10 214 Meeting of the Johnston County Board of Commissioners November 21 , 2022 6 00 pm The Johnston County Board of Commissioners met in regular session Monday , November 21 , 2022 at 6 00 pm in the Commissioners Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina The following members were present Present Chairman RS “ Butch ” Lawter , Jr , Vice Chairman Patrick E Harris , Tony Braswell , Ted G Godwin , Fred J Smith , Jr , Richard D Braswell , and April Stephens Absent None Also Present County Manager Rick J Hester , Finance Officer and Deputy County Manager J Chad McLamb , County Attorney Jennifer J Slusser , Clerk to the Board Paula Woodard , Executive Assistant Deputy Clerk Dana Cuddington , and Executive Assistant Susie Reeves Chairman RS “ Butch ” Lawter , Jr called the meeting to order at 6 00 pm Commissioner Ted G Godwin opened the meeting with a prayer Commissioner Tony Braswell led everyone in the Pledge of Allegiance to the American Flag Commissioner Tony Braswell noted there is no comma after one nation , and it is one nation under God for the Pledge of Allegiance 1 Recognition of Retiring Clerk Chairman RS “ Butch ” Lawter , Jr presented a plaque of appreciation to Clerk to the Board , Paula Woodard in honor of her retirement at the end of this month Chairman RS “ Butch ” Lawter , Jr announced that the Board members will provide comments to Paula at the end of the meeting Paula introduced her husband Tommy Woodard , son Cameron Woodard , Niece Deanna Byrd and husband Jordan and brother Paul Whitehurst and wife Diana A group photo was taken with Paula and the Board Former Commissioner Lee Jackson said there is a saying that no one is replaceable , and Paula has been invaluable to the County and keeps it moving smoothly He said there is work that occurs behind the scenes that she handles on a daily basis that many are not aware of He thanked her for her service and especially during his term as Commissioner Former Commissioner Jeff Carver thanked Paula for her service to the County He said that it is hard to believe that it has been since 2007 that she came to the Commissioner’s office Former Commissioner Chad Stewart thanked Paula for her work and especially when he served as Commissioner and Chairman He said all staff are the backbone of the County He recalled a memory of Paula and Dana assisting with visitation at his home when his dad passed away He described Paula’s dedication to her job when he requested information He thanked her for her work over the years 2 Approval Discussion of Agenda Upon a motion by Vice Chairman Patrick E Harris seconded by Commissioner Ted G Godwin , and carried by unanimous vote , the Board approved the agenda as presented 3 Consent Agenda Items Upon a motion by Vice Chairman Patrick E Harris , seconded by Commissioner Ted G Godwin , and carried by unanimous vote , the Board approved the consent agenda items as follows A Approval of Minutes – September 19 , 2022 ; mail The Clerk indicated there were none Page7230 November 21 , 2022 – 6 00 pm Continued 5 I - 95 I - 40 Crossroads of America Economic Development Alliance – Training Center Project Request for Funding Mr Harold Keen , representing the Alliance I - 95 I - 40 Crossroads of America Economic Development Alliance , addressed the Board to request funding in the amount of 175 million dollars to help construct the Advanced Training Center Mr Keen said the goal of the Alliance is to create above - average jobs on the I - 95 corridor He said that advanced manufacturing is the best method in obtaining above - average jobs Mr Keen said that Economic Development Director Chris Johnson has indicated that over 60,000 people will leave the County for jobs He said that education is a big factor in gaining advanced manufacturing He said that in contacting Johnston Community College for assistance , it was determined that they needed updated space and equipment for their Advanced Manufacturing Program Mr Keen said a grant of 12 million was received from Raleigh to develop plans for a technology center to be built in Dunn , NC including an advanced manufacturing building to be built in Johnston County Mr Keen noted those programs were developed to obtain cost estimates Mr Keen stated 10 million was needed for the updates to the technology center in Dunn , NC , and 35 million to build a state of the art new building in Four Oaks Mr Keen also stated the Johnston County Workforce Training Building was designed to house Johnston County Community College Manufacturing Program and to allow the college to increase that program by 50 percent and that there is currently a waiting list for the program Mr Keen said 12 million was obtained from state - local officials and requested local matching funds of at least fifty percent of the cost Mr Keen stated the Workforce Training Center will be 60,000 square feet with Johnston Community College using 70 percent of the space for their expanded manufacturing program Mr Keen also stated that 30 percent is high bay open area to be used for specific industry training and the building will be constructed on a 45 acre site that is part of over a 16 acre site that is owned by the Four Oaks Economic Development Corporation Mr Keen continued that after completion of the building it will be deeded to Johnston Community College He requested funding in the amount of 175 million for the project He said that if Johnston County desires above average work in the County , then above average paying jobs are required Mr Keen introduced Johnston Community College Interim President Dr Ken Boham He read aloud a letter that was from the November 10 , 2022 Johnston Community College Trustees meeting providing the support for the funding request for the Advanced Manufacturing Training Facility He said the project will assist in expanding educational opportunities for training and for Workforce Development for the citizens of Johnston County At the inquiry of Commissioner Tony Braswell Dr Boham indicated his last day with Johnston Community College will be December 23 , 2022 He said that he will be on the Board’s agenda for an item on December 5 Town of Four Oaks Mayor Pro - Tem Andy Hardy thanked the Board for the consideration of the project and said the Town of Four Oaks is committed to collaborating with Johnston County and Johnston Community College to make the project a success Mr Hardy stated the Town is convinced the project will assist the current and future students at Johnston Community College and that businesses , citizens , and the entire community will benefit from the project Mr Hardy thanked the Board for allowing this project for consideration At the inquiry of Commissioner Richard D Braswell , Mayor Pro - Tem Hardy indicated preliminary discussions have occurred regarding the maintenance of the facility and the Town is willing to continue discussions with the County Commissioner Ted G Godwin questioned if the facility belongs to the college and whether it would generate taxes Chairman RS “ Butch ” Lawter , Jr said today’s action would approve the partnership and there would be further discussions in the future with the Town regarding other aspects of the project William Elmore Mayor of the City of Dunn said one of the largest projects he has been involved in has been in Four Oaks and Johnston County He said that he has served as Commissioner with the Town of Mount Olive and has served as Mayor with the City of Dunn for three years He said the City of Dunn officials met with the Town of Four Oaks to discuss the challenges with Interstate I - 95 Mr Elmore stated discussions among both officials were about the approach to bring better jobs to the area and that the direction of this project will providePage8231 November 21 , 2022 – 6 00 pm Continued generational changes Mr Elmore stated the City of Dunn was behind the project 100 percent for Johnston County including the support from the City of Dunn and Harnett County He stated there was an agreement for the City of Dunn and the Town of Four Oaks to provide 55,000 for the project and there was support from the State Mr Elmore also stated the City of Dunn would benefit from the 10 million for the updates to the technology center and this would provide training support Mr Elmore asked the Board for support of the project At the inquiry of Chairman RS “ Butch ” Lawter , Jr , Johnston County Economic Development Director Chris Johnson addressed the Board and stated bringing jobs to the area provides workforce and employment for the County Mr Johnson stated that in the business community the number one goal is bringing jobs and partnering with the community college to achieve this goal and this is a huge win for Johnston County Mr Johnson stated the Johnston County Economic Development Board is in support of this project Commissioner Tony Braswell asked if the Town of Benson will be a part of this process Mr Keen said that he was not present for the initial discussions of the Town Mr Keen stated the Town of Benson was a leader in the discussion and some of the Town Board members were not in favor of the project Mr Keen also stated he hopes the Town will change and support the project to strengthen the region Chairman RS “ Butch ” Lawter , Jr said there is the Alliance Economic Development Board in Four Oaks and Benson for regional utilities that are being considered and this project is all tied together for Workforce Development for the I - 95 corridor Chairman Lawter stated previous discussions indicate there is a movement to include all three towns Commissioner Ted G Godwin said other sites were considered Commissioner Godwin asked if there are specifics that are included in the design Mr Keen said the engineer has completed about 27 of these facilities in the southeast , and they are all similar Commissioner April Stephens said she was excited to learn about additional education for Johnston County and stated regionalization and growing together are positive for Johnston County Commissioner Stephens also stated workforce is an issue , and it is important to be proactive with project considerations Commissioner Richard D Braswell said it is important to address these type of requests now so the County is prepared for the growth Commissioner Ted G Godwin said it is a bold step to improve the I - 95 corridor and time for changes Chairman RS “ Butch ” Lawter , Jr said the Board held a retreat in May and two of the items discussed were tied to Workforce Development One being education funding and the other financial stewardship to provide opportunities for citizens to stay and work in Johnston County Chairman Lawter stated discussions have been made about citizens leaving the County for jobs , and the Board wants the younger generation to stay in Johnston County and have good paying jobs in addition to those residents that already live in Johnston County Chairman Lawter also stated the Board has heard about significant funds being set aside for this project and there are municipalities that are going to invest in this project which will bring about a generational change Chairman Lawter suggested staff look at options for funding Commissioner Fred J Smith , Jr said clarity is needed on what entity is going to own this facility Commissioner Smith stated that because of the use of taxpayer funds , the facility needs to be owned by a public owner Chairman RS “ Butch ” Lawter , Jr said the Alliance will be the facilitator of construction and when the construction is completed it is his understanding Johnston Community College will own the building Commissioner Fred J Smith , Jr said the Board has a duty to taxpayers and there is an assumption on who will own this facility Mr Smith stated 175 million dollars is substantial to provide to a private business Commissioner April Stephens suggested that the motion include that the Board will know who owns the property before it is funded The Board members agreed Page9232 November 21 , 2022 – 6 00 pm Continued Mr Keen thanked the Board for their commitment to this project Mr Keen stated in Raleigh the regional approach is key in order to secure funding Upon a motion by Commissioner April Stephens , seconded by Commissioner Ted G Godwin , and carried by unanimous vote , the Board approved an amount of up to 175 million for the Advanced Training Center Project with the condition that the funds not be released until it is known who will own the facility 6 Johnston County Public Schools – Request for Funds for Schools Security Equipment Project Johnston County Schools Chairman Todd Sutton introduced Dr David Pearce , Assistant Superintendent of Auxiliary and Administrative Services , and Mr Steven Britt , Chief Financial Officer Dr Pearce shared that the safety of students is a priority for Johnston County Schools Dr Pearce stated school safety plans , schematic drawings , and action plans are considered confidential by law He said the conversation today would be surrounding safety related equipment and the commitment to proactive measures Johnston County Schools applied for a grant through the Center for Safer Schools Dr Pearce stated the schools were awarded three grants totaling 1,693,500 and one of the grants was for 1,408,000 , which will allow the schools to begin the process with a school resource officer in every single school in Johnston County The funding will only fund a portion of the officer’s salary but will make an impact in the vital measures and safety protocols Dr Pearce also stated the request from Johnston County Schools are items that are needed to provide the next level of safety measures on school campuses Dr Pearce also shared the following information on the items needed Weapon Detection - All Elementary , Middle , and High Schools ? 54 stationary detection systems to be placed at our elementary , middle , and high school main entrances and other places throughout the district Some additional power outlets and installation adjustments equipment will be needed where these devices are placed Estimated 62 million dollars ? 37 portable detection systems to be placed at our strategic entrances other than the main entrance bus rider entrance , student driver entrance , secondary carpool entrance , some additional power outlets and installation adjustments equipment will be needed where these devices are placed 800K ? Updates to the current school camera system ? Total Cost Estimate - 1,100,000 Dr Pearce indicated that 1,500,000 of the recent successful bond will be used to help support this request At the inquiry of Commissioner Tony Braswell Dr Pearce stated this will part of the ongoing process for future schools Commissioner Ted G Godwin asked about the lifespan of the equipment and whether it is state of the art Dr Pearce said the equipment has seven years of warranty and updates The expected life is 17 - 20 years as long as it is continually updated He said the current devices being used have a long life span Vice Chairman Patrick E Harris said that he has had numerous conversations with Dr Pearce and school board members , and they have been successful in pulling this together and keeping our children safe He said that Board members agree that keeping the public safe is a top priority and children are the highest priority Dr Pearce also stated that the County would be providing the 1,505,83182 and reimbursed after the first sale of the 1,500,00000 Bond Commissioner Tony Braswell said the most unsafe children are those in mobile classrooms Commissioner Braswell stated the commitment of the bond and that the Board will assist with safety and replace additional classrooms with a brick - and - mortar facility Vice Chairman Patrick E Harris said the bond referendum that was just approved will eliminate 83 mobile classrooms Page0233 November 21 , 2022 – 6 00 pm Continued Johnston County Board of Education Chairman Todd Sutton thanked the Board for supporting this request Mr Sutton announced his last meeting of the Board of Education is coming up and he thanked both the Board of Education and Johnston County Commissioners for their collaboration for the safety of the schools Upon a motion by Vice Chairman Patrick E Harris , seconded by Commissioner April Stephens , and carried unanimously , the Board adopted the following Resolution JOHNSTON COUNTY BOARD OF COMMISSIONERS Resolution to Approve Appropriation to Capital Outlay Fund to Johnston County Public Schools to Improve School Safety and Security for the 2022 - 2023 School Year WHEREAS , Johnston County Public Schools recently identified critical school safety needs which are subject to time - sensitive market conditions ; and WHEREAS , the Johnston County Board of Education requests an appropriation from the Johnston County Board of Commissioners in the amount of 9,605,83182 to the Johnston County Public Schools Capital Outlay Fund for the restricted purpose of purchasing equipment and construction at school facilities to improve school safety and security for the 2022 - 2023 school year for the projects identified on the attached Exhibit A ; and WHEREAS , of this cost , the Johnston County Board of Education intends 1,500,00000 to be reimbursed to Johnston County with the safety allocation of the first sale of the 2022 School Bond proceeds ; and WHEREAS , the Johnston County Board of Commissioners supports the request to fund critical school safety needs as identified on the attached Exhibit A and is willing to appropriate Johnston County Reserve Funds in the amount of 9,605,83182 to the Capital Outlay Fund of Johnston County Public Schools which shall be restricted for these purposes NOW , THEREFORE , BE IT RESOLVED by the Johnston County Board of Commissioners that 1 The Johnston County Board of Commissioners amends its appropriation to Johnston County Public Schools for the 2022 - 2023 school year such that 9,605,83182 is appropriated from Johnston County Reserve Funds to the Johnston County Public Schools Capital Outlay Fund for the restricted purpose of improving school safety and security for the 2022 - 2023 school year for the projects identified on the attached Exhibit A ; and 2 Johnston County shall be reimbursed the amount of 1,500,00000 with the safety allocation of the first sale of the 2022 School Bond proceeds st This the 21 day of November 2022 Exhibit A Weapon Detection - All Elementary , Middle , and High Schools 7 My Kids Club – Request for Funding Ms Lynn Daniels Bowles presented a request for funding in the amount of 200,000 to the Board to assist with the My Kids Club Project Ms Bowles presented the following information to the Board Ms Bowles said the My Kids Club Project has consistently provided daily and after - school and summer school kids programming to help students with their learning in schools and provide opportunities for them She stated 200 kids are served annually at the two campuses in Selma and Smithfield Since the pandemic , assistance continues as the kids reengage in academics , recuperate from learning loss , and focus on healthy growth and development Over the summer there was a partnership with UNC Health Johnson Foundation The Board of Directors is comprised of local educators , business leaders , and community members Page1234 November 21 , 2022 – 6 00 pm Continued Ms Bowles said the mission of My Kid’s Club is to encourage and empower youth in Johnston County She stated 100 percent of high school seniors graduate on time , 92 percent of club members are promoted to the next grade level on time , and 28,000 healthy meals and snacks have been served Ms Bowles also stated 100 percent of students attend title I schools and are as diverse as the schools they represent Ms Bowles stated since the beginning of the program in 2006 , the Johnston County Board of Commissioners has supported the mission of My Kid’s Club , and the long - term support is appreciated She noted with the Board’s support , thousands of children have been assisted as they strive to reach their potential Page2235 November 21 , 2022 – 6 00 pm Continued Ms Bowles said today’s request is 200,000 and said there would be a forthcoming invitation for the January 30 groundbreaking of their new building Commissioner Richard D Braswell asked if there is a merger with Wake County Ms Bowles said there was a letter of intent from the Boys and Girls Club for a potential merger and this will be discussed at the next My Kid’s Club Board meeting Commissioner Richard D Braswell asked if the name of the organization would return to the Boys and Girls Club Page3236 November 21 , 2022 – 6 00 pm Continued Ms Bowles said previously that it was Wake County , but if the partnership occurs it will be named the Boys and Girls Club of Johnston County Commissioner Ted G Godwin asked about funding in place for the new building Ms Bowles stated that the building will break ground soon and Barnhill contracting has assisted with the build At the inquiry of Commissioner Tony Braswell , Ms Bowles said the funding will be used for operating , funding salaries of workers that are in Johnston County , and expansion of programs Ms Bowles also stated the counselors have competitive wages with the program At the inquiry of Commissioner Tony Braswell , Ms Bowles stated there is additional funding through their annual campaign in May , a year - end campaign , a 5K with the Town of Selma at Railroad Days , and a grant rider Commissioner Tony Braswell asked whether additional youth can be served in the new facility Ms Bowles said there are mobile units at Selma Elementary and the program will continue to work with the schools She stated the program continues to work with Smithfield Elementary School Chairman RS “ Butch ” Lawter , Jr asked about the benefit potential of a merger with Wake County and what would be the benefit to children in Johnston County Ms Bowles said the name of Boys and Girls Club assists with getting the program’s name recognized and the additional programming that it will offer Commissioner Ted G Godwin said a business associate of his served as Chairman of My Kid’s Club and stated the program aids in the prevention of juvenile crime At the inquiry of Vice Chairman Patrick E Harris , Ms Bowles stated only the building was included in this current year’s budget Commissioner Tony Braswell said budget time was the best time to present budget requests Commissioner April Stephens commended Ms Bowles and what the program has accomplished Commissioner Tony Braswell commended the work of the program and said with the I - 95 corridor and Workforce Development project , this program will also enhance opportunities for the citizens of Johnston County Chairman RS “ Butch ” Lawter , Jr said the Johnston County Board of Commissioners desire to see the entire County improve , and this program will definitely create opportunity for its residents Commissioner April Stephens said that today has been good for the kids of Johnston County Upon a motion by Commissioner Richard D Braswell , seconded by Commissioner Ted G Godwin , and carried unanimously , the Board approved an allocation in the amount of 200,000 for the My Kids Club 8 Parks , Greenways , & Open Space – Open Space Fund and Disbursement Policy Amendments Parks , Greenways , & Open Space Coordinator Adrian O’Neal requested the Board to approve amendments to the Open Space Fund and Disbursement Policy , as follows Mr O’Neal stated that 946,568 was disbursed in 2020 , and all of that amount except 163,000 has been spent Mr O’Neal also stated currently there is 18 million in the Open Space fund and the biggest change is the reinstitution of the 5 percent match for the communities and partners 1 Change of application period The change would reflect an open period of December 15 , 2022 , through February 14 , 2023 , to receive applications for funding requests The last County - lieu of Chairman RS “ Butch ” Lawter , Jr said this would provide recreational opportunities on collection for developments and this will make impacts on the County Mr O’Neal stated the fees are through June 30 and there may be some fees returned out of the 163,000 that were not used Commissioner Ted G Godwin asked if staffing is adequate for these entities He noted there is a large concentration in the high school area of development Mr O’Neal said staffing is adequate and the funding has covered ball field lights and playgrounds He said the funding was needed for these high school areas Mr O’Neal stated if the Board approves the request the application time frame would be from December 14 through February 14 Upon a motion by Commissioner Ted G Godwin , seconded by Vice Chairman Patrick E Harris , and carried unanimously , the Board approved the amendments as requested by staff 9 Planning Department – Upper Coastal Plain RPO Amendment to MOU Planning Director Braston Newton requested the Board to approve an amendment to the Upper Coastal Plain Rural Planning Organization Memorandum of Understanding Mr Newton stated the amendment would change the lead agency to be the City of Wilson instead of Nash County Commissioner Ted G Godwin said he attended a recent meeting about the Highway 70 corridor and there was discussion about the City of Wilson not being in favor of the amendment Mr Newton said he has not received any indication there was any descent from the City of Wilson At the inquiry of Commissioner Tony Braswell , Mr Newton stated section one of the amendment that references the County instead of the City of Wilson appears to be a typo Upon a motion by Commissioner Ted G Godwin , seconded by Commissioner Richard D Braswell , and carried unanimously , the Board approved the amended Memorandum of Understanding as requested by staff 10 Draft Envision Johnston Comprehensive Land Use Plan – Continued Discussion Planning Director Braston Newton stated some of the discussions at the previous meeting surrounded amending the map for the doughnut holes Mr Newton stated that the map would be available at the Board’s th December 5 meeting Commissioner Ted G Godwin said that he has read through the plan and is in favor of the plan and it reflects what he wants to see in the plan Commissioner Richard D Braswell said as it relates to utilities , the County is being very aggressive to tackle the problems with water and sewer He stated it is important to look at changes in wastewater and water treatment capacity and that changes will be necessary with the treatment of wastewater With the improvements ,Page5238 November 21 , 2022 – 6 00 pm Continued the Neuse River will not be able to continually take the nutrients and that staff needs to look at adjoining Counties and the Cape Fear since there are no limits with nutrients Mr Braswell further stated that Wilson Mills and Archer Lodge are able to expand , and Johnston County provides the sewer and water for them He stated the County needs to look into the regional system with the Town of Wilson Mills and Archer Lodge and mentioned conversations need to occur with these Towns Mr Braswell stated back in 1975 many Towns had their own water and sewer department , but in Wake County , the City of Raleigh handles the water and sewer and Mecklenburg County is in a similar situation Mr Braswell stated staffing is needed with proper training and equipment is better suited to handle the water and sewer Commissioner Richard D Braswell said as it relates to broadband , he is interested in whether or not certain districts that are currently without coverage will benefit from it Commissioner April Stephens said she agrees with the regionalization of sewer and partnering with surrounding areas Ms Stephens also agrees with the plan but believes it should go deep instead of wide and she loved McGees Crossroads plans Ms Stephens stated the land at 210 has been for sale as long as she can remember and the plan was a combination of residential , mixed - use , and commercial She said the flow of the 210 exit is what is needed Going deep would require a long - term use plan that allows for small area plans Ms Stephens stated when Ordinances are amended , the Planning Board needs the authority to deny communities if they do not conform to the contiguous uses She shared an example of how California builds out its super streets and condenses residential and commercial together and that being detailed in the future growth is important Commissioner Fred J Smith , Jr agreed with Commissioner April Stephens to go deep and take it to execution Mr Smith mentioned there are three main points Mr Smith circulated an article from the New York Times from November 13 , 2022 , as the article references a South Dakota family from Florida It spoke of farmland value that is pricing out farmers and the challenges a farmer has to stay in business Land to a farmer is like inventory is to other businesses Mr Smith stated that 75 percent of the land in Johnston County is either farmland or vacant land and the article speaks about agriculture and protecting working lands Mr Smith further stated if people are using the land as a business to farm , the farms should be profitable and sustainable and stated most farmers that are farming do not have an exit strategy They just want to farm One day they will need an exit strategy Mr Smith stated that farmers need their land for the most economical use and if the government wants to take the farmland then that needs to occur , but for the government to make demands of that land is coveting a person’s property which is wrong He said legally that is taking the value of the property and the article and the study references the increasing unprofitability of agricultural land in Johnston County He said that the County is divided with the western portion of I - 95 where the Piedmont and Coastal Plains meet and the western side is the wrong side to farm The soil types are not conducive to profitable farming , and the farm size is small Mr Smith also stated that page 43 of the study points out that 51 percent of the farms in Johnston County are less than 50 acres and he asked , how do you make a living on that amount of land He said not only is the farm size small , but equipment must be moved from field to field He said this is inefficient for diesel fuel and traffic Viability and sustainability for farming west of I - 95 are less East of I - 95 the farms are more viable and larger with better soils Commissioner Fred J Smith , Jr said that when adopting rules this incorporates 75 percent of the land and abilities to use the land profitably and sustainably in a business He said that when the plan is implemented , the Board needs to ensure that land is not being taken away Mr Smith referenced page 43 of the plan which speaks of the present use value of the program He said the article circulated said the average farmer is subsidized 40 percent of the revenue last year and he spoke of present use value programs Commissioner Fred J Smith , Jr spoke about goals in Section 3 of the plan He said if the County is going to continue to have agriculture and meet the needs of people that move to the County , the first goal notes physically efficient compact growth lessens the tax burden He said that type of growth cannot be accomplished without water and sewer He said building houses and development requires pieces such as lumber , framers , HVAC , windows , doors , land , and the cost is passed along to the customer Mr Smith further stated when discussions are made about water and sewer , a similar method should take place in order to have efficient compact growth and this would preserve land to be used for agriculture purposes He said goal four speaks of development quality improvement that remains high and compact growth is the only way to have growth He said this will allow for residential , commercial , and mixed - use growth and brings everything to the resident , and keeps people off the highways Mr Smith stated goal six speaks to housing choices He said housing choices and quality development with compact development assists with keeping farms as long as possible He said this should be the concentration as the County moves forward Vice Chairman Patrick E Harris said the Board has put forth effort with a series of meetings of diverse individuals in the County to provide input He said in looking at the final product , he does not have significantPage6239 November 21 , 2022 – 6 00 pm Continued changes for this plan He said in developing Ordinances , there needs to be a way to make the plan enforceable and understandable from a citizen , builder , developer , and farmer perspective Commissioner Ted G Godwin said each Board member may have different opinions on what priorities should have focused on in the goals that are listed He said he has not found any goal that should be changed He said that the draft is a solid working document Commissioner Richard D Braswell said as Commissioner Fred J Smith , Jr mentioned quality development He said in California there are requirements for parks , grocery stores , schools , and all the amenities to be within walking distance He said if lots continue to be one acre or larger , future Boards will need to address that with the growth that is occurring Mr Braswell stated Meadow and Bentonville residents have a significant drive for health care or Walmart and suggested an incentive to these areas such as a strip mall Mr Braswell said the County will experience growing pains along the way and there can be discussions , or the Board can do something about it and it is time to do something about it Vice Chairman Patrick E Harris said housing brings a different perspective to the different age groups He said the younger generation has no desire for a big lot or yard to care for He said that the younger generation wants smaller lots and less to maintain He said if the Board waits to make the plan perfect , then it will never be done , and suggested frequent tweaks and adjustments along the way will be needed Commissioner Fred J Smith , Jr said the younger generation wants parks , swimming pools , and walking trails He said the County has the power to require developers to build parks and other amenities and a plan requires goals , objectives , and policies The goals include what the plan will look like Goals without implementation are nothing more than a dream and there needs to be an objective If there is no objective , it cannot be measured He said the policy is what action is required to achieve the goals and objectives and the heavy lifting is not in this plan Commissioner April Stephens said there are many goals that can be achieved such as changing Ordinances or Land Use Plans She said goal eight cannot be changed as it relates to preserving farmland , and the agriculture industry continues to thrive Ms Stephens stated there may be ideas that the Board can accomplish such as preserving farmland Commissioner Fred J Smith , Jr said the concept of persons using other people’s land for their enjoyment is unbelievable because the farmer’s land is a business He said being helpful and supportive is important to farmers , but telling them what to do with their land is not Commissioner Richard D Braswell said the average age of a farmer is 58 years old and ten years ago , it was 42 years old Mr Braswell stated the cost of nitrogen , lime , and all aspects of farming has doubled and if the market continues , then farming becomes less profitable If there is no profit , there is no farming He said that citizens do not want to be bothered with mowing grass and trimming hedges They want to go to the beach and play golf He said starter homes are out of reach to the younger generation The prices of homes have almost doubled in the past four years He said the Board has a hard time tracking what is going on in the market Vice Chairman Patrick E Harris said he has had numerous businesses over the years , and a business that does not make much money is a hobby He said that he does not need another hobby , so the ones that did not make the money were given up He said he had the freedom to do that without regulation and a farm is a business similarly Commissioner Fred J Smith , Jr said 50 percent of the farms in Johnston County are hobby farms , a way of life , and are not viable He spoke of a farmer in Hyde County picking corn on a combine on over 20,000 acres He said at the same time , Randy Edwards planted corn on his land for payment and crop insurance and then had to mow it down because it was not producing He said this was the same year , and one farmer lost money He said there are factors such as soil type and rain for growing that have impacts on income - producing crops Commissioner April Stephens suggested that the Comprehensive Plan be revisited at the Strategic Planning Session of the Board annually Chairman RS “ Butch ” Lawter , Jr agreed that the plan should be revisited each year Vice Chairman Patrick E Harris said that once it is finished then the plan is never done He agrees as the County changes the plan , it should be revisited Page7240 November 21 , 2022 – 6 00 pm Continued Commissioner Fred J Smith , Jr said if the County is going to be responsible for the development and mixed - use communities , then the Board needs to be the final authority to approve them The Planning Board has a role , but the Board is responsible for the rules and has the authority to create quality development Commissioner Tony Braswell said everyone is concerned about pushing development to municipalities and the question is how to do that He stated that it cannot be pushed unless there is a municipal sewer district and the resources are not there He stated his concerns about the equalization of virtual towns like McGees Crossroads and the Cleveland area and he remembers the day when each school was in the City limits of a Town He said the schools need to be built where children are He also stated a plan needs to be made on how that will happen with the resources available and that he does not want to see urban sprawl He said he does not have the answers , but the discussion is needed about pushing development to municipal areas He said this is a vision and when the Ordinances are formed , the plan is a road map and the Board members will be the GPS Commissioner Fred J Smith , Jr said these are valid points He asked whether the municipalities need funding , roads , water , and sewer , or land Mr Smith stated this is a goal with no specifics on how to implement them and there is no code enforcement in ETJs He mentioned one City asked for funding for drainage and said he is unsure of how to support municipalities when there are no resources He stated the Board can have control over mixed - use development Commissioner Tony Braswell said the ETJ does not have the enforcement Commissioner April Stephens asked about the opportunities for the municipalities and ETJ expansion requests mentioned in the report and the old saying “ if you build it , they will come ” Commissioner Fred J Smith , Jr said ETJ means the City has the right to direct the building process specifications with the plans to incorporate property Chairman RS “ Butch ” Lawter , Jr said that typically water and sewer are not available in the ETJs More density incentive is water and sewer Enforcement is straightforward , and the issue is when there is a violation Chairman RS “ Butch ” Lawter , Jr said there are “ good bones ” for the Land Use Plan and there would be policies and agreements with the Towns He stated this plan is a vision , and the Board will need to develop the policies and agreements Chairman Lawter also stated implementation of the plan , is how to accomplish the vision Chairman RS “ Butch ” Lawter , Jr said that in Section 4 , Land Use One of the plan outlines the direct growth toward Towns He said a key part of that will be regionalization , and the plan will be difficult to implement without coordination or authority with the Towns regarding water and sewer He stated the Neuse River will not enable the County to handle the growth He said page 85 of the plan addresses the mixed - use in unincorporated areas and it is important that the Board identify where the areas are He noted that page 89 addresses reinventing employment centers , but it does not address the reduced parking requirements He said that page 90 speaks of residential development and land types that may not be included in the Land Use Plan He said this area needs to be revisited in that the Board needs to decide where mixed - use development should occur He noted he was in favor of the suggested requirement for open space recreation on page 91 of the draft plan He said for future development it is important to raise the bar for the quality expected for the open space and recreation amenities He noted that Lu 6 , page 92 of the plan outlines the policies that will enable farmers to at least break even with their profit He said further policies and programs are needed to determine how the Board helps with the preservation of farmland He said page 93 speaks about the purchase of the development rights program and should be revisited again He noted on page 95 of the plan speaks about the residential and agriculture buffers 30 feet for adjoining properties He said when the Board develops the Ordinances , this part of the plan should be revisited He said limited utility restrictions are noted and allocation policies for water and sewer should be considered He said page 96 speaks about economic development and making public utilities available such as natural gas , I - 95 , and I - 40 crossroads alliance , and continues to promote the assets that make a viable community He said part of this is a skilled workforce He said page 101 of the plan encourages open space , and the Board needs to address passive and active as Ordinances are developed He said page 102 , cbd1 speaks of higher standards for new development He said the Board needs to develop a plan on how to incentivize higher - quality development He said page 103 , cbd2 identifies those areas that are on the map Chairman RS “ Butch ” Lawter , Jr said on page 115 , Healthy Living Section , LL5 , he was unclear about health in all policies approach that is noted and how it ties into the Land Use Plan He said on page 108 , addresses Parks and Recreation and the Board is making progress with the Trail and Greenways Plan He said a discussion has been made about a Special Use Tax District creation He said that further discussion by the Board is neededPage8241 November 21 , 2022 – 6 00 pm Continued on how to continue to fund Parks and Recreation and how to equally distribute services throughout the County He noted on page 110 , further discussion is needed about the regionalization of infrastructure and utilities in the Land Use Plan He said page 113 speaks about broadband , and further discussion is needed toward these efforts He said that the Board is currently looking at updating the transportation plan that is mentioned in the plan He said regarding the Land Use category and the map , mixed - use should be identified so that citizens are not as dependent on vehicles to commute to work , shop , and enjoy the amenities in the County Chairman RS “ Butch ” Lawter , Jr said that based on this evening’s discussions , Board members agree on the majority of the items that are in the draft plan The main objective will be updating the policy and Ordinances and implementation will be key including frequent updates of the plan to keep up with growth and being fair to future Boards Commissioner Ted G Godwin said broadband is the second repetitive complaint he hears from citizens other than to slow the growth in the County Commissioner Richard D Braswell spoke on current development being considered for development on Highway 70 He said State law requires the nearest municipality to the property have the first right to serve and annex He said if one municipality refuses , then the next closest municipal entity gets the opportunity to annex He said if Pine Level annexes the property , then a pump station would be required on the property He said the waste would be pumped through 3,000 feet of force main to one of the Town’s pump stations It could require a modification and improvement to the pump station at cost burden The gravity lines would likely need to be upsized He said there are two stations before the County’s pump station that removes the waste from Pine Level and sends it to the equalization facility at Selma At Selma , it is held in an equalization facility and is pumped to the Buffalo Creek pump station behind the Town of Smithfield’s Water Treatment Plant and pumped a distance before it reaches gravity and moves onto the plant He said there are up to five pump stations involved , gravity , and force main He said if there was a regional system the closest solution would be to run 55 feet of force main to 70 Highway and tie into the sewer plant that would carry the waste the fastest He said this would solve all the upgrades and maintenance of lines that are being impacted He stated regionalization is needed to better manage the waste He said the State only has one regional authority He said once permits , understanding , and relationships are in place regionalization will be easier He said we need to make the County’s Subdivision Ordinance compatible , not easier than the municipalities He said the quality of development in Johnston County needs an upgrade and amenities need to be provided and end users will pay the cost Chairman RS “ Butch ” Lawter , Jr said the discussion would continue about the Comprehensive Land Use Plan at additional meetings of the Board Commissioner Fred J Smith , Jr discussions have been made about designating where mixed - use development can be in an unincorporated area He said a developer will come along to build a mixed - use development and will pay for the water and sewer line He said care needs to take place in adopting rules to prevent that from happening He suggested language in an Ordinance to protect this development Chairman RS “ Butch ” Lawter , Jr said the plan is a guiding document and each project will be unique and what is designated for the map would be set in stone He said the quality of development and life is important , and he looks toward staff providing language for these types of projects Commissioner Ted G Godwin suggested looking past the letter of the document and regarding the spirit of the document Mr Newton said mixed - use may look different from one person to another The smaller scale of mixed - use may not work in an area because there is an opportunity for the availability of land , resources , and infrastructure He said flexibility can be obtained through Ordinances and policies Chairman RS “ Butch ” Lawter , Jr said as the discussion has taken place today with long - range planning responsibilities ultimately fall on the Planning Director , and staffing shortages are critical because this will be a never - ending process 11 Manager Reports and Comments County Manager Rick J Hester said broadband was of discussion this evening , and there is a meeting next week with the group the State awarded Page9242 November 21 , 2022 – 6 00 pm Continued 12 Board Reports and Comments Chairman RS “ Butch ” Lawter , Jr asked each Board member to share their comments about the retiring Clerk to the Board Paula Woodard Commissioner Richard D Braswell stated being the new Commissioner , he was lost in the beginning He said that everything was planned out for his arrival on the Board , and he has admiration for Ms Woodard He noted she is one of the most efficient individuals that he has ever known He stated she is very dependable , easy to approach , and ready to assist and also said this will be big shoes for Clerk Dana Cuddington to fill Commissioner Ted G Godwin recalled when he was Chairman in 2019 - 2020 during the pandemic He said that logistical challenges were a part of daily life and Ms Woodard was on top of all the functions and everything ran smoothly He commended her dedication and noted that she has been a part of the North Carolina Association of County Clerks serving as President and has been recognized as Clerk of the year He said this exemplifies the greatness among her peers Vice Chairman Patrick E Harris said there is an issue that has been raised on the DSS and Board of Health He said this issue was raised due to the lack of mental health services in the County He said when the State was involved and the Dorothea Dix campus closed , there was no plan to provide services He said DSS is charged with locating assistance for these patients , and they are ending up in the local hospital He said one individual was in the hospital for 71 days and psychiatric assistance is needed He said in speaking with County staff and other hospital staff , a meeting was held He noted County Manager Rick J Hester , Commissioner Ted G Godwin , Former Commissioner Lee Jackson , Johnston County Health Director Dr Marilyn Pearson , and Representative Donna White were in attendance He said the goal is to obtain some solutions to this problem He said Alliance is working on some ideas and recommendations that will come forward to the Board at a future meeting He said this is not just a Johnston County issue , but Counties all over North Carolina are experiencing these issues Commissioner Ted G Godwin said there was a follow - up from Former Commissioner Lee Jackson said that Alliance CEO Rob Robinson is requesting a service expansion proposal based on the meeting that was held on November 9 , 2022 He said engagement is occurring and thanked Vice Chairman Patrick E Harris for putting the meeting together Vice Chairman Patrick E Harris said that he has known Ms Woodard for many years and worked with her brother He thanked her for being an extraordinary person in addition to serving as Clerk to the Board He said Johnston County is better because of her work and serving Johnston County He said Ms Woodard is always smiling , happy , and efficient , even when there are times when the Board has to be herded and guided in the right direction Commissioner Fred J Smith , Jr said effective and efficient describes Ms Woodard He said someone is effective when they get the job done and efficient when they get things done in the most economical and best way He also stated some persons have only one quality , and Ms Woodard has both those skills He offered a job to Ms Woodard if she wanted to return to work Commissioner April Stephens said she has been a fan of the County Commissioners and receives weekly updates from Ms Woodard She said that she was greeted with a notebook and open arms when she came onto the Board Ms Stephens stated that every time she has called upon Ms Woodard , she has been helpful , polite , and sweet She stated effective and efficient describe her Commissioner Tony Braswell said that when photos are taken next month with the new Clerk , she will be the fourth Clerk to the Board in his tenure He said all of them were good , but Ms Woodard has been in Johnston County the longest since his tenure He stated that during his time as Chairman he could not have done his job without Ms Woodard He said she always has a smile and she and her family have been good for Johnston County He said he was confident in Ms Cuddington coming aboard as the new Clerk because she has been trained by Ms Woodard He said work runs smoothly to have someone like Ms Woodard He thanked her for her service and wished her well in her retirement He also stated that in Johnston County the staff work well together and provide a great working environment for the Board and everyone Chairman RS “ Butch ” Lawter , Jr said there is a meeting tomorrow at 9 00 am to discuss the Middle Creek 210 detour He said that he and Vice Chairman Patrick E Harris attended the North Carolina Association of County Commissioners Legislative Goals Conference He said they began with 286 goals and ended with 90 goals at the end of the day He said the 90 goals were paired down to three goals He shared the three main priority goals as follows Page0243 November 21 , 2022 – 6 00 pm Continued ?
