W S KetchensJohnnie Stott, Tax Supervisor, explained that property of W S KetchensRoute # 1, Angier, N C, had been double listed and paid by both listings forthe years 1979, 1980, 1981, and this property owner has requested a refund Thetax supervisor recommended that this request be grantedCommissioner Howard Benton moved that W S Ketchens be refunded in theamount due on property that has been double listed and paidCommissioner John M Booker seconded the motion which was carried5 Afterlist ReportThe tax supervisor filed an afterlistreport for the month of November,1981, and also reported that the county was losing tax revenue on automobilesnot listed6 Triangle J Council of Governments - MembershipAt the request of the board, Bradley Barker, Executive Director, andRobert Heater, Chairman, Triangle J Council of Governments, along with otherstaff members met with the Board of Commissioners to again discuss membershipand proposed administrative charges for Johnston County as a non - memberThe board had asked the manager to contact Triangle J in reference toadministration of the Aging Programs in Johnston County and the proposed chargesfor these services The board had been made aware that the administrative costwould be greater than the countys annual membership dues Chairman Heaterexplained the services rendered for the counties and towns through Triangle JCouncil of Governments He also explained the method of computing charges foradministration of programs for an isolated unit within the region JohnstonCountys share of the cost for administering the Aging Programs as a non- memberwould be approximately 29,247, as computed to 23;474 for membership ChairmanHeater further emphasized there could be additional charges for programs suchas Emergency Medical Services, and other projects funded through Triangle JThe board found it difficult to understand why it cost more to administethese programs for an isolated unit, and could not seem to find justificationfor membership dues in the amount of 23,474David Moser, Director of Aging Programs, explained that it was hard toput dollars marks on general assistance, training, coordination and training inaging centers and aging programs, and technical assistance to directorsThe board learned that Triangle J has an annual payroll of approximately550,000 and an annual budget of some over 3 million dollarsBrad Barker commented that the Council of Governments is a serviceorganization that does a reasonably good job with a very dedicated staffThe board thanked Chairman Heater and Mr Barker for coming to JohnstonCounty to help the board better understand the administration of programs bythe Council of Governments,Pat Cunningham, Director, Johnston County Council on Aging, present atthis time, expressed concern for the on- -going aging programs in the county astheir present contract expires as of December 31, 1981, under the non- membershipstatusThe board took no action at this time pending further discussion andconsideration184December 7th Continued7 Sasser Property DamagesThe manager advised the board that Mrs L H Sasser had again calledcomplaining about damage to her property building on Johnston Street MrsSasser contended that the deteriorated condition of her building was caused byleaves and pecans from the trees on county property and that she had replacedthe roof approximately four years ago Mrs Sasser has requested compensationfrom the county to repair all damages The manager told the board that thebuilding was in bad shape due to age and that the pecan trees may have causedsome damageThe board discussed this matter recalling that the trees on countyproperty have been trimmed very closely and felt•no additional liability inthis matter8 Child Restraint Distribution ProgramMr Jackson addressed the board with a request from Katrina McDaniel,Coordinator, Johnston County Early Childhood Intervention Program, asking thatJohnston County be the sponsoring agent to receive three infant safety seatsfrom the State of North Carolina, Governors Highway Safety ProgramThe manager explained that the Early Childhood Intervention Programwould handle the loan of the seats to parents of infants He further explainedthat the primary purpose in this request coming before the board was that thecounty must request the seatsfrom the StateThe board related that this request had been presented to the boardbefore and at that time there was much concern regarding the countys liabilityshould a child be injured while riding in a loaned safety seat, and further thiswas still their main concern The board rejected this proposal at this time9 Reorganization of the Board of CommissionersAt this time the Chairman turned the meeting over to the Clerk forthe nomination and election of a ChairmanThe clerk called for nominationsfor Chairman of the BoardCommissioner Frank B Holding nominated and moved that Norman CDenning be elected Chairman of the Board of County CommissionersCommissioner Howard Benton seconded the motion There being no othernominations, Norman C Denning was elected Chairman by unanimous voteThe Clerk turned the meeting back to the ChairmanThe Chairman called for nominations for Vice ChairmanCommissioner Howard Benton nominated and moved that Frank B Holdingbe elected as Vice Chairman of the Board of County CommissionersCommissioner James WCash seconded the motion There being no othernominations Frank B Holding was elected Vice Chairman by unanimous voteIIIivAppointments by the Chairman to AgenciesFrank B Holding Industrial CoordinatorJohn M Booker Mental Health Board; Rescue SquadsJames W Cash Social Services Board; Hospital Board;Triangle J Council of Governments;Designation of person to Community ActionBoardHoward Benton Council on Aging; Capital Health SystemsAgency; Designation of person toCommunity Action BoardNorman C Denning Health Department Board; Fire Departments10 Procurement Procedures - Social ServicesCommissioner James W Cash moved that the following budget amendmentbe approvedRevenuesExpendituresCrisis Interventi,Low Income EnergyPermancy PlanningIncrease 1035001 33,99200Increase 12,56000IncreaseDn Allocation 12,560001035001 32,128001035001 1,86400Revenues Decrease 15,08100Expenditures DecreaseTitle XX Allocation 15,0810016 Domiciliary Home Advisory CommitteeThe manager explained that an act to create a Domiciliary HomeResidence Bill of Rights was ratified by the 1981 session of the North CarolinaGeneral Assembly The manager explained that a domiciliary home means anyfacility which provides residential care for aged or disable persons, and thebill encourages counties to establish a Do iciliary Home Community AdvisoryCommittee The manager furnished a ;copy of the ratified bill for the boardsinformation¦December 7th ContinuedAfter discussion ,of the bills purposes and requirements, CommissionerHoward Benton moved that the Domiciliary Home Advisory Committee be comprisedof the same members as the Nursing Home Community Advisory Committee as thebill allows, as follows; Worley Earp, Thelma Pearson, Jean Adams, Lacy RuthCoates and Mildred Strickland, and further that these terms run concurrentlywith their terms on the Nursing Home Community Advisory CommitteeCommissioner James W Cash seconded the motion which was carried17 Water Offered to County by Harnett CountyMr H M Brock, Manager, Harnett County, advised that Harnett Countywas willing to sell water to Johnston County at a price of 935 cents per 1000gallons with requirements that Johnston County purchase 750,000 gallons per dayThe county manager stated that Harnett County was eager to proceed with thisprojectThe board asked the manager,to communicate with Mr Brock telling himthat Johnston County was not ready at this time to make a determination on theHarnett County offer However, they would like to keep the offer underconsideration until the county was in a position to make a decision18 Diversified Fuels, IncThe manager advised the board that Diversified Fuels, Inc, has appliedfor approval to construct,,and operate a proposed fuel grade alcohol productionplant near Selmaand; that State regulations require a publication of publicnotice and that the Board of County Commissioners be informed of the projectThe county manager stated that the board is hereby notified and given anopportunity to comment19 Moccasin Creek Drainage District - Maintenance ReportGordon Peedin, Chairman, Moccasin Creek Drainage District, and BillHarrell, Supervisor, Johnston Water and Soil Conservation District, presenteda slide presentation on the Moccasin Creek Drainage District Maintenance to theboard for information20 Hesco - IndustrialAccess RoadThe manager reported that he had learned that the State would bewilling to participate in the paving of the Hesco road # 1914 in the amountof 1100 feet, and the county would have to relinquish county secondary roadfunds to pave the remaining 750 feet It will cost approximately 45,000 topave this road The states share being 26,550 and the countys share being18,450The board talked with Paul Anderson, District Engineer, about thepaving of this road in order to better serve the new plant to be constructedby HescoAfter discussion, Commissioner Frank B Holding moved to allow theapproximate750 feet from railroad to plant driveway of secondary road #1914 to be paved with funds allocated to the countys Secondary Road ConstructioFund predicated on Hesco awarding a contract to build a plantCommissioner Howard Benton seconded the motion which was carried21 Jail - Second Means of EgressCommissioner Howard Benton moved that Harry McGee, Architect, beauthorized to advertise for bids to construct the fire escape stairwell fromthe county jailCommissioner James W Cash seconded the motion which was carried22 Resolution M J OliverWhereas, M J Oliver on January 22, 1982, will have served twenty -fouryears as Secretary- Treasurer of the Johnston County Volunteer FiremenAssociation;Whereas, Mr Oliver has also served as Chief of the Brogden FireDepartment and as County Fire Marshall for a number of years;IIi1December 7th ContinuedWhereas, Mr Oliver plans to retire as Secretary- Treasurer of theJohnston County Volunteer Firemen Association and as Chief of the Brogden FireDepartment, but he has agreed to continue serving as County Fire Marshall;Whereas, his knowledge and skill in fire fighting have enabled him tobecome a true professional in this field;Whereas, he has rendered long and devoted time to his duties in serviceto the Brogden Fire Department, the Johnston County Volunteer Firemen Associatioand the peopleof Johnston County, all of which deserves high commendation;NOW, THEREFORE, THE BOARD OF COMMISSIONERS extends great thanks to MrOliver for his outstanding service as Chief of the Brogden Fire Department andas Secretary- Treasurer of the Johnston County Volunteer Firemen Association andcommends him highly The Board also thanks Mr Oliver for his excellent serviceto the people of Johnston County as County Fire MarshalTHIS RESOLUTION was introduced by Commissioner Frank B Holding, secoby Commissioner Howard Benton, and carried unanimously23 Appointment - Johnston County Industrial Facilities and PollutionControl Financing AuthorityThe manager advised the board that Ralph Canady, Jr, of Four Oaks hadresigned from the Industrial Facilities and Pollution Control Financing AuthoritCommissioner Frank B Holding moved that Ayden R Lee, Jr, Route # 1,Clayton, N C, be appointed to the Industrial Facilities and Pollution ControlFinancing Authority to fill the unexpired term of Ralph Canady, Jr This termexpiring August 1, 1983Commissioner Howard Benton seconded the motion which was carried- At this time, Commissioner John M Booker moved that the board go intoexecutive session to discuss personnel mattersCommissioner Frank B Holding seconded the motion which was carriedImmediately the board realized they had another item of business to takecare of, so it was moved and carried that the above motion be rescinded and theboard go back into regular session25 Membership -
