Previous page1 9Fit widthMeeting of Board of Commissioners for the County of JohnstonFebruary 7, 1977The Johnston County Board of Commissioners met in regular session in the CommissionersRoom of the Johnston County Courthouse, Smithfield, North Carolina, Monday, February 7, 1977, at10 oclock am with the following members presentNorman C Denning, Chairman, Frank B Holding, Vice Chairman, Howard Benton, J E Rogersonand John M Booker, DVMMembers Absent NoneChairman Denning called the meeting to orderThe following business was transacted1 Approval of MinutesThe Board reviewed the minutes of the January 3, 1977, board meetingCommissioner John M Booker moved that the minutes of the January 3rd meeting be approvedas recordedCommissioner Howard Benton seconded the motion which was carried unanimously2 Tax Complaint - Senior Citizens ExemptionMr H G Herring, Route # 1, Selma, North Carolina, had complained that his taxes in 1976were double what they had been in the past Mr Herring had failed to apply for the Senior CitizensExemption for 1976After discussion, Commissioner Frank B Holding moved that Mr Herring be granted the SeniorCitizens Exemption for 1976Commissioner John M Booker seconded the motion which was carried unanimously3 Secondary Road Petition #1316Mr Seba Charles Jones appeared before the Board and presented a petition requesting theDivision of Highways, North Carolina Department of Transportation and Highway Safety to paveSecondary Road # 1316After discussion, Commissioner Howard Benton moved that the petition be forwarded to theNorth Carolina Department of Transportation, Divsion of Highways, Wilson, North Carolina, with theBoards recommendations for considerationCommissioner John M Booker seconded the motion which was carried unanimously4 Energy ReportKramer Jackson, County Administrator, presented a County Energy Audit report of all CountyBuildings to the Board of County CommissionersMr Jackson explained that Fred Hamilton, Mecklenburg County Engineering Department, cameto Smithfield to assist him with the Energy Audit The purpose of the energy audit was to find waysin which Johnston County Government might save energyMr Jackson advised the Board there was not much waste of energy in the County buildings,however, there is a problem in the Courthouse with only one thermostat located in the Courthouseon the main floor opened to maximum setting in order to provide a comfortable temperature in thecounty jail and air conditioners in offices operating in order to lower the office temperature backto a comfortable level, doors in Courtroom have been left open because of the heat in the CourtroomMr Jackson also reported that heat was not preserved in the jail area as he found windowswhich would not close, prisoners were dressed either in underwear only or pants with no shirts andmany were barefootThe Board discussed the installation of a heat pump with mechanical valves on individualradiators and instructed Commissioner Howard Benton to work with Mr Jackson on this matter TheBoard also discussed using antirecession funds for this renovation if permissibleCommissioner Howard Benton moved that the thermostats be set at 65 degrees in the followingcounty buildings and departments; Department of Social Services, Veterans Office, District CourtBuilding, Agriculture Building, Tax Supervisors Office, Tax Collectors Office and the MaintenanceOfficeCommissionerFrank B Holding seconded the motion which was carried unanimously250February 7, 1977 Cont5 North Carolinas Energy Conservation PlanUpon a motion by Commissioner John M Booker, duly seconded by Commissioner Frank B Holdingand carried unanimously, the following resolution was adoptedRESOLUTIONWHEREAS, the County of Johnston has indicated an interest in energy conservation programs andan interest to participate in a pilot purchasing plan to be coordinated through the Division ofPurchase and Contract; andWHEREAS, the County of Johnston is willing to make a dedicated effort to implement energyconservation programs;NOW, THEREFORE BE IT RESOLVED, THAT the Chairman of the Board of Commissioners is herebyauthorized to advise the State Task Force that Johnston County is willing to serve as a PilotCommunity for the preservation of energy as a part of North Carolinas Energy Conservation PlanThis the 7th day ofFebruary, 19776 Juvenile Detention Care - Contract - Wake CountyKramer Jackson, County Administrator, advised the Board that the North Carolina Division ofYouth Services was negotiating a contract with Wako County which would allow their juvenile detentionfacility to be used on a regional basis, and it is proposed that Wakes Detention facility couldserve juveniles from Johnston County Mr Jacksonexplained that under this procedure the statewould pay one -half of the costof keeping juvenilesUpon a motion by Commissioner Howard Benton duly seconded by Commissioner J E Rogerson andcarried unanimously, the Board agreed to enter into the following contract with the State of NorthCarolina, Department of Human ResourcesDETENTION SUBSIDY REPAYMENT AGREEMENTThis contract is hereby executed between the Department of Human Resources, herein calledDepartment, and Johnston County, hereinafter called CountyWITH ESSETHTHAT WHEREAS, Johnston County is eligible under a separate contract, hereinafter referred asAgreement, with the Department and Wake County which,-operates a juvenile detention facility locatedat 401 -12 Whitaker Hill Road, Raleigh, North Carolina which is known as the Wake County JuvenileHome, and pursuant to said Agreement Wake County will providejuvenile detention services toJohnston County in its juvenile detention facility, andWHEREAS, under said Agreement, the Department will make certain subsidy payments to WakeCounty towards the cost of maintaining children from Johnston County in the Wake County detentionfacility, andWHEREAS, North Carolina General Statute 134A -38 providesthat the Department shall developa State subsidy program to pay a county detention home which,provides regional detention servicesand meets State standards a certain portion of its operating costs and its per- capita daily costper child for any child cared for from another county, andWHEREAS, North Carolina General Statute 134A -38 provides that any county placing a child inthe county detention home of another county providing regional juvenile detention services shall payfifty percent 50 of the per - capita daily cost of caring for the child to the DepartmentNOW, THEREFORE, for and in consideration ofthe mutual promises to each other, as hereinafterset out, Department and Johnston County do mutually agree as followsSECTIQN, ONEPAYMENT TO DEPARTMENTA The County agrees to pay the Department 1250 per child care day for which the Wake Countydetention facility keeps the child from Johnston County in its county detention facilityFor the purposes of this contract, child care day is defined as any calendar day or portion thereofduring which a child from Johnston County is detained in the Wake County detention facilitySECTION TWOUSE OF DETENTION FACILITYA Johnston County shall have the right subject to the conditions set out in this section toplace in the detention home operated hJake County children from Johnston County who are alleged oradjudicated to be delinquent or undisciplined as defined by Article 23, Chapter 7A of the NorthCarolina General Statutes and who requires secure custody for the protection of the community or inthe best interest of the child? l ?February 7, 1977 ContAfter much discussion, Commissioner Frank B Holding moved that the following resolution be adopted; acceptance of Federal GrantWHEREAS, the United States Environmental Protection Agency under the provisions of theFederal Water Pollution Control Act Amendments of 1972 has authorized the making of grantsto aid eligible units of government in financing the cost of construction of wastewaterfacilities; andWHEREAS, the County of Johnston has made application for grant assistance from the UnitedStates Environmental Protection Agency under the provisions of the federal Water PollutionControl Act Amendments of 1972 to aid in the construction of the first stage regionalwastewater facilities to serve the Smithfield-Selma 201 Area, andWHEREAS, the United States Environmental Protection Agency has offered a grant in the amountof 3,106,725NOW, THEREFORE, BE IT RESOLVED BY THE JOHNSTON COUNTY BOARD OF COMMISSIONERSThat the County of Johnston accept this grant offer in the amount of 3,106,725 and herebyagrees to all Standard and Special Conditions of the EPA grant agreement, and herebyauthorizes the County Administrator to execute thisgrant agreementDULY ADOPTED THE 7th DAY OF FEBRUARY, 1977Commissioner John M Booker seconded the motion which was-carried unanimouslyCommissioner Howard Benton moved that the following resolution be adopted; acceptance ofState GrantWHEREAS, the United States Environmental Protection Agency under the provisions of theFederal Water Pollution Control Act Amendments of 1972 has authorized the making of grantsto aid eligible units of government in financing the cost of construction of wastewaterfacilities; andWHEREAS, the United States Environmental Protection Agency has offered, and the County ofJohnston has accepted a grant in the amount of 3,106,725 to aid in the construction of thefirst stage regional wastewater facilities to serve the Smithfield -Selma Area, andWHEREAS, the North Carolina Clean plater Bond Act of 1971 has authorized the making of Stategrants to match EPA grants to further aid eligible units of government in financing thecost of certain wastewater facilities, andWHEREAS, the North Carolina Department of Natural and Economic Resources, Division ofEnvironmental Management has offered a grant in the amount of 517,787 to match said EPAgrantNOW, THEREFORE, BE IT RESOLVED BY THE JOHNSTON COUNTY BOARD OF COMMISSIONERSThat the County of Johnston accepts this grant offer in the amount of 517,787 and herebyagrees to all Standard and Special Conditions of the State grant agreement, and herebyauthorizes the County Administrator to execute this grant agreementDULY ADOPTED THE 7th DAY OF FEBRUARY, 1977Commissioner John M Booker seconded the motion which was carried unanimously?4 E Property ti s`Ki ng - Wilson Coun;,Qy,Johnnie Stott, Tax Supervisor, again talked with the Board of Commissioners regarding theMayo and Rose property Mayo property formerly owned by Linda Moore This property had beenlisted in Johnston County and was recently discovered to be located in Wilson County Mr RossIngram, Wilson County Tax Supervisor, had requested this property be released to Wilson CountyOn December 6, 1976, the Board agreed, based on facts and recommendations that this property waslocated in Wilson County from Johnnie Stott, that this property be released to Wilson County,however, the property owners wanted it to remain to be listed in Johnston County and had talkedwith Commissioner J E Rogerson The Board, at this date, asked Johnnie Stott to again talkwith Mr Ingram and see if this property could remain to be listed in Johnston County25 Tax List Takers - CompensationCommissioner Frank B Holding moved that the county Tax List Takers in the various townshipsbe paid from antirecession fundsCommissioner John M Booker seconded the motion which was carried unanimously26 Recommendations - Zoning OrdinanceKen Windley, County Planner, met with the Board and advised that the County Planning Boardrecommended that the County Commissioners hold one more public hearing; for more public imput beforeany action is taken to zone the remaining portion of lest Smithfield not already zoned by the Townof SmithfieldChairman Denning stated that he would like for the West Smithfield Sanitary District toindicate whether or not they favored this zoning in West Smithfield4ii?rtP?February 7, 1 77 Cont-The Board tentatively scheduled Monday, March 7th at 1000 am regular Commissionersmeeting date for the public hearingThe County Planning Board also recommended that the County Commissioners adopt the proposedCounty Zoning The Board took no official action at this time on this recommendationThe Board also discussed briefly land use planning, Chairman -Denning stated that he feelsthe county needs some type of land use planning27 Heating - Agricultural BuildingCommissioner Frank B Holding asked Kramer Jackson, County Administrator, to make a reporton the heating system at the Agricultural Building at the next Board meeting The Board indicatedthat maybe they could get the heating system -fixed using antirecession funds28 Neuse River ProjectChairman Norman C Denning asked Commissioner John M Booker to consider representingJohnston County on the Neuse River Project Committee Chairman Denning further stated that ifCommissioner Booker could not serve on this committee that he would29 Resolution - Approving Amendment No 1 - Johnston County AirportThe following resolution was introduced by Howard Benton, seconded by John M Booker, DVM,read in full, considered and adoptedRESOLUTION AUTHORIZING, ADOPTING, APPROVING, ACCEPTING AND RATIFYING THE EXECUTION OFAMENDMENT NO 1 TO GRANT AGREEMENT FOR PROJECT NO 5 -37- 0068 -01 BETWEEN THE UNITED STATESOF AMERICA AND THE COUNTY OF JOHNSTON, NORTH CAROLINABE IT RESOLVED, by the County Commissioners of the County of Johnston, North CarolinaSECTION 1 That said County Commissioners hereby authorizes, adopts, approves, acceptsand ratifies the execution of Amendment No 1 to Grant Agreement between the FederalAviation Administration -on behalf of the United States of America and the County ofJohnston, North CarolinaSECTION 2 That the execution of said Amendment to Grant Agreementin quadruplicate onbehalf of said County Commissioner of the County of Johnston by Norman C Denning, Chairmanand the impression of the official seal of the County of Johnston, North Carolina, and theattestation of said execution by Eleanor Creech, Secretary is hereby authorized, adopted,approved, accepted and ratifiedSECTION 4 That a true copy of the Amendment to the Grant Agreement referred to hereinabove is hereto attached and made a part of this Resolution as though it were fullycopied hereinAmendment No 1 to Grant Agreement for Project No 5- 37- 0068 -01 filed with the ClerkUpon a motion by Commissioner John €-],Booker, duly seconded by Commissioner Frank B Holdiand carried unanimously, the Board recessed to meet again Tuesday, February 15, 1977,at 7 oclockpm, 1--f , 4 au?Eleanor N Creech, ClerkDorman C Denning, Chairman
