Meeting of Board of Commissioners for the County of JohnstonSeptember 7, 1982The Johnston County Board of Commissioners met•in regular session on Tuesday,September 7, 1982, at 10 oclock am, in the Commissioners Room of the Johnston CountyCourthouse, Smithfield, North Carolina, with the following members presentNorman C Denning, Chairman, Frank B Holding, Vice Chairman, James W Cash,Howard Benton and John M Booker, DVMMembers Absent NoneThe Chairman called the meeting to order and the following business was transacted1 MinutesThe minutes of the August2, 1982, board meeting stand approved as recorded2 Sheriff Johnson Addresses Board - Departments Conditions and Special DeputiesSheriff George Johnson met with the board to address the needs of the SheriffsDepartment and to discuss the need for the assistance of special deputies in the SheriffsDepartmentThe Sheriff stated that, with the 19 men he now has, special deputies are essentialif the Sheriffs Department is to perform the duties required by the North Carolina GeneralStatutes The Sheriff presented the board with an employee comparison of the Johnston CountySheriffs Department to other counties with population between 60,000 to 80,000 Thiscomparison showed Johnston County the largest in square miles, however, with the least numberof regular deputies Continuing, the Sheriff emphasized that with crime on the rise andchanging conditions in the county, and with the number of papers to be served, with the migrantlabor force, special deputies are vital to the operation of his department He further statedto the board that the demands are great and the citizens of Johnston County deserve and needmore law enforcement, and that the Board of Commissioners should pay very close attention tothe growing needs of the county Sheriffs Department as he desperately needs their supportComments by board members indicated support to the Sheriff and his staff and to thisdepartments needs, and,too, the board desires to accept its responsibility in an effort toprovide the citizens of this county with better law enforcement and to bring this departmentup to standardsSheriff Johnson was commended by board members for the job he is doing with hispresent staff and with what he has to work with The board, however, still contended thatspecial deputies should not receive payment for service of a paperby telephone, and furtherthat no special deputy, at any time, should drive a county car for reasons of insurancecoverageThe board concluded they should look into the operation of the Sheriffs Department,so they can more fully understand the Sheriffs situation and make every effort to do the bestjob possible in providing satisfactory and adequate law enforcement for the citizens of thiscounty3 Soil Survey ReportBill Harrell, Supervisor, and Dan Bliley, Soil Scientist, Department of Water andSoil Conservation, reported on the Soil Survey in Johnston County Mr Bliley stated about15 of the field mapping has not been done, however, it should be completed by September of1983 The Soil Conservation Service will publish a Soil Survey Report when the Soil Surveyhas been completed in the county, but it will probably not be ready for publication untilabout 1985, however, all information gather in this survey will be available in the SoilConservation Office4 Airport Authority — Improvement ProjectColonel Paul Johnson, Chairman, Johnston County Airport Authority, met with the boardto report on the Airport Development Grant and Improvement Project Colonel Johnson explainedthat the Airport Improvement Plan had been approved by the FAA and that State funds have beenapproved for this project The improvement project involves extension of the runway from 3700to 4400 feet toward Swift Creek and to add a taxiway along the runway The Chairman furtheradvised that the Federal Government will require assurance that there will be compatible useof land surrounding the airport or that the county will make satisfactory progress in adoptingland use controls before a grant for airport development can be made The board was alsoadvised that this improvement project does not require any additional land easementsColonel Johnson further advised the board that the FAA is mostly concerned with theheight of structures that may be built near or around the airport and in talking with theCounty Planner, it is his opinion, that a Height Limitation Ordinance may be more suitableat this time than comprehensive land use planning or zoningSeptember 7th ContinuedSeveral interested residents that live near or around the airport property, andthat own adjoining property, were present at this meeting showing concern about land useplanning, operations at the airport, surviellance and improvement projectsAfter discussion, the board instructed the County Manager to work with the CountyPlanner and Planning Board to draw up an Ordinance for Land Use Planning around the airportproperty for the boards study and considerationColonel Johnson also advised the board that the Airport Authority is consideringwith the Board of Commissioners concurrence submitting a proposal for an FAA Communicationsbuilding to be constructed at the Johnston County Airport Colonel Johnson stated that shouldJohnston County receive this bid it could mean about 80 federal employees in this facilityThe board advised they had no objections to this proposal5 Road PetitionsPaul Anderson, North Carolina Department of Transportation, visited with the board,and at this time the board considered several road petitionsUpon motion by,Commissioner Frank B Holding, duly seconded by Commissioner HowardBenton and carried by unanimous vote, the following road petitions were approveda South Englewood Drive SR 2176 from Second Street NC 222 to dead end; tobe removed from the State Highway System and added to the Town of Kenly StreetSystem;b Goldsboro Street SR 2344 from College Avenue to Pope Street to be removedfrom the State Highway System and added to the Town of Kenly Street System;c Pope Street from Goldsboro Street to Second Street to be added to the StateHighway System as a connector between NC 222 and SR 23446 SubdivisionsUpon the recommendation of the County Planner, Commissioner Frank B Holding movedthat the following subdivision be approved and the Chairman authorized to execute the plat;Ia Edward Turlington, Wilsons Mills Township, 6 lots, location intersection ofHighway 70 -A and SR 1907 Commissioner John M Booker seconded the motion whichwas carried by unanimous voteUpon the recommendation of the County Planner, Commissioner Howard Benton movedthat the following subdivision be approved and the Chairman authorized to execute the plat;b Duane Poole, Clayton Township, 5 lots, location SR 1556 approximately 1 milenorth of Swift Creek addition to subdivision recorded prior to SubdivisionRegulations effective date; see Environmental Health Soil Report No 316,8- 19 -82Commissioner James W Cash seconded the motion which was carried by unanimous vote7 Voting Machines - Contract AwardedCommissioner Howard Benton moved that the contract to purchase nine 9 electronicvoting machines be awarded to Airmac Technology Systems, Inc, at a bid price of 33,200, witha delivery date of 60 days after contract awarded and payment within 30 days after deliveryCommissioner John M Booker seconded the motion which was carried by unanimous vote8 Budget Amendment — SchoolUpon a motion by Commissioner John M Booker, duly seconded by Anointment - ABC BoardCommissioner James W Cash moved that Lloyd Gilbert of Smithfield be reappointedto the Johnston County Alcoholic Beverage Control Board for a three year term This termhaving an Director, Johnston County HealthDepartment and Johnnie Stott, Tax Administrator, Commissioner Frank B Holding moved that oneyear extensions of service be granted to Joyce Jones Health Department and Millard B Peedin Tax Administration Department in accordance with Article VII, Section 13 of the JohnstonCounty Personnel Policies These two employees having reached the retirement age of 65Commissioner John M Booker seconded the motion which was carried by unanimous vote12 Easement Across County Property - Brian LangleyBrian Langley, President, Langley Construction Company, has requested an easementof approximately 80 feet across county owned property behind the Johnston County Rescue SquadBuilding located on 301 highway southThis easement will enable Mr Langley to request the Town of Smithfield to lay a34 inch water line to a repair shop on his propertyAfter discussion, Commissioner Frank B Holding moved that the County Attorney beinstructed to draw the proper easement, one that will be adequate and suitable for Mr Langley,however, one that will protect the countys propertyCommissioner James W Cash seconded the motion which was carriedby unanimous vote13 Fireworks - Benson Mule DayCommissioner Howard Benton moved that the request from the Benson Chamber of Commerceto hold a fireworks display on Saturday, September 25, 1982, in conjunction with the BensonMule Day Celebration be approvedCommissioner John M Booker seconded the motion which was carried by unanimous vote14 Second Exit - County JailThe County Manager reported to the board on the recommendations made by architectson a second exit from the county jail The County Manager stated that he had asked twoarchitects for recommendations, and these architects, working independently, had reached thesame conclusion; in order to provide the second exit, the entire stairwell from the basementto the jail will have to be closed in; walls would have to be built around the stairwell oneach of the upper floors The cost has been estimated to be around 80,000, and the structuralchanges would drastically alter the appearance of the-CourthouseThe County Manager further reported that he had visited the jail to find 46 prisonersin a jail with beds for 39, and this overcrowded condition exists virtually every week -end, andthe capacity of the county jail is no longer adequate to serve Johnston County It is verylikely that any amount of money spent on the present jail would do little or nothing to improvethe overcrowded conditions The situation with the jail being on the -top floor of the Court-house will continue to cause greater problems with time The County Manager recommended thatthe board retain an architectural firm which specializes in jail construction to draw up pre-liminary plans to construct a new jail on one level to be built adjacent to the CourthouseAfter discussion, the board agreed that the county should not spend 80,000 fora second exit from the present jail facility15 Recreation Grants ApprovedAfter discussion and upon motion by Commissioner Frank B Holding, duly seconded byCommissioner James W Cash and carried by unanimous vote, the Litter campaign, andWHEREAS, Governor Jim Hunt has designated the first day of the campaign as YouthInvolvement Day WHEREAS, the Department of Transportation will furnish at least three litter pick -upcrews in every county to work with volunteers in litter clean up efforts;WHEREAS, all of our citizens and civic groups will want to participate in theseactivities;WHEREAS, the Board of regulationsin the Johnston County Subdivision Regulations Mr Wilson contended that the Countys Sub-division Regulations on the number of lots allowed on a private street do not agree with theregulations of the North Carolina Department of Transportation Mr Wilson asked that theCounty Subdivision Regulations wording on Page 11 be changed to read at least two insteadof not more than two After discussion, Commissioner Frank B Holding moved that this complaint be referredto the Johnston County Planning Board for review and considerationCommissioner-John M Booker seconded the motion which was carried by unanimous vote22 County Owned Lot - Wilsons Mills TownshipJohnnie Stott, Tax Administrator, and John Whitley, Attorney talked with the boardregarding a lot located in Wilsons Mills Township owned by the county This lot was foreclosedon in the 1930s by the county Mr Whitley stated that he has a potential negotiable buyer ifthe board is interested in selling this lot In discussion, the board questioned if it wouldbe sound judgement to sell this lot, as it may be advantageous to the county in conjunctionwith the Wilsons Mills Community Development Project should this project be approved and fundedAfter discussion, Commissioner Frank B Holding moved the board ask CommissionerJohn M Booker to look into this matter and determine if the county should kept the
