Newton replied, no sirMr Michael Coats, 12400 NC 50 Hwy N, Willow Springs, stated they had been workingon this since 2005 when they stubbed the road out through Harvest Ridge Phase I Thelandowner was not ready to sell this property until 2011 and at that time, he continued, noone could buy anything They made a deal to buy the property last year in 2018 for thisportion He stated they have met with the homeowners of Harvest RidgeMr Paul Evaniak, I 60 Prosperity Court, President of the Harvest Ridge HOA, stated thatthere had been conversations with Mr Coats and there is an annexation agreement thatwas shared with them to which they have some concerns One of the concerns was withthe square footage of the homes being built, a compromise has been reached between thetwo, and it is 1500 sq ft minimum Mr Coats stated that the developer has agreed tothose terms as well, he stated The other change to the annexation agreement would bethat all the homes be built on slabs He continued that all the homes in Harvest Ridgemust be built on foundations The HOA is ok with this as long as the agreement statesthat this will only be for Phase II since there are lots still available in the original HarvestRidge He concluded that Mr Coats has met with homeowners, just last week andanswered some of their questions and concerns He states this is not a perfect agreementbut it is a compromise all patties are willing to move forward withMs Judy Schmidinger, 151 Abundant Ave, in Harvest Ridge, stated that she hasconcerns with the TIA study She understands this does not require one, however, Joshua Inscore, 212 Landmark Rd, stated that he was in favor of the subdivision butthe only concern he had was the entrance being right across the street from his home Hehas had conversations with the Surveyor and asked if they could move it over Hecontinued that he would like to have it moved further east down Landmark Rd if possibleMr McCabe stated that it depends on the soils They would be glad to look at it and havediscussions with DOT as wellMr Darren Mercer, 52 Buck Ridge Lane, stated that they like the dead end the way it isand this project will be in his backyard He understood they were not going to sell that landand he understands things change but he would like it to stay a dead endStaff recommendation is for preliminary approvalMr Letchworth asked if staff had any opposition to issue has been brought up numeroustimes, however, staff does not have control over the school systemsMs Stewart interjected that she knows staff does not have control over them but the boardneeds to know how many subdivisions are in the works in the same areas so they have abetter understanding of the capacity issuesMr Newton stated staff could do that and add the numbers on the staffrepottMr Creech asked what determines what the board can approve or turn downMr Newton replied there are ce1tain development c1iteria in the Land Development Codebut to preface that, it does state adequate facilities as a purpose and intent so there is somesubjectivity in regards to that He stated that is the gray area and not the black and whiteMs Hackler stated that the Commissioners are aware that this is a concern of theirs andstaff has heard these complaints from them for monthsMs Stewmt asked why have the numbers if there isnt an option of turning somethingdownMs Hacker replied that they had asked that question many timesMs Slusser stated that if the proposal meets the standards in the ordinance then you have tofind reasons within the ordinance where you can turn it down School capacity is not astandard in the ordinance in which you can make a determination9Mr Letchworth refe1Tcd to the report in the back of the packet and how those numbers areimpacting schools, especially with the large number of lots as this one isMs Stewart stated that she believes the ordinance needs to be changed There isnt a needfor staff to go to extra work and get all these numbers if the board cant use them to turnthings downMr Newton stated staff is working on some ordinance amendments that are forthcomingMr Massengill stated that he believes the timing is the issue and so many coming forwardall at once it seems The projects themselves can take years to develop He understands thatthe schools use these numbers for projectionMs Stewmt stated that she believes it will take a lot longer to build schools than to buildthese subdivisionsMr Massengill replied that is probably c01Tect depending on the market economyMr Letchworth stated that the intent of the subdivision ordinance is the main concernMr Smith asked when the latest school generation numbers were completedMr Newton replied October He went on to explain the second entrance and trafficimprovementsMs Stewmt asked when the TIA was completedMr Newton stated it was provided at the last meeting and the addendum was placed at yourseats for this eveningMr Lipscomb, spoke on behalf of the Surveyor, and introduced the team he had present atthe meeting Donnie Adams and Steve Green with Ramey Kemp He wanted the board toknow they have done their due diligence and tried to answer all the questions the board hadfrom the previous meetingThere was a powerpoint presentation to the boardMr Donnie Adams, Engineer, 314 E Main St, Clayton, explained the area, the nearbyVADs, the locations of the schools in the area and explained the wetlands and riparianbuffers at the back of the prope1ty and what they have done to coTect some previousissues He went through the slides of the powerpoint and explained what they have changedsince the board denied the request last timeMr Steve Green, Ramey Kemp and Associates, Engineer, explained the TIA and thechangesimprovements He described the turn lanes and where they would be as well as theintersection changes with signals or changes to existing signalsIOMr Letchworth asked about the email to Braston on Feb 8th concerning the improvementsat Maggie Way and Buffalo RdMr Green replied there is an existing church, cemetery and a house at that intersection andDOT is requiring design plans for all the improvements as far as the ROW They have notentered into any plans at this time, he statedMr Letchworth stated that Maggie Way to him is a winding, substandard, rnral counttyroad Pavement condition is bad and many potholes, he added He asked ifthcy had madean assessment on Maggie Way itselfMr Green replied he is not aware of any improvements to be made since the traffic count islow on that roadMr Adams discussed the environmental plans as far as the crossings of buffers andstreams They do not foresee any issues with pennitting to cross them but he feels it willdig deep into the developers pocket He proceeded with the slides to explain the phases ofthe subdivision and the density He explained that this will be phased out over a 7 yearperiod Instead of an immediate issue with you approving a 30-40 lot subdivision and itgoes on the ground immediately, he explained, this subdivision will give the schools timeto project out for yearsMs Stewart asked what held them to that timeframeMr Lipscomb responded that is their best professional estimate of timeframe It is a targettime frameThere was brief discussion on the phases and why they are not combined into fewer phasesMr Adams stated that the first three phases would probably be done at the same time butrecorded in separate phasesMr Letchworth is concerned that if this is approved that the improvements at Buffalo Rdwill go awayMr Lipscomb discussed the idea of using curb and gutter as to not disturb too much of theROW since there isnt a lot of ROW there to deal with He added they have spoken withsomeone from the church and they stated they are out ofland and already sit so near theroad as does the cemeteryMs Stewart stated that she is confused with the recommendations that are from DOT Shewants to know which ones the applicant is agreeing to do or which are required for them todoMr Newton clarified the recommendations from the last meetingMs Stewart asked why they cant consider this in smaller phases11Mr Lipscomb replied that the contract states they had to buy the entire piece ofland andthat is the biggest reasonMr Adams walked the board through what DOT was requiring and what was planned Heconcluded by asking the board to please give them the right to rebuttal if there were furtherconcernsThe board agreedMr Herbe11 Case, 16750 Buffalo Rd, stated that he lives directly across the road from thissite and hes opposed due to the size ofit He discussed the subdivisions that have beenapproved in the past that are in the same area and stated the article on WTSB regardinghow many subdivisions have been approved this year He stated the county didnt need anymore, especially of this size Any improvements that will have to be done to the ROW willimpact him and his daughters homes He continued that the shoulders and drainage onMaggie Way were already bad and he added that he was looking forward to the wideningof Buffalo Rd one day so DOT would buy him out DOT is reactive, he stated He hasconcerns with schools, wetlands, septic, water service and traffic, he concluded Growth isnot bad as long as its controlledMr Michael Tant, 1656 Lake Wendell Rd, referenced the construction damage to MaggieWay that will result, as has been done on Wall Rd He attends Clydes Chapel Church,which is on the comer, and the cemete1y is on the other comer He stated that there areaccidents already in that area and some stones in the cemetery have been damaged in thepast He also has
