Minutes - ApprovedThe Board reviewed the minutes of the June 5, 6 and 14th board meetingsCommissioner J E Rogerson moved that the minutes of the June 5, 6 and14th board meetings be approved as recordedCommissioner Howard Benton seconded the motion which was carried by aunanimous vote2 Road Petition -- Secondary Road # 1559Rev Merritt met with the Board regarding Secondary Road # 1559, he toldthe board the road is in real bad condition especially during wet weather Theboard advised Rev Merritt that S R # 1559 has the priority rating of 25, howeverthe board asked him to submit a petition making his request for pavement of thisroad,3 f Resolution Triangle J Grant - Sheriffs DepartmentUpon a motion by Commissioner Howard Benton, duly seconded by CommissionerJ E Rogerson and carried by a unanimous vote, the following resolution was adopteWHEREAS, the Johnston County Board of Commissioners herein called theApplicant has thoroughly considered the problem addressedin the subgrantapplication entitled Regional Training Grant and has reviewed the project describedin the application; andWHEREAS, under the terms of Public Law 90 -351 as amended, the United Statesof America has authorized the Law Enforcement Assistance Administration, throughthe North CarolinaLaw and Order Section to make federal grants to assist localgovernments in the improvement of the criminal justice system,NOW THEREFORE BE IT RESOLVED BY THE Board of Commissioners IN OPEN MEETINGASSEMBLED IN THE CITY OF Smithfield, North Carolina THIS 3rd DAY OF July, 1978, asfollowslJuly 3, 1978 Cont1 That the project referenced above is in the best interest of theApplicant and the general public2 That Kramer Jackson, Finance Director, be authorized to file, in behalfof the Applicant, an application in the form prescribed by the Law andOrder Section for a subgrant in the amount of 72200 federal 4000State to be made to the Applicant to assist in defraying the cost ofthe project described in the application This individual shall act asthe authorized representative of the Applicant in connection with allaspects of the application process3 That if the subgrant is,made, the Applicant provide or make arrange-ments to provide, a local cash matching contribution in the amount of4000 as required by the most current guidelines4 That to the full extent the law allows, the applicant agrees that uponsubmission of an application for this subgrant, the applicant intendsto continue the program at its own expense and to appropriate fundstherefore subject only to budgetary limitations should the program beuseful, effective and pertinent5 That applicant understands that approval of the subgrant application inno way implies or commits the United States of America, the Law Enforcement Administration or the Law and Order Section to approve anyapplication for continuation funding or to provide any continuationfunding whatsoever; rather, applicant understands that continuationfunding will probably not be available and applications therefore willonly be considered, if at all, under only unusual circumstances6 That the Project Director designated in the application form shallfurnish or make arrangements for other appropriate persons for furnishsuch information, data, documents and reports pertaining to the project;if approved, as may be required by the Law and Order Section7 That certified copies of this resolution be included as part of theapplication referenced above8 This resolution having been read aloud in its entirety at the meetingabove mentioned, shall be effective upon its adoption and shall berecorded in its entirety in the minutes of Board of Commissioners4 , Johnston Central Gymnasium - LeasedCommissioner Howard Benton moved that the Board of Commissioners concurin the action of the Johnston County Board of Education in leasing the oldJohnston Central Gymnasium to the Johnston Central Alumni for a ten 10 yearperiodCommissioner Frank B Holding seconded the motion which was carried by aunanimous vote5 ? Gasoline BidsKramer Jackson, County Administrator, told the Board he had requested bidson gasoline and # 2 fuel oil in an effort to get better prices for the county6 J County Permit System - ComplaintRudolph Jones and Andy Mack Penny met with the Board with a complaintregarding the county permit system Mr Jones and Mr Penny related difficultiesexperienced in obtaining permits and getting county inspections made Mr Jonesand Mr Penny asked the Board of Commissioners if there is not some way to makeit more convenient for people obtaining county permits The board apologized forany inconveniences and agreed that the county permit system should be coordinatedto accomodate the public as much as possibleKen Windley, County Planner, being present at this board meeting at thistime was asked to make every possible effort to coordinate these services toaccomodate the publicMr Jones also told the board that McGees Crossroads would like to havea live -in Deputy Sheriffri7July 3f,,1-978, Cont7 ? Subdivision Woodland TrailsUpon the recommendation of Ken Windley, County Planner, Commissioner FrankB Holding moved that Woodland Trails Subdivision, south of Clayton W C ReamsDeveloper be approved and the Chairman be authorized to execute the subdivisionplatCommissioner John M Booker seconded the motion which was carried by aunanimous vote8 Subdivision - Swift CreekUpon the recommendation of Ken Windley, County Planner, Commissioner HowardBenton moved that Swift Creek Subdivision Cleveland Road be approved and theChairman be authorized to execute the subdivision platCommissioner J E Rogerson seconded the motion which was carried by aunanimous vote9 ? Subdivision AmendmentsKen Windley, County Planner, advised the Board that the Johnston CountyPlanning Board recommends that the Board of Commissioners adopt the followingamendments to the Johnston County Subdivision Regulations;a Article VII, Section 818All residential subdivisions located on principal arterials, minorarterials, and major collector roads in Johnston County, as definedby the North Carolina Department of Transportation, shall be designedso that points of access onto the highway are no closer than 600 feetapartVariances may be granted by the Johnston County Planning Board if thetopography, size of the property, or other conditions peculiar to thesite cause an unnecessary hardship The variance shall also be granteunder the terms of Article V, Section 3, on Page 3b Article VII, Section IIn subdivision with lot sizes of less than 300 acres, all roads mustbe designed, constructed and paved in accordance with the minimumstandards established by the Secondary Road Council for acceptanceon the State Highway SystemAfter discussion and review of the above amendments, the board by motionof Commissioner Frank B Holding, seconded by Commissioner John M Booker andcarried unanimously, agreed to table and defer action on this request at this time10 Community Based Alternative FundsDan Searcy, Director, Johnston County Mental Health Center, met with theboard requesting Community Based Alternative Program funds allocated to JohnstonCounty in the amount of 12,433 Dr Searcy told the hoard these funds could beused to serve status offenders in the Day Night Program Dr Searcy explainedthat status offenders can no longer be sent to training schools, as Mental HealthCenter is now serving a number of status offenders, with additional funds theycould expand the services to include more childrenCommissioner Howard Benton told the board that the Social Services Boardhas passed a resolution requesting these same funds, as Donald Morrison says heas local Social Services Director is responsible for housing juvenile offendersMr E S Simpson, Superintendent, Johnston County Public Schools is alsorequesting these Community Based Alternative Funds to be used in the school systemThe Board discussed this matter at length with Dr Searcy and Mr SimpsonThe Board also indicated they should talk with Donald Morrison, Director, Departmenof Social Services, to try and determine what agency should coordinate theseservices The Board told Mr Simpson they would like to know how the Board ofEducation administered these funds last year Mr Simpson advised in a laterdiscussion that special teachers were employed to give special attention and speciainstructions to these status offenders Mr Simpson further told the board thateducation is a very important part of this program for these children and this granwill be alot of help478July 3, 1978 ContThe board took no action on this matter pending further consideration andstudy11 Salary Supplement - Code Enforcement OfficerKramer Jackson, County Administrator, told the board in order for the CodeEnforcement Officer CETA employee to receive a 7 pay increase as other countyemployees, the county would need to supplement his salary by 2567 per month MrJackson explained that federal guidelines place a ceiling of 10,000 on CETAsalariesAfter discussion, Commissioner J E Rogerson moved that the County supple-ment the Code Enforcement Officers salary by 2567 a month in order for him toreceive a 7 pay increase as other county employeesCommissioner Howard Benton seconded the motion which was carried unanimously12 ? Contract - Title IV -D - AttorneCommissioner Frank B Holding moved that the annual contract with AndyHolland, Attorney, for the countys Title IV -D Program, be renewed at rates of2500 per hour for regular services and 4000 per hour for time spent in courtCommissioner J E Rogerson seconded the motion which was carried by aunanimous voteThe board asked Mr Jackson to report what the county had paid to MrHolland in the past twelve months, fiscal year 1977 -7813; Fees - Register of DeedsKramer Jackson, County Administrator, told the board that House Bill 1489Register of Deeds Fees Raised was ratified by the Senate June 14, 1978, effectiveJuly 1, 1978, and increases the following fees;Instruments in general from 2 to 3 for first page, no change forsucceeding pagesMarriage License from 7 to 10 for issuancePlats from 7 to 10 original or revisedPlatsfrom 2 to 3 for copies certifiedProbate from 50 to 1 for certification of instruments for registration14 Contract for Reimbursement - North Carolina Department of CorrectionsCommissioner J E Rogerson moved that the county extend the currentcontract Agreement for Reimbursement, Per Diem Costs of Maintenance of Persons inLocal Confinement Facilities 10 per day, per inmate for a one year period ofJuly 1, 1978 through June 30, 1979 with the North Carolina Department of CorrectionCommissioner John M Booker seconded the motion which was carried by aunanimous vote15 1 Per Capita Basis for Sales Tax DistributionKramer Jackson, County Administrator, advised the board he had receivedresolutions from several towns in the county requesting the county to change theformula for distribution of the local one cent sales tax from a property tax basisto a population basisMr Jackson advised the board he had requested information from the stateon the local one cent sales tax distribution and asked the board to postpone actionat this time16 Solid Waste Planning Grant Funds - ResolutionWHEREAS, the 795 square miles of Johnston County is served by one centrallandfill operation; andWHEREAS, there exist problems involved with the large number of sites andcontainers located on private property; andWHEREAS, the entire cost of the landfill opeation is borne by the countythrough county revenues; andC,?11July 3, 1978 ContWHEREAS, the costs for operating the landfill and container sites areworking a financial hardship on the county; andWHEREAS, a solid waste study would contribute greatly to improving thecountys solid waste collections by giving answers or alternatives to the problemfaced by the county;NOW, THEREFORE, BE IT RESOLVED that the Johnston County Board ofCommissioners meeting in regular session on July 3, 1978, does hereby adopt thisresolution giving assurance to the North Carolina Department of Human Resourcesthat the board fully intends to implement the Solid Waste Plan provided for througha grant from the North Carolina Department of Human ResourcesMotion to adopt this resolution moved by Commissioner Howard Benton,seconded by Commissioner J E Rogerson, with all members voting in the affirmative17 ? County Watts Line - Sheriffs OfficeThe board received a request from the Johnston County Sheriffs Departmentfor a Watts line to be installed in the Sheriffs Office The board discussed thismatter, however, took no action at this time25 ? School Health ProgramMrs Helen Ray, Director, Dr C W Sanders, Health Board member, ShirleyMozingo,Nursing Supervisor and Diana Grimes, School Health Nurse, met with theboard regarding the School Health Program Mrs Ray told the Board of Commissionerthe County Health Board has evaluated the Health Programs and has authorized theHealth Department to discontinue the program of a Health Nurse spending full timein the county school system Mrs Ray continued that the School Health Servicesare only providing a referral service as the nurse can only send a note home tothe parents asking them to seek professional medical help, Mrs Ray said under thenew proposed system the school teacher can refer the child directly to the HealthDepartment where they can get proper medical attention Mrs Ray further emphasizethis nurse is needed in the Health Center on a full -time basis as an average of 319people come to the Health Center daily for medical attention and in two weeks timethey will have seen as many people as the School Nurse sees all year Mrs Rayfurther commented that nurses are not needed for referral, but needed for healthcare Mr E S Simpson, Superintendent, Johnston County Public Schools, presentat this time, says he places high priority on the School Health ServicesChairman Denning and Commissioner Frank B Holding seemed very disturbedthat the Health Department had decided to discontinue these services in the countyschools and expressed much concern about the school children getting the attentionthey needjCommissioner John M Booker commented that it appeared to him that thej Health Department could provide more services to school children if referred toi the Health Center by the teachers? After much discussion, Chairman Denning asked Mrs Ray and Mr Simpson tomeet and work out a feasible workable solutionThe board also asked Kramer Jackson, County Administrator, to explore thepossibility of a School Health Nurse through the Title XX Program1 July 3, 1978 Cont 26 Adoption of the 1978 -1979 Fiscal Year Budget Ordinance dThe Board of Commissioners again discussed the proposed 1978 -1979 FiscalYear Budget Kramer Jackson, County Administrator, told the board that additionalfunds of 80,000 are available in the fund balance and if they could possibly findanother 50,000 or 60,000 the tax rate could be cut by 3 or 4 cents CommissionerHoward Benton commented that the Department of Social Services Budget could becut by approximately 77,000Chairman Denning and Commissioner Howard Benton strongly favored the taxrate not increasing more than nine 9 cents 102, other commissioners agreedUpon a motion by Commissioner Frank B Holding, duly seconded byCommissioner J E Rogerson and carried by a unanimous vote, the following BudgetOrdinance was adopted for the Fiscal Year 1978 -1979 at a tax rate of 102, in thefollowing amounts and mannerBUDGET ORDINANCEJohnston County Fiscal Year 1978 -
