Literary Fund - Application to State Board of EducationCommissioner John PAZ Booker moved that the Board of Education be authorizedto forward the application for a Literary Loan in the amount of 163,000 to theState Board of EducationCommissioner James W Cash seconded the motion which was carried unanimously3 Water Line - Clayton - Carolina Power and Light EasementCommissioner John M Booker moved that Carolina Power and Light Company begranted the right, privilege and easement to go in and upon that certain tract orlot of land situated in Clayton Township, containing 3 acres, being the land des-cribed in a deed from Marion D Hobbs and wife, Clyda M Hobbs, to the County ofJohnston, dated November 14, 1977, and recorded in Book 826, page 275, JohnstonCounty Registry; and to construct, maintain and operate over, under, and acrosssaid premises a line consisting of poles, wires, cables, underground conduits, andother pertinent facilities within a strip or area of said land thirty 30 feet widefor the purpose of transmitting electricity, with the right to do all thingsnecessary or convenient thereto, including, but not being limited to, the right;a to permit the attachment of wires, cables, and conduits of any other company orperson; b to enter said strip at all times over the adjacent land to inspect,repair, maintain, and alter said line; c to keep said strip cleared of moved that the Division ofHighways, Department of Transportation, be requested to abandon from the StateMaintained Secondary Road System the east end of Secondary Road # 1228, beginningat point beyond the 50 foot easementCommissioner John M Booker seconded the motion which was carriedw,unanimously7 Landfill - Budget AmendmentRoland Hatcher, Supervisor, Johnston County Landfill, met with the boardrequesting additional funding for anticipated expenditures for the remaining fourmonths of this fiscal year Mr Hatcher made the following request for landfillneeds2 Saturday Holiday Truck Drivers4000 per Day X 40 days 1600001 Welder Repair Man73600 per month x 4 months 2944001 Regular Truck Driver72100 per month x 4 months 2884002 Clean up Men60000 per month x 4 months 480000 12,22800Needed for Repairs Code 16 25,00000Grand Total 37,22800Mr Hatcher further explained that this request is a minimum of what thelandfill needs to keep the countys garbage collection system in operation sixdays a week, including holidaysThe board discussed this request with Mr Hatcher and Mr Jackson atlength Mr Jackson recommended the board consider this budget appropriationand budget amendment at this time as the Solid Waste Study is near completionand perhaps this study will offer some relief for the countys Solid WasteProgram in the near futureAfter discussion, Commissioner Frank B Holding moved to amend the LandfillBudget by transferring 37,22800 from unappropriated revenue one cents sales taxto the Landfill expenditure accounts 1058016 25,000 and 1066002 12,22800Commissioner J E Rogerson seconded the motion which was carriedunanimously8 Aeromodeling Park - Landfill SiteBryson Houston, representing the Johnston County Aeromodeling Club, metwith the board requesting long term use of an area at the Johnston County Landfillfor the development of a Johnston County Aeromodeling Park Mr Houston told theboard they desire to lease the property at the landfill as it is in a remote siteThey plan to construct a runway approximately 250 feet by 50 feet; build an accessroad; have a locked gate so this club will have full -time use of the parkThe board discussed this matter and the Chairman advised Mr Houston theyneeded more time to consider this proposal, and would make a decision at the Aprilmeeting9 Juvenile Justice and Delinquency Prevention FundsJerry Wilson, Juvenile Probation Officer, and Chairman of the JohnstonCounty Juvenile Task Force, met with the board advising that Johnston County iseligible to receive 15,071 in federal money under the Juvenile Justice andDelinquency Prevention Act Mr Wilson explained that this is a three yearprogram with federal funds of 45,000 and in order to qualify for the money, acitizens committee must be appointed by the Board of County Commissioners and acrime report input form completed Mr Wilson stated, the purpose of the citizenscommittee is to study the needs of the youth of Johnston County to determine howthese funds can be used to prevent juvenile delinquency in the county The crimereport input form must be submitted to indicate Johnston Countys intent to apply for these fundsMMarch 5, 1979 ;; Cont Commissioner Frank B Holding asked Mr Wilson if there will be any commit-ment for the county to fund this program after the three year federal fundingperiod Mr Wilson assured Commissioner Holding and the board there is no require-ment in any way for the county to fund or continue the programUpon the recommendation of the Task Force Committee; Commissioner James WCash moved that the following named persons be appointed to seek federal fundsavailable for prevention of juvenile delinquency in Johnston CountyJoseph Mitchiner, Deputy Sheriff; Betty Burnette, Math price of the land sold by Joseph R Overby and wife, LoisM Overby to the County of Johnston December 28, 1978 Mr Overby states that helost or misplaced the originalAfter discussion, Commissioner J E Rogerson moved that Billy Britt, CountyAttorney, furnish Mr Overby with a duplicate original of this note and furtherthat the Chairman be authorized to execute sameCommissioner James W Cash seconded the motion which was carried unanimously11 Airport - Hangar Lease ExtendedThe Board of Commissioners received a letter from W W Aviation Gerald AWithrow, President requesting an extension of their hangar lease from fifteen 15years to twenty 20 years to allow a write off against additional capital outlayCommissioner James W Cash-moved that W W Aviation be granted an extensionof their hangar lease agreement from 15 years to 20 years;the first 15 years re-quire an annual rental fee of 10 however, the extension requires a monthly rentalfee of 25000 for the additional five year period; after the 20 year period thehangar becomes property of the County of JohnstonCommissioner Frank B Holding seconded the motion which was carriedunanimously12 Equalization and Review - Board MeetingsThe Board of County Commissioners will begin their meetings sitting as aBoard of Equalization and Review Tuesday, April 3, 1979, at 7 oclock pm13 Watts Line - Sheriffs DepartmentKramer Jackson, County Administrator, advised the board this budget lineitem for the Sheriffs Department telephone is over -spent because of the Watts linein the Sheriffs Office Mr Jackson asked for a budget amendment for this lineitemThe board discussed the feasibility of a watts line against the cost andasked Mr Jackson to talk with the telephone company to see if the cost can bereduced by some alternative14 Hospital Improvement ProposalJohnston Memorial Hospital Board of Trustees Chairman Howard Benton, andmembers of the Board of Trustees, Hospital Administrator, Terry Carson, andinterested citizens, met with the Board of Commissioners to seek the boardsendorsement for paying approximately 30,000 to consultants for plans to improvethe hospital and its facilitiesMr Benton advised the Board of Commissioners that the Hospital Board ofTrustees and a Hospital Planning Committee had selected a firm to study and prepareplans to modernize the hospital548March 5, 1979 ContinuedMr Benton and trustee members strongly emphasized that the time has cometo up -date the hospital and to be competitive in providing the best medical carepossible for the citizens of Johnston County Mr Benton continued, the peopleare demanding better health care, health care is vital to our county, JohnstonCounty has got to do something Mr Benton stated to the board; we would liketo have a new hospital altogether, on a new site, but this will have to be thedecision of the Board of County CommissionersDr Hubert Poteat, a surgeon and Hospital Board of Trustee member,emphasized that in order to attract good young doctors, we need a modern up -to-date facility Dr Poteat stated that he recommends and encourages the Board ofCommissioners to endorse the Hospital Board of Trustees request to seek plans tomodernize the hospital Terry Carson, Hospital Administrator, stated that many studies will bemade to come up with the most economical and most feasible way to deliver goodquality medical care for the people of Johnston County It is evident, according to the Hospital Board, that Johnston County islosing patients and will continue to lose patients to surrounding medical carefacilities until improvements are madeSeveral citizens spoke supporting the need to up -date Johnston Countyshospital and its facilities and pointed out the important need to be competitivein hospital care and medical servicesThe Board of Commissioners discussed the request at length and reactedvery favorably to the Hospital Board of Trustees request The Commissionersagreed that the Board of Trustees were going in the right direction as the needis tremendous Chairman Denning indicated the Hospital Board is really talkingabout a bond referendum at a later date and he expressed favorCommissioner John M Booker offered a suggestion of what might help withthe 30,000 expenditure needed for architectual and planning servicesCommissioner Booker suggested that better-collection of fees for services renderedto hospital in- patients admitted to the Johnston County Mental Health Clinic wouldgenerate additional revenue This budget appropriation totals about 321,040 andonly about 26,333 has been collectedBy motion of Commissioner Frank B Holding, duly seconded by CommissionerJ E Rogerson and carried unanimously, the Board of County Commissionersauthorized and endorsed Johnston Memorial Hospital Board of Trustees in proceedingwith architectual planning to improve the hospital and its facilities15 Revaluation and Land Use ScheduleJohnnie Stott, Tax Supervisor, met with the board and reported on theprogess of the county revaluation Mr Stott advised that informal appeal hearingwill begin on Wednesday, March 7th in the Grand Jury Room, Johnston County Court-house These appeals will be heard by representatives of Associated Surveys andif the property owner is still not satisfied with the appraisal of his herproperty they will have the opportunity to appear before the Board of Equalizationand ReviewMr Stott asked the board to adopt a Land Use Value Schedule of 650 anacre for cleared land and 200 an acre for woodlandCommissioner J E Rogerson moved that the Land Use Value Schedule at 650an acre for cleared land and 200 an acre for woodland be adoptedCommissioner John M Booker seconded the motion which was carriedunanimously16 ReportsThe following reports were filed with the board Tax Collector, DogWarden, Electrical Inspector, Veterans Office, Agricultural Extension ServiceThe Tax Collector in making his report asked for the boards opinion ofwhether or not to continue writing delinquent taxpayers to advise them ofadvertisement of the tax lien saleThe Commissioners told the Tax Collector that it was definitely the boardintentions to advise the taxpayer, and to give them every opportunity to pay theirtaxes before advertisement in the local newspaperThe board asked Mr Jackson to work with Mr Godwin in composing a letterto be mailed to the delinquent taxpayer giving them the opportunity to pay theirtaxes before their names are released for advertisementI ?ii r? fMarch 5, 1979 Gone17 Rescue Squads - Request for Additional AidPurcell Holland, President, Johnston County Rescue Squads Association, andmembers met with the board requesting an increase in county contributions to thecounty rescue squads from 250 to 300 a month Mr Holland also presented arecommendation from the association to increase the ambulance contribution from25,000 this appropriation provides two designated ambulances each fiscal yearto 32,000 annually This requested appropriation of 32,000 a year would bedivided bqually between the rescue squads 4,000 each with the present eightsquads for the purchase of new ambulances when needed Mr Holland furtherexplained that this money would be spent only for the purchase of ambulances and bydividing these funds this would give each squad equal opportunity to purchaseambulances to fit their needsJim Bailey with the Clayton Rescue Squad presented the following letterregarding the ambulance service in the Clayton area;Mr Norman Denning, ChairmanJohnston County CommissionersSmithfield, N C 27577Dear SirRe Ambulance Service -- Clayton AreaEffective 7179, Clayton Rescue EMS will no longer be able to provideAmbulance Service in West Johnston County This action is required toinsufficient financial support provided by the County This difficultdecision was made without malice, but with the reality of economics asthey seem to exist We have made repeated attempts to find solutions forthe financing of this much needed Ambulance Service through establishedchannels to ono avail, The Town of Clayton and ourselves have attemptedto resolve this financial crisis for approximately three 3 years toinclude the proposal of a Tax District See Attached The servicedistrict had 1,371 calls in calendar year 1978The service district of which we speak, consistsan estimated population of 10,424 persons in the1970 These figures were supplied by the Countythe influx on industry in the Clayton areaWe hope that means can be found to alleviate proprovide the best quality of Emergency and Rescuein the Service Districtof 151 square miles withthree 3 townships inPlanners Office prior toblem We will continue toService to those personsHowever, after June 30, 1979, Ambulance Service request will be directedto servicesdue to increased cost and insufficient funding The Rescue Squad Association isespecially concerned with the number of non-- emergency calls received by the rescuesquads and hoped for assistance from the Board of County Commissioners The assoc-iation is also concerned with the possibility of a further fee system, if some formof support is not securedThe Board of Commissioners showed much interest and concern toward theRescue Squads Association,s request; Chairman Denning responded that the board isvery limited with the tax dollar, however, he stated feelings that the board wouldtry to help and they will consider this request at budget making timeMarch 5, 1979 Cont18 Social Services - Budget DeficitsMrs Frances Woodard, Chairman, Johnston County Board of Social Services,and Ben Niblock, new Director, met with the Board of Commissioners to define ananticipated budget deficit and to request the Board of Commissioners fund thesedeficits Mr Niblock told the board that they were concerned with budgetarydeficits occuring in the Medicaid Budget and the Transportation Budget MrNiblock further explained that Social Services is not spending as much as isbudgeted in some of the assistance programs and the Medicaid deficit could possiblybe off -set somewhatThe Transportation deficit seemed to surprise the board as they were underthe impression this program was operated totally with Title XX federal fundsMr Niblock explained the county was participating about 25 , and some of the de-ficit could be blamed on two vans operating that were not approved in the 1978 -79Budget for the Transportation ProgramChairman Denning replied that in his opinion the transportation program hadgrown way out of proportion and the program will have to be held downHoward Benton, former Commissioner and Acting Social Services Director forapproximately three months, told the Commissioners that the Social Services Boardwas told that transportation funding would become available, but never did Thisis one reason for the transportation deficitIt was also pointed out that another reason for deficits in the budget wasdue to action by the 1978 North Carolina General Assembly which raised the countysshare of Medicaid participation from 15 to 35 Commissioner Frank B Holdingemphasized that the board should encourage the General Assembly to give everyconsideration of voting in favorof a bill that will reduce the countys share ofnon - federal medicaid expenses back to 15 Lee Elmore, Director, Johnston County Council on Aging, spoke supportingthe Transportation Program because of the services it renders to the SeniorCitizens of Johnston County that-are without transportation After many questions regarding the budget deficits and much discussion,Commissioner Frank B Holding moved that the County Commissioners appropriatesufficient funds to cover the countys share of the Medicaid expenses and that theproper budget amendment be made to fund this expenditure Commissioner Holdingfurther moved the Board of Social Services be instructed to use their best effortsto balance the departments budget for the remainder of this fiscal yearCommissioner James W Cash seconded the motion which was carriedunanimously19 1979 -1980 Secondary Road Program PresentedAs the new 1979 -80 Secondary Road Program was to be presented to the Boardof Commissioners at this meeting many interested citizens attended concerned aboutthe Secondary Road Program and priority ratings Several people informed PaulAnderson and Wade Pridgen, Highway Engineers, their roads were passable andneeded maintenance so they could at least get in and out Many were unhappS7- withthe new priority ratings and asked for an explanation of the priority rating system,and criteria used to make these determinations Mr Anderson and Mr Pridgenexplained the priority rating system and advised several people that they wouldcheck their road for maintenance and improvements as soon as possibleWade Pridgen, Assistant Division Engineer, and Paul Anderson, DistrictEngineer, with the Divisionof Highways, State of North Carolina, Department ofTransportation, appeared before the Board of County Commissioners and presented theSecondary Road Program for 1979 -1980After reviewing the proposed construction and paving program for 1979 -1980,Commissioner Frank B Holding moved that the following resolution be adoptedRESOLUTIONWHEREAS, the Board of County Commissioners of Johnston County have receivedfrom the Department of Transportation the Secondary Road Program for 1979 -1980 aspresented by Mr Pridgen and Mr Anderson, said roads being a part of the systemmaintained by the North Carolina Department of Transportation, Division of HighwaysAND WHEREAS, after careful consideration of the services rendered by saidroads and the traffic demands of said County, it is deemed necessary that saidroads be improved, in order to better serve the interest of the people of theCounty;II1IiraMarch 5 , 1979 ,-font NOW THEREFORE, BE IT RESOLVED, that the Board of Commissioners of JohnstonCounty hereby approve and request that the North Carolina Department of Collector HarperGodwin to accept Mr Herreraa payment of taxes Mr Mast advised the board thatthe Tax Collector had refused to accept payment of Mr Herreras personal propertyand real estate taxes unless he paid the taxes of Herrera Contracting Company MrMast explained to the board that Herrera Contracting Company is a corporation HeMarch 5, 1979 Contfurther explained that the next day after refusing to accept Mr Herreras payment,the Tax Collector issued two separate attachments against Toby Herreras bankaccounts personal and corporation, and further that he Tax Collector hadviolated and abused the law and abused Toby Herrera Mr Mast contends the TaxCollectorhas no legal right to attach a personal bank account against corporationtaxesIn response, Commissioner Frank B Holding stated unless for some reason aperson is insolvent or in flight, and as long as a taxpayer is struggling to paytheir taxes, the county should not be abusive, it is not the intentions of theBoard of County Commissioners for the Tax Collector to abuse a citizen or a tax-payer for any reasonMr Mast told the board he has a check for Mr Herreras taxes and it isup to the Commissioners as to whether or not they accept it However, Mr Mastwas quite upset over the Tax Collectors actions and advised the Board ofCommissioners that legal action may be taken in behalf of his clientThe board asked Billy Britt, County Attorney, for an opinion Mr Brittadvised he would certainly need time to investigate and get all the details ofthis case before he could give legal advice The board indicated they certainlywanted good judgment and sound reasoning used in this matter; therefore, theyasked Kramer Jackson, County Administrator and Billy Britt to work with Mr Mastto see if a satisfactory decision can be reached in the Toby Herrera tax matter22 Planning Director EmployedKramer Jackson, Administrator, introduced and recommended to the Board ofCommissioners, Richard E Rick Cannity for the new County Planning DirectorMr Jackson told the Commissioners Mr Cannity is a native of Massachusettsand is presently employed in the Planning Department with the City of Raleigh, andworked primarily with subdivision regulationsThe Commissioners talked with Mr Cannity for a short while, after which,Mr Cannity excused himselfAfter discussion, Commissioner John M Booker moved that Richard E RickCannity be employed as Johnston County Planning Director at a beginning annualsalary of 14,000Commissioner James W Cash seconded the motion which was carriedunanimously23 Farm Pilot ProgramBruce Woodard, Chairman, Johnston County Extension Service, met with theBoard of Commissionr seeking endorsement of a Small Farm Opportunity Service PilotProgram for Johnston County Mr Woodard explained that with the assistance ofone additional Extension Agent to work with small farmers the county can becomeinvolved in a one year 1000 State funded pilot farm program Mr Woodard alsotold the board there is no obligation for the county to continue this programafter the one year periodAfter discussion, Commissioner J E Rogerson moved that Johnston Countyparticipate in the Farm Opportunity Service Pilot ProgramCommissioner John M Booker seconded the motion which was carriedunanimously24 Sub- Division Plat - PriceCommissioner Frank B Holding moved that the Subdivision to be developedby Franklin L
