boardmeetingsCommissioner Howard Benton moved that the minutes of the December 23rd and January 5thboard meetings be approved as recordedCommissioner James W Cash seconded the motion which was carried by unanimous vote2 Road Paving Request - S R # 1311Mr J W Clayton, Route # 1, Angier, met with the board seeking the boards approvaland assistance in getting Secondary Road # 1311 paved The board asked Mr Clayton to submita road petition to the board for consideration3 Mental HealthDan Searcy, Director, Johnston County Mental Health met with the board and invited theCommissioners to be luncheon guests of the Mental Health Centers Unity House in Selma onMarch2ndfirst Monday Dr Searcy also thanked the Board of Commissioners for permissionto accept a federal grant to construct greenhouses for vocational rehabilitation for MentalHealth patients4 Water Needs - Smithfield Water PlantHubie Talton, Manager, Town of Smithfield, appeared before the board to advise theCounty Commissioners of the present and prospective demands and urgent need of expanding theSmithfield Water Plant Mr Talton stated that the countys industrial growth and water linesto various towns in the county has created water demands on the Smithfield Water Plant that areclose to maximum treatment capacity The Commissioners agreed that the county needed toevaluate its water system and the present and future needs The Commissioners also agreed thatwhat the County had done was good for the citizenry of Johnston County, however, they alsorealize that the demand for water is greater than the present water supply, Tim Broome ofRagsdale Engineers advised the board that 560,000 of State Clean Water Bond money allocatedto Johnston County will expire in June of 1982, if not committed to a project for the countybefore that date The Chairman advised that the board, sometime later in the day, wouldappoint a committee to study the countys water demands and needs and to meet with the Smith-field Town Board and or appointed representatives regarding the water problems5 Water - Town of Pine LevelSam Godwin, Mayor, Town of Pine Level, appeared before the board and advised that theTown of Pine Level must construct a new water supply well even though the towns well isproviding plenty of water at the present time Mayor Godwin told the board that the StateDivision of Health Services has told them that any well supply system that serves more than50 customers must have a standby well Mayor Godwin further stated that in order to continuegrowth the town board is working on a new well and they have applied for State Clean WaterBond money, however, need county financial aid or a water line connecting the Town of PineLevel to the county regional water supply system,The board advised Mayor Godwin they would take this under advisement6 Water - Town of PrincetonRed Smith, Director, Princeton Community Development, along with Mayor A C Edwards,and other town officials, met with the board stating Princetons water needs Mr Smithpointed out several alternatives available that would improve the water shortage for the Townof Princeton Carl Gurley, Chairman, Princeton Planning Board, indicated that Princeton islooking and hoping for industrial growth, however, they can not plan for any significantgrowth, residential or industrial, without available water sources Mr Gurley asked thecounty to consider Little River and the rock quarry water hole, which has underground springs,as sources to assist the county water supply,IiIi2 1981 ContinuedThe Board of Commissioners discussed these water requests at length realizing thecountys overall water needs and, also, their desire to assist with the towns water needsThe Commissioners advised the Town of FacilitiesCommissioner Howard Benton moved that the Central Johnston County Regional WastewaterFacilities User Charge System be adopted and recorded in the Johnston County Ordinance BookSee pages 231 - 252 - Ordinance Book # 1Commissioner James W Cash seconded the motion which was carried by unanimous vote9 Wastewater - ,Declaration of Joint Venture - Town of Pine LevelUpon a motion by Commissioner Frank B Holding, duly seconded by Commissioner James WCash and_carried by` unanimous vote, the following resolution was adopted and the Chairmanauthorized to - executer this documentDECLARATION OF JOINT VENTURE made this 2nd day of February, 1981, between units ofgovernment consisting of the COUNTY OF JOHNSTON and THE TOWN OF PINE LEVELWITNESSETHTHAT FOR AND IN CONSIDERATION of the mutual covenants and agreements herein contained,hereinabove named units of government hereby enter into an agreement for the administration,construction, operation and maintenance of a wastewater facility hereinafter definedWHEREAS, P L 92 -500, known as the Federal Water Pollution Control Act of 1972 hasrequired the implementation of the best practicable waste treatment technology to be institutedby local governments on or before December 31, 1983; andWHEREAS, pursuant to the provisions of Public Law 92 -500, the units of governmententering into this agreement made an area -wide study to determine the most cost effectivemeans of wastewater treatment and collection The study area known as the Smithfield -Selma201 Wastewater Facilities Planning Area, hereinafter referred to as 201 Area, was formed toaddress wastewater needs of the area The goals of the 201 Plan include, but are not limitedto, the national water quality objectives to preserve and protect area water supplies, thepreservation and enhancement of surface waters for recreation and fishing, identification andalleviation of local sewage problems, and provisions for future growth of the areaThe 201 Plan was completed Nine separate alternatives for wastewater collection andtreatment were investigated and all units of government agreed on one Plan Plan lA in the201 Study Plan, and all units of government adopted by resolution Plan 1A, copies of saidresolution being attached hereto and incorporated herein by referenceThe joint venture by all units of government to this agreement adopted for implement -ation of thePlan provides for the County of Johnston,hereinafter referred to as County, toown, operate, and control the wastewater treatment plant, and all joint -use collection,interception and pumping facilities outside the existing municipal boundaries and the WestSmithfield Sanitary District boundaries; and, further that the County is to own, operate, andcontrol all joint use interception and pumping facilities lying within the municipal limits ofany Town or the West Smithfield Sanitary District boundaries Each municipality and the WestSmithfield Sanitary District are to own, operate, and control its respective collectionfacilitiesThe County shall arrange for local capital financing of the joint use facilities, withthe users reimbursing the County for the costs Users shall pay for all costs of operation,maintenance, and equipment replacement The basic system will be financed and operated on auser pay basis, which incorporates flow rate and strength as the bases for determining unitcostThe parties to this agreement selected Plan lA to the exclusion of all other alternatiand all parties to the agreement understand and accept that the basis for selection of thisPlan to the exclusion of others was as follows1 Plan lA offers lower annual costs for wastewater disposal to more units ofgovernment and agencies than any other plan n2 Plan IA will eliminate all discharges of treated effluent within the 201 Areaupstream of the Smithfield Water Supply Intake, a regional water supply source The onlydischarge to surface water in the 201 Area will be the regional plant discharge and twoindustrial cooling water discharges3 Plan lA will consolidate operations and eliminate duplication of wastewater treat- fwent plant operation for smaller units of government4 Plan lA makes optimal use of the Smithfield area interceptors which have excesscapacity and further makes optimal use of the Smithfield treatment facilities already inoperation15 Plan IA provides for singular responsibility for wastewater treatment, managementand quality control of effluent6 Any required further improvements in effluent quality during the planning periodcan be more;economcally achieved by upgrading the system at one site, rather, than improvementsto multiple systemsAttached hereto and incorporated herein by reference are the resolutions by the County,all municipalities and the West Smithfield Sanitary District for adoption of Plan lA under the201 Study and adoption of the aforesaid administrative and financial arrangements for implementtion of this Plan and the agreement to continue participation in the Plan,NOW, THEREFORE, THE COUNTY OF JOBNSTON AND THE TOWN OF PINE LEVEL AGREE AS FOLLOWSI THE COUNTY OF JOBNSTON AGREES1 To own, operate, and control the wastewater treatment plant and all collection,interception, and pumping facilities outside town and West Smithfield Sanitary District WSSDjurisdictional limits, in addition to all joint use interception and pumping facilities lyingwithin town and -WSSD jurisdictional limits,2 To serve as lead agency in implementing Plan lA of the Smithfield -Selma 201 Waste-water Facilities Plan3 To exercise best effort in obtaining grants from the Environmental ProtectionAgency and the State of North Carolina for construction of the first phase, second stagefacilities under the Plani4 To finance the local capital cost share of the first phase, second stage wastewaterfacilities for conveyance of wastewater from the Town of Pine Level to the Central JohnstonCounty wastewater treatment facilities on the basis that the Town of Pine Level reimburse theCounty for said capital expenditure on a pro -rata basis in the form of a;,cmnnection chargeSaid connection charge to be due and payable upon substantial completion of the constructionof the Pine Level wastewater system5 To acquire all additional tracts of land, access easements and utility easementsrequired for construction of the improvements proposed in the first phase, second stage ofPlan IA under the SmithfieldzSelma 201 Wastewater Facilities Plan6 To construct all improvements proposed in the first phase, second stage of Plan lAunder the Smithfield -Selma 201 Wastewater Facilities Plan,7 To receive and transport wastewater from the Town of Pine Level and from adjacentareas and environs, which may be developed in the future but which would not be served directlyby the Town of Pine Level, to the Central Johnston County Wastewater Treatment Plant Theamount of wastewater shall not exceed 124,000 gpd with the following limiting characteristicsBOD5 220 mg 1 MaximumCoD5 500 mg l maximumSuspended Solids 250 mg l maximumAmmonia Nitrogen 25 mg l maximumpH 6 -9Temperature 1200 F maximumOil and Grease 100 mg 118 To treat and discharge the aforesaid wastewaters in accordance with the require-ments of the NPDES- discharge permit to the best of the Countys ability To operate the waste-water facilities on a user pay basis and to charge Pine Level for the services of receiving,transporting, treating, and discharging wastewater G,9 To meter the quantity of wastewater from the Town of Pine Level at the centralpumping facility known as the North Side Wastewater Pumping Station10 To periodically at least quarterly determine the quality of wastewater from theTown of Pine Level11 To conceive, adopt, and implement a fair and equitable system of user chargeswhich shall be based on the quantity and quality of wastewaters received and the direct andindirect costs incurred in transporting and treating said wastewaters Charges shall include,but not be limited to, costsof labor, administration, energy, water, vehicle transportation,training, repair, replace, materials, supplies, and chemicals, and reimbursement payments tothe County for debt service on local cost and the Town of Smithfield for outstanding bonds on8February 2, 1981 Contthe joint use facilities acquired by the County, and to levy additional charges on the Townof Pine Level for higher strength wastewater than that specified under Item 712 To maintain a cash reserve fund for emergency repai?s to equipment and facilitieswhich exceed 5,000 for any one occurrence The amount of the fund shall not be less than50,000 for each years operation13 To prepare a schedule of charges by May 1 of each year for the upcoming fiscalyear July 1 - June 30 and to review the charges annually on the basis of the past yearsexperience and estimated costs for the coming year and to adjust charges, if required, annuallyor more frequently but not greater than quarterly if required due to extraordinary costsThe initial user charge schedule shall be determined and the Town of Pine Level notified priorto the 75 construction completion stage of the Pine Level Wastewater facilities14 To invoice the Town of Pine Level by the 15th day of the month for the previousmonths services Invoices shall show base charges15 To prepare, adopt, and implement a sewer use ordinance which will be to theextend possible compatible with those of the Towns of Smithfield, Selma, Pine Level, FourOaks, and West Smithfield Sanitary District The ordinance shall apply to all users, notserved by either Smithfield, Selma, Pine Level, Four Oaks or the West Smithfield SanitaryDistrict16 To maintain this contract in effect for a period of ten 10 years from the dateof its execution and to renew the contract in increments of ten 10 year periods upon mutualagreement of both parties The ten -year contract period is dictated by the ten -year waste-water treatment plant design flow under the 201 Plan,II TBE TOWN OF PINE LEVEL AGREES1 To participate in Plan IA of the Smithfield -Selma 201 Wastewater Facilities Planwith the County of Johnston to serve as lead implementing agency for the Plan; the County ofJohnston to own, operate, and control the wastewater treatment plant and all joint -usecollection, interception, and pumping facilities outside Town and WSSD jurisdictionallimits in addition to all joint -use interception and pumping facilities lying within Town andWSSD jurisdictional limits; the County of Johnston to construct all joint -use wastewaterfacilities improvements and to finance the local capital cost share of the first phase, secondstage facilities2 To pay the County of Johnston a connection charge in the amount of the Townspro -rata share of the capital expenditure for the local cost of the Pine Level to Smithfieldpumping and transmission facilities, in accordance with the Agreement between the County ofJohnston and Town of Pine Level dated May 16, 1979, which is attached hereto3 To prepare and adopt a suitable sewer use ordinance subject to the approval of theCounty of Johnston and to implement same prior to completion of construction of the Townswastewater facilities4 To prepare, adopt, and implement a user charge system basedon quantity and qualityof wastewater meeting the approval of EPA5 To pay the County of Johnston within 15 days after receipt of an invoice forreceiving, transporting, treating, and discharging wastewater from the Pine Level sewer systemThe invoice shall be based on the wastewater flow quantity and quality as determined in themanner outlined in I9 and I106 To institute an accounting system to separately account for all costs related tooperation, maintenance, and replacement of the County facilities for which the Town is tocontract with the County for operation and maintenance, and to implement said cost accountingsystem prior to completion of construction of the Pine Level wastewater systemII7 To prepare an annual budget for the cost of operation, maintenance, and replacementof said County facilities and submit same to the County by April 1 of each year8 To prepare an audit of all costs of operation, maintenance, and replacement of theaforesaid County facilities and submit to the County by December 31 of each year9 To provide sewer taps to all potential customers requesting sewer service whichlie within the legal and or contractual jurisdictional limits of the Town, provided the potenticustomer is situated within a reasonable distance of an existing gravity sewer line and gravityservice can be provided to said customer In event said customer is not provided water by theTown, then the Town shall require the customer to install at his own cost an approved watermeter on his individual well system and grant the Town access to read the meter for sewerbilling purposes86February 2, 1981 Continued10 To maintain this Agreement in effect for ten 10 years from the date of executionand reserve the right to renew the Agreement in increments of ten 10 year periods of whichsaid resolution being attached hereto and incorporated herein by reference; andWHEREAS, under the saidplan, all the units of government within the said area,including Town and County which are parties to this agreement, entered into a joint venture forimplementation of the plan which provides that County should own, operate and control thewastewater treatment plant, and all joint -use collection and pumping facilities outside theexisting municipal boundaries of the participating local governments, and the West SmithfieldSanitary District boundaries; and also that the County was to own, operate and control alljoint use interception and pumping facilities lying within the municiapl limits of any partici-pating town, including the Town of Four Oaks, and the West Smithfield Sanitary Districtboundaries; andWHEREAS, said Plan lA of the 201 Study Plan also provided that each participatingmunicipality, including Town, and the West Smithfield Sanitary District are to own, operate andcontrol their respective collection facilities; andWHEREAS, County agreed to arrange for local capital financing of the joint usefacilities, with the participating users reimbursing the County for the cost, with participatingusers to pay all costs of operation, maintenance and equipment replacement the basic systemto be financed and operated on a user pay basis, which incorporates all joint use interception and pumping facilities lyingwithin Town and WSSD jurisdictional limits2 To serve as lead agency in implementing Plan IA of the Smithfield -Selma 201 Waste-water Facilities -21715 To contract with the Town of Four Oaks on an annual basis for operation andmaintenance of the wastewater pumping facilities known as the Four Oaks Equalization andPumping Facility, Holt Lake Pumping Station, 6 force mains, and 10 gravity line from FourOaks to a manhole along US 301 at the intersection of NCSR 1341 and US 301 in front of theWhite Swan Motel16 To invoice the Town of Four Oaks by the 15th day of the month for the previousmonths services, invoices shall show base charges and ICR charges17 To prepare, adopt, and implement a sewer use ordinance, to the extent possible,which willifi_be compatible with those of the Towns of Smithfield, Selma, Pine Level, Four Oaks,and West Smithfield Sanitary District, said ordinance to apply to all users not served byeither Smithfield, Selma, Pine Level, Four Oaks, or the West Smithfield Sanitary District18 To maintain this contract in effect for a period of ten 10 years from the dateof its execution and to renew the contract in increments of ten 10 year periods upon mutualagreement of both parties; said initial 10 -year period being dictated by the ten -year waste-water treatment plant design flow under the 201 PlanII TOWN OF FOUR OAKS DOES HEREBY AGREE1 To participate in Plan 1A of the Smithfield -Selma 201 Wastewater Facilities planwith the County of Johnston to serve as lead implementing agency for the Plant; the County ofJohnston to own, operate, and control the central wastewater treatment plant and all joint usecollection, interception, and pumping facilities outside Town jurisdictional limits in additionto all joint use interception and pumping facilities lying within Town jurisdictional limits;the County of Johnston also to construct all joint use wastewater facilities improvements andto finance the local capital cost share of the first phase, second stage facilities2 To pay the County of Johnston a connection charge in the amount of the Townspro -rata share of the capital expenditure for the local cost of the Four Oaks to Smithfieldpumping and transmission facilities, in accordance with the Agreement between the County ofJohnston and the Town of Four Oaks dated May 16, 1979, and which is attached hereto3 To prepare, adopt, and implement and Industrial Cost Recovery System in accordancewith EPA requirements, therefor, and meeting the approval of the County of Johnston4 To prepare and adopt a suitable sewer use ordinance subject to the approval of theCounty of Johnston and to implement same prior to completion of construction of the Townswastewater facilities5 To prepare, adopt, and implement a user charge system based on quantity and qualityof wastewater meeting the approval of EPA, the ICR provisions of the user charge system shallmeet the approval of the County of Johnston6 To pay the County of Johnston, within 15 days after receipt of an invoice charges,for receiving, transporting, treating, and discharging wastewater from the Four Oaks sewersystem, County facilities for which the Town wouldcontract with the County for operation and maintenance and to implement said cost accountingsystem prior to completion of construction of the Four Oaks wastewater systemiitFebruary 2, 1981 Cont9 To prepare an annual budget for the cost of operation, maintenance, and replacementof said County facilities and submit same to the County by April of each year10 To prepare an audit of all costs of operation, maintenance, and replacement of theaforesaid County facilities and submit to the County by December 31 of each year11 To provide sewer taps to all potential customers requesting sewer service whichlie within the legal and or contractual jurisdictional limits of the Town, provided thepotential customer is situated within a reasonable distance of an existing gravity sewer lineand gravity service can be provided to said customer; it being understood that, in event saidcustomer is not provided water by the Town, then the Town shall require the customer to installat his own cost an approved water meter on his individual well system and grant the Town accessto read the meter for sewer billing purposes12 To maintain this Agreement in effect
