10 137 Meeting of the Johnston County Board of Commissioners October 3 , 2022 10 00 am The Johnston County Board of Commissioners met in regular session Monday , October 3 , 2022 at 10 00 am in the Commissioners Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina The following members were present Present Chairman RS “ Butch ” Lawter , Jr , Vice Chairman Patrick E Harris , Tony Braswell , Ted G Godwin , Fred J Smith , Jr , and Richard D Braswell Absent Commissioner April Stephens Also Present County Manager Rick J Hester , Clerk to the Board Paula G Woodard , Finance Officer and Deputy County Manager J Chad McLamb , County Attorney Jennifer J Slusser , and Executive Assistant Deputy Clerk to the Board Dana Cuddington Chairman RS “ Butch ” Lawter , Jr called the meeting to order at 10 00 am Commissioner Fred J Smith , Jr opened the meeting with a prayer VFW Post 5955 from Selma led everyone in the Pledge of Allegiance to the American Flag 1 Approval Discussion of Agenda Upon a motion by Commissioner Ted G Godwin , seconded by Commissioner Richard D Braswell , and carried by unanimous vote , the Board approved the agenda as presented 2 Consent Agenda Items Upon a motion by Vice Chairman Patrick E Harris , seconded by Commissioner Ted G Godwin , and carried by unanimous vote , the Board approved the following consent agenda items , removing the proclamations for National 4 - H Week and Employee Appreciation Week to be considered as separate items A Approval of Minutes – August 15 , 2022 ; September 6 , 2022 - 2 00 pm and 6 00 pm B Department of Transportation – Additions to System The Board concurred with the Department of Transportation’s recommendation to add the following roads to the State Maintained System Shallow Falls Lane , Belmont Farms Drive , and Boulder Brook Lane – Belmont Farms – Elevation Township C Town of Pine Level – Appointment to Pine Level Planning Board Per a request by the Town of Pine Level , the Board made the following appointment to the Pine Level Planning Board representing the ETJ area of the Town Greg Johnson , 530 Rains Crossroads Road , Selma term expiring October 31 , 2025 D Sheriff’s Office – Surplus and Donation of Laptops to Johnston County Schools , resolution adopted as follows Resolution Approving Conveyance of Personal Property to Another Governmental Unit Pursuant to GS 160A - 280 WHEREAS , the County of Johnston “ County ” owns the following equipment that has been previously used in the Johnston County Sheriff’s Office operations ; and ? 101 Dell Latitude Laptop Computers Model 5280 93 Good Condition 8 Parts Only ? 7 Lenovo ThinkPad Laptop Computers Model Yoga 260 WHEREAS , North Carolina General Statute § 160A - 280 authorizes a county to convey personal property for nonmonetary consideration to another governmental unit within the United States if the governing board deems the property to be surplus , obsolete , or unused ; and WHEREAS , the County of Johnston has determined that the personal property described above is surplus ,Page138 October 3 , 2022 – 10 00 am Continued obsolete , or unused ; and WHEREAS , the County of Johnston finds that the public will benefit from the conveyance of the property described above by assisting the Johnston County Public Schools with necessary equipment THEREFORE , THE JOHNSTON COUNTY BOARD OF COMMISSIONERS RESOLVES THAT 1 The manager and or finance officer of Johnston County is authorized to execute all documents necessary to convey the equipment described above to Johnston County Public Schools 2 The consideration for the conveyance is the public benefit from the conveyance of the property described above by assisting Johnston County Public Schools with necessary equipment 3 In accordance with the notice requirements of NCGS § 160A - 280 , public notice of this resolution was given by posting on the county’s website on September 21 , 2022 rd Adopted this the 3 day of October , 2022 E Appointments , approved as follows ? H Week Commissioner Ted G Godwin stated each year at the North Carolina Association of County Commissioners ’ Conference there are youth representatives in attendance from 4 - H across the State and it is always inspiring to see their accomplishments He commended all the 4 - H members and leaders Commissioner Godwin read aloud the following proclamation for National 4 - H Week and moved for its adoption Commissioner Richard D Braswell seconded the motion , which carried by unanimous vote NATIONAL 4 - H WEEK PROCLAMATION WHEREAS , 4 - H youth across the nation are leading efforts to solve problems in their communities and make a difference for their futures ; and WHEREAS , 4 - H is the largest youth development organization in North Carolina and the largest in the nation with over six million participants ; and WHEREAS , 4 - H in North Carolina claims 260,000 youth members and 13,000 volunteers , while Johnston County’s 4 - H program numbers reach more than 2,000 youth participants and more than 125 volunteers ; and WHEREAS , 4 - H as part of the NC Cooperative Extension System of NC State University and NCA & T State University is a program where youth learn through opportunities that provide them hands - on experiences in 4 - H’s mission mandates of science , engineering and technology ; healthy living ; and citizenship ; and WHEREAS , 4 - H has connected youth and their communities with the innovative research and resources from our nation’s 112 land - grant universities and colleges for more than 118 years NOW , THEREFORE , the Johnston County Board of Commissioners , do hereby proclaim October 2 - 8 , 2022 , as National 4 - H Week in Johnston County We urge the people of this County to take advantage of the opportunity to become more aware of this special program that enhances our young people’s interests in their futures as part of Johnston County 4 - 28 , 2022 Commissioner Tony Braswell stated Johnston County has the best employees in the State and he emphasized that their hard work is appreciated Commissioner T Braswell read aloud the following proclamation for Employee Appreciation Week and moved for its adoption Vice Chairman Patrick E Harris seconded the motion , which carried by unanimous vote JOHNSTON COUNTY EMPLOYEE APPRECIATION WEEK October 24 – October 28 , 2022 WHEREAS , Johnston County employees represent over 1,000 men and women , working in 31 different service departments and agencies , devoted to making Johnston County a better place to work and live ; and WHEREAS , Johnston County employees provide a multitude of services for all the citizens of the County ; and WHEREAS , Johnston County employees are both skilled and efficient in their jobs , making every effort to expend County tax dollars in the most effective way for the betterment of the County and its citizens ; and WHEREAS , Johnston County Government runs smoothly on a day - 28 , 2022 as COUNTY EMPLOYEE APPRECIATION WEEK rd Adopted this the 3 day of October , 2022 5 Public Comments A Update from Hurricane Ian Emergency Services Director Kevin Hubbard introduced 911 - Communications Support Services Manager Jimmy Turbeville for an update from Hurricane Ian Mr Turbeville stated during the storm , there was a total of 954 calls received by 911 and he noted which of those were for fire services as well as EMS Mr Turbeville stated three fatalities occurred in Johnston County and there were over 13,000 power outages during the peak of the storm Mr Turbeville stated the power outages have since been restored He offered to answer any questions Vice Chairman Patrick E Harris expressed his appreciation for the hard work of the employees in the 911 Center as well as all those that responded during the storm Vice Chairman Harris also expressed the Board’s sympathy to the families of those that lost their lives B New EMS Unit at Elevation Fire Station Emergency Services Deputy Director Josh Holloman thanked the Board for the EMS positions that were approved in the Fiscal Year 2022 - 2023 budget Mr Holloman stated four of those positions will be used to add an EMS unit at the Elevation Fire Station He stated the unit would be for a peak time from 7 00 am to 7 00 pm Mr Holloman stated a geographical gap has been identified during this timeframe and the unit would benefit the Elevation , Four Oaks , Benson , and McGee’s Crossroads areas He commended Elevation Fire Chief Timmy Stanley and the Elevation Fire Department Board of Directors for their work and support during this process Mr Holloman stated if there were no objections , the new unit would be placed at the Elevation Fire Station in mid - November There were no objections by the Board C Marty Clayton – Duke Energy Marty Clayton , District Manager of Government and Community Relations for Duke Energy , thanked the Johnston County team of employees as well as elected officials , stating he values that partnership Mr Clayton stated although there was a significant impact from Hurricane Ian , most customers had their power restored by Saturday evening Mr Clayton stated thoughts and prayers go out to all those that were hit hard by the storm Commissioner Tony Braswell thanked Mr Clayton for his dedication and responsiveness stating he has always done a great job Commissioner Fred J Smith , Jr stated with companies as large as Duke Energy , sometimes things get lost ; however , Mr Clayton has always been available and he thanked Mr Clayton for what he does for Johnston County Mr Clayton commended his team and stated the process of responsiveness is a team effort Chairman RS “ Butch ” Lawter , Jr commended the level of communication from Mr Clayton and his team to Johnston County 6 Public Hearing – Economic Development Incentive Grant – Project Neyer Chairman RS “ Butch ” Lawter , Jr opened the Public Hearing to receive public comment on a proposed economic development incentive grant for Project Neyer Economic Development Director Chris Johnson stated over the last 12 months , the Johnston County Economic Development office has not been able to respond to over 50 investment and job creation projects due to the lack of building inventory , which represents billions of dollars of investment and thousands of highPagePage pageNumber8144 October 3 , 2022 – 10 00 am Continued paying jobs Mr Johnson stated the question for many communities is how to properly address this issue and still be prudent to the taxpaying citizens Mr Johnson noted that many counties have purchased their own land and built their own buildings and while this has been successful in many cases , it puts the taxpayers at risk Mr Johnson continued that here in Johnston County , there has been a more prudent and conservative approach where government is not competing against the private sector but is partnering He stated the Economic Development staff has been fortunate to work with willing property owners to offer up their land for industrial development at no cost to the taxpayers , noting this public - private partnership has been successful with the recent project announcement in the Four Oaks Business Park last month Mr Johnson stated the question before communities today is how to remain competitive in the economic development field , grow jobs at home , and expand the tax base He stated speed to market has never been greater and this was highlighted and addressed in the Fiscal Year 2022 - 2023 budget Mr Johnson explained that with the building lease program that was funded in the budget , developers work in partnership with the County to construct a Class A building to be marketed to potential clients considering Johnston County He noted this model has been extremely successful in Lee County and it is the hope that it can be duplicated in Johnston County Mr Johnson stated this two year , month - to - month lease program does not begin until the building has received its temporary certificate of occupancy and the 300 per foot for up to 100,000 square feet lease rate is well below the average market rate for a Class A space He stated if the building is sold or leased prior to the completion of the building , the County is not required to make any lease payment for the building and if at any time during the two year lease period the building is sold or leased to a client , the County’s commitment is immediately over Mr Johnson stated it is AL Neyer’s desire to partner with the County through this program and invest and build a state - of - the - art 260,000 square foot Class A facility that will be located on Wal - Pat Road in the Town of Smithfield He stated Neyer is a leading commercial real estate development and design - build firm in multiple markets throughout the Eastern US , and they have a very strong background that focuses on build - to - suit office , medical , and industrial projects Mr Johnson stated in addition to the over 25 million dollar industrial investment , the project has the ability to create over 25 new jobs in the foreseeable future , with an average salary of over 50,000 , which far exceeds the current average for the County and Town Mr Johnson stated as with all economic development incentive grants , this has been vetted and approved by the Johnston County Economic Development Advisory Board that consists of 14 business , civic and community leaders with representation from every municipality in Johnston County He also noted the project and investment projections have been evaluated by Dr Mike Walden , Retired Professor and Economist from North Carolina State University , in which his reports show that the monetary investment as well as the jobs and ancillary job growth is projected to be in the thousands annually for the County Mr Johnson stated the project meets the four factors to be considered for an economic development incentive grant , including job creation , capital investment , competition , and diversification of the economy Mr Johnson requested the Board to approve an Economic Development Incentive Grant and Lease Program Agreement and offered to answer any questions County Attorney Jennifer Slusser requested the Board to consider a resolution for a proposed economic development incentive grant and single tenant commercial lease for the project proposed by Brogden Industrial I , LLC AL Neyer and described by Mr Johnson Ms Slusser stated as described , the project meets the four factors required to qualify for an economic development incentive grant that includes job creation , capital investment , competition , and diversification of the economy She noted the economic impact analysis by Dr Mike Walden opines that the direct , indirect , and induced impacts from the development at full build out is estimated to be over 23 million Ms Slusser continued that the project is a proposed 25,000,000 capital investment to develop and construct approximately 264,000 square feet of Class A speculative industrial facility space in the Smithfield Township , which is strategically important to the County and will serve as a catalyst for future development in this area of Johnston County She stated the employment commitment for this project is solid with 25 permanent full - time job positions for employees working on the project site with an average salary of 50,000 with benefits Ms Slusser stated the capital investment is proposed to be completed by December 2024 and the job creation completed by December 2025 Ms Slusser stated the incentive proposal is a cash grant to be made in five annual payments beginning April 15 , 2025 which are quantified and measured as 50 of the ad valorem taxes paid on eligible investments She noted in this case , the eligible investments are real estate improvements during the investment period Ms Slusser stated if the incentives are granted , the company commits to the following PagePage pageNumber9145 October 3 , 2022 – 10 00 am Continued 1 Make eligible investments of no less than 20,000,000 by December 31 , 2024 2 Attain the employment goal of 25 full time permanent employees by December 31 , 2025 with an average salary of 50,000 3 Provide certification of investments and employment Ms Slusser stated the grant payments are conditioned upon the following 1 the company paying in full its ad valorem tax bills for that year for all of its property situated in the County that is subject to ad valorem taxation ; 2 the company being current on all payments owed to County ; 3 the company being current on the filing of their annual property tax listings ; 4 the company having no current appeal pending regarding the valuation of the property at the project site ; and 5 the company not being in violation of any other obligation to the County , including all county ordinances and regulations Ms Slusser stated there are recapture provisions in the proposed agreement if the company does not carry out and maintain the terms of the agreement She noted the grant agreement also contains provisions for a single tenant commercial lease not to exceed two years at 25,000 per month and recapture provisions apply if the building is sold during the lease period Ms Slusser offered to answer any questions Commissioner Ted G Godwin asked for clarification on the factor for diversification of the economy Ms Slusser said the diversification of the economy is to ensure that jobs are being created and there will be tax base created in the County She stated this is the reason that Dr Walden provides the economic impact analysis and the estimated projection for this project at full build out is over 23,000,000 At the inquiry of Chairman RS “ Butch ” Lawter , Jr , Ms Slusser stated the goal is for a lease to occur to a third - party user before the temporary certificate of occupancy is issued Daniel Gunter , Manager of Real Estate Investment for AL Neyer , commended Mr Johnson and Ms Slusser for their work on this project Mr Gunter stated his team looked at other counties , but ultimately selected Johnston County and noted the grant is making it possible to move forward with this type of project There being no further comments , the Chairman closed the public hearing Upon a motion by Commissioner Tony Braswell , seconded by Commissioner Ted G Godwin , and carried unanimously , the Board adopted the following resolution approving an Economic Development Incentive Grant agreement between the County and Brogden Industrial I , LLC AL Neyer and authorized the County Manager and County Attorney to finalize the corresponding agreement RESOLUTION OF THE JOHNSTON COUNTY BOARD OF COMMISSIONERS AUTHORIZING INCENTIVES FOR ECONOMIC DEVELOPMENT WHEREAS , the County seeks to promote economic growth and development within its jurisdiction and the social and economic improvement of its citizens , and desires to accelerate the quality and quantity of economic growth and employment opportunities in its jurisdiction by encouraging business enterprises satisfying the aforementioned public purposes and thereby reduce physical , economic and social distress resulting from unemployment and under employments existing in its jurisdiction ; WHEREAS , while Johnston County offers many advantages as a business destination , it suffers from a shortage of ready - to - go industrial , assembly , and manufacturing space and desires to promote economic growth and development opportunities in the County ; WHEREAS , the County is in discussions with Brogden Industrial I , LLC the “ Company ” to induce the Company to locate a new Building the “ Building ” which will provide Class A speculative building space for industrial , assembly , and manufacturing purposes on a Project Site in the Smithfield Township of Johnston County , which is an area strategically important to the County and a valuable asset enhancing the County’s economic development efforts ; WHEREAS , the Company proposes to develop and build a 264,000 + - square foot , single - story , cross - docked , concrete tilt - up , Class A speculative industrial facility , with flexible design and accommodating auto parking , truck docks , and trailer storage , capable of accommodating industrial requirements , worth approximately twenty th million and 00 100 dollars 20,000,00000 ;Page0146 October 3 , 2022 – 10 00 am Continued WHEREAS , North Carolina General Statute 158 - 71 a authorizes the County to make appropriations for economic development purposes which will increase the population , taxable property , employment , industrial output or business prospects of the County ; WHEREAS , the Board has determined that granting incentives the “ Incentives ” to the Company in exchange for the commitment of the Company to locate , develop and build out the Building with expandable Class A speculative industrial space on the Project Site in Johnston County would be beneficial to the County’s efforts to increase economic opportunities for its residents , its population , ad valorem tax revenues and sales tax revenues , and enhance and improve business prospects in general , including the creation of a substantial number of jobs ; WHEREAS , the Board has received and reviewed a proposed Economic Development Incentive Agreement between the County and the Company the “ Agreement ” and the proposed Lease between the County and Company providing for the County’s granting the Incentives to the Company in consideration of the Company’s commitments set forth in the Agreement ; and WHEREAS , the Board has , pursuant to the notice and hearing requirements of North Carolina General Statute 158 - 71 , held a public hearing to consider whether to grant the Incentives in exchange for the commitment of the Company to locate and operate the industrial logistics facility in Johnston County NOW THEREFORE , the Board 1 Determines and concludes a that granting the Incentives in exchange for the commitment of the Company to proceed with the development and buildout of the 264,000 + - 3,804,77055 YTD 21 22 - 3,518,59633 Upon questions by Commissioner Fred J Smith , Jr , Ms Andrews reviewed the increase in the levy from July to August and noted that one of the causes is the public services levy received from the North Carolina Department of Revenue , which includes infrastructure owned by private entities for things like power , transportation , and rail She noted the levy should remain consistent throughout the rest of the year 12 Manager Reports and Comments None 13 Board Reports and Comments A Selection of Design Firm – Logistics and Warehousing Facilities Vice Chairman Patrick E Harris stated Johnston County issued a Request for Qualifications for interested design firms to evaluate property near the Detention Center site for the siting of future logistics and warehousing facilities He stated qualification statements were evaluated and while all the firms were highly qualified , the recommendation is to select CPL as the best qualified company based on the criteria used to evaluate the responses Vice Chairman Harris noted that Commissioner Tony Braswell was also part of the selection process Commissioner Ted G Godwin expressed his reservations about spending this amount of money for a project such as warehousing Commissioner Godwin asked about other design build firms that could provide the service for less money rather than contracting with an architectural firm Commissioner Tony Braswell spoke on the amount of due diligence and environmental assessments required for this project and stated an architectural firm is necessary to determine if the facilities can even be constructed on the site Commissioner T Braswell expressed his support for proceeding with negotiations with CPL for a contract At the inquiry of Commissioner Godwin , Vice Chairman Harris stated once a firm is selected , contract negotiations still have to take place Vice Chairman Harris stated this would be a 40 – 50 year structure and noted this facility will be more than a warehouse and will benefit the County for many years to come At the inquiry of Chairman RS “ Butch ” Lawter , Jr , County Manager Rick Hester stated staff would be bringing the project back to the Board for approval in phases after the proper due diligence has been completed Mr Hester noted the Detention Center and Public Safety Centers were also approved in phases by the Board of Commissioners Upon a motion by Vice Chairman Patrick E Harris , seconded by Commissioner Tony Braswell , and carried by unanimous vote , the Board approved the selection of CPL as the design firm for the logistics and warehousing facilities project and directed staff to negotiate a contract with the firm , subject to Board approval at a future meeting B Other Board Comments Commissioner Ted G Godwin spoke on the initiative called Operation Greenlight in support of Veterans by displaying green lights during October through Veterans Day and he encouraged everyone to participate At the inquiry of the Board , County Manager Rick Hester noted that most County buildings would be displaying a green light for this initiative Commissioner Godwin also spoke on the annual Veterans Day Celebration to be held this year at Smithfield -
