ApprovedThe Board reviewed the minutes of the March 29, 1977, and April 4, 1977, board meetingCommissioner J E Rogerson moved that the minutes of the March 29th and April 4th meetingsbe approved as recordedCommissioner John M Booker seconded the motion which was carried unanimously2 Resolution - Older Americans Month in Johnston CountyUpon a motion by Commissioner J E Rogerson, duly seconded by Commissioner John M Bookerand carried unanimously, the following resolution was adoptedRPZnf 1ITTOKIWHEREAS, while the County of Johnston is appreciative of all of its citizens, we areespecially indebted to those citizens over sixty years of age for their significantcontributions_ to the development and progress of our County; andWHEREAS, these older adults have been a valuable resource of knowledge, skills, experienceand leadership for one -third of the entire history or our County, State and Nation; andWHEREAS, as a progressive County, we must be forever conscious of its most valued resources-- its people; yet constantly aware and appreciative of those citizens of the County oversixty whose contributions have and shall remain the foundation of solidarity and ensuinggrowth; andWHEREAS, we urge the people of Johnston County to seek to expand opportunities_ for activeparticipation of older adults through paid or voluntary endeavors that assure continued -usefulness and nondiscriminatory involvement in helping to assess and meet both the growingneeds of our older citizens and the needs of the County as a whole through all public andprivate organizations planning together to meet these needs effectively;THEREFORE, in this Bicentennial year of Johnston County,I proclaim the month of May, 1977OLDER AMERICANS MONTH IN JOHNSTON COUNTYand commend this observance to all our citizensAt this time, 1035 am, the Board of Commissioners recessed to be organized as a Boardof Equalization and ReviewThe minutes of the Board of Equalization and Review are filed with the Clerk and TaxSupervisorAt 1048 am, the Board of Equalization and Review recessed and the Board of Commissionersreconvened for further business3 Road Petition - Social Services - Legal CostCommissioner Howard Benton moved that 1260 be transferred from Unencumbered Cash to theSocial Services Budget - Legal Cost to cover retention of Andy Holland, Social Services AttorneyCommissioner John M Booker seconded the motion which was carried unanimously6 Budget Amendment - Clerk of Superior CourtCommissioner Howard Benton moved that 2450 be transferred from the County Contingency Fundto the Clerk of Superior Court account to cover charges to this acount for renovationCommissioner John M Booker seconded the motion which was carried unanimously7 Budget Amendment - Sheriffs Office - GasolineCommissioner Howard Benton moved that 11,000 be transferred from Reimbursement - SocialServices to the Sheriffs Department - Gasoline line item to cover an expenditure of gasoline usedby the Social Services Transportation Program and charged to the Sheriffs Department gasoline lineitemCommissioner J E Rogerson seconded the motion which was carried unanimously8 Buffet Amendment - School - Special and Vocational FundsCommissioner John M Booker moved that 44,975 be transferred from Unencumbered Revenue toSchools - Special and Vocational Program to cover revenues received from ad valorem tax in excessof the budgeted amountCommissioner Howard Benton seconded the motion which was carried unanimouslyThe Board instructed Kramer Jackson, County Administrator, to request a budget amendmentin this amount showing the expenditures from the Board of Education9 Budget Amendment - Antirecession FundsCommissioner J E Rogerson moved that 108,507 be transferred from Federal GovernmentGrants to Antirecession Expenditure to cover necessary expenditures for salaries, travel and repairsCommissioner Howard Benton seconded the motion which was carried unanimously10 Budget Amendment - Summer Recreation ProgramCommissioner Frank B Holding moved that 5,86614 be transferred from Federal Grants toSummer Recreation Equipment to cover the expenditures of the summer recreation program summer of1976Commissioner J E Rogerson seconded the motion which was carried unanimously11 Budget Amendment - Airport AuthorityCommissioner Frank B Holding moved that 2155 be transferred from County Contingency Fundto the Johnston County Airport Authority to cover the cost of land easements at the Airport sitefederal grants will reimburse 95 Commissioner Howard Benton seconded the motion which was carried unanimouslyIn discussion of budget amendments the Board asked Kramer Jackson, County Administrator,to talk with the Board of Elections officials regarding clerical duties and clerical work in theBoard of Elections Office12 Contracts Awarded - Community Action BoardCommissioner Frank B Holding moved that Levi Jones be appointed to the Johnston -LeeCommunity Action Board for a one year term expiring June 1, 1978 Commissioner Holding furthermoved that Howard Benton and Paul Keller be re- appointed to the Johnston -Lee Community Action Boardfor a one year term expiring June 1, 1978Commissioner John M Booker seconded the motion which was carried unanimouslyCommissioner Benton advised the Board that he was not sure how long he would be able toserve on this Board The Board of Commissioners told Commissioner Benton that if and when thetimecomes that he feels he could no serve, they would replace him at his request14 Appointment - Public Library BoardCommissioner J E Rogerson moved that Mrs William I Wellons and J Herman Brown bere- appointed to the Public Library Board of Trustees for a three year term expiring June 30, 1980Commissioner Frank B Holding seconded the motion which was carried unanimously15 Appointment - Technical Institute Board of TrusteesCommissioner J E Rogerson moved that Dr C C Sox be reappointed to the Johnston TechnicalInstitute Board of Trustees for an eight year term expiring June 30, 1985Commissioner Howard Benton seconded the motion which was carried unanimously16 Emergency Medical Services GrantCommissioner Howard Benton moved that an EMS Grant in the amount of 1657 beapproved forupdating the mobile emergency radio equipment operated by Johnston Memorial Hospital CommissionerBenton further moved that the budget be amended from unencumbered cash to EMS Grant in this amountCommissioner J E Rogerson seconded the motion which was carried unanimouslyI280May 2, 1977 Cont17 County Rescue EquipmentCommissioner J E Rogerson moved that the county Emergency Preparedness equipment storedfor several years be distributed among the eight county rescue squadsCommissioner Frank B Holding seconded the motion which was carried unanimouslyThe Chairman instructed Commissioner J E Rogerson to supervise the distribution ofthis equipment18 Bingo Legislation IntroducedKramer Jackson, County Administrator, advised the Board that State Representative JackGardner had drafted a bill for introduction to the North Carolina Legislature that would allowbingo in Johnston County in connection -with fairs, conventions, dinners, bazaars or exhibitionssponsored by church, religious, civic, charitable, social, patriotic, fraternal, or tradeassociations or by public or private schools or educational` institutions in the countyMr Jackson explained that Mr Gardner would like comments from the Board before makingintroduction of this billThe Board discussed this bill, however, took no official action, as they had reservationsabout the bill19 Summer Recreation Program - 1977Kramer Jackson, County Administrator, advised the Board that Johnston County would receive6,836 from the Federal Government through the Raleigh CETA Office for summer recreation fordisadvantaged children Mr Jackson also told the Board he had two requests for these funds, onefrom the Department of Social Services and one from Johnston`Lee Community ActionAfter discussion and consideration of these requests, Commissioner Frank B Holding movedthat the summer recreation funds be distributed in the following manner, one -third to Departmentof Social Services, one -third to Johnston -Lee Community Action and one -third to the county to beadministered by Kramer Jackson, County Administrator Commissioner Holding further moved if forany reason these two agencies can not use this money it is to divert back to the county for useCommissioner J E Rogerson seconded the motion which was carried unanimously20 Benson Medical CenterHickey Matthews, Chairman, Board of Directors, Benson Area Medical Center, met with theBoard requesting county matching funds to help finance approximately 50 of the construction ofa building to house the Benson Medical Center Mr Matthews told the Board they believed that amedical center in Benson will help attract doctors to the Benson area and southern JohnstonCounty The Board was also advised that the Benson Medical Center Board of Directors is sub-mitting two federal grant applications to help finance the clinics operation, one grant for200,000 for rural health care and 175,000 for the treatment of migrant workersThe Board agreed that the Benson area needed additional medical facilities, afterdiscussion, Commissioner Howard Benton moved that the Johnston County Board of Commissionersobligate 30,000 matching funds toward the construction of a building to house the Benson MedicalCenter and further that when the development of this center arises this facility is going to be ofa nature that will require additional space, additional personnel and additional services and theBoard should consider additional funding Commissioner Benton further moved that should thisfacility ever be disposed of, the money proportioned out in the same manner as receivedCommissioner Frank B Holding seconded the motion which was carried unanimously21 Resolution - Hospital Bond Issue RequestedBob Terrell, Administrator, Johnston Memorial Hospital, presented a resolution adoptedby the Hospital Board of Trustees to the Board of County Commissioners requesting the Board toschedule a bond referendum at the earliest possible date to finance a 66 million dollarhospital expansionThe Hospital Trustees had met with the Board earlier with plans for up- dating the hospitalfacility at a cost of 66 million The Board at this time indicated they had rather financethe project over a period of years rather than call for a bond issueCommissioner Howard Benton, a member of the Hospital Board of Trustees, stated, he did notfeel the hospital board had put enough thought into this recommendation The Board of County Commissioners reluctant to schedule a bond issue for anytime in thenear future, took no formal action on this matter at this time{?I;IIl `12 May 2, 1977 Cont22 Reports The following reports were filed with the BoardL P Creech Veterans OfficeHarper Godwin Tax CollectorBobby Corbett Electrical InspectorRubert C Barbour Dog WardenJohnnie Stott Tax Supervisorreported that Revaluationwork had begun23 Protest - Subdivision RequlationsGeorge Mast, Attorney and Real Estate developer, met with the Board protesting the JohnstonCounty Subdivision Regulations Mr Mast contended that it would be a mistake to allow these sub-division regulations to go into effect July 1, 1977 Mr Mast further emphasized that he agreedwith the aims of subdivision regulations, but these regulations are more restrictive than thetowns and will increasethe cost of rural lots by 2,000 Mr Mast reviewed the SubdivisionRegulations in detail with opposition to the existing regulationsKen Windley, County Planner, defended the regulations and disagreed with Mr Mast, relatingother counties are getting along very well with similar more restrictive subdivision regulationsand the county should give these regulations a try to see how they work outThe Board took no further action at this time on the Subdivision Regulations24 District Engineer - State Highway CommissionPaul Anderson, District Engineer, State Highway Commission, met with the Board and talkedwith them about the bridge at South Johnston High School No action25 Seaboard Coastline Railroad Agreement Kenl_y Waterline File 351 -2361Be it resolved by the Board of County Commissioners of the County of,Johnston, NorthCarolina in regular session assembled that the Chairman of said Board be, and he hereby is,authorized to enter into an agreement with the Seaboard Coast Line Railroad Company, and to signsame on behalf of said County whereby said Railroad Company grants unto said County the right orlicense to install and maintain, for the purpose of water mains, lines of pipe across the rights ofway and under tracks of said Railroad Company at or near Selma, North Carolina, as particularlydescribed in said agreement, which agreement is dated April 15, 1977, a copy of which agreementis filed with the Board of County Commissioners26 Seaboard Coastline Railroad Agreement - Kenly Waterline File 351 -1616Be it resolved by the Board of County Commissioners of the County of Johnston, NorthCarolina, in regular session assembled that the Chairman of the Board of Commissioners be, andhereby is, authorized to enter into an agrement with the Seaboard Coast Line Railroad Company, andto sign same on behalf of said County whereby said Railraod Company grants unto said County theright or license to install and maintain, for the purpose of conducting water, lines of pipe acrossthe right of way and underneath the tracks of said Railroad Company at or near Smithfield, NorthCarolina; as more particularly described it said agreement, which agreement is dated March 22, 1977,a copy of which agreement is filed with this Board of County Commissioners27 Dues - Triangle J Council of GovernmentsThe Board in discussion of the annual dues to the Triangle J Council of Governments decidedagainst any increase in dues to Triangle JThe Board of Commissioners at this time expressed their congratulations to Wingate Lassiteron his promotion to Editor of the Smithfield HeraldThe Board of Commissioners recessed and went into Executive Session at 430 pm, for thepurpose of discussing personnel and administrative mattersThe Chairman called the meeting to order and the Board of Commissioners reconvened at 455pm26 Special Deputies - Fee System - Sheriffs OfficeKramer Jackson, County Administrator, discussed with the Board the over expenditure of9,000 in the line item Special Deputies in the Sheriffs Department Budget and requested a budgetamendment to cover this over expenditure Mr Jackson explained that 25,000 was budgeted in thisline item for fees for special deputies, however, 34,000 had been spent as of April 30thWith interest, the Board inquired as to the cause of this over expenditure Mr Jacksonadvised that from seven to ten special deputies were serving papers and some months they served asmany as 1200 papers at 350 per paper Mr Jackson further informed the Board that special deputiehad been paid 11,000 in the past three months for their services282May 2, 1977 ContThe Board discussed this matter at length and expressed concern and opposition ofcontinuing with the special deputy system in regards to serving papersCommissioner Frank B Holding indicated that the county needed to work away from the,feesystem completely, even if it means hiring more regular deputies Commissioner Howard Benton stated he had believed that special deputies would help lawenforcement in the county by giving the regul -ar deputies more time for investigations, butevidently this system had not helped very much Commissioner John M Booker emphasized he feltthe regular deputies had time to serve all the papers and suggested that the fee system bestopped immediatelyCommissioner Benton did not agree that the fee system should be stopped immediately asit might affect the efficiency of the county court system Chairman Denning, CommissionersHolding and Rogerson agreed with Commissioner Benton,that it should not be completely stoppedimmediately, but indicated the fee system might eventually be eliminated _After a lengthy discussion, Commissioner Holding moved that Kramer Jackson, CountyAdministrator, be authorized to amend the Sheriffs Department Budget line item Special Deputiesby 9,000, the amount overspent to date Commissioner Holding further moved that from now untilJune 30, 1977, the Special Deputies be limited to 25 of the civil papers to be served by theSheriffs Department and further the county will not reimburse special deputies for more than 25of the total papers servedCommissioner,J E Rogerson seconded the motion which was carried unanimouslyUpon a motion by Commissioner Frank B Holding, duly seconded by Commissioner J ERogerson and carried unanimously, the Board recessed to meet again May 24, 1977, at 730 pmcNorman C Denning, ChairmanEleanor N Creech, erk0?6
