Chairman Hackler asked about the location of the stormwater pond to which Mr Swarigen stated that it would be located in the back left corner of the subject property Mr Rynal Stephenson , 5808 Faringdon Pl , Raleigh , NC , Ramey Kemp Associates , spoke about the traffic impact study Vice - Chairman Hackler asked about the recommendations suggested by NCDOT to which Mr Stephenson replied that they did not have any problems with the recommendations 3PageMr Caldwell asked about the section of NC HWY 42 and if it would impact the proposed development Mr Stephenson replied that it was accounted for in the traffic impact study and the improvements identified by NCDOT Mr Eatman offered to answer any additional questions Ms Davis asked if the lots were to be residential or commercial to which members of the Board responded that they were to be commercial There was no further discussion Vice - Chairman Hackler asked about wetlands across the back of lots 12 - 16 to which Mr Lane confirmed Ms Davis asked about the location of the mail kiosk to which Mr Lane stated that it would be located on the front lot and they are waiting for postmaster approval 6PagePage pageNumber7Ms Claudia Mason , 3370 NC HWY 222 W , Kenly , NC , an adjacent property owner , asked how the wetlands would be protected and about plans for stormwater control Ms Mason asked about future utility easements and road drainage while sharing concerns about runoff onto adjacent properties Ms Mason spoke about a branch on the property Ms Mason also asked about the types of homes , if there would be an HOA , who would be responsible for maintaining the landscape and road , and would the development be marketed for high speed internet and cable Mr Lane explained that a stormwater management plan will be in place and added that the plan will be approved by the County Mr Lane also stated that they have a pending riparian buffer request that would go along the stream Vice - Chairman Hackler asked if there would be a possibility that the buffer would be extended Mr Lane explained that it is possible Mr Lane also explained the permitting process for stormwater management through the US Army Corps of Engineers and Johnston County Public Utilities Vice - Chairman Hackler asked if calculations would need to be submitted showing the amount of runoff both pre and post construction Mr Lane confirmed Mr Lane acknowledged the presence of a branch on the property and that the label may have been left off of the preliminary plat Mr Lane also stated that he was unsure about a covenant , as well as internet and cable utilities Mr Lane stated that an HOA was planned and would be responsible for any areas not part of private property such as the mail kiosk and signage Mr Lane stated that the road is designed to be a public right - of - way Vice - Chairman Hackler asked Mr Lane if he would like for there to be access to high speed internet and cable for the proposed development to which Mr Lane confirmed Vice - Chairman Hackler asked Ms Mason if her questions were answered to which Ms Mason confirmed There was no further discussion Vice - 0 , the written decision for The Laurel was approved as presented August 16 , 2022 Planning Board Meeting Mr Newton asked the Board members for confirmation of who would be in attendance at the August 16 , 2022 Planning Board meeting Ms Byrd , Mr Caldwell , Ms Davis , Ms Hackler , and Ms Howard all showed by a raise of hand that they would be in attendance at the August 16 , 2022 Planning Board meeting Mr Newton stated that he would follow up with an email to all Board members Johnston County Comprehensive Land Use Plan 15Page6Mr Newton spoke about the draft of the Johnston County Comprehensive Land Use Plan and encouraged Board members to review the draft Mr Newton stated that he would like for the consultants to present the draft to the Planning Board and asked if the Board members would be available for a meeting on Wednesday , August 10 , 2022 There was discussion among the Board concerning members ’ availability for this date and alternate dates An alternate date of Wednesday , August 3 , 2022 was suggested and discussion continued Ms Hackler asked about the possibility of holding a virtual meeting of the draft presentation Ms Slusser stated that the Governor has announced that North Carolina’s State of Emergency would end on August 15 , 2022 Ms Slusser advised there is no clear legal authority for remote meetings once the State of Emergency ends Ms Slusser stated the safest process moving forward would be to not permit members attending remotely to be counted as part of the quorum and to not permit those members to vote Those members attending remotely would be participating only Ms Slusser advised that the meeting should be scheduled prior to August 15 , 2022 if they wanted to hold the meeting remotely Ms Hackler asked for clarification that no action would be taken at the meeting to which Ms Slusser stated that is correct Ms Slusser stated that a meeting is a gathering of the group for the transaction of public business and to receive the report is the transaction of public business Ms Slusser also stated that staff would need to know which members would be in attendance at the meeting and who would be joining remotely There needs to be an option for the public to participate in person or remotely if the entire meeting is held remotely Ms Byrd , Ms Caldwell , Ms Davis , Ms Howard , and Mr Hudson stated they were available to meet in person on Wednesday , August 3 , 2022 Ms Hackler and Ms Holmes stated they preferred to join the meeting virtually on Wednesday , August 3 , 2022 Mr Caldwell asked if the plan was to receive the draft presentation in August and then vote on it in September Mr Newton responded that the plan was to receive the draft plan in August and to make a recommendation at the August 16 , 2022 Planning Board meeting Mr Newton stated that the Board already has access to the draft via the Planning website Mr Newton stated that the Board can make recommendations to the County Commissioners with regard to the content of the plan Ms Slusser provided examples for the Board Mr Newton shared the draft of the Future Land Use and Conservation Map 16Page7There was discussion among the Board and staff The Board suggested an alternate date of August 23 , 2022 for the August 16 , 2022 Board meeting Mr Newton stated that he would follow up with an email to all Board members There were no discussion items The meeting ended at 7 30 pm Respectfully submitted by _______________________________________ Jodie Gay , Secretary for the Board 17Page
