Meeting of Board of Commissioners for Johnston CountyJune 7, 1982The Johnston County Board of Commissioners met in regular session Monday, June 7, 1982,at 10 Oclock am, in the Commissioners Room of the Courthouse, Sanithfield, NorthCarolina, with the following members presentNorman C Denning, Chairman, Frank B Holding, Vice Chairman, James W Cash,John M Booker, DVM, and Howard BentonMembers Absent NoneThe Chairman called the meeting to order and the following business was transacted1 MinutesThe minutes of the May 3, May 10 and May 17th board meetings stand approved asrecorded,2 Quit -Claim Deed to T W Shirley and WifeW R Britt, County Attorney, reviewed with the board a Quit -Claim Deed from the countyto T W Shirley and Wife, Hazel W Shirley This deed prepared by George W Mast, Attorneyfor T W Shirley and wife This lot located in Greytown, Smithfield Township was sold fortaxes by the county in 1932 Misted to Olive Horton and later reconveyed back to Olive HortonThere are back taxes owed on this property in the sum of 56293, from 1963 to 1981 MrShirley has agreed to pay the back taxes at the time the property is conveyed to himAfter discussion and review with the County Attorney, Commissioner Howard Benton movedthat the Chairman be authorized to execute the following Quit -Claim Deed to T W Shirley andwife, Hazel W Shirley, upon payment of back taxes in the amount of 56293;BEGINNING at a point on Hill Street at the corner of Fenny Sanders lot lot # 5 andruns southwest 52 12 feet to Eno Peacocks corner, known as Lot ## 3; thence along the line oflot # 31n a southeast direction 96 feet; thence parallel with Hill Street in a northerlydirection 52 12 feet to line of lot # 5, owned by Fenny Sanders; thence along the line ofsaid lot # 5 in a northwest direction 96 feet to Hill Street, the beginning point and beinga part of lot ## 4 in Block C in the plan of Greytown as recorded in Book A -6, Page 271,Also see H -7, -Page 63 and Book 137, Page 346, Johnston County RegistryCommissioner James W Cash seconded the motion which was carried by unanimous vote3 Highway EngineersWayne Bailey and Paul Anderson, Department of Transportation, met with the board anddiscussed several roads in Johnston County Commissioner Howard Benton talked with the engiabout a road # #1133 in Banner Township that was being stabilized for paving CommissionerBenton spoke with the engineers advising that he had heard that this road #1133 was to beabandoned for the paving of another road Mr Bailey indicated this was apparently just arumor4 Tax Release Request - Jennifer Woodard Creech HeiligJohnnie Stott, Tax Administrator, explained to the board that Jennifer Heilig, who waspreviously Jennifer Woodard Creech was requesting a release of 49 interest and 4,00 costof sale which has been assessed on a real estate listing in the name of Jennifer Creech TheTax Administrator explained that Mrs Heilig was requesting a release because she stated shehad not received her tax statements, and further advi8ed - that Mrs Heiligs addresshad changed several times and she had listings in two different names, the tax office hadmade every effort to notify her, and further that a person was liable for their taxesAfter discussion, Commissioner Howard Benton moved that Mrs Heiligs request for arelease of 49 interest and 400 cost of sale be denied and that the Tax Administratornotified her of this actionCommissioner James W Cash seconded the motion which was carried by unanimous vote5 Tax Release Reauest - Larry BailJohnnie Stott, Tax Administrator, again talked with the board regarding Larry Bailysrequest for a release from paying late payment penalties on his outstanding tax account TheTax Administrator explained that Mr Bailys contention was that he moved out of the countyand left the paying of his taxes up to his secretary The Tax Office does not show aforwarding address for Mr Baily The only address the tax office has on each abstract forMr Baily is Route ## 1, Zebulon Mr Baily feels that as he did not receive the tax notices,he should not be responsible for penalties and legal fees and request that the board releasethe amount of 7334230June 7th ContinuedThe Tax Administrator further explained that the late payment penalty and cost for 1981had been released due to Mr Bailys attempt to pay his 1981 taxesThe board discussed this matter at length again, however, agreed that Mr Baily` wasresponsible and liable for his taxesCommissioner Howard Benton moved that Mr Bailys request be deniedand that he benotified and directed to pay back taxes, penalties and cost in the amount due and payable asof February 1, 1982Commissioner James W Cash seconded the motion which was carried by unanimous vote6 Subdivision- High MeadowsHarold Blizzard, County Planner, and Lewis R Wilson, Developer, met with the boardregarding the High Meadows Subdivision This plat was presented for approval at the May 3rdboard meeting, however, it was determined that the private road had not been completed as ofthat date, therefore, the board delayed approval until such time as this road would be finishedAt this meeting date, due to the wet weather, the private road has still not beencompleted, however, Mr Wilson requests permission to put up an amount of money in escrowneeded to complete this road in case of default on his part, and further requests that theboard approve the High Meadows Subdivision platAfter discussion, Commissioner Frank B Holding moved that the High Meadows Subdivision,Wilders Township, be approved and the Chairman be authorized to execute this plat CommissionerHolding further moved that the county accept a cashiers check in the amount of 4,125 payableto Johnston County and deposited with the County Manager, to be held in escrow until such timeas the private road in the High Meadows Subdivision, Wilders Township has been completedCommissioner Howard Benton seconded the motion which was carried by unanimous vote7 Wilsons Mills Community Development ProjectKramer Jackson, County Manager, told the board that he had met with Ralph Willoughby,North Carolina Department of Human Resources, and the Wilsons Mills delegation, and hadlearned that it was possible to receive Community Development funds from the State providedthe project qualifies for grant funds Representatives from Triangle ,J Cbun-c,il of Governmentshave visited the Wilsons Mills area and determined that it would be a good selection for a {Community Development grant as substandard conditions exist in this community, with the watersupply and housing seeming to be first priorities that need to be improvedThe County Manager also told the board that Triangle J advises that funds are availablefor about fifty 50 projects in North Carolina that may get as much as 750,000 each, and theWilsons Mills area stands a good chance in getting approvalThe Wilsons Mills group is asking the county to file an application prior to July 30,1982, and to sponsor this project as Wilsons Mills is an unincorporated communityThe County Manager also told the board should the board approve the filing of anapplication for a Community Development Block Grant, they would- contractwith Triangle J toprepare the application and the charge will be 2500 per hour, not to exceed 3,000, however,this amount may be grant eligible fundsThe board discussed this matter at length, however, delayed action at this time8 Moccasin Creek Drainage DistrictGordon Peedin met with the board seeking 3,000 for maintenance of the Moccasin CreekDrainage District Mr Peedin indicated this should be the last time they have to seekfinancial assistance from the county for maintenanceAfter discussion, Commissioner Frank B Holding moved that 3,000 be appropriated tothe Moccasin Creek Drainage District for maintenance and further that the budget be amendedin the following mannerFrom Contingency Fund 4007490 3,000To Moccasin Creek DrainageDistrict 10823,82 3,0001Commissioner John M Booker seconded the motion which was carried by unanimous voteJune 7th Continued9 Region J EMS Council - July 4thCommissioner James W Cash moved that the Four OaksCivitan Club and the Archer LodgeCommunity Recreation Center be granted permission tohold a fireworks display on Saturday, July3, 1982, at their designated locationsCommissioner John M Booker seconded the motion which was carried by unanimous vote11 Tires — Sheriffs Department - Contract AwardedThe County Manager reviewed the following bids for tires for the Johnston CountySheriffs Department; 6,84625 7;07755 7,07755 7,95875After discussion and review of these bids, Commissioner Howard Benton moved that thecontract to furnish 160 police pursuit radial tires to the Johnston County Sheriffs Departmentbe awarded to Perry Brothers Tire Service of Smithfield, low bidder, at a bid price of 6,84625Commissioner Frank B Holding seconded the motion which was carried by unanimous vote12 Audit Contract AwardedThe County Manager reviewed the following bid proposal from Daniel G Matthews andAssociates, Smithfield, to perform the 1981 -1982 audit for Johnston County;County of Johnston General Fund, Capital Outlay Fund, Revaluation Fund, PublicAssistance Fund, Debt Service Fund, Revenue Sharing Fund and Anti - Kenly LeakThe County Manager advised that Tim Broome, Ragsdale Consultants, had reported a leakin the 16 water line near Kenly, and that they had talked with the Mayor of Kenly and advisedthey needed to fix the leak The board instructed the County Manager to make an investi-gatioA and determine what the cost will be to repair the water line15 Recreation Grant Extension - Bentonville Recreation CouncilCommissioner John M Booker moved that the Bentonville Recreation Council be grantedan extension of thirty 30 days July 30th to use the 1981 -1982 Revenue Sharing RecreationGrant of 1,920Commissioner Frank B Holding seconded the motion which was carried by unanimous vote16 Wilsons Mills Community Development Grant ApplicationThe board again discussed the Wilsons Mills request for the county to sponsor aCommunity Development project, keeping in mind that representatives from Triangle J havevisited the area and determined that there are substandard housing and other deficienciesin this areaAfter further discussion and much consideration, Commissioner Howard Benton moved thatthe county sponsor an application for a Community Development project at Wilsons Mills, thisapplication to be filed with the North Carolina Department of Human Resources, prior to July30, 1982, and to contract with Triangle J to prepare the application for the Wilsons MillsCommunity Development Block Grant, and that the cost to prepare the application not exceed3,000Commissioner Frank B Holding seconded the motion which was carried unanimously17 Landfill - Lo -Boy TrailerCommissioner James W Cash moved that the County Planner and County Manager be authorizto purchase a 1977 Lo -Boy trailer, if they determine it is in good condition, for hauling thetractors and equipment to and from different locations were neededCommissioner Frank B Holding seconded the motion which was carried by unanimous vote18 Industrial CoordinatorThe board briefly discussed industrial coordination for the county and agreed that thecounty needs to be ready to work with industrial prospects19 Hospital AccreditationThe board briefly discussed accreditation problems at Johnston Memorial HospitalCommissioner Howard Benton, who serves as Chairman of the Hospital Board of Trustees, explainedsome areas of problems with the accreditation team20 Planning GrantThe board asked the County Manager to look into a Planning Grant through Triangle JCouncil of Governments A Planning Grant could determine where Johnston County should goeconomicallytIrJune 7th Continued21 Budget WorkThe County Manager briefly discussed with the board the 1982 -1983 Proposed Budget,however, the board postponed any decisions on the budget until a later dateUpon a motion by Commissioner John M Booker, duly seconded by Commissioner Frank BHolding and carried, the board recessed to meet again Tuesday, June 22, 1982, at 730 pmNorman C Denning, ChairmanEleanor N Creech,Clerk to the Board
