Meeting of Board of Commissioners for the County of JohnstonFebruary 1, 1982The Johnston County Board of Commissioners met in regular session Monday, February1, 1982, at 10 oclock am, in the Commissioners` Room of the Johnston County Courthouse,Smithfield, North Carolina, with the following members presentNorman C Denning, Chairman, Frank B Holding, Vice Chairman, James W Cash,John M Booker, DVM, and Howard Benton -Members Absent NoneThe Chairman called the meeting to order and the following business was transacted1 MinutesThe minutes of the January 4, 1982, board meeting stand approved as recorded2 Emergency Telephone NumbersKramer Jackson, County Manager, advised the board that he had received prices onprinting stickers with the new central telephone numbers for the fire and rescue service Thecounty manager stated that sixty thousand stickers roll -type would cost about 252The board agreed and authorized the county manager to order 60 thousand of the roll -type stickers for distribution3 Tax Listing Period ExtendedCommissioner John M Booker moved that the 1982 Tax Listing period be extendedthrough Wednesday, February 3, 1982Commissioner James W Cash seconded the motion which was carriedj4 Road PetitionsCommissioner James W Cash moved that the following road petitions be approved andforwarded to the North Carolina Department of Transportation for consideration; Secondary Road# 1586 for paving; Lake Eva Marie Drive, Beechwood Subdivision, Cleveland Township, additionto the system; and Mollie Avery Road, Route # 1, Clayton, N C, addition to systemCommissioner John M Booker seconded the motion which was carried5 Banner Fire District CommissionCommissioner John M Booker moved that J Gerald Johnson, T Ed Dixon, and JackieElton McLamb be appointed to the Banner Fire District Commission for two 2 year termsexpiring February, 1984Commissioner Howard Benton seconded the motion which was carried6 Citizens Involvement Council — AppointmentsCommissioner Frank B Holding moved that James E Peedin, Selma, Helen Holt, FourOaks, and Geneva Wilder, Route # 1, Zebuton, be appointed to the Johnston County CitizensInvolvement CouncilCommissioner John M Booker seconded the motion which was carried7 Upchurch PropertJames Wellons, member of the Library Board of Trustees, met with the board with aproposal and request to the board to purchase the Upchurch property building for the PublicLibrary of Johnston County and Smithfield, located corner of Market and Third Streets at aprice of 42,500, with the county appropriating one half of the cost, anticipating that theTown of Smithfield would consider appropriating the other half Mr Wellons told the boardthathe plans to submit the same proposal to the Smithfield Town Board Mr Wellons furtheradvised that he felt it necessary to secure an option for the property signed by Mrs Upchurch,which is good until March 15, 1982After discussing this proposal, Commissioner Frank B Holding moved that the countymanager talk with Hugh Talton, Town Manager, and see what attitude the Town of Smithfield hasregarding the purchase of the Upchurch property at the corner of Market and Third StreetsCommissioner Howard Benton seconded the motion which was carriedhIaFebruary 1, 1982 Cont8 Little River Project Study Public Law 566By motion of Commissioner Howard Benton, duly seconded by Commissioner James W Cashand carried, the following resolution was adoptedRESOLUTIONWHEREAS, members of the Johnston Soil and Water Conservation District Board ofSupervisors met with the Board of Commissioners to seek the boards recommendation on theLittle River Study Project Public Law 566 - Small Watershed and Flood Prevention Act inWake, Fra klin and Johnston Counties; andEREAS, this study is to be made to determine the benefits, conservation of soilresources, flood prevention and other resources that might be attained from a watershedproject o the Little River; andthe Board of Commissioners discussed this study project at length, wereadvisedJEREAS,e study would be financed entirely with federal funds, not obligating the county;NOW, THEREFORE, BE IT RESOLVED that the Board of Commissionersof Johnston Countyendorse the Little River Study Project Public Law 566 on Little River in Wake, Franklinand Johnston Counties, and recommend a copy of this resolution be given to the JohnstonSoil and Water Conservation District Board of Supervisors9 20 T 1 Projects - Status ReportGene Cobb and C T Clayton, Ragsdale Consultants, met with the board to bring themembers up-to-date on the status of the county 201 projects in Kenly, Micro and Clayton, andto provide more information on anticipated county costs of these projects The engineerspointed out that federal funding has been cut in this area, and this probably means morecounty funds for these 201 projects The engineers furnished the board with a summary ofimmediate local effects; 75 federal funding and 20 year domestic growth capacity is retained providedproject is in construction by October 1984 Thereafter, federal percentagedrops to 55 and extra capacity becomes more local cost Industrial capacity is eligible for federal participation only for existingindustrial floras plus extra 10 of total existing flow for unspecified growthRequested reserve for existing industries is not eligible Step 2 costs preparation of plans and specifications are not eligible forreimbursement until project is in Step 3 constructionTYe engineers told the board they need to determine at this point if the county iswilling toll, put up money to build in industrial reserveTle board discussed at length wastewater treatment construction in Johnston Countyrecognizing the need, however, with much concern about additional funding cuts by the federalgovernmentAfter discussion of all three 201 projects, Clayton, Princeton and Kenly- Micro, andprojected cost increases because of federal cut - backs, Commissioner Frank B Holding movedthat the county support Option B request industrial reserve for the Micro - Kenly 201 ProjectCommissioner Howard Benton seconded the motion which was carried10 Senatorial Redistricting - Johnston CounS nator Robert D Bob Warren met and talked with the board about the proposedredistric ing plan for the North Carolina Senatorial Districts that will split Jonston CountySenator W rren told the board that he has proposed and will present an alternate plan tokeep John ton County and Sampson County in the same districtThe The board discussed the redistricting plan with Senator Warren, as they were concernedabout the new districts11 Undergrowth - County PropertyThe board granted Waylon Broadwell permission to cut the undergrowth from countyowned property near the hospital Mr Broadwell owns property adjacent to county property12 Moldex Water and Sewer Lines - Contract PostponedThe county manager reported to the board that Moldex manufacturer of toilet seatsan industry to locate at Four Oaks has postponed construction of its plant because of theeconomy Learning this, the board unanimously agreed to postpone the construction contractfor water and sewer lines until Moldex decides to go ahead with the plant constructioniFebruary 1, 1982 ContThe Board of Commissioners instructed the county manager to write the contractor,Bunn Backhoe Construction Company, Kenly, N C, and advise of this decision13 Easement - Seaboard Coastline Railroad - Moldex IndustryUpon a motion by Commissioner Frank B Holding, duly seconded by Commissioner HowardBenton and carried, the following resolution was adoptedBE IT RESOLVED by the Board of County-Commissioners in regular meeting assembledthat the Chairman of said board be, and he hereby is, authorized to enter into an agreementwith the SEABOARD COAST LINE RAILROAD COMPANY, and to sign same on behalf of said Countywhereby said Railroad Company grants unto said County the right or license to install andmaintain, for the purposeof;a SEWER MAIN, a line of 8 inch DUCTILE IRON pipe on and along aportion of Railroads southeasterly right -of -way; at or near FOUR OAKS, NORTH CAROLINA, asmore particularly described in said agreement, which agreement is dated November 5, 1981, acopy of which agreement is filed with this Board of County Commissionersi14 Citizens Involvement Council Request FundsThe board received a request to fund communications cost for the Johnston CountyCitizens Involvement Council in the amount of 300The board discussed this request, however, took no action at this time15 Budget Amendment - Family Planning - HealthCommissioner John M Booker moved that the following budget amendment be madeRevenues Increase 1037004 2,321Expenditures Increase 1059447 2,321Commissioner Frank B Holding seconded the motion which was carried16 Resignation - Home Economic Extension AgentMary C Wiggins, Home Economics Extension Agent, submitted her resignation from theJohnston County Agricultural Extension Service effective February 28, 1982iThe board acknowledged Mary C Wiggins resignation with regretI17 Grassroots Art GrantThe county manager reminded the board that several years ago the board authorizedthe Johnston County Arts Council to be the recipient of the Grassroots Arts Program Grants,and that the State has now determined that the Arts Council is not authorized to be the granteeof these funds The county manager further advised that he had requested that the county bethe grantee and the grant offer be made to the countyCommissioner Howard Benton moved that the county accept the Grassroots Arts Grantfrom the state in the amount of 10,020, and further that this grant be designated to theJohnston County Arts CouncilCommissioner Benton further moved that the following budget amendment be madeRevenues Increase add 1034805 10,020Expenditures Increase add 1069099 10,020Commissioner John M Booker seconded the motion which was carried18 Automobiles - Sheriffs DepartmentThe county manager told the board that the Sheriff has requested a budget amendmentin the amount of 4,610 in order to purchase five 5 1982 Chevrolet Impala automobilesThe board discussed the purchase of automobiles for the Sheriffs Department Thecounty manager told the board that the Sheriff had received information that the smaller carsFord Fairmont that are on state contract have been very expensive to operate and maintainand have not been satisfactory in any mannerAfter further discussion, the board asked the county manager to check with localdealers to see what prices the county could get locallyiiaiII a1197February 1, 1982 Cont19 Easement Pine Level - Selma WaterlineThe county manager and the engineers talked with the board about problems with waterline easements along Highway 70 to Pine Level The county manager explained that propertyowners are very concerned about losing some of their trees along the right -of -way The boardasked the county manager and the engineers to save as many of the property owners trees aspossible20 Shoe Heel Fire District - Extension of BoundariesUpon a motion by Commissioner John M Booker, duly seconded by Commissioner Frank BHolding and carried, the following resolution was adopted;RESOLUTION DESIGNATING AMENDED BOUNDARIES OF THE SHOE HEEL FIRE DISTRICTWHEREAS, the matter of fixing and declaring the amended boundaries of the Shoe HeelFire District was duly presented,AND WHEREAS, it appears that the Bethany Fire Department has complied with minimumrequirements, as contained in a resolution adopted by the Board of County Commissioners onOctober 3, 1955, pertaining to the establishment of fire departments and fire districts inthe county,AND WHEREAS, the enlargement of its fire district has met the approval of the NorthCarolina Fire Rating Bureau,NOW THEREFORE, BE IT RESOLVED that the boundaries of the Shoe Heel Fire District tobe served by the Bethany Fire Department be amended and officially designated and fixed asfollowsBEGINNING at a point on Old Beulah Road # 1934, 01 mile north of bridge over SwampCreek; thence in asoutherly direction to a point on road # 2151, 06 mile from its intersection with Highway #222; thence in a westerly direction to the point of BEGINNING21 Containers - McGees CrossroadsThe board talked about containers near McGees Crossroads Some small containershad been removed and replaced with larger containers to try and eliminate two trucks on thesame route People in this area want the small containers put back The county managerexplained this had been done prior to this meeting22 - Sasser Property - Pecan TreesCommissioner Frank B Holding told the board that Mrs L H Sasser had approachedhim regarding the pecan trees on county property adjacent to her building on Johnston StreetAgain, Mrs Sasser was concerned about the damage, she says, caused to the roof of herbuilding by the pecan leavesAfter discussion, Commissioner Frank B Holding moved that the county managerinstruct the maintenance crew to remove the two pecan trees located on the county lot adjacentto Mrs Sassers building on Johnston StreetCommissioner Howard Benton seconded the motion which was carriediiFebruary 1, 1982 Continued23 Tax Refund - Leawon JohnsonLeawon Johnson, representing American Dryco, Inc, met with the board regarding 1981taxes assessed on a company owned airplane Mr Johnson paid the 1981 taxes under protest thatthe airplane was not based in Johnston County on January 1, 1981 After talking with MrJohnson, the board was able to explain that taxes are listed and paid on property owned as ofJanuary 1st As it was determined that Mr Johnsons airplane was parked at the Johnston County Airport on January 1, 1981, Johnston County taxes for 1981 on the airplane were assessedcorrectly and due24 Highway EngineerPaul Anderson, District Engineer, North Carolina Department of Transportation,Division of Highways,met with the board reporting that he had received several complaintsfrom county residents during the bad weather about impassable dirt roads Mr Anderson askedthe Board of Commissioners to consider some of the Secondary Road Construction Funds for spotstabilization for dirt roads in the county that are in such bad condition25 Hickory Grove Community - Community Sign RequestedCommissioner Frank B Holding moved that the North Carolina Department ofTransportation, Division of Highways, be instructed to erect a sign on State Road # 1009Devils Race Track to designate the Hickory Grove CommunityCommissioner John M Booker seconded the motion which was carried26 Refunds and Releases - TaxJohnnie Stott, Tax Supervisor, presented the following request; 1 Mr Larry Bailyrequests release of late payment penalties and attorneys fees assessed by collectors officeconcerning delinquent taxes dueSinceMr Bailys comments are concerning the collectors area, I have norecommendation for this2 Mr Seth Williams Sauls of Selma requests a refund in the amount of 20979This request is based on the fact that a trailer was overvalued by 28,350 This error wasfound by the taxpayer and taxpayer had written his cost figures in such a way that it appearedto be 35,000 but in fact was 3,500 Recommendation That refund be granted3 Mr Berry Daughtry of Boon Hill Township requestsrefund in the amount of12259 This request is based on an over- assessment of 8380 valuation During revaluation,house was measured incorrectly Recommendation That refund be granted1 Larry D Baily The board asked the county manager to investigate thisrequest and report back to the board2 Seth Williams Sauls Commissioner Howard Benton moved that Seth WilliamsSauls be refunded in the amount of 20979 Commissioner John M Booker seconded the motionwhich was carried3 Berry Daughtry Commissioner John M Booker moved that Berry Daughtry berefunded in the amount of 12259 Commissioner Frank B Holding seconded the motion whichwas carried27 Water Study Committee ReportCommissioners Frank B Holding and James W Cash, as Water Committee representatives,reported to the board on a committee meeting with the Smithfield Town Board representativesCommissioner Holding stated this committee had studied and considered a proposal to expandthe water source for Johnston County and they have a-recommendation to present to the boardfor considerationIn discussion of this matter, the board felt it should recess Therefore, uponmotion of Commissioner John M Booker, duly seconded by Commissioner Frank B Holding andcarried, the board recessed to meet again Thursday, February 4, 1982, at 7 oclock pmNorman C Denning, ChairmanEleanor N Creech,Clerk to the Board?
