reported by Kramer Jackson, Finance Officer reports onfile4 Department of Transportation - Right -of -Way - Holt LandUpon a motion by Commissioner Frank B Holding, duly seconded byCommissioner James W Cash and carried unanimously, the following Right -of -WayAgreement was adoptedSTATE OF NORTH CAROLINACOUNTY OF JOHNSTONTHIS AGREEMENT, made and entered into this the 6th day of August, 1979, byand between the County of Johnston, Grantors, of the State aforesaid, and theDEPARTMENT OF TRANSPORTATION, an agency of the State of North Carolina, Grantee;W I T N E S S E T HTHAT WHEREAS it is mutually agreed between the parties hereto that theGrantee, may use an area owned by Johnston County for the purpose of perpetualingress and egress the land lying to the Northeast of the Johnston County tract,formerly belonging to Robert Lee Holt, now belonging to the Department ofTransportation; said area over which the Department of Transportation shall havefull right of ingress and egress is described as follows Being an area 15 inwidth on each side of the following described survey line; Beginning on a pointlying in the centerline of SR 1503 said point is approximately 050 mile north-east of the intersection of SR 1503 and NC 210; thence north 77 degrees 14 east71930 to a point; south 85 degrees 14 east 30030 to a point; thence north 83degrees 31 east 30000 to a point; thence north 57 degrees 11 east 8466 toa point; thence north 43 degrees 10 east 180 to a point, said area containingapproximately 124 acres The above described easement area is the same as theeasement area described in Deed Book 790, pages 560 -61 and attached sketchThe above described area is located in Smithfield Township, JohnstonCounty and is a portion of that tract of land recorded in Deed Book E -5 at Page 1of the Johnston County Registryand land Division E, Page 305The Grantors convenant that they are the sole owners of said land in fee;that they are the only persons having the right to execute this agreement; that said installation of a PoliceInformation Network terminal is considered to be most necessary to the preservatioof law and order and the promotion of public safety within the County; andWHEREAS, the North Carolina Department of Justice, Police InformationNetwork and this County have agreed as follows;A The North Carolina Department of Justice, Police Information Networkwill install and maintain a video terminal and printer connected to the PoliceInformation Network systemand also train operators selected and paid by theCounty to operate such terminalBThe County shall furnish a proper site for installation of a PoliceInformation Network terminal and also furnish personnel to operate said terminalC The County shall assume the rental cost which cost includdsmaintenance of the Police Information Network terminal in the amount of 17500per month beginning from date of installationNOW, THEREFORE, BE IT RESOLVED that the installation of a Police Inform-ation Network terminal be and it is hereby formally approved by the Board ofCommissioners of Johnston County, North Carolina, and that the Chairman of theBoard of County Commissioners or County Manager of this County be and they arehereby empowered to sign and execute the required Agreement between this Countyand the North Carolina Department of Justice, Police Information NetworkThis Resolution was passed and adopted the 6th day of August, 19798 Easement - Carolina Power and Light Company - Pine Level — Four Oaks 201Pump Station - WastewaterCommissioner James W Cash moved that Carolina Power and Light Companyhereby be granted the rights, privileges and easement to go in and upon thatcertain tract of land in Ingrams Township in said Johnston County and to construemaintain and operate in, upon, and through said premises, in a manner suitable toit, with poles, wires, cables underground conduits, and other necessary apparantuand appliances, a line, or lines for the purpose of transmitting power byelectricity, together with the right at all times to enter upon said premises forthe purpose of inspecting said lines and making necessary repairs and alterationsthereon; and the right to permit the attachment of and or carry in conduit wiresand cables of any other company or person together with the right at all timesto cut away and keep clear of said lines all trees and other obstructions thatmay, in any way, endanger the proper maintenance and operation of the same TOHAVE AND TO HOLD the aforesaid right, privilege and easement unto Carolina Powerand Light Company, its successors and assigns, foreverCommissioner Frank B Holding seconded the motion which was carriedunanimously1 ?IA 0August 6 ;, 1979 -Cant 9 Sewer Pump Station - Smithfield Junior HighKramer Jackson, County Administrator, advised the board the engineers hadrecommended that the sewer pump station used at the Smithfield Junior High Schoolbe transferred to the Pine Acres Pumping site Town of Smithfield Pumping StationThe board discussed thisto be reimbursed if this pumpingat the Pine Acres Pumping siteinstructed Mr Jackson to conferreport back to the board10 Landfill - Town of Garnematter at length and agreed that the county needsstation is to be used by the Town of SmithfieldThe board deferred action at this time andwith the engineers regarding this matter andrKramer Jackson, County Administrator, presented a request to the boardfrom the Town of Garner Mr Jackson explained they are interested in exploringthe possibility of using the Johnston County Landfill for disposal of solid wastecollected within the Town of Garner It was explained that Wake County hadincreased the rates which had caused the Town of Garner to seek an alternative totheir solid waste disposalThe board discussed this matter at length, however, declined this request11 Public LibraryJoint CommitteeThe Board of Trustees of The Public Library of Johnston County andSmithfield by written request asked the Board of County Commissioners to appointa joint library committee consisting of the County Administrator, the Town Manager,the Library Director and one or two representatives from the town and county boardsThis joint committee hopefully to study the library and its present state, tobetter understand library services needed in Johnston CountyThe board discussed this matter, however, tabled the request at this time12 Automobiles for County - Biddinv or State PurchaseKramer Jackson, County Administrator, asked the board if the County isinterested in purchasing law enforcement vehicles through State Purchase andContract or through local biddingThe board discussed this matter and agreed that if money can be saved thecounty needs to purchase cars through State Purchasing, however, periodicallyrequest local bidding to compare pricesBy motion of Commissioner James W Cash, duly seconded by CommissionerJohn M Booker and carried unanimously, the board authorized Kramer Jackson, CountyAdministrator, to submit the proper forms to the State so that the county will bepermitted to purchase vehicles through State contract13 Industrial Facilities and Pollution Control Financing Authority- AppointmentCommissioner J E Rogerson moved that Melvin Edwards Princeton and RalphCanaday, Jr Four Oaks be reappointed for a two 2 year term to the JohnstonCounty Industrial Facilities and Pollution Control Financing Authority Theseterms expiring August 1, 1981Commissioner James W Cash seconded the motion which was carriedunanimously14 Subdivision --C L ByrdUponthe recommendation of Rick Cannity, County Planner, Commissioner JamesW Cash moved that the C L Byrd Subdivision, Cleveland Township, 22 lots, beapprovedCommissioner Frank B Holding seconded the motion which was carriedunanimously15 PCB Spilled in Johnston County - LandfillTom Bradshaw, Secretary, North Carolina Department of Transportation, metwith the board seeking permission from the county to allow the State to bury thePCB spilled along 210 in Johnston County at the county landfill Mr Bradshawexplained to the board that there is an estimated 2,286 cubic yards, and 572 truckloads of contaminated soil; and the surface area required for disposal is 095 ofan acre at no cost to the county none other than use of the small portion at thecounty landfille tAugust 6, 1979 ContMr Bradshaw further explained that EPA will hold at least one publichearing prior to the clean up and work will begin as soon as the State can get apermit from EPAThe board discussed the matter at length with Secretary Bradshaw andindicated that very little public interest has been expressed to the boardCommissioner Holding indicated that he favored and was willing to donate and allowthe PCB to be buried at the county landfill as long as Johnston County is treated,the same by the state as other counties where PCB was spilled Other board membersagreed with Commissioner HoldingTherefore, upon motion by Commissioner Frank B Holding, duly secondedby Commissioner J E Rogerson and carried unanimously,the board agreed toaccept the PCB contaminated soil at the Johnston County Landfill at no cost to theState as long as similar agreements are reached with other counties where PCB wasspilled16 Subdivision GranthamUpon the recommendation of Rick Cannity, County Planner, CommissionerFrank B Holding moved that the Grantham Subdivision, Section II, Banner Township,five 5 lots, be approvedCommissioner J E Rogerson seconded the motion which was carriedunanimously17 Community Action Board - AppointmentCommissioner J E Rogerson moved that Shirley Mozingo be appointed tothe Johnston -Lee Community Action Board to fill the unexpired term of Paul KellerCommissioner James W Cash seconded the motion which was carriedunanimously18 State Highway EngineerPaul Anderson, District Engineer, North Carolina Department of Transport-ation, Division of Highways, met with the board and reported on the progress ofthe 1979 -1980 Secondary Road Program19 Road Petition - Beechwood DriveCommissioner Frank B Holding moved that the petition to add BeechwoodDrive adjoining Secondary Road # 1531 to the State Secondary Road Program; formaintenance be approved and forwarded to the North Carolina Department ofTransportation, Wilson, North Carolina,Commissioner John M Booker seconded the motion which was carriedunanimously20 Hospital Board of Trustees - AppointmentCommissioner James W`Cash moved that the Rev W-Maurice Grissom ofClayton be - appointed to the Johnston Memorial Hospital Board of Trustees to fillthe unexpired term of William Powell Bagley This is a five year term expiringOctober 1, 1982Commissioner J E Rogerson seconded the motion which was carriedunanimously21 Recreation Grants - 1979 -1980Upon a motion by Commissioner Frank B Holding, duly seconded byCommissioner John M Booker and carried unanimously, the following Revenue SharingRecreation Grants for 1979 -80 were approveda Selma Parks and Recreationb Archer Lodge Community Center, Incc Glendale Chapel Booster Club 3,0003,0003,00022 Recreation Grant Extensions for 1978 -79 Grant FundsCommissioner Frank B Holding moved that South Smithfield Primary PTAand Johnston County 4 -H Extension be granted a ninety day extension on the use oftheir 1978 -79 Revenue Sharing Recreation GrantsCommissioner John M Booker seconded the motion which was carriedunanimously1,III39 xAugust 6 1979 Cont23 Association of County Commissioners Convention - Voting DelegateCommissioner Frank B Holding moved that the board member attending theNorth Carolina Association of County Commissioners Convention in Raleigh bedesignated as the voting delegate for Johnston County and further that KramerJackson, County Administrator, be designated as Alternate Delegate in the eventa County Commissioner does not attendCommissioner John M Booker seconded the motion which was carriedunanimously24 Gower Property - Subdivision Near AirportHoward Gower again met with the board regarding seven 7 acres of landhe plans to subdivide near the Johnston County Airport on Secondary Road # 1501Mr Gower asked the board to consider damages to his property at 1500 an acrebecause of airport restrictions Mr Gower contended that the lots in this sub-division will be hard to sell with the restrictions placed on this property by theJohnston County Airport Authority and the county and because of low flying aircraftThe board discussed this matter with Mr Gower, however, deferred actionuntil the September board meeting to have time to seek legal advise from theCounty Attorney25 Computer - Tax OfficeJohnnie Stott, Tax Supervisor, met with the board and reported that fivecompetitive bids were received and opened pursuant to G S 143 -129 for a Computerfor the Johnston County Tax Office Mr Stott advised the board that he andKramer Jackson, County Administrator, had sought advice from Dr Woody Robbins,Head, Computer Science, North Carolina State University, and Roger Ellis, NorthCarolina State Ad Valorem Tax Office Mr Stott further advised that WayneComputer Centers machine and proposal for setting up the new tax system had beenrecommended by Dr Robbins and Mr Ellis Wayne Computer Centers bid for thenew computer was 74,660 with the balance for professional services in setting upthe new Johnston County tax systemAfter discussion with Mr Stott and Mr Jackson and upon all recommendationCommissioner J E Rogerson moved that Wayne Computer Center, Inc, of Goldsboro,N C, be awarded the contract for a Model CS -40 C6 Nova Processor Computer andfor the professional services to put the Johnston County tax records on a computersystem subject to satisfactory price negotiations with the companyCommissioner John M Booker seconded the motion which was carriedunanimouslyUpon a motion by Commissioner John M Booker, duly seconded by CommissionerFrank B Holding and carried unanimously, the board adjourned2Eleanor N Creech, ClerkAugust 15, 1979Norman C Denning, Chairman
