10 151 Meeting of the Johnston County Board of Commissioners October 3 , 2022 6 00 pm The Johnston County Board of Commissioners met in regular session Monday , October 3 , 2022 at 6 00 pm in the Commissioners Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina The following members were present Present Chairman RS “ Butch ” Lawter , Jr , Vice Chairman Patrick E Harris , Tony Braswell , Ted G Godwin , Fred J Smith , Jr , Richard D Braswell , and April Stephens Absent None Also Present County Manager Rick J Hester , County Attorney Jennifer J Slusser , Clerk to the Board Paula Woodard , and Executive Assistant Deputy Clerk Dana Cuddington Chairman RS “ Butch ” Lawter , Jr called the meeting to order at 6 00 pm and the following business was transacted 1 Appointments Announcement Chairman RS “ Butch ” Lawter , Jr stated the Board utilized written ballots at the 10 00 am meeting for appointments to the Boon Hill Firefighters Relief Fund Board , Heritage Commission and the Planning Board Chairman Lawter stated the votes have been tallied and he announced the following appointments were made Boon Hill Firefighters Relief Fund Board – Adam Stanley was appointed for a two year term to expire on October 31 , 2024 Heritage Commission - Pam Lipscomb Baumgartner , Dr John M Booker , Suzanne Benton Cook , Matthew Dean , Warren Grimes , and Raymond “ Frank ” Knott , Jr were reappointed for two year terms to expire on October 31 , 2024 Lyda Boone , Pascual Goicoechea and Angelique Legette were appointed for two year terms to expire on October 31 , 2024 Upon a motion by Vice Chairman Patrick E Harris , seconded by Commissioner Ted G Godwin , and carried unanimously , Ms Baumgartner , Dr Booker , Ms Cook , Mr Dean , Mr Grimes and Mr Knott were granted waivers in the length of service policy Page152 October 3 , 2022 – 6 00 pm Continued Planning Board – Timothy M Little was appointed to fill an unexpired term ending February 28 , 2025 2 Approval Discussion of Agenda Upon a motion by Commissioner Tony Braswell , seconded by Commissioner Ted G Godwin , and carried by unanimous vote , the Board approved the agenda 3 Public Comment A Johnston Community College – JoCo Commissioners Promise Program Johnston Community College Interim President Dr Ken Boham along with Board of Trustee Member Mary Daughtry introduced and recognized this year’s recipients of the JoCo Commissioners Promise Scholarship Program James Price , Josh Bare , Tanner Gardner , and Brandi Appell mother for Cori Appell all addressed the Board and spoke on their future plans as well as how the JoCo Commissioners Promise Scholarship Program has benefitted their education Dr Boham also took a moment to update the Board on the College’s enrollment numbers stating they have increased and he sincerely appreciates the investment by the County Commissioners in the College Ms Daughtry thanked the Board of Commissioners for their support to the College and to the success of the students At the inquiry of Commissioner Tony Braswell , Ms Daughtry stated 284 scholarships from the JoCo Commissioners Promise Program were granted this year 4 Public Hearing Rezoning Conditional Use Requests Advertised – The News & Observer , The Johnstonian News and The News in Review – September 21 and 28 , 2022 Certified letters were mailed to adjoining property owners on September 19 , 2022 Notices were posted at the locations on July 1 , 2022 for Case 22 - 19 and August 9 , 2022 for Cases 22 - 22 and 22 - 23 The Chairman opened the Rezoning Hearing for Case 22 - 19 Case 22 - 19 Petition to rezone 2345 acres located at 6695 NC HWY 42 W in Cleveland Township from Agricultural Residential AR to General Business - Conditional Zoning GB - CZ Tax ID 06D01013B Owner NC 42 Holdings LLC Applicant Gander Development Conditional Zoning Various General Business Uses Planning Director Braston Newton stated the petition is to rezone 2345 acres located at 6695 NC Hwy 42 W in Cleveland Township from Agricultural Residential to General Business - Conditional Zoning He stated as part of this conditional zoning request there are various general business uses the applicant is identifying to limit the land use on the property The surrounding land uses are zoned Agricultural Residential and used for such purposes ; General Business and used as a shopping center and gas station convenience store ; General Business – Special Use District and used as a shopping center ; and Mobile Home Park Development for a mobile home park The area is located within a designated “ Primary Growth Area ” on the County’s Comprehensive Land Use Plan Mr Newton stated the traffic count for this portion of NC Hwy 42 West is 12,500 vehicles per day as of 2020 and it appears on the Comprehensive Transportation Plan as an existing boulevard needing improvement At the inquiry of Chairman , RS “ Butch ” Lawter , Jr , Mr Newton stated the driveway shown on the site plan does not line up with Nicholas Way He stated the North Carolina Department of Transportation will most likely require some transportation improvements and potentially may require a right - in right - out only Page153 October 3 , 2022 – 6 00 pm Continued Commissioner April Stephens stated her concern relates to the location of the site on NC Hwy 42 and the number of storage facilities that are already in this area Commissioner Stephens stated with storage facilities , there can be people pulling trailers in and out of the facility which can lead to traffic back - ups on the busier highways The Chairman called for the applicant to come forward Staff displayed the proposed conditions on the screen , as follows 1 Proposed uses Any uses allowed in the General Business District on the Johnston County Table of Uses chart WITH THE EXCEPTION of Vehicular sales , Boat sales , Campground RV Park , Kennel , Hospital , Open Storage , Pawn Shop , Adult Businesses Proposed by applicant 2 Building footprints shown on site plan are subject to change with changes being limited to no more than 20 reduction in gross building area and no more than 10 increase in building area Proposed by applicant 3 Type C landscape buffers outside stream buffers and adjacent to developed residential sites shall utilize evergreen shrubs planted at 30 ” install height at 5 ’ OC in addition to trees required by Johnston County Design Manual Proposed by applicant 4 Where a landscape area is noted inside a stream buffer , the existing vegetation within the stream buffer shall qualify for landscape area requirements and no additional plantings shall be required Proposed by applicant 5 The location of sewer easement shown is preliminary in nature Exact location of the sewer easement shall be determined at construction documentation , subject to approval by county staff Proposed by applicant 6 The development shall conform to all requirements of the Johnston County Land Development Code 7 Applicant shall submit a detailed site plan for review and approval by the Planning and Zoning Department Staff 8 Landscape buffer shall be installed along all rezoning lines 9 NCDOT driveway permit required Must show ROW reservation from R - 3410 Full access driveway would be allowed pre - project , but will require turn lanes Post project this development will be required to be right in right out RIRO NCDOT requirement 10 All signage shall comply with the Johnston County sign code 11 All buildings and or structures must comply with rules enforced by Federal , State and Local agencies Katie Hamilton , representing the Applicant , Gander Development , addressed the Board Ms Hamilton stated they reviewed the current Comprehensive Land Use Plan as well as the draft Envision Johnston Land Use Plan and believe their proposal is consistent with both plans She stated there will be an open space conservation area through the site which they have committed to maintaining She also stated they will be granting a sewer easement to Johnston County for service to future development Ms Hamilton stated they will be limited to a right - in right - out turn ; however , if the Board feels a deceleration lane is necessary , they would be agreeable to that as a condition At the inquiry of Commissioner Stephens , Ms Hamilton stated the mixed general business is speculative for now She stated the topography limits the use somewhat on the site Commissioner Stephens expressed support for the addition of a condition for a deceleration lane to help with traffic backups in an already congested area There being no further public comments , the Chairman closed the public comment portion of the hearing Mr Newton reported the Planning Board recommended approval of the rezoning and adoption of a Resolution for the Statement of Consistency with an attached list of conditions as submitted in the agenda packet At the inquiry of Chairman Lawter , Ms Hamilton confirmed that they agree to the conditions as proposed and with the addition of # 12 for a deceleration lane There being no further comments , the Chairman recessed the Rezoning Hearing for Case 22 - 19 Decision on Rezoning Case 22 - 19 Case 22 - 19 Petition to rezone 2345 acres located at 6695 NC HWY 42 W in Cleveland Township from Agricultural Residential AR to General Business - Conditional Zoning GB - CZ Tax ID Page154 October 3 , 2022 – 6 00 pm Continued 06D01013B Owner NC 42 Holdings LLC Applicant Gander Development Conditional Zoning Various General Business Uses Commissioner Tony Braswell moved the Board adopt a Statement of Consistency Resolution and approve the rezoning request with conditions , including the addition of # 12 for a deceleration lane , for Case 22 - 19 Commissioner Richard D Braswell seconded the motion , which carried by unanimous vote RESOLUTION FOR CASE NUMBER 22 - 19 RESOLUTION APPROVING A ZONING AMENDMENT AND ADOPTING A STATEMENT OF CONSISTENCY REGARDING AN ORDINANCE AMENDING THE OFFICIAL ZONING MAPS OF JOHNSTON COUNTY WHEREAS , pursuant to NC Gen Stat § 160D - 605 , prior to adopting or rejecting a zoning amendment , the governing board is required to adopt a statement approving or rejecting the zoning amendment and describe if the amendment is consistent or inconsistent with the comprehensive zoning plan and why the board considers the action taken to be reasonable and in the public interest ; WHEREAS , the Johnston County Planning Board has reviewed a proposed amendment to The Official Zoning Maps of Johnston County , for parcels identified as tax Tag ID 06D01013B located at 6995 NC Hwy 42 West in Cleveland Township , from Agricultural Residential to General Business - Conditional Zoning WHEREAS , based on a review of the proposed amendment the Planning Board found that the proposed amendment is consistent with the Johnston County Comprehensive Land Use Plan and updates and further recommended that the Board of Commissioners approve the proposed amendment ; Industrial 2 – Special Use District and used for a solar farm ; Industrial 1 and used as light industrial ; and Mobile Home Park District and used as a mobile home park The area is located within a designated “ Secondary Growth Area ” on the County’s Comprehensive Land Use Plan Mr Newton stated the traffic count for this portion Lake Wendell Road is 1,100 vehicles per day as of 2016 and a count for Salem Church Road is not available He stated neither road appears on the Comprehensive Transportation Plan as needing improvement At the inquiry of Chairman RS “ Butch ” Lawter , Jr , Mr Newton provided the Board with more information regarding the Class B landscaping buffer requirement The Chairman called for the applicant to come forward Staff displayed the proposed conditions on the screen , as follows 1 Proposed uses Land use restricted to outdoor storage of boats , RV’s , travel trailers , trailers , and 10 - wheeled box trucks Proposed by applicant 2 The development shall conform to all requirements of the Johnston County Land Development Code Proposed by applicant 3 Lighting shall be engineered dark sky down - lighting so as to not shine onto adjacent properties Proposed by applicant 4 24 - hour accessibility Proposed by applicant 5 Applicant shall submit a detailed site plan for review and approval by the Planning and Zoning Department Staff Proposed by applicant 6 Site may include a future covered 3 - sided outdoor storage area Proposed by applicant 7 A Class B 2 large trees , 3 small trees , and 9 shrubs every 100 linear feet landscape buffer shall be installed along all rezoning lines 8 All signage shall comply with the Johnston County sign code Proposed by applicant 9 If 17,000 SF of impervious area is planned or 1 acre will be disturbed , a stormwater permit will be required 10 If one acre or more is planned to be disturbed , an erosion control permit will be required 11 Emergency vehicles must be granted gate access and gate must be located far enough off of roadway to accommodate emergency vehicles 12 Fire hydrant needed at entrance on the same side of the road 13 An 8 foot opaque fence or a 4 foot berm with an adequate planting of evergreen material , at staff’s discretion , to satisfy the intent of the opaque fence requirement , will be installed around storage area 14 NCDOT driveway permit required 15 Gate shall be at least 100 ’ from right of way if trailer storage is proposed and be permitted by the Johnston County Building Inspections and the Fire Marshal Division Donnie Adams , representing Applicant Adams & Hodge Engineering , addressed the Board Mr Adams stated the use would be all outdoor storage which should not be confused with mini - storage because no indoor structures will be on the subject site He noted that there is one condition proposed that would allow for a future covered outdoor storage area Mr Adams shared the following presentation with the Board PagePage pageNumber6156 October 3 , 2022 – 6 00 pm ContinuedPagePage pageNumber7157 October 3 , 2022 – 6 00 pm Continued Mr Adams stated this would be a light impact operation and with the growth in the area , the use is needed for those residents that need somewhere to park recreational vehicles and boats Mr Adams referenced the proposed conditions and stated they are agreeable to those Mr Adams referenced the site plan and pointed out the proposed locations of the 20 ’ Class B buffer with an 8 ’ fence and berm as well as a 10 ’ Class B buffer with 8 ’ fence At the inquiry of Chairman Lawter , Mr Adams stated along the street right - of - way property lines they would install an 8 ’ chain link fence along with a 4 ’ berm in addition to the landscaping He stated the remaining property lines would only have an 8 ’ opaque fence with the landscaping buffer , but no berm Commissioner Fred J Smith , Jr stated he has had neighbors reach out to him in support of this request ; and b The site is located within the Secondary Growth Area which is experiencing the stressors of growth and requires a need for specific services within the community 3 This Board approves the proposed zoning amendment from Agricultural Residential to General Business - Conditional Zoning rd Adopted this the 3 day of October , 2022 Conditions 1 Proposed uses Land use restricted to outdoor storage of boats , RV’s , travel trailers , trailers , and 10 - wheeled box trucks 2 The development shall conform to all requirements of the Johnston County Land Development Code 3 Lighting shall be engineered dark sky down - lighting so as to not shine onto adjacent properties 4 24 - hour accessibility 5 Applicant shall submit a detailed site plan for review and approval by the Planning and Zoning Department Staff 6 Site may include a future covered 3 - sided outdoor storage area 7 A Class B 2 large trees , 3 small trees , and 9 shrubs every 100 linear feet landscape buffer shall be installed along all rezoning lines 8 All signage shall comply with the Johnston County sign code 9 If 17,000 SF of impervious area is planned or 1 acre will be disturbed , a stormwater permit will be required 10 If one acre or more is planned to be disturbed , an erosion control permit will be required 11 Emergency vehicles must be granted gate access and gate must be located far enough off of roadway to accommodate emergency vehicles 12 Fire hydrant needed at entrance on the same side of the road 13 An 8 foot opaque fence or a 4 foot berm with an adequate planting of evergreen material , at staff’s discretion , to satisfy the intent of the opaque fence requirement , will be installed around storage area 14 NCDOT driveway permit required 15 Gate shall be at least 100 ’ from right of way if trailer storage is proposed and be permitted by the Johnston County Building Inspections and the Fire Marshal Division 16 The business shall not be open on the third Sunday morning of each month so as not to conflict with the neighboring church services 5 Planning Department – Presentation of Draft Comprehensive Land Use Plan Planning Director Braston Newton introduced Meg Nealon with Nealon Planning and Ben Hitchings with Green Heron Planning as the lead consultants on the Comprehensive Land Use Plan Update Envision Johnston Ms Nealon and Mr Hitchings shared the following presentation with the Board Page0160 October 3 , 2022 – 6 00 pm ContinuedPage1161 October 3 , 2022 – 6 00 pm ContinuedPage2162 October 3 , 2022 – 6 00 pm ContinuedPage3163 October 3 , 2022 – 6 00 pm ContinuedPage4164 October 3 , 2022 – 6 00 pm ContinuedPage5165 October 3 , 2022 – 6 00 pm Continued Ms Nealon concluded the presentation by stating they hope this plan will be a communication tool that can be used with partnering entities and neighboring jurisdictions to realize the vision for Johnston County Ms Nealon expressed her appreciation to the Steering Committee , the County staff , and the Board of Commissioners for everyone’s cooperation and work on this project Chairman RS “ Butch ” Lawter , Jr thanked Ms Nealon , Mr Hitchings , and their teams for their work on the update Chairman Lawter also expressed the Board’s appreciation to the Steering Committee for their time and effort on this process He also thanked the citizens for their participation Chairman Lawter stated he would th like for the Board to discuss the draft plan in more detail at the October 17 meeting and noted a public hearing would be scheduled at some point prior to adoption The Board briefly discussed the next steps and the importance of making sure that once the plan is adopted , it must be updated more frequently than in the past 6 Planning Department – Draft 2024 - 2033 Transportation Improvement Program Planning Director Braston Newton presented a draft of the 2024 - 2033 State Transportation Improvement Program as it pertains to Johnston County Mr Newton stated the list includes all the projects currently proposed for Johnston County He noted the Capital Area Metropolitan Planning Organization and the Upper Coastal Plains Rural Planning Organization is asking for comments from the counties on the draft plan He requested the Board to review the draft and provide any feedback to staff 7 Manager Reports and Comments None 8 Board Reports and Comments None There being no further business , Commissioner Fred J Smith , Jr moved the Board adjourn Vice Chairman Patrick E Harris seconded the motion , which carried by unanimous vote The meeting adjourned at 8 15 pm RS “ Butch ” Lawter , Jr , Chairman Paula G Woodard , Clerk to the BoardPage
