meetingCommissioner James W Cash moved that the minutes of the March 2, 1981, board meetingbe approved as recordedCommissioner Howard Benton seconded the motion which was carried by unanimous vote2 Budget Presentation - Department of Social Services 1981 -1982Joe Nall, Chairman, Social Services Boardand Ben Niblock, Director, presented thebudget request for the Johnston County Department of Social Services for 1981 -82 Mr Niblockexplained that the 81 -82 proposed budget will cost the county 1,340,902 or 127o of the totalSocial Services Budget which is 11,283,579 The federal share of the total will be 64 ,state share 247o and the county share 127o or 1,340,902 Mr Niblock further explained thatthe 1981 -82 budget reflects an increase in county money of 48,487 or 3757o over the 1980 -81budget, with salary increases figured at 10 and mileage reimbursement at 250 per mileThe board discussed this budget request with Mr Nall and Mr Niblock During theSocial Services Budget discussion, Mrs Joyce Walters spoke with the board again regardingfunding for transportation for the blind in Johnston County The board talked with MrsWalters regarding the transportation request,however, commented that the county could notsustain a county transportation program due to rising cost3 Farm Buildings at LandfillHarold Blizzard advised the board that he had received an offer of 25 for the oldbuildings at the county landfill farm4 Septic Tank Waste Pumping Disposal PolicyHarold Blizzard advised the board that beginning April 1, 1981, all carriers will bedelivering septage wastes to the Central Johnston County Regional Wastewater Treatment Plant,and that charges will be made according to tank capacity at rates based on user charges asapproved by the Board of Commissioners, and farther that carriers will be notified 30 daysin advance of any disposal policy changes taking effectThe board discussed this matter and agreed that the towns should make decisions onuser charges and the administration of user charges and asked Tim Broome to schedule a meetingwith the town mayors to discuss this matter5 Garbage Dumping in CountyThe board discussed several complaints regarding illegal dumping at several sites inthe county and on private property The board asked the County Planner to look into thismatter with the possibility of making some recommendations to the board at a later date6 Princeton 201 Wastewater Faci _kfi_ es- - ResolutionUpon a motion by Commissioner Frank B Holding, duly seconded by Commissioner John M,Booker and carried by unanius vote t was mloved that the Xollowing resolution be acceptedand approved subject to the approval of the EPA grant and State Clean Water Bond grantTHAT, the Board of Commissioners of the Town of Princeton requests the County ofJohnston to own, operate, maintain, and control the wastewater treatment plant and all inter-ception, and pumping facilities outside town limits, in addition to all joint -use interceptionand pumping facilities lying within town limits The Town is to own, operate, maintain, andcontrol its collection, interception, and pumping facilities;THAT, the Board of Commissioners of the Town of Princeton understands that the systemwill be self- supporting;THAT, the Board of Commissioners of the Town of Princeton understands and agreesthat the County owned and controlled facilities are to be operated on a user -pay basis and asystem of user charges shall be determined and implemented by the CountyTHAT, it is the expressed intent of the Board of Commissioners of the Town ofPrinceton to participate in the regional wastewater interception and treatment system asproposed under the 201 Plan,April 6, 1981 Continued7 Town of Princeton - Housing and Urban Development Block GrantUpon motion of Commissioner John M Booker and seconded by Commissioner James W Cash,it was unanimously carried that the Countys grant of 1,000,00000 from the Department ofHousing and Urban Development be transferred to the Town of Princeton to be used and disbursedas provided by law_8 Cable TV Requesting Extension of Existing Cable Television OperationsAlert Cable TV asked the Board of Commissioners for permission to extend its existingcable TV operations in Selma, Smithfield, Four Oaks, Pine Level and Clayton which are presentlyfranchised into unincorporated areas of Johnston County adjacentto;said municipalitiesThe board asked the County Attorney to review this resolution and report back to theboard with recommendations9 ReportsThe following reports were filed with the board Tax Collector; AgriculturalExtension; Electrical Inspector, Tax Supervisor and Planning10 Tax Collector - ComplaintsGeorge Mast, Smithfield Attorney, met with the board briefly regarding numerouscomplaints that he has received as an attorney about the Tax Collector Mr Mast advised theboard that citizens do not mind paying their taxes, however, they do not like to be abusedas taxpayers11 Secondary Road 2160 and 2161 - Right -of -WaysPaul Anderson, District Engineer, North Carolina Department of Transportation, metwith the board and advised that the State has been unable to secure right -of- way - agreementsfrom some of the property owners on Secondary Roads # 2160 and 2161,After discussion and recommendation from Mr Anderson, Commissioner Howard Bentonmoved that the Division of Highways, North Carolina Department of Transportation, be requestedto delete Secondary Roads # 2160 and 2161 from the State Secondary Road Improvement ProgramCommissioner James W Cash seconded the motion which was carried by unanimous vote12 Secondary Road # 1366 - AbandonedCommissioner Howard Benton moved that the Division of Highways, North CarolinaDepartment of Transportation, be requested to abandon Secondary Road # 1366 from the StateMaintained SystemCommissioner James W Cash seconded the motion whchwas carried by unanimous vote13 Seventh Street Property — Drainage ProblemCommissioner Frank B Holding moved that Paul Anderson, District Highway Engineer,be requested to work with Hugh Talton, Town Manager, Smithfield, Billy Britt, County Attorney,and Johnnie Stott, Interim County Administrator, to investigate and see what can be done toresolve the water drainage problem that exist in the area behind Johnston Memorial Hospital onSeventh StreetCommissioner Howard Benton seconded the motion which was carried by unanimous voteBOARD OF EQUALIZATION AND REVIEWAt this time, 230 pm, Commissioner Frank B Holding moved that regular session berecessed for the Board of Commissioners to sit as a Board of Equalization and ReviewCommissioner John M Booker seconded the motion which was carried by unanimous voteWill R Crocker, Clerk of Superior Court, administered the Oath of Office to theCommissioners as members of the Board of Equalization and ReviewChairman Denning called the meeting to order and the following business wastransactedThe Board of Equalization and Review heard from the following property ownersregarding their tax assessmentsIjiI dSiApril 6, 1981 Continueda A J Abdalla, Selma Township; Service Station that was leased to Shell OilCorporation Mr Abdalla contends that the valuation placed on the Shell Oilbuilding is too high based on the amount of rent he is getting for the buildingb Dr Manmohan Singh and wife, Smithfield Township; Dr Singh states that thecost to construct the building was 30,000 He feels the valuation according toschedule is too high The schedule for this type of building produces avaluation of 36,110c Turner Vinson for Herman Vinson; Clayton Township; Mr Vinson complained offarm land values and stated that this was not good farm land and it was valuedentirely too high,After hearing these complaints, the Board of Equalization and Review requested theTax Supervisor and the Tax Appraiser to revisit and recheck these valuations and report backto the Board of E R for considerationCommissioner Frank B Holding moved that the Board of Equalization and Review recessuntil May 4, 1981, at 230 prhCommissioner John M Booker seconded the motion which was carried by unanimous voteIt was moved, seconded and carried that the Board of Commissioners reconvene inregular sessionREGULAR SESSION14 Public Hearing - Hospital Bond OrderThe Clerk reported to the Board of Commissioners that the bond order which had beenintroduced on March 30, 1981 had been published on March 31, 1981, in the manner required bylaw, with notice that the Board of Commissioners would hold a public hearing thereon on April6, 1981, at three oclock, pm The Clerk also reported that the Countys Finance Officer hadfiled in the Clerks Office a statement of debt complying with the provisions of the LocalGovernment Bond Act, and such statement as filed showed the net indebtedness of the County tobe 17o of the appraised valuation of property in the County subject to taxationCommissioner James W Cash moved that the Board proceed to hold a public hearing onthe hospital bond orderThe nation was seconded by Commissioner Frank B Holding and was unanimously adoptedAt three o -,clock, pm, the Chairman of the Board of Commissioners announced that theBoard would hear anyone who wished to be heard on the questions of the validity of the hospitalbond order and the advisability of issuing the bonds At the direction of the Chairman, theClerk read the bond order and the published notice of hearing There was no opposition to theHospital Bond Order presented at this Public HearingAfter the Board had heard all persons who requested to be heard,no one appeared tobe heard, Commissioner John M Booker, DVM, moved that the public hearing be closed Themotion was seconded by Commissioner James W Cash and was unanimously adoptedCommissioner Frank B Holding moved that the Board of Commissioners adopt withoutchange or amendment and direct the Clerk to publish as prescribed by The Local Government BondAct the bond order entitled, Bond Order authorizing the issuance of 7,500,000 Hospital Bondsof the County of Johnston , introduced at the meeting of the Board of Commissioners held onMarch 30, 1981, The motion was Holding moved the adoption of the following resolution whichwas read at length to the BoardWHEREAS, the Board of Commissioners has adopted the bond order hereinafter describedauthorizing the issuance of 7,500,000 Hospital Bonds and such bond order and the indebtednessto be incurred by the issuance of such bonds and the tax to be levied for the payment of suchbonds should be submitted to the voters of the County of Johnston for their approval ordisapproval in order to comply with the Constitution laws of North Carolina; NOW,THEREFORE,April 6, 1981 ContinuedBE IT RESOLVED by the Board of Commissioners of the County of Johnston, as follows1 The question whether the qualified voters of the County of Johnston shallapprove or disapprove a the indebtedness to be incurred by the issuance of bonds of theCounty authorized by the aforementioned hospital bond order, which indebtedness shall besecured by a pledge of the Countys faith and credit, b the levy of a tax for the paymentthereof, and c said bond order, shall be submitted to the qualified voters of said Countyat an election to be held in said County on June 16, 19812 The Clerk is hereby authorized and directed to publish a notice of saidelection which shall be in substantially the following formCOUNTY OF JOHNSTON, NORTH CAROLINANOTICE OF SPECIAL ELECTIONNOTICE IS HEREBY GIVEN that a special election will be held in -the County ofJohnston, North Carolina, on June 16, 1981 for the purpose of submitting to the qualifiedvoters of said County the question whether they shall approve or disapprove, 1 theindebtedness to be incurred by the issuance of bonds of said County of the maximum principalamount of 7,500,000 which indebtedness shall be secured by a pledge of the Countys faithand credit, and 2 the levy of a tax for the payment of such bonds and 3 the bond orderentitled, Bond Order authorizing the issuance of 7,500,000 Hospital Bonds of the County ofJohnston , adopted by the Board of Commissioners on April 6, 1981, to authorize the issuanceof said bonds and the levy of such taxThe Hospital Bonds are authorized to pay capital costs of expanding and improvingJohnston Memorial Hospital, including the construction of additional hospital facilities andthe acquisition aridinstallation of furnishings, equipment and machinery required thereforThe ballots to be used at said election shall contain the words, SHALL the orderauthorizing 7,500,000 of bonds secured by a pledge of the faith and credit of the County ofJohnston to pay capital costs of expanding and improving Johnston Memorial Hospital, includingthe construction of additional hospital facilities and the acquisition and installation offurnishings, equipment and machinery required therefor, and a tax to be levied for the paymentthereof be approved , with squares labelled YES and NO beneath or beside such words inwhich squares the voter may record his choiceIn the event a majority of the qualified voters voting at said election vote toapprove such order, the incurring of such indebtedness and the levy of such tax, said bondsshall be issued and a tax shall be levied for the payment of such bondsThe polls for the election will open at the throughMay 18, 1981 The respective Registrars and Judges of Election for the above Precincts mayregister voters, by appointment, through May 18, 1981 Information concerning the names andaddresses of the Registrars and Judges of Election can be obtained from the Johnston CountyBoard of Elections at the office set forth above The last day for registration for theelection will be May 18, 1981Any qualified voter who 1 expects to be absent from the County during the entireperiod that the polls are open on said election day, or 2 because of sickness or otherphysical disability will be unable to be present at the polls to vote in person on said day,or 3 is incarcerated and otherwise entitled to vote in said election, or 4 is anemployee of the County Board of Elections and his assigned duties on the day of election willcause him to be unable to vote in person, may apply for an absentee ballot to be used invoting at said election Information concerning the time and manner for applying for anabsentee ballot, including the last day for making such application, can be obtained from theJohnston County Board of Elections at the office set forth aboveBy order of the Board of Commissioners of motion was unanimously adopted15 Smithfield -Selma 201 Wastewater Facilities Project - Revised User Charge SystemCommissioner Frank B Holding moved that the Revised User Charge System revisedas of April, 1981 be approved for the Central Johnston County Regional Wastewater Facilities,as prepared and recommended by Tim Broome of Ragsdale EngineersCommissioner Howard Benton seconded the motion which was carried by unanimous vote16 Smithfield -Selma Sewage Treatment SystemThe Board of Commissioners in a lengthy discussion with Tim Broome of RagsdaleEngineers regarding the Central Johnston County Wastewater Facilities and its involvementwith the municipalities asked that Mr Broome work with these towns in setting up a Waterand Sewer Advisory Board to work out problems and differences over issues such as administ-ration, rates and etc, before coming to the Board of County CommissionersMr Broome indicated that he would call a meeting of ,town mayors or managers towork on this matterEXECUTIVE SESSIONAt this time, upon a motion by Commissioner Frank B Holding, duly seconded byCommissioner John M Booker and carried by unanimous vote, it was moved that the board recessregular session and go into Executive Session to discuss a monetary claim by the Division V VIcontractor on the Smithfield -Selma 201 Area Wastewater Facilities Project After discussionof the above matter, the board asked Tim Broome to work with the towns and the County Attorneyin regards to the litigation and or arbitration between the County and the contractorsUpon a motion by Commissioner Frank B, Holding, duly seconded by CommissionerJohn M Booker and carried by unanimous vote, it was moved that the Executive Session beadjourned and that regular session be resumedf i,08April 6, 1981 Continued17 Radio Communications -,Base Station ExchangeAfter discussion, Commissioner Howard Benton moved that the County exchange a 75 wattbase station in the Sheriffs Office for a new 300 watt base station at no additional charge,and that the new unit be guaranteed to function properly and the exchange to be made withSouthern Communications of Goldsboro, N C Commissioner Benton further moved that theMaintenance Supervisor be instructed to install a housing unit for the new base stationCommissioner James W Cash seconded the motion which was carried by unanimous vote18 Budget Amendment — Foam TruckCommissioner Frank B Holding moved that the following budget amendment be made toreimburse the Town of Selma for the balance of expenses incurred on the foam truck from July1, 1980 to March LICENSESWHEREAS, it is provided in Chapter 158, Public Laws of 1939, in an act entitled,REVENUE ACT OF 193911, under Article II Section B, License Taxes of said Chapter, asamended, that the counties of North Carolinaor any of therm may impose and levy a countylicense or privilege tax for the privilege of carrying on the business exercises, exercisingthe privilege of doing the act named therein, beginning June 1, 1981, and ending May 31, 1982;WHEREAS, the County of Johnston, a body corporate and politic in the State ofNorth Carolina, by and through its Board of Commissioners, desires to impose and levy saidlicense and privilege taxes in Johnston County for the said tax year 1981 -1982, in strictaccordance with the provisions of said Article II, Schedule B; and to impose and levy saidtaxes, and to require reasonable reports from distributors in order to make the tax levy andcollection effective, in amounts to full extent and limit authorized under said Article II,Schedule B;NOW, THEREFORE, DID RESOLVE, THAT THE BOARD OF COMMISSIONERS OF JOHNSTON COUNTY,do hereby impose and levy in and for the County of Johnston, North Carolina, for the tax yearbeginning June 1, 1981,
