answer questions,he continued, and there have been 132,000 spent on plans for this site He added that theselots meet all the requirements of the County He explained that schools cannot beconsidered as it relates to subdivisions unless the current County ordinance is changed Hewent over a few cases that are in the Court of Appeals currently He explained thedeveloper will speak as well as engineers and a surveyor is present to answer any questionsthe board may haveMr James Lipscomb, Developer, 328 E Main St, Clayton, stated this is the third timebefore this board for this subdivision The first time it was 318 lots and this time it is only377 They are doing this in phases, with this being the first He recognized the engineers thatwere present and went through a powerpoint presentation showing the maps, access points,soils, etc He explained the stub streets that have been put in as well as the Duke Energypowerline easements He added they can do minor adjustments to make the lots work withthis powerline easementMs Stewart asked which lot #s are affectedMr Newton replied 283,282 and 281 near the backMr Letchworth asked if anything has changed for this piece of land since the past fewmonthsMr Lipscomb said there have been no changes to that portion, they just chopped it offHe added they are developers and will be coming back to phase out the other areaseventuallyMr Smith asked about how they will do the other phasesMr Lipscomb replied he would have preferred to get it all approved at one time but he isthinking 6-9 months getting the first portion of the subdivision on the ground The first 77lots will be about 2 years before being fully completedMr Smith asked about the wetlands and dealing with the Core as far as crossing itMr Lipscomb replied that would not be an issue and they are planning to buffer theimpacts to those wetlands He added that Mr Adams could explain it more There is notanything that is not permittable it is just expensiveMr Spence provided the board a copy of an excerpt from a book written by Dave Owenswith the UNC School of Government stating the laws in the state regarding subdivisionsMr Donnie Adams, Engineer, explained the design and they meet all the Countyrequirements and standards as well as the DOT standards They are confident they canmove forward with permitting The adequate size for fire department turn-arounds havebeen provided and open space has been provided, he statedMr DeLaine asked about the water on the land and how the wetlands will be impactedHe wants to make sure people that buy these lots will not be trapped back there behindthe waterMr Adams explained the streams and how they will access that area in the future Thecrossings will be by Core requirements, he stated He doesnt see a public health or safetyissue in any wayMr Smith asked about the first creek and a blue line streamMr Adams replied it was not required to be subject to the rules They designed around it4Mr, Spence asked if based on his expert opinion, have all the requirements been met anddesigned accordinglyMr Adams replied, yesMr Josh Ranki, Traffic Engineer with Ramey Kemp and Associates, explained the TIAand trip generation they had completed The major difference in this vs how the entireparcel was evaluated is with these 77 lots in the am there was approximately one tripevery minute 59 peak hour trips and the pm is slightly higher at 79 peak trips He addedthey have worked extensively with DOT to make sure all the requirementsimprovementswill be metMr Letchworth asked if they were aware at this point what requirements would berequired by DOTMr Ranki replied not at this pointMr Lipscomb added they will require improvements at Stotts Mill Rd at Buffalo, he ispretty sure They are willing to do whatever DOT will requireMr Ranki stated that Turnipseed and Maggie Way will be altered in the future, more thanlikelyMr Letchworth asked about the resurfacing of Maggie Way since it is in such bad shapeMr Ranki replied, due to the volume on Maggie Way it is probably not high on the listMr Smith asked when they could expect a final determination from DOT on what isneededMr Ranki replied they would have to do a phasing studyMr Lipscomb inte1jected that this is why it would have been easier if all of this wasapproved upfront at one time so the TIA could have answered a lot of these questionsWith the smaller phases, it will take longer, he stated There may be a bond put up,maybe 40 and 80 lots completeMr Ranki stated that DOT does know there is a bigger picture here with the entireportion developed at final stageMr Spence asked ifin his legal engineer expertise if this meets all requirements of trafficand sufficient accessMr Ranki replied yes5Mr Mike Stokes, Surveyor, Rock Quarry Rd, Raleigh, stated that he did the originalboundary survey There is a map of correction in the Planning Office showing thepowerline easement and that will be recorded probably this week, he addedMr Spence asked in his professional opinion does this meet all the requirements from asurveyor standpointMr Stokes replied yesMr Lipscomb wanted to be sure the board knew that the powerline easement was notmissed on purpose, it was not caught in all the deed references they completed, he addedMr Stokes stated there were four lots in questions and they could still meet setbackrequirements with the easementMr Spence explained the Pineville case and reiterated that schools cannot be an issue asfar as the boards decisionMr DeLaine stated that they have been provided lots of reading information at themeeting by Mr Spence and he believes the board needs time to review itMr Spence replied they have provided expert testimonyMs Stewart referenced the case he read to them and explained the modesty of the trafficimpact She is not sure how that references this caseMr Spence replied that traffic experts have spoken and brought evidence stating thatMaggie Way is competent and they are working to meet all the requirements He addedthere has to be expertiseMr Caldwell asked even if a property owner sees the property flood then that does notmatter because they are not expertsMr Spence stated that was correct On traffic, that is an expert issueMr Ranki stated the trip generation for this road is below the threshold and will haveminor impactsMs Stewart asked about the construction impactMr Ranki replied they would have to look at deterioration He does not feel like he canrespond as an expert on thatMr Letchworth stated that this is a small two-lane narrow road and there are multipletypes of traffic impacts The substandard road is an issue for him as well as the conditionand width of Maggie Way6Mr Newton has had conversations with DOT about the substandard road as far asneeding resurfacing and they are aware and will look into it, he addedMr Letchworth explained how hes aware that it does make a difference in having 77lots vs 300Mr Ranki stated DOT may not look at this now but in the future when this subdivision isbuilt out then improvements could be made at that time when buses start going downthere Priorities may change for DOT once more traffic is out thereMr DeLaine asked if he believes they are creating a safety issueMr Ranki replied no, not creating a safety issue but it is hard to say with no accidentreport to dateMr Spence asked ifthere is somewhere in the County ordinance that states they mustlook at the composition of the roadMr DeLaine replied it states they have to look at safetyMr Spence and Ms Slusser discussed the portion of the ordinance that refers tocirculation and accessMr Spence stated that is all a DOT issueMr Ranki explained that if there were a school being built down this road and buseswould be coming and going and passing one another then yes, it would have to beimmediately upgraded but for 77 lots he does not see that being an issue Once thesubdivision grows to completion then he is sure DOT will require different things Hebelieves that staff will work close with DOT and make sure needs are metMr Herbert Case, 16750 Buffalo Rd, Wendell, stated that he can see this parcel out ofhis back pasture He is an associate with an engineers office so he considers himself anexpett and he has vested interest in this The road comes out at the corner of hisdaughters house His concerns are the number of lots, just as it was before Heunderstands 77 lots is better but that is still a lot of homes back there He also hasconcerns with the average lot sizes He continued that sanitation and septic as well as theright-of-way in the middle of the cemetery and the church are other issues The area isgrowing fast and that is not a safe curve at the Stotts Mill end He understands there isno legal matter for schools but the developments are going faster than the infrastructurecan keep up with, he continuedMr Spence inte1jected that he is not adjacent to this site and he does not agree with thisbeing on recordMr DeLaine stated that it was his discretion as Chairman as to what is heard at themeeting and he is allowing this person to speak and asked that Mr Case speak directly tohim and the board7Mr Case continued, stating that Johnston County cannot support continueddevelopments He is not opposed to growth but there needs to be a safe environment forfamilies and this subdivision will directly affect his family and farmMr Braswell noted that there is no tax increase for Johnston County this yearStaff recommendation is for preliminary approvalMr Smith asked about staffs conversation with DOT about potential future roadimprovements He asked if this was verbal onlyMr Newton replied yesMr Massengill stated that he thinks these 77 lots are a pilot experiment as to what effectthey will have on the roads, school capacities, etc This phase is really just a study as towhether this will all workMr Slusser pointed out there is no master plan with phases presented There is one 77 lotsubdivision phase at this point That is what is before the board to be heard at this timeMr Smith discussed the timeframe for improvements and stated that in his opinion untilthey know what DOT is going to require for these 77 lots let alone the others, he doesntfeel comfortable making a recommendation at this timeMr Newton went over Conditions 16, 17 and 18, which state design, and approval is partof the driveway process That normally happens after preliminary approval takes placeThat is when they evaluate a planThere was brief discussion by the board on site improvements and the intentMr Letchworth stated again that he has issues with this substandard road and will havefurther issues as these phases develop but he said that 77 lots is better than the original300+Mr Caldwell agrees with Mr Smith and Mr Letchworth s concerns but he does notrecall such scrutiny at this level for a similar size subdivision in the pastUpon a motion by Mr Letchworth made a motion to approve Maggie WaySubdivision, conditions until it was brought to their attention by the County When this wasbrought to his attention he discussed with staff and they all agreed that the conditions arenot clear The main question was the 20 vehicles, not knowing if that was intended to meanoutside or inside He added that the picture shows the cars in really no sort of order and ifhe had to guess, he thinks that was where the complaint came in They have provided a siteplan to show the board how they can improve things and clarify how and where thevehicles are stored This site is a challenge since it is an existing site The vehicles that are10stored will be out of view and the customer parking will be closer to the front and sides ofthe siteMs Stewmi stated confusion concerning the indoor storage vs outdoor storage She askedif there would be gravel or asphalt where cars are storedMr Leonard replied existing gravel is what will remain and explained where the vehicleswill be located at each stageMr Caldwell asked about the aerial photo and said he counted 54 He asked if they aretrying to reduce that numberMr Leonard replied yes, they are definitely trying to reduce that numberMr Letchwotih asked about the house that shows up on the google street view and asked ifthat was included in the rezoningMr Leonard stated that the intent is anyone that inhabits that house will have parking rightsto park in the front The house is included in the rezoning Parking for staff will be morealong the sidesMr Smith asked how many staff they haveMr Leonard replied space for 13 He understands it looks cluttered and he is aware that afire luck cannot reach all areas of this site There are concerns with that but he feels likethey have provided an avenue for them to at least get in to the siteMr Letchwotih asked if they would site specific parking for the residence on the planMr Leonard stated that was no problemMr Delaine thanked Mr Leonard for his presentation and said it was refreshingMr Thomas Honeycutt, 75 Home Run Alley, adjacent prope1iy owner to the east and northand all of the surrounding property owners are present at the meeting He added the ownersand operators are good people and he is not present to attack the garage He stated thatthere are lots of junk cars and bodies in the back of the garage and showed the boardpictures of the site as of this morning He has actually had some work done at the garagebefore His concern is the number of vehicles on site, 80-100 at times He is opposed toincreasing beyond the original 20 that was first approved There are three buildings on thesite as well He explained an underground tank leak back in the 70s on this site As of2018 it was finally cleaned up He has lived there all his life and many times he has beenmowing grass near it and there have been screeching of tires, accidents and near accidentsdue to people trying to get in and out The fence surrounding the prope1iy is falling downand needs to be improved, he continued11Mr Leonard clarified that they are trying to improve this site and make it legal The storagearea in the back will be only for 26 vehicles to be stored 180 days The ones around thefront and sides of the buildings will only be for daily useMr Letchworth asked if they were requesting this to be a repair shop or a junk yardMs Hackler stated she was wondering the same thingMr Leonard replied repair shop but comes with that is a necessity to store vehiclesMr Smith stated that he would like to hear from the tenant and he feels that 180 days is along time and feels that is more like a junk yardMr Newton explained the junkyard wording in the ordinance vs a repair shop as it relatesto storageMr Letchw01th stated he has no issue with a repair shop but there should be conditionsassociated with itMr Leonard stated that the goal is to try and keep this tenant in business without going toextremeMr Smith stated there needed to be a happy medium somewhereThere was brief discussion of the board on designated parking spots vs number of cars onsite total at any given pointMr Leonard stated they have something to show how things will be from here on out withthe updated site plan He knows that history is hard to overcomeMr Lloyd Glover, Owner, 126 Circle G Lane, Willow Springs, stated that he has knownthe tenant for many years and they own PJs Auto The previous owner was in financialdistress and the site has always looked as it is As long as he is getting rent then he hasallowed it to stay as it is They have done a lot of cleaning in the past 60 days or so andthey have to have order to do business He also tows for the Highway Patrol and that is howthe numbers calculate so fast For highway rotation, when they haul in a wrecked vehicle,you have to wait to find owners, wait on insurance, lots of reasons they have to sit there along time He does not want PJs to not be able to continue to operate but they understandit needs to be cleanedMr Caldwell suggested they need to speak with the tenantStaff recommendation is for denial due to inconsistency with the Comprehensive LandUse Plan and continued violation of current Special Use Also, Emergency Managementhas issue with Fire Trucks not being able been in operation for at least 19 years and has operated in amanner that has presented no immediate threat or harm to public health, safety, or welfareUpon modification of the original Special Use Permit, and bringing the site into compliance withany modified conditions as required, the site itself will continue to be operated as an existing orsimilar use, in the same general manner, with even
