Bear Farm Road 3 Consent Agenda Items – Consent agenda approved A Approval of Minutes – July 18 , 2022 10 00 am and 6 00 pm ; and August 1 , 2022 10 00 am and 6 00 pm B Proclamation – Child Passenger Safety Week and National Seat Check Saturday The Partnership for Children of Johnston County is requesting the Board to adopt a proclamation declaring the week of September 18 - 24 , 2022 as Child Passenger Safety Week and September 24 , 2022 as National Seat Check Saturday C Proclamation – 2022 Fall Litter Sweep – September 10 - 24 , 2022 Staff requests the Board to adopt a proclamation for the 2022 Fall Litter Sweep scheduled for September 10 - 24 , 2022 D Animal Cruelty Officers Reappointment Request Animal Services Director Chad Massengill is requesting the Board to reappoint Roger Davis and Chad Massengill as the Animal Cruelty Officers to serve Johnston County for one year terms This is an annual administrative action and does not require any additional funding E Appointments i Juvenile Crime Prevention Council – Advertised in June - 19 vaccination related activities Pageii Heritage Center – 250,00000 – Funds from a State grant received in FY 2021 - 2022 for the Freedmen’s School Project – at their August 8 , 2022 meeting , the Heritage Commission voted to transfer these funds to the Historic Smithfield Foundation who owns the schoolhouse and is overseeing the project iii Library – 31,00000 – To amend the Library’s FY 2022 - 2023 budget based on actual allocations received iv Sheriff – 42,50707 – To budget revenue Controlled Substance Tax , Insurance Recovery , Miscellaneous Revenue , Federal Grant Equipment , Sheriff Fees , and Sale of Assets into appropriate expenditure line items v Social Services – 34,49300 – To budget additional Crisis funds to reflect Funding Authorization received August 12 , 2022 100 federal funds with no required county match and used for utility assistance for low income families G Tax Releases & Refunds – 07 15 2022 – 08 15 2022 4 Public Comments None Chairman RS “ Butch ” Lawter , Jr took a moment to remember Mr Ken Taylor , a Johnston County resident that recently passed away , and who often addressed the Board during public comment Chairman Lawter stated Mr Taylor was always very thoughtful and respectful when he addressed the Board He asked everyone to be in prayer for Mr Taylor’s family 5 Public Hearing – Petition for Road Abandonment SR 2815 - Bear Farm Road The purpose of the public hearing is to allow for public comment on the proposed road abandonment of a portion of SR 2815 Bear Farm Road in Johnston County The property owners have petitioned the North Carolina Department of Transportation to abandon this portion of Bear Farm Road The North Carolina Department of Transportation is requesting the County to concur with the request 6 Emergency Services – Resolution for Firefighters Week in Johnston County Resolution adopted Johnston County Emergency Services is requesting the Board to adopt a resolution declaring the week of September 11 - 17 , 2022 as Firefighters Week in Johnston County 7 Health Department – Consideration of Preliminary Plan for Opioid Settlement Funds Resolution adopted North Carolina received 26 billion from national opioid settlements Of this 26 billion , Johnston County will receive 8,055,92100 over an 18 year period Settlement funds are specifically dedicated to opioid remediation strategies that address prevention , treatment and recovery due to the opioid epidemic On June 21 , 2021 , the Johnston County Board of Commissioners approved the Memorandum of Agreement between the State of North Carolina and Local Governments for the Opioid Litigation Settlement The Memorandum of Agreement authorized the County Manager and County Attorney to take such measures necessary to comply with the terms of the MOA and receive settlement funds On June 16 , 2022 , Johnston County received 309,50511 in settlement funds These funds were placed in a special revenue fund as required by the MOA PageTransparency and accountability are key to successful implementation of high - impact opioid remediation strategies During the past five months , Johnston County has conducted key stakeholder meetings , community meetings , and significant public outreach to get feedback on the use of funds Before opioid settlement funds can be spent , the Board of Commissioners must adopt a resolution authorizing local spending that includes specific details regarding the amount , time period , and strategy on which the funds are being spent Recommended use of funds are included in the Opioid Settlement Funds Preliminary Plan contained within the agenda packet Staff requests the Board to consider the Opioid Settlement Funds Prelminary Plan and if appropriate , adopt a resolution approving the plan with revisions , if any and authorizing expenditure of settlement funds 8 Parks , Greenways , and Open Space Coordinator – Neuse River Trail Feasibility Study The Board took the study under advisement to be considered at the September 19 , 2022 meeting McAdams has completed the Neuse River Trail Feasibility Study and staff would like to present it to the Board The complete study can be downloaded at the following link https wwwjohnstonnccom files board NeuseRiverTrail_FeasibilityStudypdf Hard copies will be provided to the Board at the September 6 , 2022 meeting Following the presentation , staff requests the Board to take the study under advisement for adoption consideration at the September 19 , 2022 meeting 9 Public Utilities – Resolutions for Proposed Funding Applications Resolutions adopted The deadline to apply for the Fall 2022 round of loan and grant assistance administered through the NCDEQ Division of Infrastructure is September 30 , 2022 Applications that were not funded in the Spring 2022 round will be automatically reconsidered The County previously submitted applications for the following projects No Project Name Description Status Wastewater Treatment Plant Expansion New 1 210 WWTF 4 MGD Expansion 40 MGD Treatment Facility on County Home Unfunded Road Central Johnston County Regional Preliminary treatment and SCADA 2 Wastewater Treatment Facility improvements at the existing wastewater Unfunded CJCRWWTF Improvements treatment facility Timothy G Broome TGB Water Water Treatment Plant Expansion from 140 to 3 Treatment Plant 14 – 18 MGD Unfunded 180 MGD Expansion Asset Management & Construction Initiation and implementation of asset manage Maintenance Management System and construction maintenance management 4 Funded CMMS Initiation at the software at the existing wastewater and water CJCRWWTF and TGB WTP treatment plants Water Supply Improvements to the Upgrades to suction pipelines and the existing 5 Cleveland 1010 Booster Pump booster station to increase water supply capacity Unfunded Station available to the station The Department of Utilities recommends the County submit the following additional funding applications for the Fall 2022 round No Project Name Project Description Upgrades to the existing Four Oaks Four Oaks , Holt Lake & Neuse River WW WWPS Equalization Facility , Holt Lake WWPS Force 6 Transmission Improvements Main and Neuse River WWPS Force Main in order to transmit future additional flows received from thePageTown of Four Oaks to the County’s Treatment Facility Replacement of existing ductile iron sections of the Four Oaks to Benson Force Main Repair and 7 force main along US 301 from Four Oaks to Benson , Replacement due to repeated material failures The previously approved 2022 Water and Sewer Capital Improvements Plan includes all of the proposed projects Staff respectfully requests the Board’s consideration of resolutions authorizing the submission of the new loan applications and designating signatory authority to Rick J Hester , County Manager 10 Public Utilities – Proposed Bulk Water Purchase Agreement with Aqua North Carolina , Inc Agreement approved The Town of Archer Lodge approved a proposed subdivision 36 single - family lots on NC PIN 1689 - 17 - 2430 on Castleberry Road The property is located within the Archer Lodge Town Limits and the Archer Lodge Water District Furthermore , there is a prior agreement between River Dell Company Flowers Plantation and the property owner related to sewer service to the parcel Under the agreement , Aqua North Carolina is obligated to provide sewer service to the parcel through their Flowers Plantation system Since Aqua NC is required to provide sewer service , the same utility should provide retail water service The County has an existing three - party bulk water agreement with Aqua NC formerly Heater Utilities , Inc and River Dell Company for service to Flowers Plantation However , staff recommends a new agreement between Johnston County and Aqua NC in order for the County to provide bulk water service to Aqua to serve this additional parcel The proposed agreement includes the following key components ? The County will provide bulk water supply to Aqua for the Castlewood Subdivision 36 single - family residential lots ? Aqua will purchase water capacity 6,480 gallons from the County at the bulk rate adopted by the Board of Commissioners at the time of payment ? Aqua will install or require a new master meter to be installed at the proposed Castlewood Subdivision water connection on Castleberry Road ? Aqua will pay the County monthly commodity charges as billed by the County ? The agreement term is for 10 years with four automatic renewal periods Staff respectfully requests the Board’s consideration of the proposed bulk water purchase agreement 11 Appointment to Hospital Authority A Hospital Authority Board of Commissioners – 1 position ; 3 year term At the August 1 , 2022 Board Meeting , Brad Oakes was nominated for the position on the Hospital Authority The Hospital Authority met on August 25 , 2022 and concurred with the nomination Pursuant to General Statutes , Chairman RS “ Butch ” Lawter , Jr will make the final appointment Chairman RS “ Butch ” Lawter , Jr appointed Brad Oakes 12 Delinquent Tax Collection Report - Informational item 13 Manager Reports and Comments A Acceptance of a Grant for 911 - Communications County Manager Rick Hester and 911 - Communications Director Brett Renfrow informed the Board that Johnston County 911 - Communications received notification from the North Carolina 911 Board GrantPagePage pageNumber5Committee of a grant award in the amount of 1,756,65727 Mr Renfrow explained that the funding will assist with replacing current infrastructure equipment used in the 911 Center and the associated communication equipment at the new Public Safety Center He requested the Board’s approval and acceptance of the grant funding and authorization to enter into a grant agreement with the NC 911 Board for the funds The Board approved and accepted the grant funding and authorized the County Manager and County Attorney to finalize and execute the grant agreement with the NC 911 Board B Municipal Proposals for Infrastructure Funds Deputy County Manager and Finance Director Chad McLamb reported the County received proposals from seven municipalities for the infrastructure funds set aside by the Board of Commissioners Mr McLamb stated staff is currently reviewing the proposals and he anticipates the towns will formally present their proposals to the Board at a future meeting Mr McLamb stated staff would keep the Board updated 14 Board Reports and Comments A Commissioner Tony Braswell – Request for More State Troopers for Johnston County Commissioner Tony Braswell spoke on the importance of public safety , which includes highway safety Commissioner Braswell stated in a recent conversation with the North Carolina Highway Patrol , he learned that Troop C , which is assigned to Johnston County , is allocated 27 State Troopers and 3 Supervisors Commissioner Braswell stated at this time , there are only 23 State Troopers assigned to Johnston County and given the number of vehicle accidents that the Troopers must respond to on a daily basis , there is a need for additional Troopers to be assigned to Johnston County Commissioner Braswell expressed his concern with highway safety considering Johnston County has two , soon to be three , interstates within its boundaries Commissioner Braswell stated he would be working with staff to draft a letter to the State requesting additional Troopers Commissioner Fred J Smith , Jr suggested sending the letter to Johnston County’s representatives in the North Carolina General Assembly since they are the ones that appropriate the funding B Appointment The Board voted to appoint Dana Cuddington as Clerk to the Board Understudy with the effective date of October 1 , 2022 and Clerk to the Board with the effective date of December 1 , 2022 at a salary of 76,00000 , given the upcoming retirement of Clerk to the Board Paula Woodard C Special Meeting Chairman RS “ Butch ” Lawter , Jr announced that the Board would be attending a special meeting today at 2 00 pm at the Four Oaks Town Council Chambers located in the Four Oaks Town Hall at 304 North Main Street , Four Oaks , North Carolina The purpose of the special meeting is to hold a public hearing to receive public comment on a proposed economic development incentive grant for Project Firefly 15 Closed Session – NCGS 14331811 a 3 – Attorney - Client Privilege ;
