Board of Equalization and ReviewKramer Jackson, County Manager, and JohnnieStott, Tax Supervisor, advised the Boardof Equalization and Review that letters have been received and requests made from Colonial PipeLines, Southern Bell and Carolina Telephone and Telegraph that the county reduce their 1982 taxasse sment value by 4812 The county manager advised the board that allthree companies hadsubmitted data reflecting the county to be assessing property at a ratio to true market valueof 5188 The Board of` Equalization and Review discussed these requests at lengthCommissioner Frank B Holding moved that the requests from Colonial Pipe Lines, SouthernBell and Carolina Telephone and Telegraph to reduce their 1982 tax assessment values by 4812be deniedCommissioner Howard Benton seconded the motion which was carriedUpon a motion by Commissioner Howard Benton, duly seconded by Commissioner James W Cashand carried, the Board of Equalization and Review iaas•,adjaurndd3 Micro Water Association Request County FundsCarl Smith, Secretary- Treasurer, Micro Water Association, and Percell Holland, Mayor, jTown of Micro, met with the board requesting -funds from the county in the amount of 150,000to extend a water line from the existing Micro system to the North Johnston High School toprovide fire protection to the school Mr Smith stated they had been before the Board ofEducation and they favor extending the water line to the school Mr Smith,also asked thecounty for 150,000 to construct a water tankMr Smith and Gene Cobb, Engineer, explained and presented maps on the routes proposedfor the water line to North JohnstonThe board recognized the fact that North Johnston School, as well as other ruralschools_ in the county, needs fire protection, and the board commended the Micro Water Associatmembers for their concern, however, took this request under advisementApril 5, 1982 Continued4 Aeromodeling Club Park - Landfill SiteThe county manager advised the board that Bryson Houston of the Johnston County Aero-modeling Club had presented a proposal asking the Board of County Commissioners to approve afive 5 year lease agreement contract with the Aeromodeling Club for rights to use five 5acres at the Johnston County Landfill for flying model airplanesThe county manager further advised that the Aeromodeling Club proposes to constructa 15 foot wide road into the site, construct a runway 80 ft wide by 300 ft long with asphaltbeing contemplated, construct a building 20 by 20, lay -off a parking area of about four acres,install a lockable gate, and the county would be required to install a gate on the north sideof the siteThe county manager and the landfill supervisor have expressed reservations as to whetheror not the county should lease a portion of the landfill at this time, with the liability andrisk involved in opening an area of the landfill to the publicThe board discussed this matter at length with much concern regarding a five year leaseagreement contract In considering the request the board was also concerned about the Aero-modeling Club spending money for capital improvements on county property in the event theyshould have to discontinue useAfter further discussion, Commissioner Frank B Holding moved that the Johnston CountyAeromodeling Club be given permission to use, at the pleasure of the board, the designated five5 acre tract at the county landfill, and the county manager and landfill supervisor todetermine, where the gates are to be put and further to keep a close check on the use of thisarea and report back to the board should any problems occurCommissioner John M Booker seconded the motion which was carried5 Public Hearing - Johnston County Secondary Road Program 1982 -1983The 1982 -1983 Secondary Road Program for Johnston County was presented to the Board ofCommissioners by Wade Pridgen and Wayne Bailey, Engineers, North Carolina Department of Trans-portation, for consideration A Public Hearing being scheduled for this time 11oclock amand date was held with the board hearing from the following people concerned about their road,its condition, maintenance and paving priority;a Walter Barnes - Oneals Township - Secondary Road # 2106, priority number 24;b Walter Herring - Boon Hill Township - Secondary Road # 2319, priority number 10;c Earl Creech - Banner Township - Secondary Road # 1359, priority number 26;Mr Creech and the families on this road asked for a meeting with Mr Bailey andMr Pridgen regarding the traffic count system of determining priority6 1982 -1983 SecondaryRoad Program - AdoptedWade Pridgen and Wayne Bailey, Engineers, North Carolina Department of Transportation,Division of Highways, appeared before the Board of County Commissioners and presented the 1982-1983 Secondary Road Program for Johnston CountyAfter reviewing and discussing the proposed Secondary Road Program for 1982-19E3,Commissioner James W Cash moved that the following resolution be adoptedRESOLUTIONWHEREAS, The Board of Commissioners of Johnston County has received from the D partmentof Transportation the Secondary Road Program for 1982 -1983 as presented by Mr County Manager and Ben Niblock, Social Services Director, presented the proposedSocial Services Budget for 1982-1983 fiscal yearThe county manager explained that the Social Services Director had kept the cost ofnext years budget as low as possible with reductions in Administration down 21,723, minus2, Child Day Care down 3,956, minus 3, Transportation down 1,288, minus 7, ChoreServices down 38,492, minus 26 As the budget was further explained the Public Assistancerequest showed an increase of approximately 7 75,149 The request for county revenueshave increased by 6, an overall increase of 82,247The County Manager and Social Services Director explained that in this budget federalgovernment revenues have been cut 10 for a total of f 102,319, and further that Medicaid wasup 57,938 and Special Assistance for Adults was up 38,073Board members showed much concern over the federal government cuts and agreed that thecounty could not assume responsibility for the State and Federal governments The countymanager recommended that the Social Services Budget be limited to an overall 5 increase, andthat the Public Assistance Budget be cut by 16,026 to achieve the 5 increaseCommissioner John M Booker stated that he was not in favor of an increase in theSocial Services BudgetThe board deferred action until later on in this meeting and commended Ben Niblockfor his performance record as Social Services Director8 Bulk Container Site LeasedUpon a motion by Commissioner Howard-Benton, duly seconded by Commissioner John MBooker and carried, the following contract Planning Department provide plumbing,building and mechanical inspections within the towns corporate limitsMayor Whitehurst explained in a letter to the board that this willbe of great serviceto the town as the county has the trained personnelApril 5, 1982 ContinuedThe board talked about this request and Commissioner John M Booker questioned doinginspections in the area of the town limits that goes into Wilson County The county managerstated that Wilson County recognizes the Town of Kenly as sovereign and does not enforce anycodes within this areaCommissioner Howard Benton moved that the county agree to make plumbing, building and r {mechanical inspections for the Town of Kenly within the towns corporate limits including thearea that is in Wilson County on a 12 month basis, and further that the County Finance Directorkeep records of revenues and expenditures for these inspections to determine if it is feasiblefor the county to continue11 Nicklaus Drive - S R 1603Commissioner Howard Benton moved that a petition requesting that Nicklaus Driveextension of Secondary Road # 1603 be added to the StateSecondary Road System for maintenancebe approved and forwarded to the North Carolina Department of Transportation for considerationCommissioner Frank B Holding seconded the motion which was carried12 Budget Amendment - Johnston Technical CollegeUpon a motion by Commissioner James W Cash, duly seconded by Commissioner Frank BHolding and carried, the board approved a budget amendment to allow Johnston Technical Collegeto transfer 755 from the school operating budget to the school capital outlay budget, 330 forimprovement of grounds and 425 remaining cost for renovation of classrooms13 Schedule B Licenses - ResolutionUpon a motion by Commissioner Frank B Holding, duly seconded by Commissioner HowardBenton and carried by unanimous vote, the following resolution was adoptedRESOLUTION FOR SCHEDULE B LICENSESWHEREAS, it is provided in Chapter 158, Public Laws of 1939, in an act entitled,REVENUE ACT OF 1939 , under Article II Section B, License Taxes of said Chapter, as amended,that the counties of North Carolina or any of them may impose and levy a county license orprivilege tax for the privilege of carrying on the business exercises, exercising the privilege of doing the act named therein, beginning June 1, 1982, and ending May 31, 1983;WHEREAS, the County of Johnston, a body corporate and politic in the State of NorthCarolina, by and through its Board of Commissioners, desires to impose and levy said licenseand privilege taxes in Johnston County for the said tax year 1982 - 1983, in strict accordancewith the provisions of said Article II, Schedule B; and to impose and levy said taxes, andto require reasonable reports from distributors in order to make the tax levy and collectioneffective, in amounts to full extent and limit authorized under said Article II, Schedule B;NOW, THEREFORE, DID RESOLVE, THAT THE BOARD OF COMMISSIONERS OF JOHNSTON RequestedThe following requests for refunds were presented to the board for consideration1 Mr Phil 0 Lassiter of Smithfield is requesting a refund in the total amount of1,27200 This request is based on an addition error on his property card of60,000 This error was committed during the year of revaluation and was notquestioned or discovered until March 22 of this year Mr Lassiter stated thathe had thought it seemed awful high, but thought that the appraisal company musthave been right so he never questioned it until recently when he was in generalconversation with an employee and asked the employee to check into it if he hadtime When it was checked into, the addition error was discovered, copy of propercard presented showing the 60,000 error Mr Lassiter is requesting a refund for1979, 1980 and 1981 overpayment of taxes - totaling 1,27200Recommendation That amount requested be refundedAfter reviewing the above information and request from Phil 0 Lassiter, CommissionerHoward Benton moved that the refund be granted to Mr Lassiter in the amount of 1,27200 foroverpayment of taxes for 1979, 1980 and 1981Commissioner Frank B Holding seconded the motion which was carried2 Mr Dolph Overton of Smithfield is requesting a refund in the amount of 1,14108for two years overpayment of taxes on property he owns in Beulah Township MrOverton notified the tax office in 1979 that the acreage of the Industrial Park inBeulah Township was incorrect We advised Mr Overton that we were unable to makeany adjustments unless a new survey was made of the property Mr Overton informedus that he would get such a survey but in the meantime he would pay the taxes asstated Under Protest as provided in General Statutes During 1981, the surveywas completed and Mr Overton brought maps, aerial photos, and other documents toour office for observation Based on these documents, Mr Overton was assessed for70 acres that he did not own This was calculated to be an over - assessment of77,100 based on the per acre valuation on property at that site Based on thefact that Mr Overton did pay his1979 and 1980 taxes under protest contingent onpresentation of the new survey and the fact that -no sales have been made since theoriginal protestaccording to registered deeds that would alter the total acreagecount, it is recommended that the refund request of 1,14108 be grantedAfter review of the above information and request from Dolph Overton, CommissionerFrank B Holding moved that the refund be granted to Dolph Overton in the amount of 1,14108for an over- assessment of property for 1979and 1980Commissioner John M Booker seconded the motion which was carried21 Subdivision - High Meadows-- Wilders TownshipThe county planner presented a subdivision plat for the High Meadows Subdivision, 12lots, owned by Lewis R Wilson, in Wilders Township, located on SR 1700 one -half mile west ofArcher Lodge, The subdivision has a restriction that the private length required for a subdivision with 12 lots Mr Wilson is requesting a variance to theprivate road criteria due to topographical reasonsThe Planning Board has recommended that this variance be grantedAfter discussion and careful consideration, Commissioner James W Cash moved that thisvariance request be approvedCommissioner Howard Benton seconded the motion which was carried0nApril 5, 1982 Continued22 Road Petition - S R # 1554Commissioner James W Cash moved that the petition requesting that Secondary Road # 1554becconsidered for paving be approved and forwarded to the North Carolina Department of Trans-portation for considerationCommissioner Howard Benton seconded the motion which was carried23 Citizens Involvement CouncilThe county manager presented a request to the board from Johnston County CitizensInvolvement Council for operating expenses in the amount of 300 to help pay for postage,telephone cost and miscellaneous expensesAfter consideration, the board denied this request24 Bentonville Community Building - AppointmentsCommissioner Howard Benton moved that Buck Dunn and Mrs Norwood Smith be reappointedto the Board of Trustees of the Bentonville Community Building for six year termsCommissioner James W Cash seconded the motion which was carried25 County Owned Buildings - RentalsThe county manager and Commissioner John M Booker reported they had inspected thecounty owned buildings on Third Street and considering the condition of these buildings thiscommittee does not recommend renovation for office space The committee also reported thatthe roofs were leaking The board instructed the county manager to have the maintenancesupervisor paint the roofs26 1982 -1983 Social Services Budget - Tentative ApprovalThe board gave further consideration to the requests of the 1982 -1983 Social ServicesBudget and again discussed the reduction of federal funds of 102,319 The social servicesdirector reminded the board, however, that the State Govenment would pickup about 41,934 ofthe federal cutbacks, leaving an anticipated balance of 60,385 The commissioners againstrongly emphasized they are not willing to absorb any federal cutbacksAfter further discussion and consideration, Commissioner Frank B Holding moved thatthe 1982 -1983 Proposed Social Services Budget be tentatively approved with a reduction of60,385, and further that the subject of salary increases not be addressed at this timeCommissioner Howard Benton seconded the motion which was carried by the followingvote;Aye Frank B Holding, Howard Benton, James W Cash and Norman C DenningNay John M Booker27 Executive SessionAt
