Jennifer Slusser , County Attorney Chairman Letchworth opened the meeting at 6 00 pm with the Pledge of Allegiance led by Mr Moore Chairman Letchworth welcomed Mr Little to the Planning Board Approval of the Minutes The September 20 , 2022 Planning Board Minutes will be considered at the November 15 , 2022 Planning Board Meeting Rezoning and Conditional Zoning Cases Rezoning Case 22 - 27 Rezoning Petition Agricultural Residential AR to General Business - Conditional Zoning GB - CZ Tax ID 14M08010B Owner Blade Hunter Perdue Applicant Adams & Hodge Engineering , PC Location 373 acres located at 4880 NC Hwy 96 in the Selma Township Conditional Zoning Request Outdoor Storage Mr Marr introduced the case and referenced the information listed above Mr Donnie Adams , 314 E Main St , Clayton , NC , adjacent property owner , shared concerns about the impact on property value , the 24 - hour accessibility , and the close proximity to his home Chairman Letchworth spoke about the proposed condition for an 8 foot opaque fence surrounding the entirety of the subject property Ms Annette Calderia , 5014 NC HWY 96 N , Selma , NC , an adjacent property owner , shared concerns for the proposed outdoor storage Chairman Letchworth asked Mr Adams about the purpose for fencing around the property creating a barrier between the Pleasant and Norris properties Mr Adams responded that the subject property’s owner wanted the option to fence in the entire property and does not have plans to go beyond the pond The narrow portion of the subject property may be used to handle stormwater Mr Adams storage in relation to the subject property to which Mr Adams stated he did not have an answer Chairman Letchworth asked Mr Adams about the proposed conditions to which Mr Adams agreed to the proposed conditions Ms Byrd asked for clarification that there are no plans for storage in the narrow portion of the subject property between the Pleasant and Norris properties to which Mr Adams confirmed that there are no plans for storage in that area of the subject property Ms Davis asked about lighting requirements in the conditions to which Mr Adams stated they were included in the conditions There was Chairman Letchworth asked staff to revisit the surrounding zonings in the area Mr Marr stated that the area is a community activity node with the surrounding zonings in the area including AR and used for residential and agricultural purposes , I - 1 and used 2Pageas woodworking shop , CB and used as a gas station , auto service station , GB - SUD and is a Dollar General , and MHP and used as a Johnston County Land Design Manual regarding developments creating 4 or more lots Ms Davis asked staff about recent waivers and the number of driveways Mr Marr responded that the preliminary plat shows one driveway onto Bryant Pond Rd as the entrance into the proposed subdivision and then an access easement to each individual proposed lot Chairman Letchworth asked if the Board had previously way Ms Davis asked about the nearby Voluntary Agricultural Districts to which Mr Lane stated that it should be noted on the preliminary plat Ms Hackler asked about what was on the Voluntary Agricultural District properties , what kind of operations Mr Lane responded that it was a row crop but he did not know if there were any storage buildings as well Ms Amelia Hockaday , 4702 Bryant Pond Rd , Dunn , NC , an adjacent property owner , shared concerns for increased congestion from the proposed development There was no further discussion Chairman Letchworth asked for the staff recommendation Mr Marr stated the staff recommended denial due to not having a dedicated ROW meeting county requirements Chairman Letchworth spoke about the hammerhead configuration seen in the also shared information from the Johnston County Land Design Manual regarding developments creating 4 or more lots Ms Howard asked about driveways for lots 1 , 4 , 5 , and 10 to which staff responded that those lots are most likely proposed as single driveways Ms Howard asked about NCDOT requirements for driveways to which Mr Marr responded that NCDOT has already stated they will require shared driveways for all lots as shown in condition 15 on the staff report There was a brief discussion about the shared driveway requirement Mr Curk Lane , 205 West Main St , Clayton , NC , Surveyor , stated the particulars of the development and was present to answer any questions the Board may have Mr Lane discussed the reason for the proposed driveway design Chairman Letchworth restated the information presented by Mr Lane concerning the proposed driveway design for understanding to which Mr Lane affirmed Ms Hackler asked about the distance between the driveway for lots 10 and 11 Ms Davis asked about the existing easement between lots 4 and 5 and the neighboring properties Mr Lane responded that the existing easement is already in place and serves the neighboring properties Ms Hackler asked about the cemetery on lot 4 and if there would be anything else on lot 4 to which Mr Lane responded that there would be a house on lot 4 Mr Lane also stated 6PagePage pageNumber7that the cemetery is maintained by family members of those buried in the cemetery Mr Lane stated that access to the cemetery is included in the existing access easement Mr Hudson asked if the 0785 acreage for lot 4 included the cemetery to which Mr Lane responded that it does include the cemetery Ms Hackler asked Mr Lane to explain the hardship Mr Lane responded that there was not enough good soil and to maximize lot count Mr Lane also discussed the road design and there would not be enough houses on each road for them to be taken over by NCDOT The result would be four private roads with four private road maintenance agreements Ms Hackler asked about the nearby Voluntary Agricultural District Mr Lane stated that the Voluntary Agricultural District was large and may have storage on it as well Mr Lane stated that it should be noted on the preliminary plat Ms Hackler asked about mail to which Mr Lane stated that they would like to put two mailboxes per driveway The two mailboxes would be on the same pedestal Mr Lane stated that should a mail kiosk be required that they would be located at the shared driveways to allow for the mail carrier to pull in and turn around Chairman Letchworth asked for confirmation concerning the distances between the driveways on the western side of Herring Rd Mr Lane stated that they would also have to petition to NCDOT about site distance There was no further discussion Chairman Letchworth asked for the staff recommendation Mr Marr stated the staff recommended denial due to direct driveway access on to Herring Rd and lots not being internally served Mr Hudson discussed the potential results of taking out the cemetery from lot 4 and its effect on the size of lot 4 There was brief discussion among the Board Chairman Letchworth stated that Mr Lane has done the best he can trying to maximize the number of lots and utilize shared driveways Chairman Letchworth expressed concerns for the amount of proposed shared and individual driveways in the and referenced the above information Mr Marty Gilbert , 273C Blue Pond Rd , Clayton , NC , stated the particulars of the development and was present to answer any questions the Board may have Mr Gilbert stated they had consulted with a Licensed Soil Scientist , Brown’s Environmental Group , and Johnston County Public Utilities with regards to design and the wetlands on the subject property Ms Barbara Crabtree , 35 E Calvert Ct , Clayton , NC , spoke on behalf of her mother , Pansy Evans , whose property is adjacent to the subject property Ms Crabtree spoke about an agreement with regards to the property line between the subject property and Ms Evans ’ property Ms Crabtree asked if a berm or fence would be along the property line Chairman Letchworth responded that typically buffers are not required between like uses and both properties are Agricultural Residential Mr Sylvester Holder , 363 Crocker’s Nub Rd , Middlesex , NC , a nearby property owner and pastor at Saint James Church of Christ , expressed concerns for increased traffic and public safety describing the area as a connector for highways 39 , 96 , and 222 There was no further discussion Chairman Letchworth asked for the staff recommendation Mr Marr stated the staff recommended approval with the stated conditions and requirements in the staff report Chairman Letchworth asked Mr Gilbert about a berm or fence along the subject property line to which Mr Gilbert responded that there were no plans to include a berm or fence Ms Davis raised attention to the school districts in the area of the proposed development and was present to answer any questions the Board may have Mr Burrell stated that the lagoon of previous concern is no longer part of the subject property Mr Hudson asked about responsibility of the pond to the south of the subject property to which Mr Burrell confirmed that the pond is the responsibility of the new owners of the parcel to the south of the subject property Ms Hackler asked about lot 27 Mr Carlos Bagley , 63 Watkins Rd , Clayton , NC , Surveyor Engineer , was present to answer any questions the Board may have Mr Bagley stated that the mail kiosk is at lots 18 and 19 Mr Bagley stated that the existing barns on lot 27 would be removed Ms Hackler asked about the gravel path shown on the preliminary plat that runs across lots 27 - 31 to which Mr Bagley responded that the gravel path would be removed and that all lots would be served by internal streets Mr Hudson asked if there would be a landscaping buffer around the pond Mr Bagley responded that the preliminary plat shows a 50 foot buffer around the pond and that there are no plans to add to the buffer or disturb the buffer Mr Bagley also stated that Johnston County staff determined that the pond was buffered Chairman Letchworth clarified that this parcel does not include the pond nor the 50 foot buffer Mr Bagley confirmed and stated that the subject property’s lines are 50 foot upstream Mr Steven Walker , 100 Professional Ct Suite 102 , Garner , NC , Attorney representing Mr Don Byrd with Pleasant Grove Holdings , LLC , a nearby property owner , asked questions about the hog waste lagoon , an active NCDEQ investigation with possible violations , the demolition of barns , and abandonment of wells Mr Walker referenced information from when the proposed development was previously presented to the Board in May 2022 Chairman Letchworth asked Mr Walker how does Mr Byrd have standing in this matter and how is he directly affected by the proposed development Mr Walker responded that Mr Byrd is directly impacted because his LLC owns property that is on the same tributary and creek where the water would be running off into Mr Geno Kennedy , with Agriment Services , Inc , has experience with closing hog operations and spoke about current decommissionings and working with NCDEQ Ms Hackler asked Ms Slusser about the Board’s responsibility in terms of reviewing the presented updated application 11Page2Ms Slusser responded to the presented concern of how the stormwater impact from this particular development comes into play with properties downstream Ms Hackler asked Ms Slusser about considering known violations on the entirety of the property when reviewing the presented updated application Ms Slusser responded that she did not have all of the NCDEQ paperwork but that typically in Johnston County the violation attaches to the property and that the problem doesn’t necessarily go away if there is a subdivision of that property Ms Slusser advised the Board to make their decision based on the testimony received with regards to the particular project Chairman Letchworth asked Mr Bagley if the proposed subdivision as designed and presented meets all of the Johnston County codes and ordinances for stormwater runoff Mr Bagley responded that he believed it does and that they will go through the permitting and approval process Mr Bagley also stated that they are proposing 15 impervious There was discussion among the Board Mr Little asked about access to the property south of the subject property to which Mr Burrell responded that the way the property was divided there is road access There was no further discussion Chairman Letchworth asked for the staff recommendation Mr Marr stated the staff recommended approval with the stated conditions and requirements in the staff report Ms Howard asked for confirmation that the new property owners of the southern parcel will be responsible for the parcel to the south of the subject property Ms Davis asked Mr Bagley if there would be any signage on lots 5 and 6 with regards to the pond , property line , and safety Mr Bagley stated that they would be willing to post No Trespassing signs Ms Howard asked if the Developer would be willing to put up fencing or a barrier at lots 5 , 6 , and 7 for safety to which Mr Bagley stated that the Developer would be open to considering the request Mr Bagley also stated that he believes they are meeting all codes and will go through the permitting processes with NCDOT , stormwater , and erosion control and that there has been no other opposition to this proposal Ms Hackler asked Ms Slusser if a condition could be included in the approval regarding the decommissioning of the abandoned hog farm 12Page3Ms Slusser advised that the alleged hog lagoon is not on this parcel so adding that conditional requirement would not be possible Ms Slusser also stated that to add the condition of approval of this parcel would be putting an obligation on somebody
