4Ms Denise Penny, 8197-D NC 50 N Angier, stated that she was not in opposition butshe owns property on both sides of this land She would like a privacy hedge or berm onthe east side specifically due to them farming the land on that side She added that theprevious owners put underground power lines in and there is a home at the back of thatproperty She would like for that underground line to be done away with if possible andto make sure it isnt on their propertyMr Lee Byrd, 2705 Zacks Mill Rd, Angier, Captain at Elevation Fire Dept and a paidfirefighter at 502 IO Fire Dept which is the district where this subdivision will belocated He stated that his property borders this land and he has concerns with stormwater runoff The north side, he added, there is a blue line stream that runs into his pondThe school district is another concern he has Four Oaks schools are at capacity, hecontinued He stated he is in opposition of this subdivisionMs Wendy Collins, 2967 Zacks Mills Rd, Angier, stated that she lives across from thisland She is concerned with the size and types of homes that will be built She is alsoconcerned about the septic issues as she is aware that the land has not perked in the pastThe storm water runoff is also an issue with her, she concludedMr Blevins replied that the homes will be about 2000 sq ft The entire property has beentested and they could not even lay out the lots had the land not been tested for good soils,he stated This has to be done before the placement of homes are determinedMr Massengill asked about the 24-inch pipe under the highwayMr Blevins responded this area where the pipe is will help with the water flow and thepipe will remain in place They will not disturb the drainage easements at allMr Letchworth asked about the water flows with the development and where the homeswould sit, specifically on Lot 22Mr Blevins stated Lot 22, the house will be on the right hand side The left hand sidethere is no room for setbacks The 24-inch pipe will be sufficient for the subdivisiondesign, he addedMr Massengill asked if he had noticed the washout problem that was mentionedMr Blevins replied no he has not There is an 8-foot fill thereMr Byrd inte1jected that flow is not going down to a blue line stream; it is flowing into amanmade ditchMs Natalie Vecchione, 3028 Zacks Mill Rd, Angier, stated she is in opposition of thissubdivision She has a special needs child and subdivisions are not good for kids withspecial needs as they bought their house because there were no subdivisions around at thetime She has concerns with the water runoff as well Her other concerns were with cable,power and internet She stated that upgrades need to be made She concluded with thenoise with traffic and construction, and barriers as a concern2Mr Steve Byrd, 2901 Zacks Mill Rd, Angier, lived at this location since 1978 He hasconcerns with entrance being near his mailbox and the safety with that as well as thepond and the liability with thatMr Newton explained how storm water is approved with major subdivisionsThere was brief discussion by the board on water flow and the rate of which it flowsMr Blevins stated that he is sensitive to the storm water issues and concerns He addedthat you are looking for 10 or more and they are providing 15 impervious includingthe road and added thatthis is good protection He continued that there are buildingsetbacks required which will add to buffering and he is sure the owners would not haveissues with providing more buffering if the board wishes He cannot speak to internet andspeed, he statedMs Karen Byrd, 2901 Zacks Mill Rd, Angier, stated that she was under the impressionthat this subdivision was shut down years ago due to septic issues She added that theirseptic will fill up at times She does not believe there are 22 lots that can be approvedwhen they can not even cut their grass when it rainsMr DeLaine inte1jected that Environmental Health will look into the septic issuesMr Caldwell asked if buffers were typical for subdivisionsMr Newton explained there is no buffer requirement since it is an AR District There arenegotiations for owners and developers, of Steven Stewart, 11630 Brogden Rd, Princeton, currently farms the land This issandy land and naturally wet He has horse quality hay on the property and does not useanimal waste for fertilizer due to the runoff He is concemed about chemicals being usedon the farm for new homeowners He does not want to be a liability He is requesting abuffer, fence or boundary not for privacy but something to cushion the in-between Hestated there is a natural dike that has been repaired over years of dragging due to stormsMr Marr referenced that during the teclmical review committee meeting, Watkins showed the board on the map where his property isMs Hackler wanted to express her concern with the schools and overcrowding in thisareaMr Marr stated that DOT stated at the TRC meeting that a new traffic count was neededfor Polenta RdStaff recommendation is for preliminary approvalMr Massengill made a motion to approve Polenta Tract Subdivision with the addedcondition of a berm andor fence along Mr Watkins property line, seconded by MrCreechMs Slusser informed the board what they need to be aware of as far as the ordinancegoes with berms and buffersMr Corbett stated that he will run a berm as long as he can with the septic systems sincethe berms take up septic areas He added the fence alone would be SOK or higher and fora small community, they will not have the funds to maintain representing the County Mr David Mills will berepresenting staff if there are questions concerning the staff report, etc then they should bereferenced to him, she began, stated this was a request for a special use modificationproperty and she introduced Chandra Farmer and Rick Proctor, who would be speakingRick Hester, the County Manager, is also present to answer any historical questions Shegave the board the background of the prope11y, purchasing it in September of 2001, whichwas known as the Heavner Holding Tract She continued that they purchased this propertyto expand county operations She went on to explain that CLO is County Landfill DistrictAt the time this portion was purchased the County requested an I-2 SUD zoning in order toexpand the landfill as well as other county operations such as the Agricultural Center that islocated on this site The SUP was issued on June 10, 2002 In looking back at the records,they realized there were some ambiguities with the buffer requirements This is one facilitybut different tracts that make up the prope1ty, she stated The County has tried to be a goodneighbor and has tried to reduce the impacts to the neighboring prope11y owners TheCounty agreed to an 800 setback from property line to edge of waste The SUP had anambiguity with the setback and even though this could have been handled administrativelyaccording to the Land Development Code, however, the County wishes to do what is rightand to err on the side of transparency, the County wishes to modify the SUP to clarify andcorrect the setbacks She concluded that the County is not changing the Use of the propertyMs Chandra Farmer, Utilities Director for Johnston County, explained the original intentwas for the 800 buffer to be included only along NC 210 and not the entire property Shewent over the colored map describing each setback She added this was only for the 1-2district and the SUP, not the CLO district The County has a public necessity for the use protect the safety andwelfare of the public as it pertains to the landfillMs Farmer replied yes, the state has required setbacks and permits that the County arerequired to adhere to There are also federal requirements She added that when they wentback and read the SUP and the meeting minutes there was an ambiguity with the setbacksIt was unclear between the SUP and the minutes as to where the 800 buffer was to beapplied, she stated She added there is a capital improvement plan that the Board of CountyConm1issioners have adopted and approvedMs Slusser called Mr Rick Proctor back to the podiumMs Slusser asked Mr Proctor what his understanding was of the 800 setbackMr Proctor replied he believed it was a buffer to protect the homes along NC 210 HwyMs Slusser asked if it made sense to have an 800 buffer all the way around the siteMr Proctor replied no, since there was an active landfill operation and that would limitthem for being able to use the site for the landfill purpose He stated they want to put a treatment plant right in hisyard He added there are 7 homes there that would be within 1000 feet of a treatment plantHe is concerned about the hazards, safety and the smell
