Board of Commissioners for the County of JohnstonJanuary 2, 1979The Johnston County Board of Commissioners met in regular session in theCommissioners Room of the Johnston County Courthouse, Smithfield, North Carolina,Tuesday, January 2, 1979, at 10 oclock am, with the following members present;Norman C Denning, Chairman, Frank B Holding, Vice Chairman, J ERogerson, John M Booker, DVM, and James W CashMembers Absent NoneThe Chairman called the meeting to order and the following business wastransacted1 Minutes - December 4, 1978 - ApprovedThe Board of Commissioners reviewed the minutes of the December 4, 1978,board meetingCommissioner John M Booker moved that the minutes of the December 4, 1978,board meeting be approved as recordedCommissioner James W Cash seconded the motion which was carriedunanimously2 Appointment - Nursing Home Community Advisory CommitteeCommissioner James W Cash moved that Thelma Pearson of Clayton beappointed to the Johnston County Nursing Home Community Advisory Committee for aterm of one year beginning February 29, 1979Commissioner John M Booker seconded the motion which was carriedunanimously3 Mobile Home Ordinance Enforcement - Town of MicroCommissioner J E Rogerson moved that the request from the Town of Microto permit the County Code Enforcement Officer to enforce the Johnston County MobileHome Ordinance as an employee of the Town of Micro be approved CommissionerRogerson further moved that a nominal annual fee of 5000 be assessed the Town ofMicro as has been assessed other towns for this serviceCommissioner John M Booker seconded the motion which was carriedunanimously4 Report on Roofs - Courthouse and LibrKramer Jackson, County Administrator, reported that along with Don Hines,Consultant, Celutex Corporation, and Harry McGee, Architect, he and Buck McLamb,,Maintenance Supervisor, had inspected the roofs of the Courthouse and Librarybuildings The problem was bubbles in the top layer caused by the layer methodused to cover the roofs Mr Jackson explained neither roof is in immediate dangerof leaking unless the air bubbles are broken Mr Jackson also advised the boardan approximate cost to reroof would be for the Courthouse 10,000 and Lij?rary-15,0005 Budzet Amendment - Social ServicesCommissioner James W Cash moved that a budget amendment for the Departmentof Social Services be approved in the amount of 10,000 to cover the expenditureof state funded abortions, and further that the budget be increased by adding toState Revenues - Family Planning 1035008 10,000 and Expenditure - FamilyPlanning 1061061 10,000Commissioner Frank B Holding seconded the motion which was carriedunanimously6 ONeals Fire District - Resolution Calling Special ElectionCommissioner J E Rogerson moved that the following resolution be adoptedRESOLUTION CALLING SPECIAL ELECTIONWHEREAS, A PETITION has been duly presented to the Johnston County Boardof Commissioners by at least fifteen per cent of the resident freeholders livingand residing in the area lying outside the corporate limits of any municipality inJohnston County, North Carolina, which area is designated as the Oneals FireDistrict and being described as followsJanuary 2, 1979 ContBEGINNING AT A POINT 1 on N C 39 11 miles north of its intersectionwith SR 1731; thence in a northeasterly direction to thebeginning point on N C 39It is requested that the Board of Elections in Johnston County hold aspecial election in said district for the purpose of submitting to the qualifiedvoters in said area the question as to whether or not there shall be levied andcollected in said area a special tax not to exceed fifteen 15? cents on the 100in valuation of all taxable property, real or personal, in said area for thepurpose of providing fire protection in said fire districtCommissioner John M Booker seconded the motion which was carriedunanimously7 Minutes - December 28, 1978 ApprovedThe Board of Commissioners carefully reviewed the minutes of the specialcalled meeting of December 28, 1978Commissioner Frank B Holding moved that the minutes of the December 28,1978, board meeting be approved as recordedCommissioner John M Booker seconded the motion which was carriedunanimously8 Wastewater Pretreatment Facilities - Cutter Laboratories - Town of ClaytonFramer Jackson, County Administrator, told the Board of Commissioners theTown of Clayton is requesting 114,500 for the construction of a SupplementalWastewater Treatment Facility for Cutter Laboratories Mr Jackson explained theTown of Clayton needed the boards approval and authorization to start design workon or before April 1, 1979 It was pointed out the county had previouslycommitted capital outlay funds at such time as needed for this project MrJackson also advised the board the Town of Clayton is requesting that the countygive up all claims on the existing pretreatment facilities at Cutter LaboratoriesThe county contributed 10,000 on the existing pretreatment equipment at CutterLabs hair Jackson explained that this industry is upgrading the present pre-treatment facilities on their site in order to pretreat waste from the new plantnow under constructionAfter much discussion of the above request, Commissioner Frank B Holdingmoved that the County of Johnston relinquish all claims, responsibilities andobligations on the existing wastewater pretreatment equipment at the CutterLaboratories siteCommissioner James W Cash seconded the motion which was carriedunanimouslyThe board discussed the Town of Clayton request of 114,500 at length withreference to the cost of the water line projects, wastewater projects, and theera of doing things the county has been in for the past three years TheCommissioners pointed out it can not continue at this pace, with respect to thetax rate, the revaluation and the effect it will have on the taxpayer and thecountys financial status at this time The chairman emphasized that the Town ofClayton in -this particular case has obligations as well as,the countyi ; IJanuary 2, 1979 ContAfter further discussion, Commissioner Frank B Holding moved that theTown of Clayton be authorized tostart design work on the Supplemental Treatmentcapacity to serve the new Cutter plant now under constructionCommissioner James W Cash seconded the motion which was carried by thefollowing voteAye Frank B Holding, James W Cash, J E Rogerson and Norman CDenningNay John M BookerHowever, Commissioner Frank B Holding further commented the commitment offunds from the county and the repayment schedule should be handled in the samemanner as the other projects and a contractual agreement between the county andthe Town of Clayton signed before a definite commitment of funds authorized Theother board members agreed and Commissioner Frank B Holding moved that the abovemotion to authorize the Town of Clayton to proceed with the design work on thesupplemental wastewater treatment capacity to serve the new Cutter plant berescindedCommissioner James W Cash seconded the motion which was carriedunanimouslyThe board at this time asked Mr Jackson, County Administrator, to draw upan agreement between the County of Johnston and the Town of Clayton, and furtherthat this agreement be considered by the Town of Clayton for adoption and broughtback before the Board of Commissioners at the February meeting9 ReportsThe following reports were filed with the boardDog Warden, Agricultural Extension Service, Veterans Office, ElectricalInspector, Tax Supervisor, Revaluation Report, Financial Report, Waterand Sewer Line Reports10 Tax Refunds and ReleasesJohnnie Stott, Tax Supervisor, met with the board and explained that 11rGeorge Alassad, TA Edmonds Department Store in Benson had paid receipt # 1714 -A1978 afterlist under protest Air Stott further explained that as the result ofthe audit which was made during 1978, and Mr Massad understands the procedurewhich was used and understands the additional assessed value of the inventory, buthe does not feel it fair to charge the late listing penalty of 7507 In orderto prevent the possibility of late payment penalty, Mr Massad paid,all the taxesand penalty under protest based on his right to appeal the late listing penaltybefore the Board of CommissionersThe Board of Commissioners discussed this matter at length, and wasinformed by Mr TZassads son that an attorney had listed this property representingMr George Massad T A Edmonds Department Store, Benson, N C and he was of theopinion that the 1978 property,tax listing had been properly taken care of and ontime ,Commissioner Frank B Holding, in further discussion, asked Mr Jacksonwith the assistance of Johnnie Stott, Tax Supervisor, to make a complete in-vestigation of this tax matter as there may have been some error made not knownto Mr Massad11 Solid Waste Ordinance ProposedLeon Powell, Sanitarian, Johnston County Health Department, met with theboard and presented a proposed Solid Waste Ordinance for Johnston County for theboards study and consideration Air Powell told the board the ordinance wastentatively adopted by the Johnston County Board of Health on November 20, 1978In introducing the ordinance, Mr Powell commented that the county has nomeans to control the abuse of solid waste disposal Mr Powell further commentedthere are many problems with solid waste disposal in the county, as they getcomplaints every week about solid waste dumping The Board of Commissioners discussed this proposal at length and agreedit needs more study and consideration Commissioner Holding commented that puttinan ordinance on the books is serious business r536January 2, 1979 ContCommissioner Frank B Holding moved that the board not consider the SolidWaste Ordinance for adoption at this timeCommissioner John M Booker seconded the motion which was carriedunanimously12 Board of Education - Request for Commitment of Funds - Selma ProjectiJohn Radford and members of the Johnston County Board of Education, alongwith E S Simpson, Superintendent, and a delegation from Selma representing theSelma project request met with the Board of Commissioners asking for considerationof funds for two more school projects, Selma and Benson Elementary additions, oneproject now Selma and the other project Benson as soon as possible Mr Radforasked that the Board of Commissioners consider a Literary Loan if county funds arenot available when needed by the Board of Education for these projects Mr Radforalso advised that plans are ready on the Selma project and Benson would like toproceed as soon as possible Commissioner Frank B Holding asked how much moneythe Board of Education had to appropriate to the Selma project now Mr Simpsonreplied, about 40,000 and this is approximately a 250,000 project CommissionerHolding also asked Mr Simpson, how much money would be needed on the Selma projectand how soon Mr Simpson indicated about 70,000 to 75,000 a month in July,August and September; and the project is tentatively set for completion by Septembe30, 1979The board was concerned and asked whether or not the county could handlethis Mr Jackson told the board that county funds are low and problems maydevelop during the next fiscal year Mr Jackson suggested that the Board ofEducation proceed with formalities and make application for State Liberary Fundsso that the money will be ready when and if needed The Chairman assured theBoard of Education members and the Selma delegation the county would not be thehold up when the money is neededAfter further discussion, Commissioner Frank B Holding moved that, subjectto the Board of Educations action with the necessary resolution seeking StateLiterary funds the Board of Education proceed with plans for the Selma ElementaryClassroom project Commissioner Holding further moved that the county willappropriate the necessary amount of money for this project in the 1979 -1980 BudgetCommissioner J E Rogerson seconded the motion which was carried 3unanimouslyf13 Landfill ProblemsCommissioner Frank B Holding advisedBoard of Commi ?ners that there are seriousoperations aidoardneeds to give much studythis situationUpon a- motion by Commissioner John MFrank B Holding and carried unanimously, thethat he wanted to give notice to theproblems with the countys landfilland consideration as how to deal witBooker, duly seconded by Commissioneboard adjournedNormET C Denning, Chairmay, OFEleanor N Creech, Clerki 4I 41 l?A?
