January 7, 1980 - Regular1 6Fit width41Meeting of Board of Commissioners for the County of JohnstonJanuary 7,1980The Johnston County Board of Commissioners met in regular session Monday,January 7, 1980, at 10 oclock am, in the Commissioners Room of the JohnstonCounty Courthouse, Smithfield, North Carolina, with the following members presentNorman C Denning, Chairman, Frank B, Holding, Vice Chairman, J ERogerson, John M, Booker, DVM, and James W CashMembers Absent NoneThe Chairman called the meeting to order and the following business wastransacted1 MinutesThe Board of Commissioners reviewed the minutes of the December 3, 1979,board meetingCommissioner James W Cash moved that the minutes of the December 3, 1979,board meeting be approved as recorded,Commissioner J, E Rogerson seconded the motion which was carried byunanimous vote2 Veterans-Pro? ram - Johnston Technical InstituteDr John Tart, President, Johnston Technical Institute, met with the boardexplaining that the Technical Institute needs and is seeking a person to work infinancial aid Dr Tart told the board that many of their students receivingfinancial aid are veterans and a qualified person is needed to administer theseclaims Dr Tart also advised he had received many applications, however, the mostqualified applicant was Mrs Marie Creech, Dr, Tart requested that Marie Creech,employee in the County Veterans Office, be transferred to Johnston TechnicalInstitute and further that Mrs, Creechs salary for the remainder of this fiscalyear go with her,After much discussion, Commissioner J, E, Rogerson moved that Dr Tartsrequest be granted; that Marie Creech be transferred to the Technical Instituteand that her salary go with her for the remainder of this fiscal yearCommissioner James W Cash seconded the motion which was carried by unanimousvote,3 Timber Easement - Union PacificKramer Jackson, County Administrator, advised thad received the bid to remove the timber from Southand that an easement had been drawn by attorneys andMr Jackson stated that the committee had met and itCorporation will be liable for any damages caused bytherefore, no bond is being requirediat Union Pacific CorporationSmithfield Wellons Propertyapproved by the County Attornwas agreed that Union Pacificthis loggingoperation and,After discussion, and upon motion by Commissioner Frank B Holding, dulyseconded by Commissioner James W Cash and carried by unanimous vote, Norman CDenning, Chairman, was authorized to execute the following easementNORTH CAROLINAJOHNSTON COUNTY EASEMENTTHIS EASEMENT, made this 7th day of January, 1980, by and among the Town ofSmithfield and the County of Johnston, parties of the first part; and Georgia -Pacific Corporation, a corporation doing business in North Carolina with an officein Dudley, North Carolina, party of the second part;WITNESSETHThat the Town of Smithfield is the owner of these two certain tracts of landon the east side of the Neuse River as shown on a map attached as EXHIBIT A to thetimber deed filed of record in Book , Page , Johnston CountyRegistry, from Nell Wellons, et als, to Georgia Pacific Corporation; that theCounty of Johnston is the owner of a certain tract of land on the east side ofthe Neuse River on which is located the Johnston County Wastewater Treatment Plant,as shown on the map attached as EXHIBIT A to the aforesaid timber deed; that thereis an existing path or road as shown by a heavy broken line on said map whichtraverses the lands of the parties of the first part in a generally North -Southdirection and which provides access from Huntley Street to the westernmost portionof the Mattie W Kiracofe tract described in the deed of record in Book 388, page327, Johnston County Registry;That Mattie W Kiracofe, Emma W Broome, and Nell Wellons, all owningcontiguous tracts, have sold and conveyed to Georgia - Pacific Corporation the rightto cut and remove all merchantable timber from those tracts which the own andwhich are shown on the aforesaid map; that Georgia- Pacific desires to use ther1January 7, 1980 Contsaid path or road for access from Huntley Street to and from the Kiracofe tractsand the contiguous tracts for the purpose of removing timber;That the Town of Smithfield and the County of Johnston have agreed to grantsuch access to Georgia- Pacific Corporation subject to the terms and conditionshereinafter set out;NOW, THEREFORE, in consideration of the sum of 10,00 and other valuableconsiderations in hand paid, the receipt of which is hereby acknowledged, theTown of Smithfield, the County of Johnston and Georgia - Pacific Corporation herebyagree as followsA That the Town of Smithfield and the County of Johnston do this dayand by this instrument grant unto Georgia- Pacific Corporation the right of ingressand egress over and along and across the existing path or road on the aforesaidland owned by the parties of the first part, as aforesaid, for the purpose ofremoving the timber located on the lands of Nell Wellons, Emma W Broome andMattie W Kiracofe;B That it is agreed by Georgia - Pacific Corporation that Georgia- PacificCorporation will confine all its traffic and logging operations to the existingroad that begins at Huntley Street and crosses the lands of the parties of thefirst part to the westernmost boundary of the lands of Mattie W Kiracofe, andthat this access easement applies only to the said road;C That it is further agreed by Georgia- Pacific Corporation that it willbe responsible for its logging contractors maintaining the access road passibleby conventional drive vehicles at all times with the exception of interruptionscaused by flooding of the river and will grade and stabilize the access road withborrow materials or stone as may be required to leave it in passible conditionupon completion of logging operationsD That it is further agreed that Georgia- Pacific Corporation will haveits logging contractor stay clear of all construction operations which may be inprogress by the County of Johnston on or around its Wastewater Treatment Plantsite and will have the logging contractor yield to any ongoing constructionoperations, such as earth moving, materials handling, grading and grassing;E That it is further agreed that Georgia- Pacific Corporation will holdharmless the Town of Smithfield and the County of Johnston for any damage toTown property or to Town facilities or County property or County facilities doneby Georgia - Pacific Corporation or by its logging contractor;
