Howard Benton,J E Rogerson and John M Booker, DVMMembers Absent NoneChairman Denning called the meeting to order and the following businesswas transactedChairman Denning announced the Board needed to elect a Chairman and a ViceChairman to serve the Board of Commissioners for a one Vear term1 Election - ChairmanCommissioner Frank B Holding moved that Norman C Denning be elected asChairman of the Board of Commissioners for a one year termCommissioner John M Booker seconded the motion which was carriedunanimously2 Election - Vice - ChairmanCommissioner Howard Benton moved that Frank B Holding be elected as Vice -Chairman of the Board of Commissioners for a one year termCommissioner J E Rogerson seconded the motion which was carriedunanimouslyThe Chairman at this time asked if any board members now serving on variousboards and committees wanted to make any changes Commissioner J E Rogerson askeif it is necessary for a County Commissioner to serve on the Health Services AgencyBoard Commissioner Holding suggested that Mr Jackson check into the appointmentrequirements and if Commissioner Rogerson wants to be relieved that another personbe namedCommissioner Benton serving on the Triangle J Council of Governments LawEnforcement Committee asked Mr Jackson to find out if a County Commissioner needsto serve on this Boards?•December 5, 1977 ContAfter a telephone conversation with these agencies, Mr Jackson reportedthat on the Health Services Agency it is not essential that a County Commissionerserve, but recommended, however, on the Triangle J Council of Governments LawEnforcement Committee, the by --laws require a County Commissioner to serve on thisBoard3 Public Hearing_- Federal Flood Plain InsuranceMr Ayden Barefoot and Mr L B Peacock, landowners from Meadow Townshipappeared before the Board regarding the Federal Flood Plain Insurance Program,Chairman Denning explained to Mr Barefoot and Mr Peacock, the reason itis necessary for the county to adopt a Building Permit Ordinance and participatein the Federal Flood Plain Insurance Program is because the federal government hasmade it mandatory in order to assure additional federal funding for the SmithfieldSelma 201 Wastewater Facilities Chairman Denning further emphasized that thecounty has been very reluctant about getting involved in the flood plain insuranceprogramMr Barefoot told the_Board he could not see coming to Smithfield to geta building permit when youre not in a flood prone area,Ken Windley, County Planner, explained by seeking a buildingpermit theCounty Planning Office can determine whether the property in question lies in theflood plain area, if the property is not in th-e flood plain area, the permit will,then be issued, however, if the property is located in the flood prone area theplanning department will have to make an inspection and the individual will berequired to follow certain regulations of the Johnston,County Building CodeOrdinance Mr Windley further explained that all construction and renovationwill have to have a building permit in accordance with Building Code Ordinance,but will not have to have an inspection unless in a flood prone areaCommissioner Frank B Holding indicated he felt the public should beaccomodated, if they have to get a permit it should be as simple and an unrestrict-ed as possibleMr Barefoot and Mr Peacock again expressed concern about having to driveapproximately eighteen 18 miles to Smithfield to get a building permit, MrBarefoot also commented that he felt a dollar value should he placed on constructiodetermining whether or not you would have to get a, building permitCommissioner Holding suggested that maybe the Board could work out a systemwhereby permits could be issued by town clerks in the county, The county buildingcode will not affecttowns that already enforce a building permit systemCommissioner Booker asked, if a person makes application for a buildingpermit, how long will it be before they know they can start building Mr Windleyreplied, right away , if they are in a flood prone area, we will begin workingwith the applicantA Johnston County Flood Damage Prevention OrdinanceUpon a motion by Commissioner Frank B Holding, duly seconded by CommissionEJ E Rogerson and carried unanimously the Johnston County Flood Damage PreventionOrdinance was adopted effective January 1, 1978, This ordinance recorded in theJohnston County Ordinance Book # 1B Resolution - Applying for Flood InsuranceUpon a motion by Commissioner Howard Benton, duly seconded by CommissionerJ E Rogerson and carried unanimously, the following resolution was adopted;RESOLUTIONWHEREAS, certain areas of Johnston County are subject to periodic floodingfrom STREAMS and RIVERS, causing serious damages to properties within these areas;andWHEREAS, relief is available in the form; of Federally sudsidized floodinsurance as authorized by the National Flood Insurance Act of 1968; andWHEREAS, it is the intent of this BOARD to require the recognition andevaluation of flood hazards in all official actions relating to land use in theflood plain areas having special flood hazards; andWHEREAS, this body has the legal authority to adopt land use and controlmeasures to reduce future flood losses pursuant to N C General Statue 143- Article21iIDecember 5, 1977 ContCommissioner John M Booker moved that Mrs Pearl Ivey Chandler of 1101Forbes Drive be refunded in the amount of 5197 for overpayment of 1976 taxesCommissioner J E Rogerson seconded the motion which was carriedunanimously27 Tax Supervisor - AfterlistJohnnie Stott, Tax Supervisor, presented the November afterlist #4 reportto the Board of Commissioners showing a value of 2,809,008, total tax of 31,0826z,tax receipts 32,788 through 33,32528 Tax Listing PeriodThe Board of Commissioners set the 1978 Tax Listing Period of January 3rdthrough January 31st, and authorized the Chairman and County Administrator to checkwith the Tax Supervisor and to extend the tax listing period for one 1 week ifthey think it necessaryUpon a motion by Commissioner Frank B Holding, duly seconded by CommissionJohn M Booker, the Board adjourned-z di,Eleanor N Creech ClerkBorman C Denning, ChairmanL3
