Tabled Item No 8 – Planning Department Presentation of Draft Land Use Plan until the October 3 , 2022 6 00 pm meeting per staff’s request – due to unforeseen circumstances , consultant cannot attend 2 Consent Agenda Items – Consent agenda approved A Department of Transportation – Additions to System NC DOT is requesting the Board to concur with their recommendation to add the following roads to the State Maintained System Connelly Way , Dundalk Drive , Hawick Court , Aviemore Lane , and Lasswade Court – Wilders Farm – O’Neals Township Tan Oak Drive – Mason Pointe West – Micro Township B Second Amendment to Bulk Wastewater Agreement for Flowers Plantation Staff requests the Board to approve the Second Amendment to the Bulk Wastewater Service Agreement for Flowers Plantation This Agreement settles the claims between the parties in Flowers v Aqua , et al , 21 CVS 3096 C Planning Department - Approval of Southeast Area Study Fund Agreement Staff requests the Board to approve a Southeast Area Study Funding Agreement with Nash County as the Lead Planning Agency for the Upper Coastal Plains RPO and the City of Raleigh as the Lead Planning Agency for the Capital Area Metropolitan Organization As part of the agreement , Johnston County is asked to provide a cost share towards the study in the amount of 3,75000 D Buildings & Grounds – Sole Source Purchase Request – Annex Cooling Tower Replacement Staff requests the Board to approve the sole source purchase of the Annex cooling tower replacement through JMP Equipment Co , LLC of Raleigh at a price of 55,29900 The purchase will be funded through a SCIF State Grant JMP Equipment Co , LLC is the manufacturing representative for Baltimore Aircoil Company which is the same model being replaced Staff recommends the sole source purchase for consistency in operations and maintenance PageE Budget Revisions i Finance – 92,01252 – To amend the actual FY 22 appropriation of the transfer of System Development Fees collected in the County’s Water District Operating Fund 69 to the Water District System Development Fees Capital Reserve Fund , pursuant to NCGS 162A - 211 ; 4,220,81620 – to amend the actual FY 22 appropriation of the transfer of System Development Fees collected in the County’s Wastewater Fund 68 to the Wastewater System Development Fees Capital Reserve Fund , pursuant to NCGS 162A - 211 ii Health – 115,00000 – To budget State Grant Funding for Public Health Nurse School Health Liaisons for the coordination of COVID - 19 and other school health public health related services iii Heritage Center – 5,00000 – To budget book souvenir sales into appropriate expenditure line item 3 Public Comments No one present addressed the Board The Chairman acknowledged an email received from Citizen Shannon Petersen 4 I - 95 I - 40 Crossroads of America Economic Development Alliance – Training Center Project Request for Funding This item was removed from the agenda per the request of the Alliance 5 Parks , Greenways , & Open Space Coordinator – Adoption of Neuse River Trail Feasibility Study The Board adopted the study At the Board’s September 6 , 2022 meeting , McAdams presented the completed Neuse River Trail Feasibility Study Parks , Greenways , & Open Space Coordinator Adrian O’Neal is requesting the Board to consider adopting the Study https wwwjohnstonnccom files board NeuseRiverTrail_FeasibilityStudypdf 6 Public Utilities – Massey - Holt Road Water System Interconnection Proposed Capital Project Budget - Request approved On September 20 , 2021 , the Board of Commissioners approved a request from the Town of Princeton to fund a portion of the proposed Massey - Holt Road Water Main project The proposed project will interconnect the Town and County water systems on Massey - Holt Road providing improved flow , improved quality and redundancy for both systems At the time , the Town estimated a total project cost of 400,000 , and the Board of Commissioners approved the County funding 50 of the project , up to 200,000 The Town has completed the project design , secured permits and bid the project for construction Construction bids were higher than the engineer’s estimate , and the total project cost is now 549,000 The Town of Princeton has requested the County fund one - half of the new total project costs the original approved 200,000 plus an additional 74,500 The Johnston County Public Utilities FY 22 23 Budget includes sufficient funds to fund 274,500 of the proposed project from Fund 69 – Water District Fund Balance Staff recommends funding one - half of the total project costs 274,500 from Fund 69 – Water District , as included in the FY 22 23 previously adopted budget Page7 GoTriangle – Commuter Rail Update – Informational item A complete copy of the presentation can be downloaded here https wwwjohnstonnccom files board GTFeasibilityStudypdf Representatives from GoTriangle would like to present an update to the Board 8 Planning Department – Presentation of Draft Comprehensive Land Use Plan This item was tabled until the October 3 , 2022 6 00 pm meeting per the request of staff The draft Comprehensive Land Use Plan can be viewed on the Planning Department’s website at https wwwjohnstonnccom planning 9 Manager Reports and Comments A Memorandum of Understanding with JCATS At the request of the County Manager , it was the consensus of the Board for the County to enter into the following Memorandum of Understanding with JCATS and give signature authorization to the County Manager for the necessary documents 10 Board Reports and Comments Commissioner Richard D Braswell recalled the Board had a great discussion regarding water and wastewater infrastructure at the August 15 , 2022 meeting He noted there were several items that the Board had requested staff to work on and report back at a later date He asked when the Board could expect a follow up from staff Utilities Director Chandra Farmer reported staff is working on the items requested and hopes to have that information available in October Commissioner Ted G Godwin commented on the presentation from GoTriangle stating although he felt the Board needed to have a seat at the table for the feasibility study process , now that the study has been completed , he does not believe that commuter rail is feasible for Johnston County to consider right now Commissioner Godwin stated there may be a point in the future where the idea of commuter rail is feasible ; however , not at the present Commissioner Godwin asked about the process of requiring developers to turn roads in subdivisions over to the North Carolina Department of Transportation for maintenance Commissioner Godwin noted the Board has received complaints in the past from citizens who live in subdivisions with deteriorating roads and he asked what more could be done for those situations Planning Director Braston Newton stated many years ago , the County could withhold building permits for subdivisions that were built - out at 75 until such time as the developer turned the roads over to the State Maintenance System ; however , that law changed and the County no longer has that authority Mr Newton noted staff has been exploring other avenues that could be used to encourage developers to turn their roads over to the State Maintenance System , but there is currently nothing in place Commissioner Tony Braswell commented that the Board adopted a policy some years ago to assist with these situations ; however , it required 100 voluntary participation from the residents on the road , which is very difficult to get PageCommissioner April Stephens noted that realtors are required to disclose to buyers whether or not the roads in subdivisions have been taken over by the State Commissioner Stephens stated she believes it is not so much an issue with the newer subdivisions in that developers are turning the roads over to the State Maintenance System Mr Newton agreed with Commissioner Stephens and stated the majority of the complaints received today are from residents in subdivisions that were built many years ago Commissioner Stephens wished County Manager Rick Hester a Happy Birthday Chairman RS “ Butch ” Lawter , Jr recognized Public Information Director Adam Carroll and Communication Specialist Ben Armstrong for recently winning a 3CMA Award Mr Carroll and Mr Armstrong won a Silver Circle Award in the category of Marketing & Tools – Best Use of a Promotional Item for a video they did for the Johnston County Heritage Center The Board congratulated and applauded Mr Carroll and Mr Armstrong Mr Carroll thanked the Heritage Center for working with them on the video stating they were very easy to work with 11 Closed Session – NCGS 14331811 a 3 – Attorney - Client Privilege ;
