responsibilityand maintenance of the pond would be the responsibility of the owner of lot 5Ms Hackler asked about the location of the unpermitted hog houses in relation to theproposed subdivision and to be shown their location on the preliminary platMr Bagley confirmed that the hog houses were located within the boundary of the subjectproject but southwest of the proposed subdivisionMr Hudson asked if there would be any conditions for the owner of lot 5 with concerns tobuffers and barriersMr Bagley stated that the responsibility and liability of the pond would be on the owneroflot 5Mr property owner, objected to the considerationof the proposed subdivision on the grounds that the initial application was improper and tothe submittal of a revised application Ms Norris spoke of the tabling of the subdivision atthe February 2022 Planning Board Meeting Ms Norris requested that the initialapplication be denied and that the revised application be tabled until the May 2022Planning Board MeetingOn behalf of the Applicant, Mr Hewitt responded to the concerns presented by Ms Norrisrequesting that the Planning Board continue with the consideration of the proposedsubdivisionMs Hackler asked Ms Slusser if procedure was followed and if this was an acceptableapplication Ms Slusser stated that the ultimate determination belongs to the PlanningBoard and further shared the representatives of adjacentlandowners stating that the revised application was valid for consideration and referencedNC DEQs knowledge of the former hog waste lagoon on the subject propertyMs Holmes asked Mr Bagley about the absence of the hog waste lagoon on thepreliminary platMr Bagley responded that there may or may not be a hog waste lagoon on the subjectproperty and that they would obtain all required permits for development and follow allrequired rules and regulationsChairman Letchworth asked Mr Bagley about drainage patterns in the subdivisionMr Bagley responded that the water would flow south to the pond in one location and thenthere is a low area between lots 10 and 11 Mr Bagley stated the bottom portion of thesubject property is wetlandsMr Hewitt introduced Mr Lanny back of his propertyChairman Letchworth asked Mr Averette if the preliminary plat was based on a soilscientistMr Averette confirmed that soils on the property were evaluated by Dan Bliley, a soilscientist, and further pointed out the areas labeled on the preliminary plat with unsuitablesoilsChairman Letchworth asked about county water to which Mr Averette confirmedChairman Letchworth asked if the southern border was shown as a blue lineMr Averette stated that it was not shown that way on the preliminary plat, but will delineateall streams and wetlands and provide buffers through the stormwater permitting processChairman Letchworth asked if there were any landscape buffers to which Mr Averetteresponded that there were none proposed at this timeChairman Letchworth asked if there would be an HOA to which Mr Averette affirmedMr Caldwell asked if there had been any discussion about a buffer around the WhitleypropertyMr Averette stated that there had not been any Johnson family, so the developer will contact the current ownerconcerning cemetery access and would be willing to have a conversation with the Whitleysconcerning the removal of the existing 20 access driveway to access theirlandlocked properties and that the Whitleys maintain the driveway that is used as a path tothe other propertiesMs Davis asked about the width of the path and would it accommodate farm equipmentMr and Ms Whitley shared that larger farm equipment does not fit solely on the path anddoes need to use part of the subject property to access the landlocked propertiesChairman Letchworth asked about any requirements for a subdivision to allow access tolandlocked parcelsMs Slusser stated that there was not a specific design standard Mr Marr added that acondition could be added for the development to include a stubout street with adequate turnaround space for emergency vehicles instead of a cul-de-sacMs Hackler asked staff about entrances and minimum distances between entrancesMr Marr responded that entrances are limited to 500 separations per the LandDevelopment Design Manual and NCDOTs requirement is l 00 separationMs Howard asked about the possibility of asking the developer to add an easement alongthe top of the middle parcel for the landlocked property ownersMr Marr responded that it was a possibility and spoke about promoting interconnectivitybetween subdivisionsMr Caldwell expressed concern about the size of lots for the proposed subdivision andspoke of the 2009 Land Use Plan and the land use plan for this area is rural
