consists of 14 business , civic and community leaders with representation from every municipality in Johnston County He also noted the project and investment projections have also been evaluated by Dr Mike Walden , Retired Professor and Economist from North Carolina State University , in which his reports show that the monetary investment as well as the jobs and ancillary job growth is projected to be in the thousands annually for the County Mr Johnson stated County Attorney Jennifer J Slusser will cover that the project checks the four legal statutory boxes with regards to offering an Economic Development Incentive , including job creation , capital investment , competition , and diversification of the economy Mr Johnson requested the Board to approve an Economic Development Incentive Grant and Lease Program Agreement and offered to answer any questions Mr Johnson called upon County Attorney Jennifer J Slusser to present the legal framework of the proposed grant After which , Mr Dale Parker , with the ED Parker Corporation , will make a few comments County Attorney Jennifer J Slusser offered a Resolution for consideration for an Economic Development Incentive Grant by Parker Chicopee One , LLC described by Mr Johnston She said the project meets the four factors under the Economic Development Statutes , and the Economic Development Analysis by Dr Michael Walden indicated that the direct , indirect and induced impacts from the development at full build out of a 270,000 square foot building is estimated to be over 23 million Without this grant opportunity , the project would not be moving forward with this scope or location As to the incentive grant , the Capital Investment is not less than 13 million to develop and construct and not less than 144,000 square feet of Class A spec industrial facility in the Banner Township She said in speaking with Mr Parker , phasing the project has been an option She said that the full buildout of the facility is 270,000 square feet She said the initial investment would be not less than 13 million and the total investment would be between 20 - 25 million She said the Capital Investment is proposed to be completed by March 31 , 2024 She said the job creation is expected to be completed by December 2025 She said the incentive proposal is a cash grant to be made into up to five annual payments beginning March 15 , 2025 She said this is measured at 50 percent of the ad valorem taxes paid on eligible investments She said in this case the eligible investments are real estate improvements not including the cost of land She said if the incentives are granted , then Parker Chicopee One , LLC commits to making the eligible investments , the employment goal , and certifying all these items to Johnston County prior to the payment being made She said the grant payments are conditioned upon Parker Chicopee One , LLC paying all the taxes situated in the County that are subject to ad valorem taxes and all taxes must be current and paid to the County including filing all property tax listings There shall be no appeal pending with the Property Tax Commission She said the company must not be in violation of any other obligation to the County including compliance with all County Ordinances and regulations She said there are recapture provisions in the agreement in the event Parker ChicopeePagePage pageNumber8251 One , LLC does not carry out the terms of the agreement She said the grant also contains the County’s Speculative Building Lease Program which allows the County to lease the property not to exceed two years at 25,000 per month She said the recapture provisions apply if the building is sold during the lease period Commissioner Ted G Godwin asked if there was any equipment or personal property involved County Attorney Jennifer J Slusser confirmed that this is a real estate grant only Mr Johnson recognized Benson Town Manager Kimberly Pickett and Mayor Jerry Medlin Mr Johnson also recognized Mr Dale Parker with the ED Parker Corporation Mr Parker said the project is in Benson right off of I - 95 and is serviced by two interchanges He said it is a Class A plus building He said this project fits a better product even though it is not in RTP He said the project is a big step for the family and one that he is confident in He said he was raised on a tobacco farm outside of Blackmon’s Crossroads He said he is familiar with Johnston County and is pleased with the direction of the Commissioners and County Government He said the southern end of the County will fill some of the economic expansion with roads and other infrastructure He said that some of the construction companies work all over the southeast , and he is familiar with construction for Tennessee , Alabama , Georgia , and other areas He said this area is one of the strongest areas in the southeast He expressed his appreciation for all the County has accomplished including the Mayor and Town government Chairman RS “ Butch ” Lawter , Jr the purposes of allowing public comment on the proposed road abandonment of a portion of SR 1347 Old Olive Road from the State Maintenance System Page0253 County Attorney Jennifer J Slusser presented materials that were provided earlier by email to the Board She also distributed materials received from Tami Thompson She said the issue before the Board was a petition to abandon a portion of Old Olive Road from the State maintenance system She said the materials from the Department of Transportation include the petition and map of the abandoned area She indicated there are four homes that are affected adjacent to the abandonment She said all of the owners are petitioners She said the materials include a Resolution of Consent to Close from the Town of Four Oaks Ms Slusser stated North Carolina Department of Transportation District Engineer Sam Lawhorn indicates staff supports the petition She stated there is a question about the Department of Transportation’s Right of Way Encroachment Agreement She said it is narrow along Old Olive Road and difficult to obtain paving in that area in the future without additional right of way and relocation of some structures She said the applicable statute is NCGS Sect 136 - 63 which indicates a County may on its own motion or petition from citizen’s request that the Board of Transportation change or abandon any road on the secondary system when it is in the best interest of the people of the County that will be served thereby and the cause for review of the request is public interest She said the Board has information from Mr Olive in support and Ms Thompson not in support Ms Slusser noted the Department of Transportation makes the decision regarding the abandonment from the road system and will only consider it unless there is a recommendation by the Board of Commissioners She said the property is in the Town of Four Oaks ’ ETJ , and staff asked its position on the request before it was brought to the Johnston County Board of Commissioners She said the petition was made in April 2022 , and time and research were needed to gather the necessary information to assist the Board in evaluating the request and making the decision She said the request takes the road off the maintenance system and does not close the road She said this petition is to remove it from the State system She offered to answer questions from the Board Chairman RS “ Butch ” Lawter , Jr called for anyone else in the audience that wished to comment to come forward Tami Thompson , 3583 Packing Plant Road Smithfield , stated she owns property on Old Olive Road She said that her comments are concerning the abandonment process She stated there would be adverse effects to her property and other landowners She said the statute County Attorney Slusser references requires the Board to consider what is in the best interest for the citizens of the County She said that she has some alternative solutions for the Board to consider She said the path for Old Olive has been visible since 1937 , and the road has been around for a long time She said the Heritage Center has 1945 maps available and the property has been maintained by the Department of Transportation She said maps were drawn by 1953 , but she could find any maps in 1949 She said documents provided to the Board indicate because the right of way could not be obtained it was abandoned She said in 1955 another section of the road had been built and placed under maintenance under the State Highway and Public Works Commission that is now the North Carolina Department of Transportation She said it is difficult to understand how one section was maintained for 70 years and the other abandoned at the taxpayers ’ expense without a right of way She said back in the 1950s there were verbal and handshake agreements She stated Old Olive Road is documented and maintained as being owned and maintained by the Department of Transportation She said the street information database map has been provided to the Board and the property is listed as a secondary route She said Board members were provided a map of the areas that were not included in the abandonment She said the abandonment will affect 24 parcels She said there are 450 acres only accessible by Old Olive Road She said two additional parcels that contain 76 acres that have access from Packing Plant Road and Old Olive Road She said there are 19 landowners , 9 homes , one business , airport tower , and the Johnston County Law Enforcement Pistol Range She said the abandonment will create a one 3 10 mile long one and a half lane dead end dirt road with no County water She said the Department of Transportation investigative report states that the average daily traffic count is 100 She questioned why a road that only services that many vehicles a day would be served She said the abandonment and closure will create emergency response and safety issues She said that the Board has the materials that highlight the increased travel time and distance She said all the owners will enter and exit Packing Plant Road She presented a map of where roads were washed out during flooding She said if the road closed it would be detrimental to homeowners She said if the road is closed County water accessibility may never be available She said there was nowhere to run utility easement She said closing the road without water to the residents is not in their best interest At the inquiry of Commissioner Ted G Godwin , County Attorney Jennifer J Slusser stated the request is about abandoning the road from the system , not closing the road Ms Thompson said the Department of Transportation has confirmed with her that when its abandoned , then it will then be closed She said that there will be impacts regarding schools and school bus accessibility She said the petitioner has marked where the gate will be closed at both ends She said citizens pay taxes for school buses , and if the road is closed then they cannot travel on this road She said Johnston County SchoolsPage1254 Public Schools Transportation Supervisor Joshua Lowder states that if Old Olive Road were closed at either Packing Plant Road or Black Creek Road , the Public School System school bus would not be able to travel the roadway She said there is no adjoining roadway to provide a safe turnaround If families need school transportation , they will buy property on this road She said this could be a potential hindrance for her children and grandchildren to choose to live on the family farm if they cannot ride the school bus She said the land is at the very end of this road She said she met with six developers regarding property values because of the issues of the land , road , water , and school buses She said all of them said it will cost too much money to run wells and septic tanks for anyone living on the road She said the land will be affected by value and marketability She said safety , water , school bus access , and property values are of concern to her If a right of way is given to pave the road and provide County water before the closure , then this may be an appeasing solution She said her family has been on the road since 1850 and does not like change She said there are more residents that this will affect than her A paved road will assist with safety risk and property value County water will offer a utility in need and maintain property values She suggested running the water line on the existing road that taxpayers have paid for and maintained for 70 years for the utility easement She said it makes sense to run the line while the road is being paved like the Department of Transportation has suggested The paved road and turnaround will prevent problems and provide school bus accessibility making land more attractive to potential buyers She offered the following solution If the petitioner desires the road to be closed , then provide land for the required turn around and a utility easement for the existing road for water and right of way on other properties that the petitioner owns and has influence over in the remaining part of Old Olive Road Then the improvements and paving can be completed In return , the road can be closed after the work is completed , so that residents can access their property while the work is being done Road improvement right of ways would be granted for one end of the property and water , an improved road , safety , school transportation , and will salvage property values and maintain profitability She asked if a road is abandoned does this not create a dead end on the other end Commissioner Ted G Godwin said if the right of way is still in place , then this should not change He said abandoning maintenance is the request Ms Thompson said there is no right of way and asked why the right of way was not obtained in 1955 She said she believes the right of way was obtained and lost She said the Department of Transportation could not have built and maintained the road all these years without a right of way Chairman RS “ Butch ” Lawter , Jr said this would be a question for the North Carolina Department of Transportation He said this is likely not a documented right of way since it has been many years since the road has been there Ms Thompson said the solution should not come at the expense of others and will benefit others At the inquiry of Commissioner Ted G Godwin no other property owners living on the road came forward to speak on this matter Ms Thompson said she was notified Wednesday night through the sunshine list , and other residents and owners could not attend the meeting today Chairman RS “ Butch ” Lawter , Jr closed the Public Hearing and asked the Board if there was any further discussion He said he had previously acknowledged any e - mails that were received He shared the following options Option 1 – To concur with the recommendation and petition and request Finance – Town Infrastructure Projects Recommendations Deputy County Manager J Chad McLamb said the Board requested that the Towns submit for some municipal funding requests for infrastructure grants based on ARPA funding He said the Towns have submitted their request for projects , and the Committee has met on the projects , reviewed , and are prepared to make recommendations for the eight Towns that submitted for projects or for other items that are needed He said this was based on the guidelines up to five hundred thousand dollars for each Town for each project Chairman RS “ Butch ” Lawter , Jr ask Board to take this under advisement to evaluate this further He said there are impacts to the County’s system and its benefits He said that five hundred thousand dollars has been used as a guideline He asked that when the Board considers a project that it has some benefit to the County He said that some Towns have projects that all well over a half million dollars and asked whether their project would move forward with only the half million in funding from the County Deputy County Manager J Chad McLamb said that he has spoken with the Towns about the request , and the Town of Benson indicated that the project would still take place Chairman RS “ Butch ” Lawter , Jr said that one of the Towns he had spoken with a project over a half million indicated that it may not take place without the full funding Commissioner Ted G Godwin asked if the projects over a half million could be reviewed on an individual basis Chairman RS “ Butch ” Lawter , Jr noted that some requests were not a half million dollars , and they would not receive the entire amount Commissioner Tony Braswell asked about the total amounts that were set aside and the request amount Deputy County Manager J Chad McLamb said 55 million was set aside He said the requests based on the projects are 37 million He said if the project request is under the half million , then only the amount requested would be honored At the inquiry of Commissioner Tony Braswell Deputy County Manager J Chad McLamb stated that 55 million has been set aside and the Board could decide what the remaining funds would be used for Commissioner Tony Braswell said that the Chairman has valid concerns , and he would like to see around 2 million to further advance other projects that need the funding Deputy County Manager J Chad McLamb said the Committee would discuss with the Town the Board’s wishes , including if the Board would like to allocate additional funding toward a particular Town’s project Mr McLamb stated the funds could be used until December 26 , 2026 Commissioner Ted G Godwin said he would agree with the Chairmans motion if the projects move forward by the next meeting of the Board Chairman RS “ Butch ” Lawter , Jr went over the list of requests submitted by the Town listed in the chart below Deputy County Manager J Chad McLamb said that staff has met with the County’s engineers to look at these projects and how they would impact the County Page3256 Commissioner Tony Braswell noted Pine Level’s request and said the water is metered as it is entered He said this is a benefit to Town citizens to ensure their bills are being metered correctly Commissioner Ted G Godwin asked when the 55 million was made available to the municipalities he did not recall the stipulation regarding the project being good for the County He said it was for the benefit of infrastructure Chairman RS “ Butch ” Lawter , Jr said he recalls that the project be for the benefit of the County Vice Chairman Patrick E Harris said it was his understanding this process would be similar to a grant process and projects based on their merit Projects would be scored higher based on their mutual benefit He said providing a blanket 500,000 was not his intent and suggested tabling the item and rework it to customize the project based on the requested dollar amount up to 500,000 He said the item could be brought back before the Board in January Johnston County Engineering Manager Kim Rineer said the Committee met , and some of the applicants submitted numerous applications She said the Committee discussed whether the projects were a good use of the money and consistent with funding guidelines She said the Town of Kenly’s request is a joint project and aligns with the County’s asbestos cement line replacement project and said the County recommended this project She said water meter replacement is a good idea She said the most impact for ratepayers in the Towns is to assist with funding of the non - revenue projects Replacement of meters is not a cost that can be recouped with new customers She said the Town of Benson has a request for an elevated storage tank She said the County is providing emergency storage that will allow for more storage back to the County’s system She said staff has worked with the Town of Clayton on their interconnected meter relocation They have prepared a study to begin the process , and it will be a multi - year process She stated in the past the Board and County Management has not been supported in turning over customers to Towns if rates will be significantly affected She said if the Town of Clayton purchases a water line and assumes the customer base along the water line and then rates would be doubled She indicated this would not be supported by the Board of Commissioners and County Manager She said that further details need to be worked out including customers being advanced Deputy County Manager J Chad McLamb said the Town of Selma had two projects and one was more expensive , so the Town chose a lower project amount and indicated there may be future grants for additional projects The Committee chose the project of the lower amount Commissioner Ted G Godwin said staff have completed their research Chairman RS “ Butch ” Lawter , Jr suggested the Board have more discussion about the Towns of Princeton and Clayton Deputy County Manager J Chad McLamb said that staff can look at the concerns or make further recommendations of the projects the Board has concerns about Chairman RS “ Butch ” Lawter , Jr said that he is supportive with amounts up to a half million dollars Commissioner Ted G Godwin suggested approving these requests and excluding the ones with concerns Chairman RS “ Butch ” Lawter , Jr asked the Town of Benson Mayor Jerry M Medlin about elevated water tower request Mayor Medlin said the reason for the 25 million request was because the Towns of Four Oaks and Dunn have a need for a water tower He stated the engineer indicated if they are on the same spear then there will be less water pumped He said the Town of Benson is in the south end of County and grants are not available and the funding would assist with the sewer Chairman RS “ Butch ” Lawter , Jr suggested the Town of Benson’s request be considered in the second round of consideration Mayor Medlin said yes Page4257 Smithfield Town Manager Michael Scott said the Town project is a 17 plus million dollar project , and any assistance would be beneficial for the Town and the County He asked for the Board to reconsider the original request for 1 million Chairman RS “ Butch ” Lawter , Jr asked if the Commissioners had concerns regarding the Towns of Kenly , Pine Level , Selma , and Four Oaks County Manager Rick J Hester said he met with the Mayor of Pine Level last week He said if there was further consideration for funds for wastewater capacity they would like to be considered Commissioner Richard D Braswell said when modern meters are installed in the small Towns it is a more accurate system for measuring the water Water that is being lost and not collected is from the Wastewater Treatment Plant Ms Rineer said that the same project can be considered again Commissioner Ted G Godwin moved that the Board approve the grants recommended by staff for the Towns of Kenly , Pine Level , Selma , and Four Oaks be approved not to exceed 500,000 The motion failed for a lack of a second Commissioner Tony Braswell moved that the Board approve the grants recommended by staff move forward and open a second round for the grants for all towns Commissioner Ted G Godwin seconded the motion Vice Chairman Patrick E Harris indicated that customization of these areas may be best in funding the projects as they are submitted He said this leaves money to be spent in other areas of the County He suggested providing a blanket amount was not the intent of the program He suggested reevaluation of these projects for each area in funding these areas more efficiently Commissioner Tony Braswell said his concerns about being fair to all the Towns that have applied He said that he does not have any concerns about the Committee’s work Everyone should operate on the same playing field , and all the projects should have a second round to be fair Commissioner Ted G Godwin said that 330,000 would be awarded to the Town of Selma for their water line upgrade After this is awarded , the process should be opened for a second round Vice Chairman Patrick E Harris questioned if the same amount of money is not being expended then why would it be handled in a second round This would be leaving projects that are not funded because the level was set at 500,00000 Chairman RS “ Butch ” Lawter , Jr said that if the level was set at 500,000 then the process would have been completed Commissioner Tony Braswell said the Board agreed to up to 500,000 per Town , and he was unaware at that time what any Town would request He said the level was set at 500,000 Deputy County Manager J Chad McLamb said the total project requests were 37 million There were multiple projects , and the Committee did not want to allocate more funds to one Town over another Vice Chairman Patrick E Harris said it was his understanding that if a Town submitted projects that were more than the 500,000 , they could be granted the extra as long as there was money available Commissioner Tony Braswell said there would not be enough funds if every single Town applied , and this is why the level was set at 500,000 He said that some Towns did not submit an application , so that money is available If the threshold was not set , then it leads to the Towns applying for greater amounts that exceed Deputy County Manager J Chad McLamb said that there would be 17 million left over to award Commissioner Tony Braswell said the 17 million would be based on the validity of viable projects Commissioner Tony Braswell moved that the Board approve the grants moving forward on the project He said that 45 acres of the landfill is to be closed He stated that borrow area and sediment basin work will be necessary On October 13 , 2022 , bids were opened for the that was previously budgeted in a separate project fund Thus , of the additional needed funding of 4,286,165 for the project , 525,250 will be transferred from that project fund The remainder will come from Solid Waste Fund reserves He said staff also recommends a transfer of up to 2,000,000 from the General Fund to the Solid Waste Fund to help meet the operating needs of the Solid Waste Fund due to the use of these cash reserves for the project He also stated staff respectfully requests the Board’s approval to proceed with the contract and approval of the proposed revised capital project budget Deputy County Manager J Chad McLamb said Solid Waste has raised the additional funds through the funding model to pay for the project out of cash reserves He said that it is not anticipated that all the cash reserves will be used He said that he recommends that the General Fund , if needed , transfer up to 2 million to continue operations He said this is a safeguard in case all the funds are used Commissioner Fred J Smith , Jr said it is a dangerous precedent to be using General Funds to fund an entrepreneurial division and this is not the way its supposed to be structured If Solid Waste needs additional revenue , then they should look to their customers , not the taxpayers Commissioner Ted G Godwin said he did not disagree with Commissioner Fred J Smith , Jr and asked about the alternative and if that is borrowing money Deputy County Manager J Chad McLamb said he is not certain the additional funds will be needed , and it is a safeguard He said that he can come back later in the year to make an additional request He said there are other capital projects passed this year that were budgeted for He said that he is being proactive Commissioner Fred J Smith , Jr said that he does not understand if there is an Enterprise Fund with customers and there is a shortfall in the future then the Enterprise Fund should review its structure of charges instead of using an easy button for taxpayers Chairman RS “ Butch ” Lawter , Jr agreed and said there is Enterprise Funds and was only 7 percent more than the engineer’s estimate He asked about timeframe of the construction project Mr Scheer indicated the project is expected to take a year Commissioner Ted G Godwin asked whether the item could be postponed Mr Scheer said the State’s Solid Waste rules require regulatory action Maintenance of the site would need to occur He said many factors determine that it is advantageous to proceed Commissioner Fred J Smith , Jr he is not suggesting putting the project off He said customer charges can be reviewed , the General Fund can loan money , and there are many ways to protect the average taxpayer in the County rather than bailing out enterprise money Vice Chairman Patrick E Harris inquired about the modeling procedure for the fees of the Enterprise Fund He said he is not a fan of subsidizing an Enterprise Fund and a loan should be considered Deputy County Manager J Chad McLamb said there is a modeling procedure , and the competition has been reviewed He said staff will look at this again during budget time Vice Chairman Patrick E Harris suggested that the item be approved and then a loan to the Enterprise Fund could occur later with a payback to the General Fund Commissioner Ted G Godwin asked if the motion would allow for more capture of
