Previous page1 7Fit width1?Meeting of Board of Commissioners for the County of JohnstonAugust 4, 1980The Johnston County Board of Commissioners met in regular sessionMonday, August 4, 1980, at 10 oclock am, in the Commissioners Room of theJohnston County Courthouse, Smithfield, North Carolina, with the followingmembers presentNorman C Denning, Chairman, Frank B Holding, Vice Chairman, J ERogerson, John M Booker, DVM, and James W CashMembers Absent NoneThe Chairman called the meeting to order and the following businesswas transacted1 MinutesThe board reviewed the minutes of the June 30th, July 2nd, and July7th board meetingsCommissioner James W Cash moved that the minutes of the June 30,July 2nd, and July 7th board meetings be approved as recordedCommissioner J E Rogerson seconded the motion which was carried byunanimous vote2 Easement - Carolina Power and Light - Pine Level Equalization StationCommissioner John M Booker moved that the following right -of -wayeasement be granted to Carolina Power and Light Company to service the PineLevel Equalization Station;STATE OF NORTH CAROLINACOUNTY OF JOHNSTONKNOW ALL MEN`BY THESE PRESENTS, that Johnston County, a body politicand corporate,hereinafter called Grantor , in consideration of the sum of100, in hand paid by CAROLINA POWER AND LIGHT COMPANY, the receipt whereofis hereby acknowledged, hereby grants unto said CAROLINA POWER AND LIGHTCOMPANY, hereinafter called Company , its successors and assigns, the right,privilege and easement to go in and upon that certain tract orlot of landsituated in Pine Level Township in said County and State, containing 63 acres,more or less, being the land described in a deed from Polly P Oliver, et al,to Johnston County, dated December 15, 1978, and recorded in Book 847, page794, Johnston County Registry, and to construct, maintain, and operate over,under, and across said premises a line consisting of poles, wires, cables,underground conduits, and other pertinent facilities within a strip or areaof said land thirty 30 feet wide for the purpose of transmitting electricity,with the right to do all things necessary or convenient thereto, including,but not being limited to, the right a to permit the attachment of wires,cables, and conduits of any other company or person; b to enter said stripat all times over the adjacent land to inspect, repair, maintain, and altersaid line; c to keep said strip cleared of trees, undergrowth, and structures;d to trim limbs from, and cut down, any tree outside of said strip which may,in the opinion of the Company, endanger the line or hinder the maintenance,operation, and use of the same The center line of said strip shall be thecenter line of the poles or structures which support said electric lineTO HAVE AND TO HOLD the aforesaid right, privilege and easement untoCarolina Power Light Company, its successors and assigns, foreverCommissioner J E Rogerson seconded the motion which was carried byunanimous vote3 Budget Amendment - Stricklands Crossroads Fire TaxCommissioner J E Rogerson moved that the 1980 -1981 Budget Ordinancebe amended to reduce the Stricklands Crossroads Rural Fire District taxassessment rate from 8? to 60Commissioner John M Booker seconded the motion which was carried byunanimous voteUpon a motion by Commissioner John M Booker, duly seconded byCommissioner James W Cash and carried by unanimous vote, the board instructedKramer Jackson, County Administrator, to advise each Fire District Commissionof its responsibility to adopt a tax rate each fiscal year and to advise theCounty Administrator of this action1rINAugust 4, 1980 ContinuedWHEREAS, the County of Johnston shall then cause the proportion ofthe cost thereof to be specially assessed and the terms of payment will be asfollowsa The cost of not exceeding the local share of cost as required bypolicies of the North Carolina Department of Transportations Secondary RoadsCouncil for asphalt paving as lie within the streets, roads, or rights of way,hereinabove proposed to be improved, will be assessed against the propertyabutting on the streets, or roads, or rights of way, such cost to be assessedagainst the lots and tracts of land abutting on the streets, roads, or rightsof way, according to their respective frontages thereon by an equal rate perfoot of such frontageb Terms of Payment The assessments will be payable in Hires equalinstallments, which installments will bear interest at the rate of eight percent 8 per annum from the date of confirmation of the assessment roll;provided that any such assessment may be paid in full in cash without theaddition of interest within thirty 30 days from the date of publication ofthe notice of the confirmation of the assessment rollNOW, THEREFORE, BE IT RESOLVED a That a public hearing will beheld by the Johnston County Board of Commissioners at Smithfield, North Carolinaon September 2, 1980, at 2 30 pm, in the Commissioners Room in the JohnstonCounty Courthouse, Smithfield, North Carolina, to determine finally whether theassistance in financing the road improvements shall be madeb That all objections to the legality of the making of the improve-ments shall be made in writing, signed in person or by an attorney, and filedwith the Clerk to the Board at or before the time of the public hearing Anysuch objections not so made will be waivedUpon a motion by Commissioner John M Booker, duly seconded byCommissioner Frank B Holding, and carried by unanimous vote, the board recesseduntil Tuesday, August 12, 1980, at 630 pm, to meet with the Hospital Boardof Trustees at Johnston Memorial Hospital, Smithfield, North CarolinaNorman C Denning, ChairmanEleanor N Creech, Clerk to the Board81880
