6September 4; 1979The Johnston County Board of Commissioners met in regular session Tuesday,September 4, 1979, in the Commissioners Room of the Johnston County Courthouse,Smithfield, North Carolina, at 1020 am, with the following members presentNorman C Denning, Chairman, Frank B Holding, Vice Chairman, J E Rogerson,John M Booker, DVM, and James W CashMembers Absent NoneThe Chairman called the meeting to order and the following business wastransacted1 Tax Complaint - D W WatkinsMr D W Watkins of Micro met with the board regarding his 1979 taxes inthe amount of 7676 Mr Watkins advised the board that his 1979 tax bill wastwice what it was in 1978 Mr Watkins told the board that he and his wife livedon a very limited income, that he was disabled and blind and asked the Board ofCommissioners for consideration of some relief on his 1979 taxesThe board explained t,land had increased in valuefurther that they could notDenning advised Mr WatkinsEqualization and Review andcould review his complaintD Mindotoatr Watkins that most property and especially farm1979 because of the property revaluation, andanything at this time about his tax bill Chairmancome back in the spring and meet with the Board ofthat time the Board of Equalization and Review2 Subdivision - J W LangstonJ W Langston and Wayne Starling met with the board asking the county tofinance the building of streets in the J W Langston Subdivision located east ofPrinceton between Hwy 70 and SecondaryRoad # 2371 in accordance with N C GeneralStatute 153A -205 Under this law, Mr Starling explained, the county may financethe building of streets in a subdivision and assess the property owners if 75 ofthe property owners make a request by signed petition Mr Langston advised thatthe area eligible for secondary road maintenance would cost approximately 7,700There are six dwellings that would have access to the street and these six familiesare willing to pay their share for getting the street built Mr Starling furtheradvised the board there are two property owners that have indicated they are notwilling to pay their shareRick Cannity, County Planner, informed the board this situation can continueunder the present county subdivision regulations and Paul Anderson, DistrictHighway Engineer, stated there are a number of subdivisions in the same situationThe board discussed this matter at length with Mr Langston and Mr Starlingand advised they would take it under advisement3 Airport Grant - ResolutionA motion was made by Commissioner James W Cash and seconded by CommissionerFrank B Holding for the adoption of the following resolution, and upon being putto a vote was duly adoptedRESOLUTIONTHAT WHEREAS, the County of Johnston hereinafter referred to as Sponsor has made a formal application to the Department of Transportation hereinafterreferred to as Department for State financial aid for Johnston County Airport;andWHEREAS a grant in the maximum amount of 72,00000 has been approved;NOW THEREFORE, BE AND IT IS HEREBY RESOLVED that the Chairman of the Sponsorbe and he hereby is authorized and empowered to enter into a Grant Agreement withthe Department as may be necessary to effectuate the aforesaid expressed purpose,thereby binding the Sponsor to the fulfillment of its obligation incurred underthis resolution and to its agreement under the said Grant Agreement with theDepartment4 Water Problem - Town of PrincetonMilton Toler, Commissioner, Town of Princeton, along with A C Edwards,Mayor, met with the board and advised they needed another ground well in order tohave an ample water supply for the Town of Princeton Mr Toler further requestedfinancial assistance from the county to help dig this well614September 4, 1979 ContKramer Jackson, County Administrator, told the board that the engineers,Princeton town officials, along with himself met with Congressman Whitley to tryand find grants for the Town of Princeton, however, they had not been able to findany so farThe board q- ,estioned Mr Toler with regards to a water supply for,thetown from the Nellofg @?ervoir Mr Toler told the board there was a supply ofwater, but the cost would be approximately the same as it would be to hook on tothe Smithfield water supply Mr Toler also told the board it would cost about30,000 to dig a ground well and they needed another well until such time as theycan get something more permanentiThe board informed Mr Toler and the Mayor they would take this requestunder advisement5 New Employee - Extension ServiceBruce Woodard, Chairman, Johnston County Extension Service, met with theboard and introduced Dale Wells, who joined--- the County Extension staff on August7, 1979IThe board welcomed Mrs Wells to Johnston County and as a new employee6 Howard Gower Property AirportHoward Gower again met with the Board of Commissioners regarding damagesto his property located on the north side of Highway 70 Mr, Gower contends thathis property is in line with the airport traffic and the low flying aircraft willcause damages to this property Mr Gower is planning to subdivide this propertyand the subdivision has been restricted by previous agreement with Mr, Gower,- -the County Planning Board and the Airport Authority, The restriction states thatno structure is to be built over 50 feet highbecause of low flying airplanesJimmy Flowers, Chairman, Johnston County Airport Authority, andNorman Grantham, `Chairman, Johnston County Planning Board, were also present and indicated that MrGower had agreed earlier to this restriction, However, the Planning Board had nochoice but to approve the subdivision as it meets all the requirements for aresidential subdivision with or without the restriction Mr Gower advised that hhad changed his mind and did object to the restriction on the subdivision platW R Britt, County Attorney, told the board that the State and FederalAuthorities had not required an easement from Mr Gower and in his opinion thisproperty has not been damaged Mr Britt continued actual damages are the only,damages the law will allow the county to compensate for and the county, by law,is not liable for speculated damages This matter was discussed at length and a suggestion made to do away withthe restriction on the subdivision plat, however, the board took no further actionat this time7 SubdivisionsUpon the recommendation of Rick Cannity, County Planner, CommissionerJ E Rogerson moved that the Kenneth Aycock and Billy Moore Subdivision inBeulah Township, 16 lots be approvedCommissioner James W Cash seconded the motion which was carriedunanimouslyb Upon the recommendation of Rick Cannity, County Planner, CommissionerJames W Cash moved that the Buddy McLamb Subdivision in Clayton Township, 12 lotsbe approvedCommissioner Frank B Holding seconded the motion which was carriedunanimouslyc Upon the recommendation of Rick Cannity, County Planner, CommissionerFrank B Holding moved that the James Ellerbe Subdivision, Clayton Township, 6lots, be approvedCommissioner J E Rogerson seconded the motion which was carriedunanimouslyd Upon the recommendation of Rick Cannit y, County Planner , Commissioner?Frank B Holding moved that the C L Byrd Subdivision, Garner Estates, sectionfour be approvedCommissioner James W Cash seconded the motion which was carriediunanimouslySeptember 4, 1979e Upon the recommendation of Rick Cannity, County Planner, CommissionerFrank B Holding moved that the subdivision off 96 Larry and Lynn Stallings 13lots be approved,Commissioner James W Cash seconded the motion which was carriedunanimouslyMr Cannity also talked w th the board briefly about proposed subdivisionchanges and a new Permit Fee Schedule, The board took this matter under advisement8 Social Services New PositionsBen Niblock, Director, Johnston County Department of Social Services, metwith the board requesting two new positions for the Department of Social Serviceseffective October 1, 1979 Mr Niblock explained that Annette Abdalla and RobbieBeasley are CETA employees, and in positions that will terminate,on the CETAProgram September 30, 1979 Mr Niblock also explained these two positions can befunded without any additional-appropriation from the countyAfter discussion, Commissioner James W Cash moved that these two positionsbe approvedCommissionerFrank B Holding seconded the motion which was carriedunanimously9 MinutesCommissioner John M Booker moved that the minutes of the August 6, 1979,board meeting be approved as recordedCommissioner J E Rogerson seconded the motion which was carriedunanimously10 ReportsThe following reports were filed with the boardDog Warden, Electrical Inspector, Veterans Service Office, Tax Collector,Revenue Sharing Recreation Account, Financial Report - Five Year Comparison,1975 -1979, Johnston County Budget - Expenditures and Revenues11 Recreation Grant Extension 1978 -79 - Town of KenlyAs per request, Commissioner J E Rogerson moved that the Town of Kenlybe granted a ninety 90 day extension on the use of their 1978 -79 Revenue SharingRecreation GrantCommissioner Frank B Holding seconded the motion which was carriedunanimously12 Container Contract - LandfillafterPursuant to G S 143 -129 and due advertisement bids were received andopened and reviewed by Kramer Jackson and Rick Cannity, County Planner, for four4 40 cubic yards containers for the Johnston County Landfill, Upon therecommendation of Kramer Jackson, County Administrator, Commissioner Frank BHolding moved that Waste Industries, Incorporated, Raleigh, N C, low bidder, beawarded the contract to furnish the county with four 4 40 cubic yard containersas per bid price of 11,096Commissioner J E Rogerson seconded the motion which was carriedunanimously13 Leave of Absence Bonnie Murphy - Tax Listing OfficeCommissioner James W Cash moved that a two month medical Leave of Absenceeffective September 4, 1979, be granted to Bonnie Murphy, employee in the TaxLising OfficeCommissioner Frank B Holding seconded the motion which was carriedunanimously14 Health Department - New PositionCommissioner J E Rogerson moved that a new Clerk- Typist position beapproved at the Health Department provided that this position will be funded bythe State 100 Commissioner Frank B Holding seconded the motion which was carriedunanimouslySeptember 4, 197915 Property - County Owned SelmaKramer Jackson, County Administrator, explained to the board that thecounty owned by foreclosure in 1962 two lots and a house located on the cornerof Sellers and Richardson Streets in the Town of Selma, and that this propertyneeds to be sold Mr Jackson further advised the board that assessments forpaving and back taxes are against this property The house is occupied by MrsHelen Bradley and her son -in -law has offered to pay off the assessments againstthe property for Mrs BradleyThe board discussed this matter at length and asked Mr Jackson to makea detail investigation and report back to the board at the next meeting16 Technical Institute Request 1978 -79 Funds to be ReallocatedKramer Jackson, County Administrator, advised the board that the TechnicalInstitute was requesting that 1978 -79 surplus funds in the amount of 31,86517 bereallocated to the Technical Institute as followsa_ 4,000 to install a suspended ceiling in Commercial Arts Buildingb 6,000 to fix roof on gym at Four Oaks campusc 2,000 to miscellaneous capital outlayd 19,86517 investment account for future construction projectCommissioner Frank B Holding moved that the 1978 -79 surplus funds in theamount of 31,86517 be reallocated to the 1979 -80 Johnston Technical InstituteBudget as requested and stated aboveCommissioner J E Rogerson seconded the motion which was carriedunanimously17 Rescue Squad - Base StationCommissioner J E Rogerson moved that 3,016 be appropriated for thepurchase of a base station for the Johnston County Rescue SquadsCommissioner James W Cash seconded the motion which was carriedunanimously18 Agricultural Extension Service - TravelCommissioner Frank B Holding moved that 650 be appropriated to theAgricultural Extension Service Budget for travel for H F Palmer to go to SouthDakota to receive a National AwardCommissioner John M Booker seconded the motion which was carriedunanimously19 School Budget RevisionCommissioner James W Cash moved that the request of the Johnston CountyBoard of Education to transfer 572,58890 from School Current Expenses to SchoolCapital Outlay to remove the deficit shown on the cash card for Capital Outlay beapprovedCommissioner J E Rogerson seconded the motion which wascarriedunanimously20 ABC Board - Radio Offered to CountAfter discussion, the board agreed to purchase a mobile radio unit fromthe Johnston County ABC Board and instructed Kramer Jackson to appropriate 800in the proper account 1051075 for this expenditure Budget amendment from4007490 to 1051075 80021 Recreation Grants - Town of SmithfieldKramer Jackson, County Administrator, told the board he had been advisedby Tim Broome, Engineer, that the Smithfield Water Plant needed a back -up pumpin the event the existing pumps break down After discussion, Commissioner FrankB Holding moved that 30,000 be appropriated for a backup water pump for theSmithfield Water Plant with ownership of the pump to be retained by the countyCommissioner James W Cash seconded the motion which was carriedunanimously23 Town of Princeton - Funds for WellAfter discussion and review, Commissioner J E Rogerson moved that 16,500approximately one -half of the cost be appropriated to help the Town of Princetondig a ground well for additional water supplyCommissioner James W Cash seconded the motion which was carriedunanimously24 Other BusinessMr Jackson advised the board that problems still exist with the heatingand air conditioning unit at the Agricultural Building and this situation will soonhave to be dealt withMr Jackson also reminded the board that appointments will be coming upto the Hospital Board and Mental Health Area BoardAt this time, the Chairman announced that the Board of Commissioners wouldmeet in Executive Session with Harper Godwin, Tax Collector, to discuss a personnelproblem Commissioner John M Booker excused himself and left the CommissionersRoomAfter about forty -five minutes of executive session with Harper Godwin,Tax Collector, Commissioner Frank B Holding moved the meeting be adjournedCommissioner James W Cash seconded the motion which was carriedunanimously,P A, a- 4 -
