relative to what the engineer would beaddressing Mr Wenzel stated that with the minutes of the last meeting being approved, hewould address the two primary concerns with the proposed subdivision with the first beingthe location and the rights to the small pond located on lots one, two, and three Mr Wenzelreferenced a map provided to the Board and highlighted the addition of the VoluntaryAgricultural District note Mr Wenzel called up the surveyorengineer to address thesecond issue of stormwater concernsMr Lee Richie Hines, Jr, 630 Aiken Pkwy, Fuquay Varina, NC, Engineer, stated hiseducation and professional experience Mr Hines stated that he could not speak to thewater rights of the pond on the subject property Mr Hines stated the pond as shown nowis correct and that a small portion of the pond is on the adjacent owners property with theremaining part of the pond on the Wilkins property Mr Hines addressed the storm waterrunoff questions and provided the Board with a preliminary stormwater analysis Mr Hinesstated that there would be minimal impact if any downstream from the proposeddevelopment Mr Hines stated the existing soils in the area are classified by the JohnstonCounty Soil Survey to be not well suited to perk, the soils are not going to accept a wholelot of water, and have low permeability rates Mr Hines stated that when the storms come,the rain will runoff instead of soak in Mr Hines stated that when standard practices areused to evaluate watersheds of this size in the proposed development, the soils are equal ifnot better than the soils in their current condition Mr Hines stated that his preliminary3analysis shows that there will be no increase in runoff and that it could actually improve,the bare soil is allowing water to runoff and the proposed subdivision will help stabilizeand slow the water down Mr Hines stated that they evaluated the pond and twodownstream drainage structures under Golda Road and Holly Grove Road Mr Hinesstated that it is not the Boards intent to re-open the public hearingportion and further described the Agricultural Residential zoning in Johnston CountyMs Howard asked about the adjacent property owners access and use of the pond andasked if the developer would need to disclose information about the pond to potentialbuyersChairman Letchworth asked Ms Slusser about the Boards purview with regards to thepond and if a note on the plat about the pond not being wholly within the subdivision wasrequiredMs Slusser responded that there is not a requirement within the Johnston County LandDevelopment Code to the best of her knowledgeMr Newton confirmed that there is not a requirement in the Jolmston County LandDevelopment CodeMs Slusser referenced Johnston County Land Development Code Section 14-230 whichoutlines what is required on a preliminary plat and adding a note about the pond in the4conditions is not included in the requirements Ms Slusser discussed the existing dataportion of this section and stated that the pond is shown on the plat as required for thepreliminary platMs Hackler stated that the Board asked for additional information last month and that wasthe reason for the subdivision being tabled last month Ms Hackler stated that the Boardnow has a plat map that distinctly shows the pond and that it is not entirely in the proposedsubdivision and the Board has received
