October 6, 1980 - Regular1 8Fit widthMeeting of Board of Commissioners for the County of JohnstonOctober 6, 1980The Johnston County Board of Commissioners met in regular session Monday, October 6,1980, at 10 oclock am, in the Commissioners Room of the Johnston County Courthouse,Smithfield, North Carolina, with the following members presentNorman C Denning, Chairman, Frank B Holding, Vice Chairman, J E Rogerson, JohnM Booker, DVM, and James W CashMembers Absent NoneThe Chairman called the meeting to order and the following business was transacted1 Public Hearing - Jessica Street J W Langston SubdivisionNorman C Denning, Chairman, called for the petitioners requesting the upgrading andimprovements to meet state minimum standards of Jessica Street in the J W Langston SubdivLPrinceton, N C Chairman Denning asked if there was any opposition to the petition Therebeing no opposition voiced at this Public Hearing, it was requested that Jessica Street beupgraded in accordance with General Statutes 153A-- 1854 and 153A -205 See Page 53 - 1a2 MinutesThe board reviewed the minutes of the September 2 and September 11th board meetingsCommissioner J E Rogerson moved that the minutes of the September 2 and September 11board meetings be approved as recordedCommissioner James W Cash seconded the motion whichwas carried by unanimous vote3 ABC Distribution Net Earnings - to Mental Health CenterZeb Hill, Supervisor, met with the board to discuss the distribution of ABC netearnings to the Mental Health Center for the treatment of alcoholics Mr Hill explained thata local bill enacted in 1965 by the North Carolina Legislature authorized the county boardto spend up to 57o of ABC new profits on an annual basis for the treatment of alcoholicsMr Hill further advised that the ABC Board has been turning over 4,000 a year, asdesignated, to the Mental Health Center and requested that they be authorized to continue inthis same amountAfter discussion, Commissioner Frank B Holding moved to reaffirm and authorize theJohnston County Alcoholic Beverage Control Board to continue to turn over 4,000 of annualnet earnings to the Johnston County Mental Health Center to be used for the education andrehabilitation of alcoholicsCommissioner J E Rogerson seconded the motion which was carried by unanimous vote4 Technical College - Budget AmendmentCommissioner Frank B Holding moved that the unexpended balance of Johnston TechnicalCollege in the amount of 6,94663 be reallocated to the Johnston Technical Colleges 19801981 Budget and further that the following budget amendment bb -rade;From Contingency Fund4099980 6,94663To Johnston Technical College1068389 6,946,63This amount represents the 1979 -80 unexpended budget balanceCommissioner J E Rogerson seconded the motion which was carried by unanimous vote5 Resolution of Appreciation - Henry WhitleyUpon a motion by Commissioner James W Cash, duly seconded by Commissioner Frank BHolding and carried unanimously, the following resolution was adoptedDVQnT TrrrnrTWI-EREAS, MR HENRY WHITLEY in 1980 led a movement to establish a new Johnston CountyProduce Market on the Countys property on US Highway 301 between Smithfield and Selma;andWHEREAS, the Commissioners agreed to Mr Whitleys appeal to permit a produce marketto be started on this property; andfI?ffOctober 6, 1980 Continued1 a Reference Page 46NORTH CAROLINAJOBNSTON COUNTYUpon motion of Commissioner James W Cash, seconded by Commissioner Frank B Holding,the following resolution was adopted by the Johnston County Board of CommissionersWHEREAS, the County Board of Commissioners adopted a preliminary resolution givingnotice of intention to assist in the financing of improvements to rural subdivision andresidential streets; andWHEREAS, due notice has been given on the 6th day of October, 1980, at Smithfield,N C, in the Commissioners Room, Johnston County Courthouse, Smithfield, North Carolina,a public hearing would be held on whether the assistance in financing the road improvementshereinafter described shall be made and that -all objections to the legality of the making ofsuch financial assistance are required by law to be made in writing, signed in person or byan attorney, and filed with the Clerk to the Board at or before the time of the publichearing; andWHEREAS, the public hearing has now been held and any objections made concerning thefinancial assistance were consideredNOW, THEREFORE, BE IT RESOLVED by the Johnston County Board of Commissioners1 That the street, streets, road, roads, or rights of way herein set out arewithout paving and the public interest requires that the road be upgraded to meet minimumstate maintenance requirements, or that asphalt paving be made available and that abuttingproperty will be benefitted to the extent of the part of the cost thereof to be assessedagainst the abutting property2 If the local improvements are ordered made by the North Carolina Department ofTransportation, the County of Johnston shall remit to the North Carolina Department ofTransportation the proportion of the cost thereof representing the total local share asrequired by policies of the North Carolina Department of Transportations Secondary RoadCouncil3 That the local improvements to be made on the streets, road, roads, or right ofway set out above are as follows that the road be upgraded to meet minimum state maintenancerequirements by the North Carolina Department of Transportation on Jessica Street, J WLangston Subdivision near the Town of Princeton, North Carolina4 That the proportion of the cost of the improvements to be assessed against theabutting property and the terms of payment will be as provided in the Notice of PublicHearing which was served on the owners of the property to be assessedNORTH CAROLINAJOHNSTON COUNTYUpon motion by Commissioner Funk B Holding, seconded by Commissioner James W Cash,the following resolution was adopted by the Johnston County Board of Commissioners;WHEREAS, the Johnston County Board of Commissioners ordered a public hearing priorto the confirmation of the proposed assessment roll for the paving or upgrading of JessicaStreet, J W Langston Subdivision, near Princeton, N C; andWHEREAS, the Johnston County Board of Commissioners has attached the correctassessment roll hereto and found it to be correctNOW, THEREFORE, BE IT RESOLVED, by the Johnston County Board of Commissioners thatpursuant to N C GS 153 -195, the attached assessment roll is confirmed and that each assessedas of October 6, 1980, and BE IT FURTH RRESOLVED that a copy of this resolution andassessment roll be delivered to the Johnston County Tax Collector for collection and;
