-uptype roof on the Health Department This type roof would allow water to run off instead ofponding as it does nowAfter discussion, and review of the bids, Commissioner Frank B Holding moved thatWilliams Roofing and Sheet Metal of Goldsboro, N C, be awarded the contract to reroof theJohnston County Health Department as per their bid price of 25,72650, less 2,38853Commissioner Holding seconded the motion which was carriedSecondary Road Construction Criteria - Calendar Year 1982C A Gardner, Jr, and Wade Pridgen, Engineers, Division of Highways, met with theboard to discuss the Secondary Road Construction Criteria for the Calendar Year 1982 MrGardner, newly appointed Division Engineer for this district, explained the criteria approvedby the Department of Transportation to utilize the 9,937,500 allocation from the 1977 RoadBond Funds and the anticipated State Construction Funds to become available July 1, 1982;which are as follows 1 The established 1981 -1983 biennium paving priority rating systemwill be used to pave unpaved roads in the 100 counties; 2 The need to improve the unpavedroads that will not be paved into all- weather roads through the Spot Stabilization ElementProjects in the Spot Stabilization Element will be based upon a review in each county of theshort sections of unpaved roads that are in need of immediate rehabilitation or reconstructionA minimum of 15 of all funds allocated in 1982 to each county will be reserved to address thisneed If the review of the need for Spot Stabilization in a particular county determines thata minimum of 15 of funds allocated is not necessary during 1982; the Board of Transportationmember responsible for the county may request an exception of the 15 minimum requirement tothe Board of Transportations Secondary Roads Committee and the full Board of Transportation3 The need to replace small bridges with pipe 4 The need to continue to address safetyproblems on the paved and unpaved secondary roads 5 From all funds allocated by the NorthCarolina General Statutes 136 -445 formula to the 100 counties, a minimum of 20 percent ofsuch funds will be used on the State- maintained paved secondary roads This would includewidening, strengthening, intersection improvements and bridge improvements replacements Dueto the small amount of funds received by several counties, appeals for an exception to the20 percent minimum required for paved road improvements will be brought to the Board ofTransportations Secondary Roads, Committee and the full Board of Transportation by individualBoard Members 6 The Board of Transportation recognizes the potential for assistance withfunds allocated to the 100 counties for the location of new industrial manufacturing facilitiesshould the need arise due to the limitations on the Statewide Access and Public Service RoadFund which is used to provide industrial access roadsMr Gardner also told the board that Johnston Countys allocation would be approximatel879,003; Secondary Road Bond 174,282 and Regular Secondary 704,721The board was very disturbedllto learn that only about 50 of Secondary Road Fundsappropriated for 1982 will be used tolIpave unpaved roads in the county Commissioner Frank BHolding stated to the engineers that the certainly questioned the wisdom of this proposal forconstruction funds to be withheld ands used for stabilization Commissioner Holding furtheradvised that lien was opposed to this decision and by motion moved that the Johnston CountyiiBoard of Commissioners oppose using any Road Bond money to maintain secondary roadsCommissioner John M Booker seconded the motion which was carried14 Railroad Suit — Property ValuationsThe county manager, to up date the board on the Railroad Law Suit brought against theState and counties by the railroad companies, seeking relief reducing local property valuationsadvised that Federal District Court had ruled against the counties and in favor of the railroadand further that this ruling is being appealed Based on recommendations by the North CarolinaCounty Attorneys Association, the counties across the state are being asked tocontribute12,500 more to the legal fund to handle this appeal, Johnston Countys pro -rata share is46825After discussion, Commissioner Howard Benton moved that Johnston County contribute40000 to the Railroad Law Suit Legal FundCommissioner John M Booker seconded the motion which was carried15 Sheriffs Request fotAdditional Office SpaceThe county manager brought to the boards attention a request from the Sheriff foradditional office space for the Detective Division In a letter to the board, the Sheriffadvised that the detectives are faced with a desperate situation as four detectives are housedin one small r66 ,in the basement of the CourthouseThe board discussed the space problem in the Courthouse and agreed to take this requestunder advisement The board also asked the County Manager to take inventory of all countyowned property that is being rented and how much revenue received from the rentals and reportback to the board16 Extended County Telephone ServiceCommissioner John M Booker told the board that he supports the proposal seekingextended telephone service in Johnston County Commissioner Booker asked the board to adopta resolution supporting this extended serviceIn discussion, Commissioner Howard Benton told board members that he had called peopleat random seeking opinions on the extended service Commissioner Benton says he feels likethe people out in the county will be carrying the load as far as the rates are concerned; forthe extended service and that he can not go along with this endorsement without a vote of thepeople Other board members concurred, indicating they are not endorsing any type of ratestructure, but the concept of the extended serviceAfter discussion, Commissioner Howard Benton moved that the Johnston County Board ofCommissioners endorse and favor the citizens of the county being given an opportunity to voteon extended county telephone serviceCommissioner John M Booker seconded the motion which was carried17 Board of Equalization and Review - Meeting DatesCommissioner Howard Benton moved that the Board of Equalization and Review meet onApril 5, 1982, at 10 oclock amCommissioner John M Booker seconded the motion which was carried18 Tax Refunds - Raymond Elmore Earp, JrThe Tax Supervisor stated that Richard Moore, Attorney, representing Raymond ElmoreEarp, Jr, and Mary Earp Moore, is requesting a refund in the amount of 57989 for threeyears over - payment of fire district taxes This request is for fire district taxes that wereassessed as being in ONeals Fire District when in fact the property is in Thanksgiving FireDistrict Since the taxpayers knew the property was in a fire district, they did not questionthe fact-that they were being charged a fire district tax until a recent meeting withThanksgiving Fire Officials revealed that there are no taxes charged The 57989 would notaffect the county -wide charge but would be charged against ONeals Fire Department accountRecommendation That refund be grantedUpon the Refund - Harold Wayne CrossThe Tax Supervisor advised thatHarold Wayne Cross of Selma Township came to the TaxSupervisors Office on February 2, 1982, and requested a refund in the amount of 52385 whichhis lending institution paid taxes on for three yearstaxesThis property was double listed to Mr and Mrs Ervin Bailey and they also paid theRecommendation That refund be grantedUpon the recommendation of the Tax Supervisor, Commissioner Howard Benton moved thatthe above refund be granted;Commissioner James W Cash seconded the motion which was carried20 Town of Selma - Clean Water Bond Grant ApplicationThe Town of Selma has asked the county to support and endorse an application forClean Water Bond grant money in the amount of 49, 525 that will enable the town to improvetheir water facilities, total project cost 198,100Dan Collins, Selma Town Manager, explained these improvements and the cost as follows1 Deepwell No 6 with connecting 8 raw water main access road 84,0002 Cash moved that Jim Levinson be appointed to the Johnston -LeeCommunity Action BoardCommissioner Howard Benton seconded the motion which was carried22 Sasser PropertyCommissioner Frank B Holding told the board that Mrs L H Sasser had called himagain regarding her building on Johnston Street Mrs Sasser is still not satisfied aboutthe matter of the pecan trees on county property as she contends that leaves from these treeshave caused damage and deterioration to her building The board indicating that they havetaken care of any county responsibility in this matter by removing the trees from the property,asked the County Attorney to write Mrs Sasser regarding this complaintresponding accordingly23 Upchurch Property - County Purchases One -HalfThe county manager advised the board that the option on the Upchurch Property expiresMarch 15, 1982, and that the Town of Smithfield says they can pay their one -half 21,250 ofthe purchase price in July, 1982After discussion, Commissioner Frank B Holding moved that the county authorize anappropriation of 21,250, which represents the countys share, to purchase the Upchurch propertyadjacent to the Public Library on the corner of Market and Third
