Meeting of Board of Commissioners for County of JohnstonJune 30, 1980The Johnston County Board of Commissioners reconvened in regular sessionMonday, June 30, 1980, at 730 pm, in the Commissioners Room of the JohnstonCounty Courthouse, Smithfield, North Carolina, with the following members presentNorman C Denning, Chairman, Frank B Holding, Vice Chairman, J ERogerson, John M Booker, DVM, and James W CashMembers Absent NoneThe Chairman called the meeting to order and the following business wastransacted1 Transportation Study - Urban Transit Act FundingTravis Payne, Attorney, Legal Services, representing Johnston CountyHuman Services Council, met with the board asking for an appropriation of 1,000to conduct a local feasibility study to determine transportation needs in JohnstonCountyMr Payne explained that federal funds are available through Section XVIIIof the Urban Transit Act, and that county matching funds can be in -kind servicesof available resources provided by county administration, Mr Payne also advisedthe board that 25 of the transportation systems operating cost would have to befunded by the county This system would serve the public regardless of income,those not eligible because of income would be charged a fareThe board discussed this proposal with Mr, Payne, however, took no actionon this request2 Budget Work SessionThe Board of Commissioners continued work on the 1980 --81 Proposed Budgetrequests by departments Sheriff George Johnson asked the board to seriouslyconsider his department so that he can better serve the people of Johnston CountyMr Jackson reviewed theproposed working budget advising that this budgetas presented would require a 730 tax rate, In discussing the Health Departmentrequestthe board tentatively agreed to add 6,420 to the budget for microfilmingpatients recordsThe board again discussed and considered theSchool budget, reviewing thesalary line item request at length, and asked Kramer Jackson, County Administrator,to meet with the new superintendent and Glenn Wiggs, School Finance Officer, todetermine total salaries and total supplements requested for school teachers,and also to come to an understanding on the Special and Vocational tax levyIn discussing the hospital budget the board agreed that a new computerlease contract for the hospital would not be funded in the 1980 -81 Fiscal YearBudget The board asked Mr Jackson to advise the hospital administrator of thisactionIn further discussion of the 1980 -81 Budget requests the board againconsidered each departments request at length After discussion of the requestfor transportation, the board tentatively agreed to fund transportation budgetsfor the Council on Aging, Johnston County Industries, and Mental Health CenterIn further discussion and consideration, the board made no changes3 Contract - Legal Services - Social Services - IV -DUpon a motion by Commissioner Frank B Holding, duly seconded byCommissioner James W Cash, and carried by unanimous vote, the following contractwas approved and the Chairman authorized to execute same;STATE OF NORTH CAROLINACOUNTY OF JOHNSTONCONTRACT OF EMPLOYMENTTHIS CONTRACT made and entered into this the first day of July, 1980,by and between the Johnston County Commissioners, party of the first part, andW A Holland, Jr, Attorney, party of the second part;f11THAT WHEREAS,the second part asfollowing termsJune 30th ContinuedW I T N E S S E T Hthe party of the first part desires to employ said party ofits counselor at law for the County of Johnston upon the1 ? i1 This Contract shall begin on the first day of July, 1980, and shallexist and continue until the last day of June, 1981, unless sooner terminatedupon thirty 30 days notice of either party2 Said party of the second part, upon reasonable notice, is to be availablefor consultation, legal advice and representation on all legal matters arisingfrom the duties of the party of the first part under sections 128 through 140 ofChapter 110 of the North Carolina General Statutes and United States Public Law93 -647 and the federal regulations lawfully promulgated pursuant thereto3 Said party of the second part agrees to comply with all the requirementsof sections 128 through 140 of chapter 110 of the North Carolina General StatutesUnited States Public Law 93 -647, and the regulations promulgated pursuant theretorelating to the performance of program legal services including, but not limitedto, maintaining such records as are required by the party of the first part, tomake said records available for federal or state audit if required, and to makefinancial, statistical, and program progress reports as are required4 For his services under this contract, the party of the first part agrees topay the party of the second part Forty In Court dollars 4000 Twenty -five2500 per hour for each hour spent by the party of the second part providinglegal services under the Child Support Enforcement Program, Such hourly rateshall encompass all expenses, including but not limited to, those for salary,supplies, office space, heating and maintenance for office space, telephoneservices, long distance telephone calls, and travel The party of the secondpart is not to be reimbursed for any extraordinary expenses incident to performingthe services included under this agreement; except, that the party of the firstpart agrees to pay all court costs and filing fees which are required to be paidin conjunction with services provided by the attorney under this agreementIN TESTIMONY WHEREOF, said parties have executed this contract in triplicateoriginals, one of which is to be retained by the party of the first part, oneof which is to be retained by the party of the second part, and one of which is tobe filed with the Child Support Enforcement Section, Division of Social Servicesof the Department of Human Resources, Raleigh, North Carolina,By W A Holland, JrATTORNEYBy Norman C, Denning4 Mental Health - Interim Budget - ApprovedCommissioner James W, Cash moved that the Mental Health Interim Budget forthe period July 1, 1980 to June 30, 1981, be approved,Commissioner John M Booker seconded the motion which was carried byunanimous vote5, Recreation Grant Extension - Glendale Chapel Booster ClubCommissioner John M Booker moved that the Glendale - Chapel Booster Clubbe granted an extension of 90 days for the use of their 1979 -80 Revenue SharingRecreation Grant acct # 7980 -7Commissioner Frank B Holding seconded the motion which was carried byunanimous vote6 Recreation Grant Extension - BentonvilCommissioner John M Booker moved thatgranted an extension of 90 days for the useRecreation Grant acct # 7980 -17Commissioner Frank B Holding secondedunanimous voteLe Recreation Councilthe Bentonville Recreation Council beof their 1979 -80 Revenue Sharingthe motion which was carried byUpon a motion by Commissioner John M Booker, duly seconded by CommissionerFrank B Holding and carried by unanimous vote, the board recessed to meet againWednesday, July 2, 1980, at 730 pm, to continue work on the 1980 -81 ProposedBudget J 4?
