antique and icePagecream retail The Planning Board recommends APPROVAL of the Rezoning request and submits to the Board of Commissioners a proposed Statement of Consistency for adoption based on the recommendation for approval CASE 22 - 17 REZONING PETITION CONDITIONAL ZONING REQUEST Case 22 - 17 was tabled until the September 6 , 2022 6 00 pm meeting , per the request of the applicant Petition to rezone 5292 acres located in the 1500 block of Cornwallis Road in the Cleveland Township from Agricultural Residential AR to Agricultural Residential - Conditional Zoning AR - CZ Tax ID 06E03012A , 06E03011T , & 06E03009A Owner Phillip & Kathleen Wood Applicant Shenandoah Homes Conditional Zoning Request Single family residential with sewer access The Planning Board recommends APPROVAL of the request and submits to the Board of Commissioners a proposed Statement of Consistency for adoption along with proposed Conditional Zoning District conditions CASE 22 - 18 REZONING PETITION CONDITIONAL ZONING REQUEST Per the request of the applicant , in a 4 - 3 vote with Commissioners Lawter , Harris , and Godwin dissenting , the Board tabled the request until the September 6 , 2022 6 00 pm meeting Petition to rezone 13058 acres located in the 1600 block of Josephine Road in the Cleveland Township from Agricultural Residential AR to Agricultural Residential - Conditional Zoning AR - CZ Tax ID 06F03013A , 06F03024X , & 06F03027P Owner Phillip & Kathleen Wood & Capital Properties of Raleigh Applicant Shenandoah Homes Conditional Zoning Request Single family residential with sewer access The Planning Board recommends APPROVAL of the Rezoning request and submits to the Board of Commissioners a proposed Statement of Consistency for adoption based on the recommendation for approval 5 Public Hearing – Ordinance Amendment – Flood Damage Prevention Ordinance The Board approved the amendment The purpose of the public hearing is to receive public comment and discussion on proposed amendments to the Johnston County Code of Ordinances Chapter 14 , Article VIII , Flood Damage Prevention Ordinance Staff requests the Board to consider an amendment to Chapter 14 Article VIII , Flood Damage Prevention Ordinance The amendments are necessary in order to satisfy 44 Code of Federal Regulations Section 603 d of the National Flood Insurance Program regulations 6 Planning Activity Report and Comprehensive Land Use Plan Update - Informational item Planning Director Braston Newton reported the draft Comprehensive Land Use Plan is on the Planning Department’s website for public inspection and he plans to present it to the Board in August Mr Newton stated once presented to the Board , staff will request the Board of Commissioners to schedule a formal public hearing At the request of Chairman RS “ Butch ” Lawter , Jr Mr Newton stated he would bring a draft Request for Qualifications back to the Board for review and consideration as it relates to updating Johnston County’s Comprehensive Transportation Plan Page7 Manager Reports and Comments A Rules of Procedure Update County Attorney Jennifer Slusser stating she has been working on a draft Rules of Procedure for the Board to consider at an upcoming meeting Ms Slusser stated the draft is in the final stages and she hopes to present that to the Board in August B Approval of Electronic Auction County Attorney Jennifer Slusser reported that at the recent public auction held by the Sheriff on th July 16 , some of the vehicles were not sold Ms Slusser stated staff is requesting the Board to adopt a resolution authorizing the County Manager , or his designee , to complete the sale of these vehicles through an electronic auction to be carried out by Randy Wester Auction Company The Board adopted a resolution approving the request 8 Board Reports and Comments At the inquiry of Commissioner Ted G Godwin , County Attorney Jennifer Slusser reported that with the Governor ending the North Carolina State of Emergency for the COVID 19 Pandemic , there is no clear legal authority for Boards of County Commissioners to continue to meet remotely Ms Slusser explained that if there is an occasion in the future where a Commissioner needs to attend a meeting remotely , she would advise against counting that Commissioner for the purposes of a quorum and further , she would advise against that Commissioner voting Commissioner Richard D Braswell commented that based on the discussions during the meeting as it relates to wastewater , he feels it is clear that the Board is not ready to start allocating sewer capacity Commissioner R Braswell spoke on the need to meet and form a plan for the future The Commissioners briefly discussed the matter and how the municipalities also factor into the conversation Page
