Proctor , Surveyor Engineer , stated in 2007 2008 this subdivision was brought before the Board but then the recession started and everything stopped He added it looks the same now and discussed the Environmentally Sensitive Area Cole Rd is a dead - end road and he added there was no negative feedback from 3PageNCDOT about the driveways He believes they have extenuating circumstances regarding the driveways Ms Hackler asked how much distance w as between the two shared driveways Mr Stewart replied 240 ’ or so Ms Hackler asked about access to Parcel 7 Mr Stewart replied it would have its own access and line it up with the driveway across the street On Parcel 6 would be served by internal street Lots 1 and 2 are sharing , Lots 3 and 4 are sharing a driveway , he added The mail k iosk w ill b e in front o f the open space Mr DeLaine asked about the open space Mr Stewart replied that there were not suitable soils for open space on much of the lot except where they have it shown located Mr Jim Middleton , Land Acquisition Manager for Habitat for Humanity , stated that the Johnston County Chapter had merged with the Raleigh Chapter to try and serve the communities better and get more homes built He explained the Habitat process and mentioned their store they now have as well This subdivision will give them more opportunities to help more people , he continued He would like to start at least 5 lots within a few months , whereas the internal street will take longer He added that they prefer the shared driveways as presented Ms S Griffith , 654 Cole Rd , Clayton , has several concerns Her main concern is the natural buffer between the homes and Hwy 70 She doesn’t want them to remove the trees due to all the noise She is also concerned about the well water across the street that all the homes use as well as a retention pond She concluded by mentioning that Cole Rd is not a major road and the construction trucks will tear it up , as has happened to a new subdivision a few miles away Mr Stewart replied that the trees between Hwy 70 and this site is not included in this plan Those trees are on another parcel of land They do not have plans for a retention pond They are trying to limit their footprint on the site for impervious surface reasons They are tapping into County Water and will not have wells or cause any issues to the wells across the street There will be an HOA created to own the open space , he concluded Ms Griffith asked about the roads and t he maintenance Mr DeLaine stated that the NCDOT would be responsible for that as it is state maintained There w as no further discussion 4PagePage pageNumber5Staff recommendation is for denial , due to direct driveway access on to Cole Rd NCDOT has stated that the shared driveways are ok as long as they are built as shown on preliminary plat Upon a motion by Ms Hackler to approve Stone Creek Subdivision as shown , seconded by Mr Moore and carried by a unanimous vote of 6 - de - sac He continued that there is an existing driveway in place for the cemetery , which is very small and doesn’t even show on most maps The graves are small and not marked The mailbox kiosk will be on the left in front of Lot 1 as you turn onto Atkinson Mill R d Ms Hackler asked about the pond and its ownership Mr Morrison stated that it belongs to the Narron family The pond is a farm pond used for irrigation The majority is on the Narron property They will design the water flow to go the natural route and it will be a gradual slope The swell goes down to NC 42 and 6PagePage pageNumber7there is not a lot of water that flows out He would like to keep it as natural as possible and it will not bother the homeowners , h e c oncluded There w as brief discussion concerning the pond Mr Timothy Narron , 9160 NC Hwy 42 , Selma , owns property that abuts some of these lots The field on either side of that pond is rented out to a farmer The cul - de - sac for this subdivision will end near the pond He has concerns about flooding from the pond when the construction starts He is not sure how the ownership and liability works with the pond if the property line splits it and there are two owners He also has concerns about the buffering that will be installed Mr Morrison replied that the pond has some clean up that needs to be done before anything can be done The overflow needs to be cleaned so it can drain well He explained how they would berm the area so it flows naturally The existing woods surrounding it would also be a buffer Ms Holmes asked who would take on that r esponsibility Mr Morrison replied they would take on that r esponsibility and fix i t a s needed Mr Marty Bizzell , Engineer , explained the pond and buffering and the defused flow He added they would follow all the rules and regulations as it relates to stormwater There w as brief discussion on impervious areas Mr Narron asked about the drainage between Lots 11 and 12 He added there would be a lawsuit if the water flows and pours onto h is p roperty Mr Morrison stated they were not planning for a berm or landscaping for any lots unless they are required with the reverse frontage buffer on Atkinson Mill or NC 42 The existing woods will be the buffer The home owners w ill be blocked b y the woods Ms Janet O’Neal , 7384 NC Hwy 39 , representing her elderly father , has issues on privacy and landscaping The reverse buffer needs to also be on NC 39 , she stated She also has a concern about lighting , if any She asked about t he size o f the h omes Mr Marr stated that he spoke in error before and the reverse frontage buffer will be on NC Hwy 39 and not NC 42 as stated Mr Morrison replied there will be a berm along the whole section of NC 39 and 42 There will not be any lighting along NC 39 and street lights will be low light LED There will be one pole per 4 lots so there will only be a few poles installed The homes will be 2,000 - 2,500 sq ft homes in the range of 350K He added the trees they will plant will be 8 ft when they are installed and will grow up to 30 ft tall Mr Glenn Wheeler , 281 Atkinson Mill Rd , lives at the dead end of the road He has concerns about the traffic this will generate onto NC 39 and it is a dangerous intersection 7PagePage pageNumber8He added that cars don’t slow down around the new traffic circle and he would like to see them square up the intersection He also has concerns about privacy and would like to see berms if possible His family owns Atkinson Mill and does not like the name of this subdivision being called the same They are not associated with the subdivision and did not want people in the area thinking they were the ones starting this Mr Morrison replied they do not have an issue with changing the name to Atkinson Point , as that was going to be the original name He described how the berm would be built up and then the trees will be planted on top of the berm He added that Lot 14 is on a tall bank and on Atkinson Mill Rd there will not be a berm but will be plantings There will also be an HOA , he concluded He believes the homeowner of Lot 14 will put up a privacy fence across the back Mr DeLaine added that NCDOT would be responsible for straightening t he intersection Ms Hackler asked Ms Slusser about the pond issue i n r egards to t he liability Ms Slusser stated that typically NC is a riparian state which means both owners have the right to use the waters and are responsible for it Maintenance agreements can be entered into as well , she added There was more discussion by the Board on the pond liability and issues associated as well as landscaping buffering Mr Morrison stated that they would be willing to do whatever was requested to be good neighbors There w as no further discussion Staff recommendation is for preliminary approval Upon a motion by Ms Hackler to approve Atkinson Mill Subdivision as is , seconded by Mr Caldwell and carried by a unanimous vote of 6 - de - sac 25 Provide flow test Discussion Item Update on NCGS Chapter 160D Draft Ordinance Changes Mr Newton explained the overview of the changes and stated he would be looking for a vote at the May Planning Board meeting so it could be presented to the BOCC at their June meeting He explained that this is a legislative hearing and discussed what conditional zoning is Mr Newton stated staff would upload examples to the P -
