Jessie B RichardsonUpon the recommendation of Harold Blizzard, County Planner, Commissioner HowardBenton moved that the Jessie B Richardson Subdivision plat, Wilders Township, 11 lots, beapproved and the Chairman authorized to execute this platCommissioner James_W Cash seconded the motion which was carried by unanimous vote7 Overall Economic Development Plan - RevisedCommissioner James W Cash moved that the revised Johnston County Overall EconomicDevelopment Plan for the year 1981 -1982 be approved and submitted to the United StatesDepartment of AdministrationCommissioner Howard Benton seconded the motion which was carried by unanimous vote8 Alert Cable TV - Resolution to Extend BoundariesUpon motion of Commissioner Howard Benton seconded by Commissioner James W Cash,the following resolution was adopted by the Johnston County Board of CommissionersWHEREAS, Mr E R Pettis of Alert Cable TV of North Carolina has requested thatAlert Cable TV of North Carolina be allowed to extend its existing cable television operationsin Selma, Smithfield, Four Oaks, not completed, Pine Level, and Clayton, which are presentlyfranchised, into unincorporated areas of Johnston County adjacent to said municipalities asper map hereto attached; in file and;July 7, 1981 ContWHEREAS, the Commissioners have been advised; by Mr Pettis that Alert Cable TV ofNorth Carolina will adhere to a line extension policy of thirty -five 35 homes or twentypetitioning homes per mile of CATV plant for service to areas of Johnston County adjacent`tofranchised municipalities of Alert Cable TV of North Carolina within JohnstonCounty;andWHEREAS, Alert Cable TV of North Carolina understands and agrees that this approvalshall terminate, subject to review and reapproval of the Johnston County Board of Commissioners,if the rights herein given are sold or otherwise transferred or if Alert Cable TV of NorthCarolina and its parent company are sold or merged with any other person, individual, orcorporate; andWHEREAS, Alert Cable TV of North Carolina agrees that any unresolved complaint by asubscriber or would be subscriber in the areas herein covered shall be referred to theCountyAdministrator, and, if said unresolved complaintis not reasonably resolved, said complaintshall be forwarded to the Board of Commissioners of Johnston County, and that any willfulfailure and refusal to take the necessary steps to resolve said complaint shall enable theBoard of Commissioners of Johnston County to terminate this Resolution and cause service byAlert Cable TV of North Carolina to be terminated or other appropriate action to be taken bythe Johnston County Board of Commissioners; andWHEREAS, Alert Cable TV of North Carolina agrees to pay to the County of Johnstonannually, three percent 3 of the gross collections from all regular subscribers of AlertCable TV of North Carolina in the area shown on map attached hereto; in file andWHEREAS; Alert Cable TVof North Carolina agrees and it is the order of the JohnstonCounty Board of Commissioner that this resolution shall be in effect, unless otherwiseterminated as provided above, for a period of fifteen 15 years from date only; andWHEREAS, it is the opinion of the Johnston County Board of Commissioners that it isthe desire of the Johnston County residents in such areas to have cable television; andWHEREAS, the Johnston County Board of Commissioners has the authority to issue rightsfor a cable television operation; andWHEREAS, it is the opinion of the Johnston County Board of Commissioners that becauseof the aforesaid considerations a full franchise proceeding is not warranted at this timeNOW, THEREFORE, BE IT RESOLVED by the Johnston County Board of Commissioners that theJohnston County Board of Commissioners has no objection to Alert Cable TV of North Carolinaextending its existing cable operations into the unincorporated areas of Johnston County asper map attached in file hereto, and that the rights granted by said Board be granted toAlert Cable TV of North Carolina and shall be as specified above and as agreed this date byAlert Cable TV of North Carolina,9 Certificate of Canvass - Hospital Bond Referendum Special ElectionThe Clerk of the Board of Commissioners placed before the Board of Commissionersa Certificate of Canvass of the Johnston County Board of Elections certifying to the Board ofCommissioners the results of the Special Election held in the County of Johnston on June 16,1981, The Certificate was read and consideredCommissioner Frank B Holding moved the adoption of the following resolutionWHEREAS, the Board of Commissioners has considered the Certificate of Canvass of theJohnston County Board of Elections canvassing the referendum held in the County of Johnston onJune 16, 1981, and certifying the results thereof to the Board of Commissioners, and hascanvassed the result of said Special Election; NOW, THEREFORE, BE IT RESOLVED by the Boardof Commissioners of the County of Johnston that it be and hereby is certified and declared thatthe number of voters registered and qualified to vote at said Special Election was 29,215FURTHER RESOLVED, that it be and hereby is certified and declared that the totalnumber of voters who voted YES in answer to the question, SHALL the order authorizing7,500,000 of bonds secured by a pledge of the faith and credit of the County of Johnston topay capital costs of expanding and improving Johnston Memorial Hospital, including theconstruction and installation of furnishings, equipment and machinery required therefor, anda tax to be levied for the payment thereof be approved , was 2,484 The total number of voterswho voted NO in answer to such question was 2,180,FURTHER RESOLVED, that a statement substantially in the form hereinafter set forthdeclaring the result of said election shall be prepared, delivered to the Clerk of the Boardof Commissioners for filing and recordation and published in accordance with lawiL?117July 7, 1981 ContSTATEMENT OF RESULT OF SPECIAL ELECTIONHELD IN THE COUNTY OF JOHNSTONJUNE 16, 1981WHEREAS, by direction of the Board of Commissioners of the County of Johnston, inthe State of North Carolina, -a special election was duly called and held in said County onJune 16, 1981, for the purpose of submitting to the qualified voters of said County thequestion hereinafter set forth, and the said Board of Commissioners has received from theJohnston County Board of Elections a certificate of the results of the election, and hasdetermined the result of said election to be as hereinafter stated; NOW, `LHUZEFORE,The Board of Commissioners hereby makes the following statement of the result ofsaid election pursuant to The Local Government Bond Act1 The number of voters registered and qualified to vote at said election was29, 2152 The total number of voters who voted YES in answer to the question, SHALLthe order authorizing 7,500,000 of bonds secured by a pledge of the faith and credit of theCounty of Johnston to pay capital costs of expanding and improving Johnston Memorial Hospital,including the construction and installation of furnishings, equipment and machinery requiredtherefor, and a tax to be levied for the payment thereof be approved , was 2,484 The total number of voters who voted NO in answer to such question was 2,180 The question in theform submitted was approved by the affirmative vote of a majority of those who voted thereonat said electionAny action or proceeding challenging the regularity or validity of this bondreferendum must be begun within 30 days after July 10, 1981, date of publicationBoard of Commissioners of the Countyof Johnston, North CarolinaCommissionerHoward Benton seconded the motion, and the motion was adopted Thosevoting for the motion were Messrs Frank B Holding, Norman C Denning, John M Booker, DVM,James W Cash and Howard Benton,No one voted against it10 Home Health Services -- Nurses RetirementHelen Ray, Administrator, Johnston County Health Department, met with the boardasking that the four Home Health nurses now employed by the Health Department; Anna Wilson,Julie Wells, Shirley Fasolt and Patricia Earp, be allowed to join the county retirementprogram, without having to wait a year Mrs Ray explained that these nurses were underretirement with Hartford Insurance Company when the Home Health Services were administered byJohnston -Lee Community Action,County Personnel Policy Section 15 states that a new county employee shall remainwith the county one full year before they are eligible to join the county retirement systemThe board discussed this matter at length, however, denied this request in keepingwith the County Personnel Policy - Section 15 - Local Governmental Employees RetirementSystem11 Water Study Progress ReportTim Broome of Ragsdale Engineers, met with the board again and reviewed preliminaryplans for an alternate water supply to expand Johnston Countys water system Mr Broomepresented first phase construction alternatives for water sources from the Cape Fear, NeuseRiver expansion of Smithfield Plant, Little River and ground water He indicated that theCity of Dunn could, if the board desired, make a formal proposal to the countyfor water comingfrom the Cape Fear River The board was further advised that the Town of Selma plans to startdrilling new wells at two sites hoping to become self - sufficient and if these wells proveresourceful this would relieve the Smithfield Plant by about 150,000 gallons a day The boardagain discussed getting water to Princeton and water storage facilitiesAs each board member showed concern about water supply for Johnston County and theSmithfield Water Plant reaching its full capacity, they discussed these alternate plans atlength, however, postponed a decision at this time to see if Selmas wells are productive12 Library Board - AppointmentsCommissioner John M Booker moved that Gordon Brown and Mrs Charles Ellen Watsonbe reappointed to the Library Board of Trustees for three year terms expiring June 30, 1984Commissioner Frank B Holding seconded the motion which was carried by unanimous voteJuly 7, 1981 Continued13 Technical College Board of Trustees - AppointmentCommissioner Howard Benton moved that N L Canady be reappointed to the TechnicalCollege Board of Trustees for an eight year term expiring- June 30, 1989,Commissioner James W Cash seconded the motion which was carried by unanimous vote14 Social Services Board - AppointmentCommissioner Howard Benton moved that Robert L Anderson be reappointed to the SocialServices Board for a three year term expiring July 1, 1984Commissioner Frank B Holding seconded the motion which was carried by unanimous vote15 Town of Selma - AppointmentsAs recommended by the Selma Town Council, Commissioner Frank B Holding moved thatthe following appointments be madeBoard of Adjustments Mrs JaneWoodard, Mr Roy Vann; Mr W LeonWilliams, Mr Charlie Hatcher and Ms, Ann Stanley outside alternatePlanning Board Mr James Smith and Mrs Rose JonesCommissioner James W Cash seconded the motion which was carried by unanimous vote16 Health Department - Leaking RoofIn discussion of the problems with the roof at the Johnston County Health Department,and after investigations by Buck McLamb, Maintenance Supervisor, and Harry McGee, Architect,it has been determined, in their opinion, that the leaks were caused by faulty materials orfaulty work when the Health Department Building was enlargedAfter discussion with W R Britt, County Attorney, Commissioner Frank B Holdingmoved that Mr Britt be instructed to communicate with Harry McGee and to investigate thecontractors liability on the roof at the Health Department and report back to the boardCommissioner Howard Benton seconded the motion which was carried by unanimous vote17 Capital Health Systems Board - AppointmentCommissioner Frank B Holding moved that Dr Norman B Grantham, Jr, be appointedto the Capital Health Systems Board to fill the unexpired term of Dr Donnie Jones This termexpiring March 31, 1983Commissioner Howard Benton seconded the motion which was carried by unanimous vote18 Mobile Home and Mobile Home Park Ordinance - Proposed ChangesWayne Strickland, County Code Enforcement Officer, met with the board seekingamendments and changes in the Mobile Home and Mobile Home Park Ordinance Mr Stricklandexplained that these changes would bring the county ordinance more in line with StateBuilding Regulations and with Health Department regulationsThe board discussed these proposed changes at length, After discussion,Commissioner Frank B Holding moved that ComnissionerJames W Cash study these changes andreport back to the board with recommendationsCommissioner John M Booker seconded the motion which was carried by unanimous vote19 Employment Security Commission - Local OfficeIt was brought to the boards attention that the Smithfield Employment SecurityCommission office wa,s`being considered for closing by the State The board received lettersfrom managers of local industries expressing much concern about this matter and asking theBoard of Commissioners to make every effort to help keep this office openRESOLUTIONWHEREAS, it has come to the attention of the Board of Commissioners that someconsideration has been given to the possible closing of the Employment Security Commissionoffice in Smithfield;EIdL_4July 7, 1981 ContWHEREAS, the 1980 federal census shows that Johnston County is gaining populationrapidly;IffMT,AS, Johnston County has become moreindustrialized, and that new industriesare presently indicating a strong desire to locate new plants in Johnston County;WHEREAS, the County of Johnston contains a large area, and energy and travel costshave been accelerating rapidly;WHEREAS, the County of Johnston pays the rent for the local office of the EmploymentSecurity Conmission;andWHEREAS,- a neighboring county with non - military population of approximately the samenumber, or slightly greater than Johnston County, now has two Employment Security Offices openin said County for which the State of North Carolina pays the rent;WHEREAS, the Board of Commissioners strongly urges the Employment Security Commissionto keep the local office in operation;WHEREAS, a number of county industrial leaders and plant managers have asked theboard to go on record against the closing of said local officeNOW, THEREFORE, upon motion by Commissioner Frank B Holding, duly seconded byCommissioner James W Cash and carried by unanimous vote, the Board of Commissioners of JohnstonCounty resolves that the only office of the North Carolina Employment Security Commission inJohnston County be kept open and operational for the convenience and continued great use of thecitizens of Johnston CountyFURTHER IT IS ORDERED that copies of this resolution be sent to the Chairman andDirector of the North Carolina Employment Security Commission, Governor James B Hunt, Jr,and the State Representatives and State Senator who represent Johnston County20 State Highway EngineerPaul Anderson, District Engineer, North Carolina Department of Transportation,visited with the board Mr Anderson and the board discussed secondary road funds21 Recreation Grant -
